planning suicide attacks in europe and here in the united states to take place during the christmas holiday season. even though the threat is vague, the government is taking it very seriously because it is credible enough, especially considering last christmas when a man tried to blow up a detroit-bound plane with a bomb hidden in his underwear. one of the people who told the iraq bes a threat claims to take orders directly from the central leadership. they claim last week's failed bombings in stoke home was part of the greater plot, but authorities are skeptical of that considering they made it after the fact. we spoke to sfo and oakland international. security at both airports are status quo until they determine otherwise. reporting live here at sfo today in the bay.

a new report on the war in afghanistan is expected to put off key decisions about troops withdrawal from the country. that report will say they are making threats against the taliban, but there is work to do. it costs the u.s. about $113 billion a year. protesters meet the at federal building in san francisco on seventh and mission streets to march for peace at noon today. the demonstration is in solidarity with veterans at the white house and in several other cities. the veterans want to end the wars and occupation in both afghanistan and iraq. >> another group of war protesters will show support for wikileaks founder. code pink and veterans for peace will gagger outside of nancy pelosi's house to hold a news conference in and a rally. they want pelosi to support

barbara lee out of afghanistan bill. they will show support and they they want the government to stop lying about what the war is costing. wikileaks released documents about the war in afghanistan. meantime he could get out of jail today. uk judge rejected an appeal and granted bail. he has been in jail since december 7th. speedish authorities accused him of sex crimes. prosecutors appealed and so he is arguing that he was a flight risk. the judge ruled on the appeal and restored the bail. he could get out of jail soon. the man accused of killing a restaurant owner could get out of jail. he was convicted of murder charges for the death in 2008, he faces in prison. that sentencing is scheduled for 1:30 this afternoon in san jose. >> police and grief counsellors will be at a high school to talk

to students about the murder of a classmate. police say two men attacked 17-year-old after school yesterday, stabbing him to death on cedar near birch. a school coach said he was a junior at newark memorial high school last year and played on the varsity football team. the coach transferred to bridge port continuation for his senior year. a school employee said members of the track team heard that a friend was hurt and they ran for help, but they found the 17-year-old stand several times. the mother said it happened as he was waiting for a ride home. >> there was an accident on dumbarton bridge i got here late before oakland and i have a call from one of them. >> parents are having a tough conversation with their kids

about life and death and enough is enough. >> 6:05. the future of don't ask don't is back in the senate's hands today. they sent legislation to end the military's ban of gay soldiers serving openly. supporters of the ban say there may not be enough time to take a vote. democratic leaders want to vote before adjourning. most of congress wants to repeal the law. the house will take on the massive tax package today. a vote is expect this afternoon on the bill that saves millions of americans thens of dollars and extend jobless benefits through 2011. the senate passed the bill yesterday, but the house may pass a higher estate tax than the one negotiated by president obama. obama is urging the house to pass the bill as is. the number of american who is lost their homes to foreclosure fell in the last

report, however scott said don't be fooled into thinking this is necessarily good news. >> this is nothing more than a delay of game. it's the banks and paperwork that are to blame. we have been talking about how banks are trying to foreclose even when the paperwork is wrong and some cases they don't even own the mortgage. they freezed all of that and that causes the number of homes taken back to fall to their lowest elf down a total of 28%. economists expect the number of foreclosures to rise again once this freezes over and when banks get their acts together. california has the third highest foreclosure rate in the nation behind nevada and utah. mortgage rates continue to rise quickly. they have been at historic lows, particularly the 30-year fixed. they are up for the fifth week in a row. mortgage rates are related to government bonds and the yield on the long bond that is the

difference between what you pay now and what you get later has gone up. again, bad news for the housing market because we want as many people to be buying homes, but it's getting more expensive to do so. >> the 49ers have a short week. they played sunday and now they play again tonight. it's a rare thursday night game for san francisco. the team is already in san diego. raiders fans are watching and rooting for the 49ers. because if san francisco wins, the raiders are still in it. they have a slim chance to make the playoffs. the niners and chargers play at qualcomm stadium. we will see how that goes. >> good morning. they will get rained on in sunny san diego. what's up with that, rob? >> good thing it's not the giants and padres. they will see showers to the south. this morning and through the game i think we will probably see rain. here in the bay area, the story is patchy frost and very chilly temperatures. 30s for most of the bay area.

the san mateo bridge. westbound traffic picking up and visibility is okay around the bridge this morning. let's take you over to oakland. 880 commute and northbound still looks good as you pass the curve. the travel times around the east shore freeway at speed approaching the bay bridge toll plaza. up and down the inner east bay towards berkeley with slowing there around highway 24. as you head north up towards the benicia bridge, patchy fog. chp reporting within the last half hour. visibilities down to 300 to 400 feet. >> thanks a lot. speaking of the commute, we have a live look outside at the bay bridge. a reminder that the commute could get messy because of work that is under way. they are trying to scramble and get extra done because of the bad weather that is set to come in. cal trans is working on the two eastbound lanes. they will be closed until 6:00 this morning. after that a single lane will be

closed. no westbound lanes will be involved. the work is expected to cause traffic problems over the next few days. caltrans is putting up parts of the new tower on the new span. they are telling drivers to keep your eyes on the road. it will be tempting to watch, but watch the road because there changes. the new span is scheduled to open in late 2013. 6:11 and doctors say more young people are losing their hearing and the biggest cause behind the loss is coming up. >> the justice department is suing bp and a few others over the oil spill. new details on the lawsuit coming up. california could pass the biggest clean air regulations in the country. a live look outside the golden gate bridge. not as much rain as earlier. it could change coming up within the next 24 hours.

lawsuit against the companies involved in the gulf oil spill. nbc's kurt gregory reports. the justice department is seeing bp and eight others involved in the gulf oil disaster. >> president obama said from the beginning the responsible parties would be held accountable. >> the federal government's first civil lawsuits against the companies involved are an effort to recover billion was dollars from the country's biggest offshore oil spill in history. the lawsuits allege that safety in operating regulations were violated before april 20th. >> we intend to prove that the violations caused or contributed to the massive oil spill. >> a spill estimated at 200 million gallons, a figure disputed by bp. the obama administration lawsuits asked that the company be held liable for removal

will contact investigators with information. >> lonnie franklin jr. had the photos and say he sexually assault and killed at least 10 women between 1985 and 2007. the 14-year gap between some murders led officers to dub him the grim sleeper. franklin pleaded not guilty and is in jail awaiting trial. >> the man accused of attacking a bay area teenager is accused of kidnapping 12-year-old brittany smith and committing credit card theft. an ark letter shopper spotted the pair at a safeway. police consider him a suspect in the death of brittany's mother, tippa smith. brittany is back in virginia with her family. i goff nof-elect is house hunting at the state capital. cameras spotted jerry brown at lost works in sacramento

minimum wage will increase to $9.92 starting january withinst, up 13 cents an hour, one of the highest in the country. it is mandated by the minimum wage ordinance passed in 2003 that calls for adjustment based on the previous year's consumer price index. >> before rushing to buy the latest gadgets, consider how you may use them. ipods and mp3 players are hot ideas, but excessive use can lead to hearing problems. it's a growing problem with teens and young adults. it's a ringing or shirping sound and usual r usually seems louder when the room is quiet. >> early signs of hearing loss when you walk on a campus and you take the earplugs out of people's ears and say let's do hearing tests. a lot of them have some if not an ongoing problem from hearing loss. >> the treatment varies, but nothing is very effective.

prolonged use of an ipod or going to loud concerts or being exposed to loud environments contribute. the best thing is to not turn the volume past 2/3 and don't listen for more than a couple of hours if you can. >> you and your family can pick up a few thousand dollars voting congress. >> for the house votes yes and that is a big if. we were talking about the average income in the bay area. i looked it up. it's about $87,000 per year for the household. if the house passes the extension to the bush era tax cuts today, that means that family's taxes would stay at 25% instead of rising to 28%. if the house votes no and the deal collapses, that tax hike will come in a few week, january 1st. add in other tax details.

capital gapes and estate taxes the there is a lot of money on the table. rich people would also get a cut, an idea opposed by many democrats. rich is defined as more than $200,000 a year per person. most say it would be good for the economy and the rich will put money back into the system. economists doubt that, saying the rich tend to bank the extra money. that's probably how they became rich. >> smart. >> there was that stimulus check a couple of years ago in 2008 and a lot of people got about $300. most people did not spend that on ipods and big screen tvs which is what the government opened. they paid down credit cards or put it in the bank which is the right thing to do, but not stimulating. >> not a short-term solution, but long-term it's a good idea. >> really, really short-term. doing the right thing is not necessarily the right thing.

decisions about troop withdrawal from the country. that report will say that nato forces are making progress against the taliban, but there is a lot of work to do. 100,000 troops are in afghanistan. students at an east bay high school are dealing with the death of a classmate. some saw paramedics try to save his life. christie smith is live in newark where counsellors will be on hand at the school today. christie? >> good morning to you. crisis counsellors are expected to be here in the library to help students cope with the horrible tragedy. some of them heard what happened a couple blocks from here and tried to run and help him, but it was too late. the 17-year-old football star died of stab wounds over at cedar and birch street right near newark memorial high school.

tributes are being posted for him all over facebook. a school coach said he played on the varsity football team and was quite popular. he transferred to bridge point continuation for his senior year. his mom told us she believes that this horrible attack could be tied to a recent party where her son stood up for a cheerleader who was getting beaten up by outsiders. she can't believe her son is gone. >> i was shocked. friends come out and start yelling and screaming and i didn't believe it. >> at birch and cedar near the bus stop where he was waiting before the attack, there flowers and candles and they describe two men in dark clothes and hoodies running away from the scene. they are asking anyone with information on this to please come forward and contact the police.

live in newark, today in the bay. >> sacramento county sheriffs say they have a suspect in a strip mall gun battle that killed two people. he is 24-year-old lonnie orlando mitchell of sacramento. detectives think mitchell was involve and cannot say if he was responsible for firing the shots. the victim included a mother trying to protect her 2-year-old son. >> we are learning more about the gang rape of a high school student. during the latest testimony, a dna expert said dna from four of the seven defendants was found on the victim and at the crime scene. the strongest dna evidence allegedly links a free-year-old defendant to the assault. the preliminary hearing is expected to wrap up soon and the judge will determine if f there is enough evidence to send the men and boys to the trial for the october 2009 rape of that teenager. the victim told police she remembered drinking alcohol with

the men and then collapsing. an interesting trend is emerging in the bay area who has many people who live year the big cities taking notice. crime is on the rise. not in san francisco or in oakland and not even in san jose, but places people move to to escape it all. there was a report out showing violent crime status dropping in oakland, but increasing in small neighboring cities. the contra costa county sheriff reporting a 39% jump in violent crime in the first half of 2010. in unincorporated alameda, violent crime rose 24% in the first part of the year compared to the same time last year. the city of berkeley saw a wave of robberies that began in september. nine people have been arrested. >> some of it is luck as you know. some of the it is that we were focusing in the areas where they were likely to happen and we

>> many u.s. airlines are raising the ticket prices as well. expect to pay about $10 more for round trip and of more than 1,000 miles and $6 more for shorter flights. according to fare compare, american airlines sparked the price hike and most of the others including southwest and virgin america jumped on board as well. an american airlines spokesman blamed supply and demand and a fuel cost. >> the house of representatives voted to end don't ask don't tell. the bill allows gays to serve openly in the military goes to the senate. there may not be enough time left for a vote before the end of this session. the bill passed the house by a wide margin. 250 to 175. congress is planning to push through other key pieces of legislation last minute. the deal to restart unemployment checks and prevent a tax hike is moving forward. the senate passed it and the

house could vote today. president obama is hoping it will prompt leaders to spend and hire. >> they feel optimistic that by working together, we can get that cash off the sidelines. >> the short-term deal is important. we have to keep the economy going. >> lawmakers will work to keep government running as well as ratifying the nuclear treaty with russia. they could end upcoming back between christmas and new year's. this does not end until january 4th. this study shows how much caffeine kids are taking in. three out of four kids have caffeine at least once a day. why this is kind of surprising to researchers. >> brent, it's because they don't expect kids would be drinking as much as adults, but some some cases it's significant

amounts. 5 year ols are taking in as much as one can of soda per day. if they are 8 to 12, three cans of soda per day. here is what is concerning about that. for children with more caffeine, they have more sleep problems and trouble falling asleep. this according to the research from the university of nebraska. it's not just soda. chocolate contains caffeine also. the average chocolate bar with about 2/3. when kids are drinking soda, they are getting empty calories and not more nutritious drinks like milk. parents should be educated when they bring their children in for the annual check ups and doctors according to the researchers should be checking the kid when is they come in for the annual physical to make sure they are not getting too much caffeine. i'm tracie potts for today in the bay.

christmas season. even though the threat is vague, the government said it is credible enough that it is taking it seriously. considering last christmas when a man tried to blow up a plane with a bomb hidden in his underwear. one of the people who told them about the new threat claims to be part of taking orders from al qaeda's leadership. they claimed the failed bombings as one of the attacks, but they are skeptical concerned they made it after the fact. this morning we spoke with the people here at sfo and across the bay at oakland international. they say right now that their status alert is status quo until we try to reach out to norm, but they were unavailable for comment. that referring to sjc. live here at sfo, today in the bay. thank you, bob. >> in the meantime, it could be a tough day dealing with the stabbing death of a classmate

and some saw what happened. christie smith is live in newark. leaders are helping them deal with the death of the former football player. christie? >> good morning. staff will have an emergency meeting and crisis counsellors will be here at the library helping students cope with the tragedy. we are told that students actually ran to the scene to try and help when they heard what happened, but it was too late. this morning there candles burning at the bus stop where the 17-year-old was waiting. a coach said he played football at newark memorial and transferred to a continuation for his senior year. his mom believes the attack could be tied to a recent incident where a cheerleader was being beaten up and her son tried to help. she is stunned that anyone would do this. >> i was shocked.

and a half? >> i don't know. thanks a lot. we want to check in with rob tracking numbers and these are chilly one. rain total amounts. >> frosty totals at 29 in fairfield and 39 in oakland. it's unusual to get that chilly this time of day with temperatures near the water line. in the upper 30s. you can see on the radar we have all three of them spinning up. sacramento in the santa cruz mountains on the north coast. no rain just yet. now we will start to see rain on the central coast and some of that right now. moving into san luis obispo. those clouds will head in and you can see the bright white cloud tops on the left side of your telephone screen. that will come screaming in come tomorrow that means rain starting up as early as later on this evening. by this time tomorrow, we will see rain coming in, but the difference of this storm is it's not going to drop rain, but

bring up the winds at 20 to 35 miles per hour and stronger gusts on saturday. the yellow and darker greens for the futurecast through saturday on the hills of the north bay. by the end of the weekend, we may be talking about five inches plus of rain there on the coastal rain. tremendous rain likely between friday and monday morning. patchy fog and no worries about the umbrella and a cool day. you need the winter coat and you will probably find wearing a jacket with highs in the low to mid 50s. the seven-day forecast shows breezy and wet tomorrow. gusty wins for saturday. breaks in between these periods of heavy rain and hopefully they are long enough otherwise we will see rises on the area streams and creeks, especially in the north bay or out of the mountains. we will be watching that closely. around the east bay, travel time are looking good. the metering lights are on.
