a few minutes. >> we were talking with the rockets, but let's stick to traffic. >> they are right there. we will get another talk with them in a few minutes. rob is talking about the clouds drifting through the area. you cannot see the lights coming down the east shore freeway. visibility is holding up already. the volume building and no metering lights. travel times approaching the bay bridge. still just 18 minutes and no problems for the freeway, but we will see the slowing kick in as well as 580 and 880. northbound and westbound for 580. an easy drive when you get to the toll plaza, but approaching we follow that non-injury accident. you will be distract and just the slowing is affected as you head towards the toll plaza. even the volume here picking up. back to you.

>> thanks a lot, mike. new this morning, one person is dead after a hit-and-run overnight. it happened just before 2:00 this morning. police say a driver hit and dragged the victim at least 75 feet. investigators are trying to put a vehicle description. >> wikileaks founder is in police custody after he was part of a sex crimes investigation. he is expected to make a court appearance later today. he was hiding out in england since his website started publishing hundreds of new u.s. diplomatic cables last week. the speaksman said it was an attack on his media freedom and will not stop the release of of more secret do you means. >> today is pearl harbor day. 69 years ago today, the japanese bombed the military base in hawaii. it's a day that will live in infamy.

today in the bay's christie smith is live in contra costa where survivors want the nation to remember the tragedy so it doesn't happen again. christie? >> survivors are really a living part of american history. this is the 47th year they gathered on top of mount diablo to share stories and lie a beacon. the phrase remember pearl harbor is taking on a more poignant and urgent tone as witnesses to one of the deadliest attacks on american soil. four members of the mount diablo chapter of the pearl harbor survivor's association passed away this summer. nationwide it's estimated that in survivor's groups, there only 3,000 members left. that serves as a reminder as to why this group is so dedicated to the cause. the attack ushered in the united states involvement in world war ii.

the beacon locally blinks a white light until it's turned off the next morning. survivors will stop at a school in concord before heading up to the top of mount diablo. in the past, fog and clouds have made the beacon tough to see. survivors say they just want to make sure that it's on for those who died december 7 th, 1941. the ceremony begins at 3:45. christie smith, today in the bay. >> a bay area man is due in court to answer to charges that he severely beat an elderly priest. will lynch is expected to enter a plea in santa clara county superior court. lynch said the priest, gerald linder molested him and his brother repeatedly for years. lynch said he was going to use the case to publicly shame linder and call attention to clergy abuse. a battle david and gi li ath

is being wa goes against the city of san jose. people who live in the small patch could wind up with a new city, but it will be san jose or campbell. san jose city leaders have other ideas. the council will vote on whether to annex 36, but people who live there said they would rather be part of campbell. >> i finally settled in my home and it's a great community and the next morning you wake up and you are governed by a different town paying a different set of taxes. >> san jose officials say as part of a settlement with the county, the city can legally annex 36. san jose claims that the residents will be better for it. >> a missing southern california hiker is being looked for. michelle yu was hiking on mt.

baldy on saturday. they are worried she would be injured. she was only supposed to be taking a day hike. yu has food and water, but was not dressed for rain, wind, and snow. mt. baldy is about 40 miles east of los angeles. trading $5 million for $1 million seems like a bad deal, but santa clara county may do it. they will consider paying out $5 million to top level managers and executives. in return there would be a cap on how much unused vacation the managers can pocket in cash. that would save the count be $1 million a year. obviously in the short-term, it would lose, but pay off effectually. santa clara county faces a budget deficit. people all over the bay area

will gather to take part in a national vigil to show support for the dream act. a candlelight vigil begins at 5:30 in san jose. students are expected to attend. there will be a canned food drive in candlelight vigil in san francisco. at 4:15 at st. john's church. the house is expected to vote on the dream act this week. if it passes, it grants permanent residence to some immigrants who graduate from college or serve in the military. >> thanks a lot. a three-judge panel from the ninth circuit court of appeals will eventually make a ruling on prop 8 that lasted about 2 1/2 hours. we talked about this a short time ago, but the legal analyst is back again to talk about what we can take from yesterday's hearing. thanks for coming. i guess one of the issues that

we have to talk about is in this case, some same-sex marriages have been performed in california and the court has to consider what we do about those people. why is that such a big deal? >> it's an important position in the case because you are now divesting people of a right they previously had. the court is going to look at that carefully to say should wey use a different standard? people were allowed to marry for months and now are we going it take that right away from other same-sex couples? that's a very important situation. i think that could turn this case around. you are divesting someone of a right they already had. >> it's not should we do this, it's already been done and you have to take it away. >> there is the evidence that these people have been married and there marriages all over the country and there has been no governmental detriment and the purpose of prop 8 according to the proponents is to

institutionalize marriage to raise children for opposite sex couples. when you look at california law, same-sex couples have virtually all the same rights with adopting children and things like that. and you are saying the status of marriage does not apply to them. what is the legitimate interest in taking that right away? >> this is an issue they are looking at in california, but the ninth circuit court is a federal court that. could have ramifications for courts across the country. >> the ninth circuit will rule on this in the west coast. circuit courts are looking at this issue. same-sex marriage is propping up across the country and that's why i think the united states supreme court will ultimately have to resolve this issue. it is a question under the federal equal protection clause. there is federal benefits involved. it's a wide-ranging decision and it's important that the united states supreme court speak as

one court. >> quickly, the last question here. if the ninth circuit court were to rule way and there is another somewhere else, is it possible they would rule a different way? >> absolutely. the united states supreme court at that point would weigh in on the issue. they may wait for a different ruling and a conflict, but at that point the united states supreme court would have to step in and give guidance to the rest of the united states on this issue. >> thanks a lot, steven clark. appreciate your perspective. >> 6:10 in the morning. in the south bay for an accident in santa clara on a major roadway. lawrence expressway. i used to hang out there as a kid. now people are hanging out because of an accident. it took a while to clear the lanes and you might find slowing at the major intersection. on the map, a new accident reported. i will get directions if there

lanes blocked. the interchange if this is that is where you are headed, there will be activity as you approach highway 87. we move through sunol, but the clouds might be touching the freeway. livermore as the commute continues to build and building at the bay bridge toll plaza where we see the cars lining up. the metering lights should be turned on, but low clouds are drifting through. >> patchy clouds, but not in san jose where it's a pleasant 45 degrees. 48 in san francisco with light winds and into oakland in the 40s with high clouds and not much wind. not much rain for the moment around the bay area across the coast. a few showers and north of healdsberg where the main rain will hold off and spread south as we head to tomorrow. today is decent with increasing high clouds. 60s around san jose and 50s and 60s across the north bay and the

now. 6:14 and we will be checking in with rob in a little bit. some democrats are upset this morning over the president's deal to extend tax cuts. the president agreed to keep the tax cuts in exchange for ex-10ing benefits until the end next year. the deal is expensive and could cost between 600 and $800 billion. democrats vow to stop it from passing. >> for a democratic president and house and senate to be following the bush economic philosophy of tax breaks for millionaires and billionaires is absolutely wrong. public policy, i will do whatever i can to see that 60 votes are not acquired to pass this piece of legislation. >> the tax breaks mean a couple making $70,000 a year will save $1400 in taxes next year. all of the tax breaks will benefit the middle class, president obama said. >> you may have noticed gas

prices are slowly creeping up. the national average for a will go on are $2.95, 32 cents more than a year ago and the highest price in three sdms. it comes at a tough time for many drivers. >> i think they know christmas is coming and we are getting toad raed to have trips and vacations and they are trying to get in our pocket books. >> if oil prices don't go down, they could hit $3 or more by the end of the year. here in the bay area, the numbers are easy. gas prices here are well above $3. here in san francisco, the average price for regular is $3.30, up 33 cents. in oakland, dollar there 3.23. >> the largest unemployment discrimination lawsuit in history today. the justices decided to review a

lawsuit brought against wal-mart that claims they pay women less than men and doesn't promote them as often. the women listed on the class action suit, some of them are from the bay area. betty dukes is from pitsburg. this follows the ninth circuit court of appeals that allows this suit to go for the. wal-mart is the world's largest retailer. facebook's owner would like to see them sell shares to the public. he is sure an ipo will happen at some point. facebook is valued at $43 billion. the company is unlikely to ipo until at least 2012. >> a bay area company is making products from environmental

friendly materials. bob redell is live at the factory with how they do it. bob? >> good morning to brent. the name of the company is the green toys. the founder is this gentlemen right here. one of the most popular products coming off the injection mold. what do you have there? >> it's christmas and we are making dump trucks. these are the ecodump trucks made from 100% recycled milk jugs and we make them all right here. how cool is that? >> if you are curious what they look like, they come from these pellets and it's put in the machine, melted and molded into what you see here. >> that's right. one of the things is we don't use metal axles at all. it's all milk jugs. >> what was your cocktail napkin moment? >> i walked into a party store where by definition everything

is disposable. i said there has got to be a better way. that's when green toys was born. >> despite of what you see, we are doing well. >> this is off the charts and we are not producing toys. we are usually done and demand has been so big, we are on three ships, seven days a week. >> they are made with plastics here in san leandro that they hired out and you have been kind of a godsend to them because they relied on real automotive products where now they are making toy products. they are relying on the new plan. >> that's right. factories like this where subcontractors in fremont closed down and we are taking up the slack. they have been happy. american jobs in american manufacturing. who would know? >> merry christmas.

it's a cool plant. ing interesting to see how they do it. 6:19 and we want had to check in with mike. a new accident in the south bay. >> we're just got the report in. we have it sorted out. it is indeed northbound as you come up towards highway 87 and the interchange. the interchange is open and as you approach the center divide, they are affected by the activity. holding up nicely and no major delays on the commutes northbound 101 and 280 including past the accident through downtown all close to the speed limit. we will take you as we follow another accident on the side of the road. highway 92. as you approach the bridge toll plaza, a non-injury accident and blocked by the crews that got there and as the volume increases, we see slowing approaching the toll plaza. 880 and the transition are holding the speed limit both before and after the bridge in

the southbound direction. northbound 880 moving nicely as well. a 15-minute drive off of 238. 580 through oakland and an easy commute. the east shore freeway with all approaches and no major back ups, but the lights are likely to be turned on. the golden gate bridge looks nice. no major issues although far in the north bay, clouds drifting through and clouds across the golden gate bridge. be prepared. i will have the video camera. you have the interview i will put on you tube. >> a big apple in the bay area. the rockets are here with me. they are in town for the radio city christmas spectacular national tours. this has got to be a tremendous exciting thing. that must be a dream come true. >> it is. it is a dream come true. we are so excited to be in the bay area. >> twice.

right now, 6:25 this morning. here's a pretty view. clear skies and cool temperatures. 45 degrees in san jose. not much clouds around the south bay. the north bay we are seeing spill on in. not much rain for the moment, but offshore, we have the powerful system that will start to spill more clouds on the coast. a chance of showers and mainly north of santa rosa. a cool start and patches of fog. temperatures in the 60s. mid 60s for the afternoon. more clouds by your evening commute. tomorrow morning plan on rain and breezy conditions. showers for thursday into friday and the weekend looks good.

mid 60s here. our weather is warming up and other parts of the country are seeing a taste of winter. >> take a look at this. snow is falling around the great lakes area this morning. western pennsylvania is expected to have a foot on the ground by tonight. the city of erie has a foot and a half and the kids are enjoying it. this is the snow north of there. it's at brockton, new york. they have a foot of snow and are expecting eight inches by the end of the day today. brockton city leaders tell people stay home if you can. nice to get a good old fashioned snow day. another ship will be hauled out of the moth ball fleet. the ss american reliance will be towed to a pier in san francisco where it will be dry dock and cleaned up. after that it will be transported to the gulf coast for dismantling. that's part of the efforts to clean up the bay and the

minutes. >> we will see what happens with the mavericks as well. we want to check in with mike and a new accident in san jose today. >> that's right. three for the south bay. northbound 101 at actually road. slowing traditionally and this may be in the back up or cause more back up. no lanes reported blocked, but activity just got reported to chp. the other one northbound, it's out of lanes, but visible into downtown. that's an unusual spot where we see build up and southbound lawrence expressway at kiper. that intersection is affected by an earlier accident. lanes are open past the scene, but it will be a distraction for you. metering lights are on and the drive off the carquinas bridge and a live look shows you quickly built up off of the 880. to west grand avenue right now.

over to you. >> thanks a lot. a pipeline explosion in the bay area and at this time a 61-year-old man is critically turned and his house is destroyed. they think a gas line exploded on 87th avenue and mac arthur boulevard. the blast collapsed part of that house and the second story was completely destroyed. it blew out the windows of nearby homes and neighbors say they were watching when they felt a rumble and heard a loud blast. >> my wife said it's an  earthquake and i ran out of the door. when i ran out the door, i saw a big plume of white smoke. i said no, it was an explosion. >> it was a rumble and then you could see the fire and feel the heat from inside the room. my grandma, she got up and she looked outside. our neighbor, he was outside and he was on fire. >> the man came out of the house

on fire. neighbors grabbed blankets to smother the flame. he is at highland hospital. there may have been a gas smell before the explosion. they think it could be related to construction work that is being done on the second floor of that house. it raises more questions about how safe pipelines are in our community. you can find out more in a forum in san bruno. they will host a town hall meeting at 5:00. several lay makers will be there with jerry hill and san francisco assembly woman. >> the aclu is demanding answers from the state of california. they want documents turned over to detail the purchase of execution drugs. the state bought a drug in the lethal injection cocktail from britain the aclu wants to know why the state was secretive about the deal and if using the

drug was legal. there is no death penalty in the united kingdom and they pan banned the export to the u.s., but the latest was made before the ban was put in place. >> people here in the bay area will remember pearl harbor day. 69 years ago today, the japanese bombed the military base in hawaii. christie smith is live where a commemoration will take place later on today. christie? >> good morning. this is a 47th year that pearl harbor survivors have come for a ceremoniy in the east bay. they share stories and light a beacon on top of the mountain. each year there seems to be more significance and urgency because the numbers are declining of those who witnessed one of the deadliest attacks on american soil, prompting direct u.s. involvement. four members of the chapter of the pearl harbor survivor's association in hawaii on december 7 th, 1941 passed away

just this summer. out of 60,000 personnel who are on the island in 1941, it is estimated there only 3,000 left in survivor's groups across the u.s. a group called the sons and daughters of pearl harbor survivors, they are working to preserve the history. locally survivors are going to stop at a school in concord and talk to students today before heading up to mount diablo. over the years, fog and clouds made the beacon difficult to see, but from a survivor's point of view, they want to know it's lit for those who died that fateful day. it starts at 3:45. christie smith, today in the bay. >> thanks a lot, christie. >> a northern california teen was hurt after a prank was made popular on you tube called fire in the hole. dozens of clips are post and people drench fast food

temperatures coming up in a few minutes. also new this morning, defense secretary robert gates is surveying progress in the-year conflict. his visit comes as the obama administration measures whether it can meet the goal of beginning to withdraw forces in july. gates's visit is a holiday visit to thank the 100,000 troops serving in the war. he is meeting with afghan president hamid karzai as well as top military and civilian leaders. british prime minister david cameron is in afghan stoon a surprise visit. he said british troops may withdraw next year. troops are working to train afghan soldiers and police to take over security in afghanistan when nato troops move on. today cameron urged an investigation into the death of a british soldier in an apparent

friendly fire incident. time now is 6:45 and we have been checking in with mike and every time you have a new to tell us about. >> 'break the chain? we have a new for westbound 580. the commute direction should clear from the roadway and no injuries reported. this is where we see the back up reach the peak over the course of the morning and an early start to that below 20 miles an hour. a 25 minute drive heading over to the dublin interchange and heading out of this area towards tracey and stockton. you might be greeted with fog as well. a note for drivers. oakland moves nicely north and southbound, the volume continues to build. the southbound side towards the bridge, the ax at the toll plaza clear and there is 1 o 880 at 92. we will look at the travel times on 880 itself. you are heading north with a 15-minute drive despite the

heavy volum of traffic. 580 with a similar route and a similar travel time on the freeway and a bay bridge pack up. we expect the back up to build and low clouds and fog have been an issue for the last half hour or so. >> light winds overnight and the patchy fog towards livermore this morning. we have clouds spilling into the north bay and the radar not showing rain yet. we have rain offshore, but likely that will hold off until late this afternoon for the far north bay and eventually spills to the south into wednesday. today mike just pointed out we have the patchy fog and waves towards the coast. today mild temperatures and san jose southward should be in the 60s and 50s. for wednesday, rain at times and breezy and a swell approaching the coast may get close to 15 feet. i don't think it will be enough to trigger mavericks.

at the beginning of the year. to deal with the massive debt to. brent? >> thanks a lot, tracy. we have this just in. antioch police are investigating a deadly hit-and-run. they say a woman was fighting with someone in a parking lot before 2:00 this morning. something happened and the woman was hit by a pickup truck and dragged several feet. the driver took off. police are looking for a truck that is similar. it's a late model nissan frontier with a luggage rack. it's not this actual vehicle, but it looks like it. the woman ended up dying in the hospital. antioch police are asking you to call with information. >> a drive goes on a rampage with a dump struck. the kicker is the person behind the wheel is the driver is just 17. a lot of the chase happened as he drove the dump truck in reverse on saturday.
