east bay. good morning. it is 4:30 and we start with rob who has a look at the hour by hour forecast. >> a bit of a change with a lot of 40s on the map thanks to the clouds spilling in. 45 in hayward and down to 38 degrees in livermore. chilly around the trivalley. the rain for now north of ukiah and some of it will be around the north bay. the temperatures with variable clouds into the afternoon. livermore near 37 for the morning and as we jump to noon, the showers off to the north bislowly heading south. we will see more opportunities for rain into the weekend. a look at the forecast in a few minutes. >> we will throw it over to mike. good morning, mike. >> i hoped the rain would come sooner. i wanted it to clear by sunday.

northbound 880 and just cleared from this roadway around fifth, we have a disabled vehicle blocking that slowing until a few minutes ago. chp helped it off the roadway and things are moving nicely through the maze. 66 on the approach, but out of the caldecott, an easy drive. the slowing should clear up over a few minutes and no problems all the way from the bridge acrossing the benicia with a snooth flow out of the north bay. the far north will get the rain later today. likely not for the morning, but we always watch that. we will bring it to you. >> thanks mike. >> police hope $30,000 will help them find two men who abducted a woman and her and her roommate. on november 20th, the men approached a woman as she was

walking home from the west oakland bart station. they sexually salted her and forced her to her house and salt assaulted her two roommates. they were flaying in a 1993 or 1994 honda civic sedan with a black soiler. those against gay marriage want a federal judge considering the legality off the case. they case judge steven rhine hart may not be able to be impartial because his wife is an outspoken critic of prop 8 and leader of the aclu. another judge may be chosen randomly. free rights work and shop is the early christmas gift to bart riders. christie smith with more on why

they are giving away the free tickets. good morning. >> reporter: you could call it an early holiday gift or way to promote local shopping. either way the key freeze is free bart tickets being given away to 60,000 lucky bart riders. they will get started in a little while here. this is in time to get you out to the mall to shop for a gift. it starts in about 90 hours and runs for three long hours. 60,000 will get a pair of ticks and each one is good for a one-way ticket on the weekend starting this saturday and sunday and runs through the weekend. all the way to december 19th. avoid the traffic and bart has free parking available and remining people that they serve downtown oakland and san francisco and an bruno, walnut creek and rock ridge shopping districts. if you don't want to shop, you

can catch a show. the give away is at a couple of locations at the center here in oakland, embarcadero and city center in the city. watch for the people with the free tickets. they will be the popular ones this morning. that start at 6:00 this morning and runs through 9:00. live in downtown oakland, today in the east bay. >> meanwhile thousands of commuters are busted for brick the law. they were simply following police orders. the commuters were on the bay bridge on the morning of november 11th. that's when they threatened to blow up the span. the droifrs were told to turn around by emergency workers and now they are getting tickets because they did. the bay area metropolitan commission said the automated fast track system that told the computer to print tickets can't

tell the difference between that and police activity. it's a $36 fine for turning around. they were not sure how many were ticketed, but 280,000 people used the bridge daily. the standoff lasted an hour. anyone who gets a ticket because of the incident needs to note on the ticket it was issued during the standoff. >> oakland's police chief was in washington lobbying for funding for cost on school campuses. police chief anthony bass is trying to get cash for a pilot program to place six officers each at four middle schools across the city. the program needs between 5.5 and $6 million in funding to get off the ground. madison, west lake, root velt and frick middle schools. the gel is to expand it to all oakland unified schools. pa. >> benicia will have to wait a

while to find out who stl new police chief will be. they want to wait until they start work to get a new chief. the current chief is leaving the department in san leandro. that police department is almost three times the size of benicia's. another ship in the moth ball fleet. after 27 years of waiting, the ss american racer will loaf the bay to be towed for san francisco for dry docking and cleaning and then towed to the gust coast. it's the 12th to leave the bay since october 2009 when the obama administration announced an effort to clean up the site. her sister ship ss american reliance will be towed out on tuesday. >> no home runs in a's stadium in oakland. it was a packed house as the study of the so-called victory

square stadium was discussed. one man voiced his concern over the proposed 39,000 seat stadium and what it would do for congestion. >> traffic counts that are current have to be part of this environmental impact study. absolutely have to be current. >> critics say the planning commission should wait on the costly report until they get a commitment from the a's and major league baseball. the a's want to move to fremont or san jose and expressed little interest in an oakland-based stadium. >> leaders will call on congress to pass the dream act today. newly elected jean quan will join the coalition to support immigrant students. it would allow high school grads to apply for citizen when they get a degree or serve in the military. today's rally will take place on the steps of oakland city hall.

mayor quan will also get to light the city christmas tree. the inner faith gospel choir will be there as well. santa will be at the event as well. the tree-lighting ceremony is at 6:00 at oakland city center plaza. you can take bart to avoid the parking. downtown walnut creek will be lit up with holiday spirit today. caring entertainment parade and that all starts at 6:00. the parade will start at 7:00 and go down broadway plaza ready to light the christmas tree. you can skate on the rink and that wraps up at 9:00. kind of quiet. >> right now. we'll give you a look at the parade of lights through oakland past the coliseum. what commute there is is in the tail lights going up northbound.

the earlier incident through downtown is off the roadway. no delays through downtown. southbound equal le as smooth towards the bridge. travel signs looking good. 680 off of walnut creek that. is moving smoothly towards the interchange. no delays out of the pass. highway 4 smooth here, but you will have the delay in just about 45 minutes to an hour. the 70 turned to about a 27 or 30 miles per hour at about 5:30 or 5:40. that's traditional for the area. you have the cold for winder, but it's cold out there. >> it is starting to feel december-like in the past couple of weeks, but 40s with clouds and no rain affecting the commute. 40 in concord. one of the cool spots. livermore is not that bad. better from the 20s we have been seeing in parts of the

where it's unlucky. around 92, i see it down towards about 55. 58 miles per hour. not sure why. no incidents. i will check and let you know if it sticks around. the bay bridge is where a clear view is. it's early in the commute and the east bay is building in antioch and livermore. >> as i was thinking about it, santa wears red sox. >> he does. he's got every team covered. >> probably. >> speaking of maybe wearing extra lines in your red socks, cold, but not as bad. 20s and 30s and 40s finally for a change. closer to average for this time of year. we have clouds over the bay area. not much in the way of rain. i think it will be areas north of the golden gate that will see showers from about san rafael northwards. into the weekend, the system that will stall out, tossing weekend showers our way.

probably seeing and hoping for a brief break as we get to the holiday parade on sunday morning in san jose. speaking of san jose, 62 degrees and 59 around livermore and closer to 60 for richmond and oakland and upper 50s to solano county and eastern contraa county. you will see scattered showers and a mix of sun all wait through monday of next week. >> big news for two bay area companies working overseas. yahoo, japan and google joined force there is. yahoo japan plans to offense a service with google's search and advertising technology by the end of the year. for more on business news, let's go to courtney reagan live at cnbc world headquarters. good morning. >> good morning to you, scott. futures are higher as the santa claus rally arrives early.

the market saw their best point and percentage gains. investors reacting to chine and the u.s. and optimism that there may be a resolution to debt woes. asia jumped overnight and it's higher. we get data on new filings on pending home sales. the dow searched 249 points to 11,255. they were up to 2549. we could get the first real glimpse how the holiday season is going as most of us report november sales. shoppers spent more as they responded to black friday deals and promotions that started earlier than usual. americans are being cautious amid high unemployment and the economy. total sales are forecast to rise 3.6%. we learned cyber monday was the big oast one-day online shopping day ever. we have a few of those numbers so far with same-store sales and they're all beating estimates.

the president is extending an olive branch hosting more republicans along with democrats. nearly two dozen newly elected governors will be at the white house to talk about how the states are suffering. jerry brown is not expected to be their there. he will stay home and work on the state budget. today in the east bay's tracie potts looks at what will be discussed. >> when governors meet with president obama today, they will say the budgets are thin and in many cases washington is not helping. >> the policies are hurting our ability to create jobs. >> tax cuts do not create jobs. >> they are hopeful they can strike a deal to prevent tax hikes. after an initial meeting with the administration, republicans claim the house is talking compromise, but the democrats push both on tax cuts just for

and josh. the three berkeley grads are supposed to stand trial in iran in february. iran requested that shourd return for that trial. you got up at 3:00 in the morning on black friday to save monoholiday gifts. if you bought the warranty, you may end up giving the savings back to the store. warranties run from 10% to 30% of the item you are buying, but failure rates for major brand electronics are so low and the products come with a manufacturer's warranty that consumer experts say you shouldn't buy the warranty because the sales person said it's a good idea. >> i always say it's a self warranty. any time you are tempted to buy it, take that money and put it into your own account. that account will grow and if you need to repair anything,

take it out of that account. you will be way ahead. >> 250 million extended warranties are performed each year. bart is giving riders an early gift. today in the bay's christie smith is live with more on the holiday freebie. >> good morning to you. this is going to be one popular event. i spoke with a spokesman and he said this is the first time they have done something like this for the holidays. they will be giving away 60,000 pairs of free bart tickets to riders. it's sort of a thank you and a way to promote holiday shopping locally. it's cost-effective because trains are going to the shopping destinations anyway, so why not have a give away. these are good for a one-way trip on weekends starting this weekend through december 19th. bart has free parking also

available on the weekends. you can drive on down there. if you want to get in on it, here's how you do it. they will be given away at a number of stations. downtown berkeley and 12th street city center here in downtown oakland. embarcadero and civic center. over in the city, they are going to be giving these tickets away until they are gone. certainly the earlier the better. the give away runs from 6:00 to 9:00 this morning. live in downtown oakland, christie smith today in the east bay. >> thank you, christie. the insurance industry pushing to make sure the crashes between suvs and cars are not as bad. it's a matter of changing the rules for people who make suvs. chris clackum takes a look. >> when cars collide at low speed, often serious damage is avoided because bumpers of similar height and standards avoid the impact.

not so when the collision involves a car and suv. >> the problem is passenger cars have to have bunchers and suvs don't. >> that are difference is what's behind the institute for safety's latest series of bumper tests. results released today show what little damage is done when bumpers matchup and when they don't. like the collision between car and suv. >> when the vehicles crash, the bumpers don't lineup and you wind up with expensive damage, grills and other expensive reports. >> safety experts at the institute have been lobbying regulators since 2004 to require the same bumper standards for suv as for passenger cars and are hopeful that the latest tests will give them the bump they need. nbc news. the race for who will be the
