good morning. it is 4:30. let's start with rob and the east bay forecast. good morning, rob. >> off to a dry start. 42 degrees and 48 in oakland. notice we have clouds over the east bay and the rest of the area, but showers should stay to the north of ukiah. we have a lot of moisture that will hold off for another day before rain chances increase in the east bay and beyond. low 60s around most of the trivalley. about 63 in oakland, but rain will start to come in around this time tomorrow. we will talk more about that storm in a few minutes. back to you. >> let's throw it over to mike. any time you have wet roads, slow it down. >> especially the off-ramps as you make the turn. spin outs can happen. right now nothing like that

the weather may not cooperate for those who want to see the beacon here in the east bay. we may have fog, but the ceremony will happen rarps at mount diablo for the are 47th year. that's how long they have been doing this. survivors share their stories and light the beacon that shines a white light on top throughout the night and it's turned off at sunrise the next morning. with the number of pearl harbor survivors dropping every year, it's taking on more significance in one of the deadestly attacks on american soil that brought the u.s. into world war ii. 2400 americans died. four members of the mount diablo chapter, pearl harbor survivor's died this summer and the group is rededicating itself.

survivors stop and talk at a school in concord before heading up to the top of mount diablo. the ceremony begins at 3:45. reporting live in concord, christie smith today in the east bay. this morning fire investigators will be at the scene of what they believe was a natural guys line explosion. the blast burned a 61-year-old man and nearly destroyed his house. it happened near mac arthur boulevard just after 8:00 last night. the blast collapsed part of the house and the roof is now covering what used to be the second for and it blew out windows of nearby homes. neighbors felt a rumble and heard a loud blast. >> my wife said it's an earthquake. when i ran out of the door, it's a plume of white smoke.

i said no, it's an explosion. >> it's a rumble and then you could see the fire and feel the heat from inside the room. my grandma, she goat up and looked outside and our neighbor, her neighbor was outside and he was on fire. >> the man who was burned came out of his house on fire. neighbors grabbed blankets to smother the flame. he's at highland hospital. there may have been a gas smell earlier. there was construction in the house and an investigation will hopefully find an answer. >> buying drugs abroad, california getting the death drug and is it legal to use? the state halted executions in september due it a shortage of sodium pen thol that renders the inmate unconscious before the poisons are administered.

the department paid for this drug from the uk. the state senator said the deal was made in secret and he wants to know why. the aclu is demanding the documents. >> it is against the law to import these drugs from outside of the u.s. and in fact last week, the uk officials have taken steps to stop the export of the drug from the country into the united states. >> there is no death penalty in britain and the government had indeed banned the import, but the purchase was made before the ban. no executions are currently planned in california. more than one person has accused of mayor of oakland for failing to show up for anything, but he san down a journalist on a government cable access channel and answered a wide

officers out at that time. >> to help with the numbers, they are increasing the partnership with federal law enforcement and looking for funding to put more officers on the street. more tug of war expected over an east bay city's controversial idea to cash in on a pot farm. the city council will once again discuss the development of point melody. one possible use is a medical marijuana farm. that would generate tax dollars and provide jobs. they admit it's risky. other ideas, wildlife preserve or a green development. here's your chance to shape or influence the future of martinez. they are holding another community meeting where neighbors can share ideas about what they do and don't like about the city and how they would like to change over the next 20 years. an east bay seminar aimed at wiping out graffiti.

stob urban blight hosting a free seminar in livermore and more than 100 people from 50 cities across northern california expected to attend, including police and volunteer coordinators. the seminar is from 10:00 to 2:00. . >> it's 4:30 and things are calmer as far as the winds are concerned. no overnight advise reece. an easy drive over to the peninsula and vice-versa. cameras steady. a map shows you further north and crossing the bay bridge towards 280 and 101 in san francisco. coming down the east shore, slowing on highway 13 is typical. they move around as more folks hit the roadways, but the travel times are reflecting at the top. 18 minutes to the bay bridge.

an easy drive heading towards that interchange and out of the pass. over in towards tracey and stockton will be greeted with fog. a note for folks. >> let's talk more fog. >> we are watching the fog around the 580 commute. fog is 48 degrees and southeast wind at 6 miles per hour. we have dry roads and that's a pleasant change n. concord and livermore, it's cooler. light winds with high clouds. you can see to the north, we have light rain moving up and should stay for today north of sonoma county into the afternoon. we will see more changes as we go through the rest of the day. more clouds starting to spill in and the clouds will lead to a chance of rain. this is tomorrow morning's commute. you can see through wednesday, showers come through and occasional showers for the north

for the afternoon and nice temperatures and rain coming in for tomorrow, thursday, and friday. showers way off to the north bay. look offshore. this is a very strong area of low pressure sitting in the eastern pacific. this will act like a wave machine into wednesday evening and thursday. 20-foot waves on the coastline, but in addition rain, we will see the chances of high surf heading to the coast line. for the east bay, increasing high clouds and highs mostly in the 60s. pleasant today and tomorrow morning, chances are we will see rain at times that take us into thursday and a few more lingering showers. looks good. 60s with dry conditions since monday of next week. >> rob, thank you much. the government said bailing out one major bank was a good thing in more than one way. courtney reagan at cnbc world headquarters to explain. good morning. >> good morning, scott. futures were higher. investors reactioning positively

to extend the tax cuts for two years. then we have the worries about europe's debt crisis and increased talks of china raising interest rates and could keep the gains in check. asia was mixed overnight and europe was higher. we have one report on consumer credit and it's out this afternoon. the dow fell to 11,362. the nasdaq rose three points to 25 nor. the treasury sold remaining shares in citigroup. taxpayers make about a $12 billion profit on the $45 billion bailout. it doesn't 43 citi from the clutches because the treasury has the right to buy more shares in the future if it's used to do so. you may have long suspected it and tests confirm it. at&t is the country's worst cell

phone service provider according to consumer reports. at&t came in dead last in the report based on 58,000 responses. the top spot was u.s. cellular that bumped verizon that was the leader since 2003. second to last was t mobile. facebook's cofounder putting his backing behind a public offering. chris hughes said he would like to see the site sell shares to the public and he is sure an ipo will happen at some point. facebook valued at about $43 billion. the company is likely to put off that ipo until 2012. the supreme court will review the largest employment discrimination lawsuit in u.s. history today. the justices have decided to review a lawsuit brought against wal-mart that claims the retailer pays women less than men and doesn't promote them as

often. it could have back pay of up to $1 billion. this follows the ninth circuit appeals ruling. wal-mart is the world's largest retailer. the president agreed to demands for a continued tax cut for everyone, including the super rich. courtney mentioned that. they will be paid for by expanding the deficit. it has some democrats livid. >> in washington, tracie potts today in the east bay. >> it becomes collateral damage for political warfare here in washington. >> instead president obama reluctantly freed to keep tax breaks for two years in a compromise to preserve tax cuts for the middle class. it will cost a half trillion dollars. liberal democrats against tax breaks for the rich are expected to revolt. >> fay a democratic president

court is thinking about how they will vote on the appeal to get his take on it. a bay area high school student discovered a possible solution to a common medical problem. we will hear about how it could day save lives. those stories and holiday gives that claim to be environmentally friendly. the company that is making toys out of recycled products. pregnant women may want to think twice beforeuing cell phones. a study published in epidemiology and community health. kids whose mothers used cell phones before and after birth were more likely to have behavioral problems. a child exposed before birth only, 40% only to have behavioral problems and a child not exposed before birth and who uses a cell phone before age 7, 20% more likely. >> enrolling your kids in daycare may have benefits.

researchers found children placed in daycare before 2 1/2 were more likely to get sick than kid who is stayed home. early exposure to infection appears to give children immunity later in life. >> placing your young one in an organized sport may or may not guarantee they get exercise. under a quarter of kids in gymnastics or softball are meeting the national guidelines of 60 minutes of physical activity every day. they did find that soccer players, boys and younger children were most likely to get the daily exercise they need. one lesson plan, a couple of raiders's players will visit marshall elementary. the raiders wide receiver and defensive end will lead the kids in fitness activity.

the play 60 campaign meant to help children and teens get at least that exercise an hour a day. today the 69th anniversary of the bombing of pearl harbor. christie smith is live in contra costa county where survivors want the nation to remember the tragedy so it doesn't happen again. good morning. >> good morning, scott. this is the 47th year where survivors gather on the top of mount diablo and share their stories. this year there is added significance and urgency because the number of survivor who witnessed one of the most deadly attacks on american soil is declining. just this summer, four members of the mount diablo chapter of the pearl harbor survivor's association passed away. many are getting up in age.
