police are trying to track down a man armed with a rifle who tried to rob a shopper in the valley fair mall. he tried to steal a car and failed twice before robbingin i a nearby men's warehouse. police have been dealing with a wave of 37 robberies this holiday season. officers say the robber or robbers are going after bags, purses, wallets and in one case a car. >> they are carrying cash and walking about it at night alone. >> police are urging shopper who is carry one credit card, keep the cash at home and don't carry too many bags. the police department is offering a $10,000 reward for information leading to an arrest or conviction in any of the robberies. this morning 60 bay area holiday packages are missing after christmas crooks hijacked

a fedex truck. the rip off happened yesterday afternoon when the fedex driver stopped to deliver a package at brook dale avenue. when the driver returned, the robber made his move, taking off with that delivery truck. after a brief search, officers found the stolen fedex truck in the 1800 block of east 25th avenue. >> the drivers said that somebody ended up pulling them out and bringing the truck to 19th and east 21st. they stripped it. it's gone. no trace of anything. >> if you are missing a package and think it may have been stolen, you are urged to call fedex with the tracking number. >> this morning they are looking for a dog abuser who shot a pet schnauzer and left him for dead. the pet named kevin is recovering and there is no sign of the other family dog. cheryl hurd reports the dog owners are relieved and anxious.

23 million americans are expected to hit the malls and that includes lots of people piling into the toys 'r us where kim berly is right now with the stories. >> we have seen a steady stream of customers over the last couple of hours. right now in the parking lot, it's about 20 cars so the stories by no means are crowded and that's the point of coming in in the overnight and early morning hours. not to mention convenience. this is the first time that all toys 'r us stores will be open 88 hours consecutively in the final countdown. toys 'r us has been open since tuesday at 6:00 a.m. and not close until 10:00 tonight. shoppers say the store is messy from being open for so long without a break for clean up, but they're still getting what they are looking for. >> the workers were in there and knew that they were doing.

against a south bay substitute accused of sexually assaulting his students. the county district attorney said there is insufficient evidence to charge the 64-year-old sub, who was accused by more than a dozen students at mckinley elementary school in san jose. they say he touched them inappropriately. police jumped the gun they say. he told the mercury news he did nothing wrong and he is hurt and confused by the accusations. >> pat the death penalty will not be used in california in the near future. the judge said he will tour california's death chamber in february. he wants to hold a hearing to see the state's changes firsthand. the judge ruled california's appropriature was unconstitutional because the death chamber was small and outdated. executions have been suspended since 2006. >> if you are making merry this

this morning the treasury department confirms it gave licenses to major american companies to let them do business in countries on the u.s. terror list. the website first reported an obscure department called the office of foreign assets control gave out 10,000 licenses to companies selling everything from gum to popcorn to cigarettes. they listed recipients of the licenses including craft foods, pepsi, citigroup and wrigley's gum. under federal law, companies can trade with companies on the black list as long as the treasury approves of them on humanitarian or medical grounds. >> you new this morning, vice president joe biden talking about the issue of gay marriage two days after the president signed the reteal of the don't ask don't tell policy. he said gay marriage is next. biden said there will be a national consensus and the same thing that has happened with gay
