but sunshine, does that change anything? >> it's friday morning and there is the positive spin. the commute is very tough from castro valley into hayward. south of hayward, this is advancing towards cal state east bay. towards oakland, light rain towards berkeley and north to highway 4. a bit of a break and you can seat rain lifting off towards fairfield. we will be in and out of the rain at times burning breezy towards the afternoon and all the specific moisture on the bay area. we will be stuck in the pattern for a while. it will be chilly from areas south, a few mid 50s and notice the temperatures into contra costa and solano counties. high temperatures only in the 40s. we will talk more about the weekend forecast and the heavy rain in a few minutes. >> woor we say welcome back to mike and just in time. >> rainy days especially. rainy days and mondays.

we just moved here to berkeley where it's starting to come down. sort of a light rain. nothing really annoying. sort of a nuisance. it seems like the heavy rain is on the way. when we first arrived it was barely raining at all. it is causing problems already overnight out on the roadways. a big rig slid off the road in contra costa and smashed the front end of the truck. the driver hit his head, but is expected to be okay. meantime near places across the bay area like redwood city, sandbags are out. heavy rain and high tides may flood neighborhoods. that happened before, especially in low-lying areas and garages. neighbors being encouraged to pick up free sandbags and signs are already out that say flood along city streets. public work crews are out just

from his school. hundreds gathered last night to share anger and grief over the football star's killing. two men attacked 17-year-old justice wednesday afternoon and he died of stab wounds. they're urging anyone with information to come forward. they could have been retaliating when he stepped in to defend a cheerleader from two attackers. two oakland men will stand trial in the death of chauncy bailey despite efforts to dismiss the counts against them. the judge will not dismiss the case in the 2007 murders of the three men. bay is the former leader of your black muslim bailey. the judge said evidence favorable to the defense should have been presented to a grand

jury last year. >> east bay schoolsifying back against bullies are increasing awareness of student difference you through workshops and diversity training. it comes after stories of gay students committing suicide after being bullied. district leaders want students to feel safe expressing themselves. a national report shows 1/3 of students ables 12 to 18 reported they were bullied at school. about 20% said they cyber bully others or are cyber bullied themselves. pa. >> more than 100 california national guardsmen will say goodbye or see you later in the east bay. the military police company will spend a year in afghanistan conducting security forces and other operations. 160 soldiers from the 870th military company will leave for texas for predeployment training tomorrow.

at midnight, more than 1500 have signed on. you can find a list at free shipping.com. bart's new board president wants you to take the train, looking to extend train operating hours. 45 to 60 minutes past midnight on saturday to help people out late at parties and other events. they complained they can't public transit home because bart stops running at midnight. the board president said there a lost issues that need to be dealt with, but thinks the change could be worthwhile. the 49ers lost last night big. that turns out to be bad for the niners and the raiders. that's because it means that the chargers have won. the raiders currently trail the chargers in their division as well as kansas city. they needed the niners to win and did they not do that. there is nor pressure on

is headed to the president's desk for his signature. >> the motion is adopted. >> the deal prevents a tax hike that would have cost the average family $3,000 and another year of unemployment and cuts your payroll tax 2% and gives tax breaks to businesses and clean energy companies all at a cost of nearly $900 billion. >> nobody on the floor likes this bill. therefore the judgment is is it better than doing nothing? >> if we don't pass the legislation, there is about to be a $3.9 trillion tax increase on the american people. >> refusing to back a generous estate tax for the wealthy, some democrats voted no. >> we couldn't afford the $14 billion to give money to older people paying heating bills. nothing in this bill that is fiscal sanity. it's insanity.

>> no conclusion yet from the fda whether mercury in dental fillings is safe. an advisory panel concluded that more research needs to be done. the food and drug administration announced the fillings are safe and did not pose a threat, but consumer and dental groups said they as youed flawed data which led to the meeting last week. members say amalgam is safe for most people, but some folks seem to be more sensitive so more studies are needed to learn the safest levels of exposure. >> a former brother is using twitter. jose canseco said no one is returning his calls so she tweeting, begging his former boss to give him a chance. the gm of the mets. he posted a video of himself taking batting practice.
