visibility in novato and santa rosa. about a mile and a half in other places in the east bay. keep that in mind this morning. 55 degrees. we will drop off in temperature for your christmas day. you will enjoy 60s for the most part. a mean winter storm is packing a punch for tomorrow. we will go into detail with the timing and how much rain we are expecting. i hope you are dreaming of a wet christmas. looks like that's what we will get. >> whether we like it or not. thanks. police in san jose and santa clara are looking for a man who walked into the valley fair mall with a rifle and tried to rob a customer. it happened at the club monaco clothing store yesterday and when the shopper fended off the crook, he tried to steal a car in the parking garage next to nordstrom. he failed and went outside the wells fargo and tried to steal a car there. again he failed. he didn't give up. he ran across the street and robbed the men's warehouse. behind that clothing store he

apparently carjacked a nissan altima. shoppers were stunned when they heard what happened. >> you don't expect it, but it can happen anywhere with the economy so bad. >>. >> valley fair mall management had no comment. police are involved because valley fair is in santa clara and santana row is in san jose. >> in palo alto police are warning people to be careful because they are dealing with a wave of 37 robberies. this holiday season alone. the robbers are going after bags, purses and a car. coast add residents are warned to keep an eye out. at least five burglaries were reported in and around moss beach. there was two in the clipper ridge area of el granada. all of the homes had easy access to highway 1.

in each case, they appear to have broken through unlocked rear doors and windows. if you see a car driving through the area, get a plate number and call the dispatch center or 911. >> south san francisco police said a third man is dead following a shooting spree. three other people were injured in the wednesday shooting, but the wounds are not considered life-threatening. all were between the ages of 15 and 20. neighbors held a vigil in honor of the victims. the three suspects are still on the loose this morning. the county gang unit is working with investigators on the case. they are looking for a dark colored model chevy impalla with tinted windows. >> a reminder not to drink and drive. between now and the new year, police forces all over the bay area will be looking for drunk

drivers. 540 police agencies state-wide are participating in the 17-day avoid campaign this year. police say your best bet if you drink is to designate a driver. >> no charges will be filed against a south bay substitute teacher accused of sexually assaulting his students. the district attorney said there is insufficient evidence to charge the 64-year-old sub, who was accused by students atkinly elementary school. they say he touched them inappropriately. his attorney said police jumped the gun. he told the mercury news he did nothing wrong and he is hurt and confused by the accusations. sewage sabotage. two spills in kentfield in the last week have officials suspicious. that's because these chunks of

asphalt, wire and hard hats were discovered nearby. now the company working near the site is denying negligence. instead suggesting that both incidents happened during heavy rain and when the kentfield pump station was shut down. some speculate the spills could have been done on purpose and may be acts of environmental terrorism. the district said it recovered about 110,000 gallons of sewage out of 842,000 gallons that spilled last week. >> how about free parking in san francisco? it is a christmas miracle. meters in almost every part of the city will be shut off which means drivers don't need to carry around spare change. residential permit parking, commuter lanes and street rules will not be enforced. the ports will be the only part of san francisco where motorists will have to feed meters tomorrow. muni will run their sunday

schedule on christmas day that means service runs at 8:00 a.m. instead of 6:00. the niners will not be moving any time soon. they renewed the lease at candlestick park and play will there until at least 2014. it was a given because the planned stadium in santa clara is not ready until 2015. if it's not ready then e they can go year by year with san francisco until the new stadium is ready. it will be official when it's approved by san francisco's parks and recreation department. . >> mall madness turns from a board game women of a certain age remember into reality this morning. more than 23 million american are expected to hit the malls in a mad dash to the finish line. that includes people piling into toys 'r us. kim terry is live with the story. >> reporter: good morning.

this was one store that truly caters to the last minute shoppers and anyone who might be up at odd hours. toys 'r us has been open since 6:00 and doesn't plan to close until 10:00 tonight. this is the first time all toys 'r us stores across the country will be open 88 hours consecutively in the countdown to christmas. it is by no means crowded. there may be 20 cars in the parking lot, but there have been customers coming and going. hard it get them to talk on camera. many of them just woke up. mom said her young son reminded her that santa was bringing her an etch a sketch. one mom was just grabbing a couple extra items. >> last monday shopping. a friend said she got something and i said i have to get something too. grabbing a couple of things. one last gift that i couldn't

find. a special with toys 'r us, shoppers will spend more this holiday season and the long hours will lure more shoppers into the store and receive daily shipments of hot items. they featured the midnight madness deals that change daily. most stores are closing tonight at 10:00 p.m. there a handful closing an hour earlier at 9:00. you have other options as far as extended hours. wal-mart, target and best buy. live in pleasant hill, today in the bay. thanks, kimberly. if you are up this early, you may be getting ready to hit the roads or head to the airports women have a few last minute travel tips for you. if you are flying, make sure you arrive at least two hours early, especially if you are headed to sfo. three hour fist you are traveling internationally. make sure any gifts you are taking are unwrapped. the tsa is warning wrapped gifts

it's 5:14. new this morning, india is on alert because of a possible terror attack. police launched a manhunt. it was blamed for the 2008 mumbai siege. the three-day siege left 166 people dead. despite the last minute work on capitol hill, the u.s.-russia arms treaty will take more than a month to go into effect. russia's hour house gave preliminary approval to the start treaty this morning. however a senior russian lawmaker said full approval won't happen until next year. he said the parliament needs more time to study the legislation accompanying the treaty. the new treaty was ratified by the senate on wednesday. it would limp each country's nuclear warheads to 1550, down from the current ceiling of

during this time in 1944, america was mired in world war ii. many troops were in europe, fighting in the battle of the bulge. it was a massive surprise offensive by the germans in december of 1944. frank was one of the men. three days into the battle, he was injury and spent christmas in the hospital. 19,000 americans lost their lives in the battle of the bulge and ended in january of 1945. >> a california world war ii veteran got a surprise christmas gift this year. eight medals he never knew he earned. his daughter and son in law petitions for the 83-year-old to receive eight overdue honors including a purple heart, combat action ribbon and a presidential unit citation. the bakersfield man received the medals yesterday. leonard korin jr. was fighting

dead. there is a plea for another dog from the same family. two rescue dogs, kevin and clint slipped out the front door while contractors were doing work on the home. on friday evening, the dog's owners brent and brad got a bad news call. >> they're found kevin and he was shot. do we want to put him down or want emergency care. >> they decided on the emergency care and so far it's $10,000 worth. their other dog clint is still missing. two groups are putting out reward money that can lead police to the person or person who is did this. to donate to kevin's recovery, go to their website. they raised nearly $4,000. >> chris matmas crooks strike w

the fedex driver stopped to deliver a package at brookdale avenue. when the driver returned, the truck jacker made his move to taking off with the delivery vehicle. after a brief search, officers found the stolen truck in the 1800 block of east 25th avenue. >> the driver said someone brought it and stripped it pretty much. it's gone. no trace of anything. some 60 holiday packages are missing. if your package was stolen, you are asked to call fedex with the tracking number. a warning for dog-walkers to be on the look out for unlikely predators. they are recommending dog-walkers use a stick against attacking deer. two dog-walkers were attack in the thousand oaks neighborhood and berkeley hills over the last couple of years that. includes a woman who needed stitches her her injuries.

the death penalty will not be used in california in the near future. a judge halted lethal injections will tour the new death chamber in february. he wants to hold a hearing early in february to see the state's changes to the death chamber firsthand. the judge ruled california's lethal injection procedure was unconstitutional because the old chim ber was too small and outdated. executions in california have been suspended since 2006. >> if you forget to feed your meter, it may not be a happy new year. that brings the fine to $58. the city's parking fees are among the highest in the bay area. even mayor-elect jean quan had been a victim. she had to pay an overdue bill for thousands of dollars. jingle bells and cash regsters will be ringing. several stores are open overnight to welcome a mad dash

of last minute shoppers. most of them are men. today in the bay's kimberly kerry is live at a toys 'r us in pleasant hill. >> today this morning we are seeing a lot of moms with babies and women who are working overnight shifts, trying to get all of their christmas shopping done and dads trying to come out here and cross off their shopping lists. toys 'r us is helping them do that. the store has been open since tuesday at 6:00 a.m. and has not closed since. they recognize the crazy schedules that parents have to keep to juggle work and kids. toys 'r us is offering last minute shoppers every opportunity to get their christmas shopping done. a peek inside the store shows the store is by no means packed with customers, but that is part of the advantage to shopping in the middle of the night and the early morning hours. customers say the store is a little bit hectic and messy after being open for nearly 72

consecutive hours. >> last minute shopping. i was like i got to go and get something too! >> grabbing a couple of things. one thing for my daughter that i couldn't find. got left out. >> toys 'r us representatives said they get daily shipments to replenish splice. toys 'r us said they were planning to hire 45,000 seasonal workers for the 587 traditional toys 'r us stores. 600 express stores and nine distribution centers. the store here will close tonight at 10:00 like most stores across the nation. i should warn you that a handful of stores will be closing an hour earlier at 9:00. today in the bay. the silver and black are blacked out once again. the raiders not selling enough tickets and their game against the colts will not be on

television unless you have a special cable package. kickoff is at 1:05 on sunday. even before the game gets under way, raider nation should know if they are in the playoff hunt. kansas city plays that morning and if the chiefs win, the dreams of a super bowl this year are over. >> as for the niners, they have more control over their own fate. they are in st. louis on sunday. if they win, they are closer to taking the division. they also need the seahawks to lose to tampa bay on sunday. then they need to win the final home game against the cardinals on january 2nd. it starts in st. louis. a loss means the niners are out. the warriors will not take christmas off, but they will be at home. they host portland in a showdown. golden state is trying to string together wins. two in a row. they beat sacramento on tuesday and hope to win tomorrow. tip off is 7:30. the sharks meanwhile are getting

complete strangers. kristin dahlgren is live in washington, d.c. with the good news. good morning. >> good morning to you, marla. we talk about shopping this time of year, but americans also opening up their hearts and pocket books for those in need. we are talking about charitable giving from causes.com, an online platform for social activisms. 85% have given to a charity in the past year. that really increases during the holidays. people are three times more likely to give to a charity. san francisco area doing great. they are one of the best and during the holidays, there is a 56% bump up in how much is given to charities. really doing well there. californians donated 53% more during the holidays. the top reasons is giving because of a friend or family member is collecting money.
