good morning, everybody. thanks for joining us. time is 4:30. scott is off this morning. we want to get you started with rob who has a look at the east bay forecast. >> good morning. one of the things we will be watching closely is the patchy dense fog we are waking up to. 54 degrees and you will find it waiting along 580 towards livermore this morning. scans not picking up any rain, but the clouds are dropping in, hinting at changes ahead into your tuesday. for the east bay and beyond, highs in the upper 50s around livermore where the low clouds linger to the afternoon. near 60 in richmond and a high of near 60. 59 in pittsburgh. we will give you a look at the satellite and notice the rain starting to move down the coast. we will walk you through the timing of the storm and the full forecast in a few minutes. >> we will see you then. we want to get you started with a look at the first monday

morning commute. it's already got a mess. >> 580's incident report, they are talking about dense, thick fog and tough to see. 580 out of the area will be a problem for you. lower those speeds. through livermore, a 14-minute drive into the area and we watch as the fog shifts and see if that affects the time through livermore or pleasanton and dublin. the 64 through antioch. about an hour from now. you have time to hit the roadways and get there without any major problems. the corridor is coming down off of the interchange is. you may have thick fog there. use caution and allow extra time. >> thanks, mike. uc berkeley students are fighting the latest issue on campus, but this time it's not about hikes. they are upset with crack downs

on bicycles on campus. today in the east bay's christie smith has the tickets that have them fuming. >> reporter: they are hot about a number of things and things you may not expect. they are giving tickets on bicycles for things you may not expect like locking your bicycle to a railing instead of a bike rack like this one. the fines have students steamed. $220 for rolling through something called a campus dismount zone instead of walking the bike or rolling past a stop sign. they even started a facebook page to air complaints. they say the laws are nothing new, but this is at a time where they are facing steep tuition hikes. police officers are trying to make sure pedestrians are safe and they are not involved in setting the fines, just enforcing the laws. they didn't know the fees were

so high until students started complaining about the fine. $220. basically two weeks worth of food and they can't afford it. some have to go to traffic school to keep it off their record and they don't have time for that with the studies as well. uc police say they have caught more bad biker this is year over last, but they will look into options for less expensive legal codes to enforce, but they are reminding everyone that monfret citations don't go to uc berkeley, but go to city, county and state. today in the east bay. >> thanks a lot, christie. the most damaging testimony from the gang rape preliminary hearing could come this week. they are the lead investigator and a dna expert. seven men and boys are charged

with the gang rape of a 16-year-old girl last year. attorneys make arguments over a defense request to suppress the police interview of the youngest defendant. oakland police are investigating a string of violence that left one dead and five wounded. one man was shot in a gun battle saturday night. police say they saw two men shooting at each other as they ran down broadway after 11:00. officers arrested man and the second was taken to the hospital and is under guard there. a few hours earlier, one was kill and four more injuried in another shooting in oakland. it happened on international boulevard. the four injured are expected to survive and the two shootings appear to be unrelated. fremont police are trying to figure out what triggered a shooting at a popular sports bar on friday night. they were called to kirby's

after a man was seen with a gun. they found a man down the street who had been shot. they think he will survive. three men were detain and two were released. no word on if the third person will be charged. >> approximate are police are investigating a disturbing crime. a 13-year-old girl and 18-month-old brother were stabbed dozens of times. the person responsible was a 14-year-old boy. >> we have seen guns drawn which is not a good sign in your neighborhood. that told me something serious was going on. >> reporter: a night of terror for a 13-year-old girl and her 18-month-old brother who was home alone. >> to see them stabbed so many times was disturbing to see. >> vacaville police said a 14-year-old suspect broke into the home, sexually assaulted the

girl and stabbed her in the back. the toddler was stabbed at least 10 times. >> mind boggling and difficult to wrap your mind around. >> neighbors were horrified to hear the news. >> it's devastating. i didn't understand why somebody would do that or why they want to hurt a child. >> the girl grabbed her younger brother and ran to a neighbor to call 911. >> to have the sense to grab her younger brother and take him to a safe place speaks highly of her. >> the suspect was friends with the victim's older brother. the suspect was found in the victim's home. >> the suspect was found in the baster bedroom by the s.w.a.t. team when they made entry. >> the single mom who was out with a friend overnight came home to find officers and crime tape around her neighborhood.

investigators decided it was best to tell her the details at the police station accident ohm sharing that her children were taken to the hospital and will be okay. >> the mother could be charged with criminal neglect. uc regents will meet to talk about how to fix the budget mess. today they will vote on a plan to reform the employee pension program. the plan would increase the retirement age after july 1st in 2013 and increase the age for maximum benefits and decrease contributions to most retiree health care premiums. they will vote on whether to endorse a commission report that offers 20 strategies to address the financial challenges of the school system. among the recommendations, increasing the enrollment of nonresident student who is pay

about three times the tuition residents pay create a way for students to complete majors in three years and develop a program for full online courses for degree credit. it will take place in san francisco. you can learn more about what was behind a radio station's near financial collapse. the berkeley fellowship of universalists will hold a forum on the kpfa radio station and why they have big financial problems and the plan to stay afloat. they laid off workers this year and some voluntarily resigned to balance the budget. tonight's meeting is at 7:00 on cedar street in berkeley. >> let's get a look from the north bay. the east bay moves smoothly. patchy fog throughout the north bay, but no incidents right now.

you see a little flowing around highway 4 in hercules and there is dlaukz goes on overnight. it might be slow for equipment moving. your travel times with an 18-minute drive down to the berkeley curve. highway 24 no problems and 580 and 880 moving nicely through oakland and northbound. a live look at the toll plaza shows not a lot going on. one car moving over from the carpool lane. don't do that. if you get into the wrong lane, proceed through the area. the crew will understand as you make your explanation to them. that person was able to get out of the lane without any incident. back to you. >> coming up, the senate is getting ready to vote on a bill that could affect how much you pay in taxes the first of the year. we will take a look at if that will pass. a former world series mvp in the east bay.

good morning and welcome back. some of the daytime highs will be around 60ish. not a lot of difference between the overnight lows and the highs. rob will sort out the forecast in a few minutes. you can meet the oakland raiders while helping a child in need. they teamed up with the toys for tots drive they do every year. jacoby ford will sign autographs in exchange for new unwrapped toys valued at $15 or more. it starts at about 6:00 this evening. we want to check in with rob to take a look at the temperatures. a few degrees between night and day. >> it's a good point. most of us will see the same temperatures. not much change no matter where you are. we will see temperatures in the low to mid 50s out to the trivalley where fog is a concern. nothing in the way of rain yet.

offshore clouds filling in that will keep the temperatures down close to the upper 50s and 60s. raindrops that should start to fly after sundown for the north bay. we approach midnight with light rain and plan on showers for the morning commute and into tuesday. by wednesday we catch a break before more raindrops in towards the second half of the week. close to 60 and fremont near 60. you saw the temperatures around oakland and highs near 60 for the afternoon and the areas out towards the delta, highs in the 50s. cooler and we will see rain at times as we go into tomorrow wednesday into thursday. it looks like more rain and some of that could get heavy at times. back to you. >> we will take a look at the morning commute. >> rob was talking about the front out of the pass. we are heading into the pass. will it be an issue between

futures are relatively flat to slightly higher. asian markets are higher in that china didn't move ahead after getting hotter than expected numbers. there was fear they would hike the rates. europe is higher this morning and no economic data for us domestically, but there is a lot ahead this week. we will get reports on the consumer prices, manufacturing and retail sales. the fed also holds the final meeting of the year tomorrow. the dow rose 40 points on friday and the nasdaq added 20 to 2637. 25 billion tweets were sent in the year 2010 according to twitter.com. what and who was most tweeted about? the top trends included the gulf oil spill at number one.

the fifa world cup and the earthquake in haiti. the top tweeted about was justin bieber and lady gaga. back to you. >> thanks a lot, courtney. the fda kills the orders to outlaw caffeinated alcoholic drinks. they are supposed to be off the shelves by today. the fda said the makers of drinks like for loco and juice stop shipping the products. the combination is said to be highly dangerous. it will cost a lot more for senta to drive his sleigh. that's probably why he goes with reindeer. gas prices are expected to rise up to the new year. the average price for a gallon of regular is expected to surpass $3.15 this year. the cost continues to rise because of higher international demand for crude oil and a weaker dollar. we always pay more than the

national average here in the bay area. according to aaa, the average cost of a gallon of regular here is 3.28 in oakland today, 9 cents more than this time last month. in san jose it's 3.29 and in san francisco, 3.34. you probably noticed the jump. we could have a better idea whether president obama's tax deal will get through congress. there is a test vote today. the latest indications show as angry as they are, house democrats will not stand in the way. tracie potts has the latest. >> tax breaks for the rich? democrats said they will swallow hard and vote for that. they are pushing to scale back an excessively generous estate tax. >> we will not hold it up at the end of the day, but we think the simple question should be put to the test. >> for allows the wealthy to pass on 10 million with no taxes

would benefit from having the team there is. hawaiian airlines are making it easy for people to say aloha. they are offering four weeks of nonstop daily flights to maui. they will run through january 10th in addition to the normal flight schedule. hawaiian airlines will use bigger airplanes to accommodate the traveler this is holiday season. only in the bay area, a group of students are protesting getting ticketed for breaking the law. christie smith live with that story. >> good morning to you. technically they are breaking the law, but it's the fines and enforcements students are protesting. $220 for doing things like parking your bicycle on a railing versus an actual rack or rolling through a stop sign or even something called the campus dismount zone, the area around the plaza. you have to get off the bicycle

there. students are so steamed, they started a facebook page full of complaints. california law requires the same fines for cars and bikes. s that nothing new, but the enforcement is coming at a time when students are facing hikes and just can't afford it. the university is saying they are trying to keep pedestrians safe and they were seeing a lot of bicycle pedestrian wrecks, especially near the plaza. they didn't even know the fines were so high until they started hearing complaints from the students. university police don't even set the fines, but they tell us they are looking for a less expensive alternative for the students. they are also reminding students that uc berkeley doesn't even get the money from the tickets. that goes to state and local governments. reporting live at uc berkeley, christie smith today in the east bay. >> living in an apartment could be bad for your health. a new study found living in an

apartment could mean more risk for exposure to secondhand smoke. they looked at 5,000 kids and claimed those living in multiunit housing had the highest risk of tobacco smoke contamination even when no one in their apartment smoked. they think the smoke is seeping through the walls or ventilation ises in the attached unit. children who eat low sugar cereals are more likely to have a nutritious breakfast. if they were given cereals high or low in sugar and given sugar packets and various fruits. those with the high sugar cereals ate more and took in twice as much sugar even when the other kids added table sugar. children with the healthier cereals are more likely to top the bowl with fresh fruit. the raiders need help from across the bay if they want to make the playoffs. the silver and black are not out
