hour. right now, meteorologist christina loren joins me. congratulations, you really nailed the time of tuesday's rain storm. what's happening right now? >> laura, we have more rain. think it's going to start to really deteriorate as we h d through the next couple of hours, but there is still more rain pushing south toward southern california. if you're traveling there today, take it easy. right now most of the showers are clearing the area. just a few coming down along u.s. 101 between gilroy and morgan hill. clearing and those winds will start to subside as well. we'll talk about what's next to come, a cold blast on the way so stay tuned for that but how of all these flooded roadways affecting drivers this morning? >> you talk about the deteriorating rain, we already had a deteriorated mountain side. devil's slide one of your usual suspects. highway 1 is closed because of a mud and rock slide. expected to close until at least 10:00 a.m. north of that, pacifica, you're going to head over to sharp park and get your way over to 280. south of there you'll take your

way to 92. locals know that is the alternate but if you're heading toward the coast, slippery conditions continue. laura, back to you. developing news out of the south bay this morning. police say an officer is injured after an overnight shootout with an armed suspect. marla tellez is live in san jose. marla, we understand police say this all started with a home invasion robbery just a few blocks away from the children's discovery museum? >> reporter: yeah, that's right, laura. actually we are about a quarter mile from the children's discovery museum just on the other side of the camera here. behind me, this is the home where the home robbery took place last night. i'm going to step out of the way so you can get a live look at the scene. officers still on the scene this morning. the crime scene unit is here investigating. you mentioned an officer-involved shooting and i do want to mention right away that no one was killed but the officer was hurt. he was not shot, though, but

assaulted in some way. the suspect, on the other hand, was shot by police. he was taken into custody and he's now in the hospital, but we're told he is expected to survive. now, about 30 minutes ago i spoke with an officer. he tells me it all started shortly after 11:00 last night when san jose police responded to a robbery in the 500 block of locust. that's where we're standing today. when officers arrived, they found the suspect's vehicle down the street. that's when the shootout happened on west reed street, not far from where we're standing on locust. right now that area is blocked off and the crime scene unit is investigating. officials tell me there could be more suspects involved, but that's not confirmed. again, there could be more suspects involved, but again, not confirmed. so again, an officer-involved shooting. the officer was not shot, but we understand he is hurt this morning after some sort of an assault. the suspect is in the hospital, expected to survive with non-life-threatening injuries.

please tell me they are going to be briefed at 5:00 or right now i should say and they will brief the media coming up in the 6:00 hour so i hope to have more details coming up later in the show. reporting live from san jose, marla tellez, "today in the bay." this morning a patient charged with attacking a therapist at a bay area hospital may be let out on bail. the 24-year-old faces felony assault charges. officers say a 60-year-old therapist was escorting him when he was attacked and injured. in october a technician at the same hospital was allegedly killed by a psychiatric patient. the attacks have prompted hospital employees to demand better security for staff members. governor-elect jerry brown's budget blueprint is coming with deep cuts to state services. when he takes office next week, brown is expected to take aim at public universities and welfare programs. it is also likely he will ask voters to extend temporary tax hikes on vehicles, income and

sales. brown may offer multi-million dollar incentives for predevelopment projects. microsoft is handing out more than a million dollars to bay area schools to settle an antitrust lawsuit. the tech company will give the schools vouchers worth $5.31 per student. the schools are in santa clara and san mateo counties. schools can then use those vouchers to buy tech gadgets and programs. in 1999 businesses and consumers accused microsoft of engaging in unfair business practices by selling some systems. the company settled with software users for more than a billion dollars. money was placed in a fund to benefit underserved schools. in about a year people will be able to rent and ride bikes in the bay area. bay area transit agencies say they envision the $7 million program as a checkout program that could one day include online reservations and smartphone apps. it is coming in the form of an environmental grant from the

metropolitan transportation commission. according to the bay area air management district 200 bikes will be placed in palo alto and mountain view. 200 also in san jose and 500 will be available in san francisco. in santa cruz county, people are toeking up for a cause. a dispensary is handing out one free prerolled joint for patients who bring in four cans of food. it will be sent to the second harvest food bank. granny pup's handed out 2,000 joints and collected 11,000 cans of food. well, the jackpot keeps going up this morning, $237 million up for grabs on friday night could be even more. no one won last night's mega millions drawing, which means the jackpot rolls on over. right now it's expected to reach $237 million. but if more people buy, that amount could rise, could get

higher. friday's drawing is at 8:00 p.m. niners team president jed york wasn't wasting any time. he's already interviewing people for the general manager's job. lawrence scott takes a look at who york has already talked to and who he plans to talk to this week. >> reporter: a very good morning to you. the talk of the bay area sports scene here before the new year, just what direction the 49ers are planning to take with football operations. team president jed york says that he'll first hire a general manager who will then find the right coach. they may just be looking for a coach, though. we'll explain. but first, yesterday york began his part of the process interviewing candidates for the gm spot. here's the first. former rams vp of person el tony softly who spent the last four years in st. louis before being fired in june. softly was interviewed yesterday. it also takes care of the rooney rule stating the 49ers have to interview at least one minority candidate. next on the list we're hearing

is this guy, former broncos gm. meanwhile last night on the broadcast, the eagles/vikings game we had here, peter king saying the talk about former raiders head coach jon gruden returning to the 49ers where he was once an assistant is not happening. king says grouden is not a candidate for head coach but they are very interested in stanford head coach jim harbaugh. king said it's going to start a trend of young, hungry, first-time nfl coaches joining a variety of franchises. but the niners say they're talking gm first. the new gm is already in the building, that trent balke will be elevated into the role. he is currently the vice president of player personnel for the niners. so if all of these interviews are simply window dressing, we'll soon know. that's a look at sports. have yourself a great morning. >> thank you very much,

lawrence. there is some good news for the niners this morning. two of the team's players will be headed to hawaii to play in the pro bowl. patrick willis and justin smith. smith was an alternate last year. while willis will be the first 49er since ronnie lott to be named to the pro bowl in each of the four seasons, not a bad name to be paired with. as for the raiders, cornerback and frequent guest here on nbc bay area, nnamdi asomugha, defensive tackle richard seymour and punter shane lechler were chosen on the raiders team. both lechler and seymour are making their sixth pro bowl appearance. as for asomugha it's his third in a row. not bad. pretty awesome. it's 5:08 right now. could be a tough commute this morning, mike? >> not so awesome there, folks. we are talking about slippery roadways. i did want to give an update because we had a tractor-trailer in lanes on 680. that has cleared over the last few minutes. northbound 680 smooth to the dub lick interchange.

580 also looking pretty clear. livermore hasn't shown any slowdowns. a light volume of traffic keeping the east bay routes pretty smooth right now. no major issues so far. we'll watch it as the commute starts to build just a little bit this week. we want to check in with christina and see how we're looking. >> we are seeing a lot of precipitation in our area this morning. yes, take a look at what's happening here. it looks like for the most part things are going to continue to clear out as we head throughout this morning. most of the activity is taking place in southern california, downright treacherous conditions driving south this morning. if you have to get down there, take it very easy or go ahead and postpone your travel plans. it's probably going to clear out by the next day or so, we're not going to have to worry about any sort of moisture. then another system arrives. for today you can count on light showered showers the next couple of hours. most of the activity is pushing south between morgan hill and gilroy. we'll see a nice break and a few

good wednesday morning to you. a live look outside at the golden gate bridge. certainly not a lot of traffic out there. wet streets, though, as a storm moved through the bay area. we'll keep tabs on it for you. it's 5:14 right now. this morning much of the northeast still trying to dig out of a holiday weekend blizzard. they got hit hard there. rescue crews in maine say winds gusting at 40 miles an hour are to blame for a ski lift accident in which five chairs fell from 25 feet injuring at least eight people. >> at that point i was scared the whole chair lift was going to fall. >> the "today" show will talk to some of the people on that lift this morning. you can catch that at 7:00. meanwhile, in philadelphia the eagles took on the vikings in an nfl game that kicked off 48 hours late due to snow. in florida, farmers are

trying to save citrus crops from ice buildup there. this morning the case against michael jackson's doctor will focus on medical items found in the late singer's bedroom. dr. conrad murray is charged with involuntary manslaughter in the singer's death. his attorneys want to test fluids from syringes and an iv bag to see how much anesthetic and pain killers they held. whistleblower or publicity seeker? an sfo airline pilot is going public for the first time since posting youtube videos that reportedly show flaws in airport security. commercial pilot chris liu touched off a national debate after shooting and posting videos that show what he calls lapses in the screenings of ground crews. federal agents suspended him from a program allowing him to carry a gun in the cockpit and went to his home to confiscate his weapon. >> there's only a cart slide and one door. this is the joke about airport security.

>> all i wanted to outline was the disparity between the screening upstairs and the lack of screening downstairs. >> sfo says liu's videos contain baseless and misleading information. the tsa considers this matter closed. liu says he's still flying for a commercial airline but won't say which one and says the airline has no comment. 5:16 right now. bay area lawmakers not giving up a billion dollar bill to restore san francisco wetlands. the bill died in congress last year but representative jackie speer said she will reintroduce it next year. it would have provided habitat for endangered animals. there's something of a food fight going on at local schools. one in three kids in the u.s. is overweight or obese, thanks in many cases to high sodium, high fat and high sugar diets and plenty of that junk food comes from where you least expect it,

school. vicky nguyen takes us inside a local company that's revamping school snacks and lunches and raising test scores and students' performance through that food. >> no transfat, no high fructose corn syrup. >> reporter: it's a long list of nos at revolution foods in oakland but an even longer list of yeses. >> we do spaghetti and meatballs, lasagna, tacos and burritos. >> reporter: an expansive menu for 20,000 students throughout the bay area, with a special focus on providing healthy food for kids who receive free or reduced-price lunches. >> my vision would be that every kid that goes into the lunchroom is excited to go in there, excited about the meal they're about to eat and feels good after they eat it. >> reporter: today executive chef amy kline is testing a new recipe, balk choi, red peppers and sesame oil. >> the salads are pretty good,

like the chef salad -- >> did you eat that before? >> no. >> reporter: sixth graders at edison charter academy. >> kids like healthy food but you have to make the food fun. >> reporter: after the school switched to revolution foods, teachers insisted they saw a difference. >> kids had more energy. you know, their grades were going up. they were more focused in class after lunchtime. >> reporter: and over a three-year period, students star test scores shot up 17%. >> one, two, three. >> reporter: the school lunch reimbursement rate is just under $3 and that includes the cost of labor and transportation to get the food here to the cafeteria. school sources tell us that's the dirty secret. schools can spend as little as $1 on frozen, processed meals. they say the food savings are then used somewhere else in the budget, even though that's not how the system should work. but she says at her school the investment is paying off,

academically and physically. >> i noticed that when i ate the food here, my body changed. like i've gotten lighter, i've gotten taller. >> reporter: revolution foods says the company has weathered a few food flops. >> we tried serving a wrap in our first year of business and we got the feedback why are you serving me this cold tortilla. i don't know why this is on my plate, but i don't find it to be delicious. >> reporter: but naysayers are eating their words. four years in revolution foods is providing meals at the government reimbursement rate. meaning it doesn't cost more to choose these meals, meals that are transforming the way kits eat, live and grow. vicky nguyen. food experts say parents should ask what their school is spending and serving. if they don't like what they hear, they should lobby for healthier choices. got to take it easy on the roadways out there at 5:19. we saw the storm pass through.

a lot of trees came down, mike. >> exactly. we're still seeing the effects of that. one of the reports right here over, pleasanton sunol road, that's a surface street right alongside 680. sometimes folks use that as an alternate but you can't use it because of that tree down right here. reportedly about an 80-foot-long tree so that's a huge bunch of wood that has to be basically chopped up and removed from the roadway. 680 should be cleared. if you're heading over from fremont through newark and toward the dumbarton bridge, keep in mind as you're passing boy the radio towers, the roadway and the water are pretty close to the same level. as the rain continues and the tide lifts, you might see issues for flooding there as well. we'll follow that and chp will let us know. we had an early report of flooding and might see the same later on. we're seeing the camera shaking because of the wind. that's one of your cues t for

good morning to you. a live picture here as the calm after the storm, but the cold will push in as we head throughout the day today. good morning to you, bay area. take a look at all the moisture that passed through the bay area overnight right now pushing to southern california. for us that means we're just going to see a few residual showers as we head throughout the day. right now just a little bit of activity over gilroy pushing south. that will be the case the next couple of hours. probably seeing a little residual activity up until about noon and then everything should start to calm down and cool off. we are going to drop off in temperatures substantially today. temperatures dropping as we head throughout the day, even with the sunshine. that is expected for the second half of the day. i want to show you something. 53 degrees right now in san francisco. it's going to take you to your

futurecast for temperatures. by 8:00 a.m. we're still at 53 degrees. by about noon we're staying steady at 53 degrees and then we actually drop off in temperature before we hit 5:00 p.m. so it's going to be one of those days where temperatures trend downward throughout the day. make sure you bring a heavy jacket with you on your way to work this morning. all of this moisture continuing to push off to the south really creating a mess for drivers heading to southern california this morning. give yourself extra time wherever you're headed. we have a lot of slick conditions. ponding left over on our local highways and it's one of those mornings you don't want to go raying out the door to get to work, especially if you're taking those little kids to school this morning. we'll have your full forecast coming up so stay tuned for that. right now back to you guys. billboard is releasing its top songs of 2010 and a bay area band is on the list. ♪ >> train, "hey soul sister"

"today in the bay." good morning, everybody. thanks for joining us. the time now is 5:30 and i'm brent cannon. >> and i'm laura garcia-cannon. >> let's get things started with meteorologist christina loren. you forecasted the timing of the tuesday storm, a heavy rain. what can we expect for today? >> a cold blast for today. good morning to you. take a look at that mess that passed through the bay area overnight, now pushing into southern california. just a few lingering showers this morning. right now it's south of gilroy and moving off to the southeast as we head throughout the morning. by 8:00 a.m. we'll see a nice break. a few showers push onto the north bay at noon and then the cold push is on tonight. we are not going to see temperatures warmer than 53 degrees and that's the current temperature in san francisco right now. so no warming up for you in san francisco today. grab a jacket on your way out the door and we'll let you know what's to come to the new year's eve celebration. >> we're seeing the aftereffects after the rain came through at

such a quick rate over such a quick period of time. we had reports of the 101, 680, 280 interchange being flooded. you're going to still see pretty big puddles there. 87 one of your usual suspects coming through downtown, just a note about that. northbound highway 9, we do have reports of wires that are down. they have cleared it from the roadway but there was live wires that had to be cleared. also mud and rock slides through the area as well. you can get through but there may be cones and traffic control through the course of the morning. a full closure at devil's slide due to a mud slide. go north to sharp park or south to highway 92. not expected to open that until at least 10:00 a.m. be careful as you head out this morning, because even though the rain is letting up you might still see slick roads, maybe a little flooding. gusty wind is also a factor for drivers. today in the bay's christie smith has a look at one trouble spot in orinda.

>> reporter: good morning. we haven't felt rain in about an hour here but everything is soaked, including the roadways. in fact a car slammed right into a light pole and knocked it right over. this is on eastbound 24 near camino pablo in orinda. i spoke with a dispatcher this morning who tells me that the wreck actually happened late last night in a downpour. it wasn't just one car but two cars, but it was so busy during that nasty weather they could only get one tow truck out there. the second car sat until they could get a crew out there this morning to hook it up. the chp also sitting by near that accident. the good news, though, they're telling me no one hurt in all this. and the light pole did not go across lanes. certainly a reminder of the kind of conditions that are still out there this morning. in orinda, christie smith, "today in the bay." medical marijuana users have a new outlet to get their supply in an east bay business park. a hercules chiropractor's office

is functioning as a medical marijuana dispensary. the hercules health center is at north shore business park. its website describes it as a state-of-the-art healing center and medical cannabis collective. there's even an express checkout service for medical marijuana patients who call in their orders. uc berkeley's 20 student-run cooperative housing is making it easier for students to report drug abuse among their peers. they adopted new rules to reveal whether a person has a drug and alcohol problem. it's meant to give students clear tools for helping their friends. the changes follow the overdose of a uc berkeley junior in march. morgan hill police stumbled upon a bizarre find in the back of a nissan sentra. they found a malnourished but live goat hog tied in the trunk. police pulled over a driver christmas eve morning after he cut off an officer. he was driving without a license and the officer found meth and open bottles of beer in the car.

there were also a couple of other passengers inside. you see all of the people, the driver and the passengers here. while searching the car, the officer heard noise from the trunk and found the goat. police think that the men had planned to eat the goat. that animal is now at an animal shelter. california is the latest state to be affected by an outbreak of salmonella tied to tainted alfalfa sprouts. the case count is now 94 in 16 states. more than half are in illinois. there have been no deaths. food and drug investigators are asking the public not to eat alfalfa sprouts made by the tiny greens organic farm in urbana, illinois. the warning also includes a mix called spicy sprouts, which contains radish and clover sprouts. a santa rosa boy is being honored by the state for testifying about the killing of his mother. the boy, identified only as victor, was just 4 years old when he says he saw his father stab his mother to death on mother's day of 2008.

that boy also helped find his mother's remains inside of a box inside a closet. the boy's father was convicted and later committed suicide at san quentin. you soon won't need to rummage around for 1 or 2 cent stamps when rates go up. next month new first class stamps will be marked as forever. it's to help people deal with the increases. they plan to announce the new policy january 14th. the first first class stamp under the new policy will be the lunar new year. an animated movie lovers, you'll want to get your hands on these. u.s. postal service giving pixar its own stamp series. there will be five stamps in all. you won't be able to get these until august. caltrain is about to begin a safety improvement project at train crossings in palo alto. it means there probably will be a few overnight lane closures. improvements will include wider sidewalks, additional

guardrails, metal fences and a new pedestrian and vehicle gate. informational and warning signs will be posted to help drivers and pedestrians. the work will happen sunday through thursdays between 8:00 in the evening and 4:00 in the morning. there are as many as four intersections that will be impacted, and that work should be finished by mid-june. the end of the line for paper tickets on ac transit buses starts friday. they will stop accepting paper tickets and are asking riders to use up all unused tickets by friday. any remaining value of paper tickets can also be applied to the new clipper smart cards. clipper cards are reloadable and good for use in several bay area transit systems, including bart. transit agencies across the bay area are offering new year's partiers free rides so you don't drink and drive. the free rides will be available on all muni railway trains and buses between 8:00 at night new year's eve and 6:00 in the morning on new year's day.

caltrain service will be free after 11:00 friday night and four extra southbound trains will be added after midnight. the last one will leave the 4th and king street station at 2:15 in the morning. so play it safe. the time is 5:37. we want to check in with mike inouye. we want to play it safe out there today. >> you were talking about transit so i thought i'd throw this in as well. bart not offering free service but they're offering skip stop service until 3:00 a.m. so that's extended. another option for you. this morning the bart system operating without any delays. 42, 43 trains reported on time as well. those rails not seeing as much traffic because the commute on the rails as well as on the roads lighter this week. we'll get a live look at the bay bridge. one of the big issues this morning is that water. there you see the huge splashes over off to the left side of your screen. big puddles left over from overnight rains. a big effect on oakland and city streets. there's the issue.

wind also shaking that camera. as you're approaching that area coming through the maze, a smooth drive but watch those wet conditions here as well as antioch where we haven't seen any major slowing all week. that typically shows the volume of traffic expected throughout the east bay. right now very light. back to you. the results of a first snow survey of the season are in and they are pretty phenomenal. state water watchers say water levels in the northern sierra are well above 100% of normal. in the southern sierra, the water content is even better. it's at 267% of normal. all of this is really good news for the state, because we've had three very dry years and so -- it's kind of still a long ways to go before winter is over but you don't want it to end if we can keep adding to that and recover a little bit. it would be great. >> it's good for the skiers as well. i know a lot of people are in heaven when it comes to skiing this time of year and there's more snow falling on the sierra

nevada right now. when it comes to precipitation in the bay area, though, it is headed out. right now just a few showers pushing south past gilroy into hollister and it looks like we're going to continue to clear as we head through the next couple of hours. all the moisture that passed through our area is now pushing into so cal so if you're headed south, take it easy. also if you're flying toward southern california, check ahead. we could see airline delays as a result of all that moisture. now, this is what's to come. we have cold air on the way. in fact some cities aren't even going to rise in temperature as we head throughout the day even with sunshine out there. san francisco will stay steady at 53 degrees all the way throughout the day today. by noon holding strong at 53 and then dropping by 4:00 p.m. when we traditionally hit our daytime highs. take a look at your overnight lows. 34 degrees for friday morning, 37 on the first day of the new year. patchy fog for sunday. so make sure you break out the snuggies, the blankets, the

up a little bit but, boy, did we get some rain last night. christina will have your forecast in just a little bit. if you felt like you paid a bit more to fill up the last time you were at the pump, that's because you probably did. gas prices have been sneaking up. brian mooar is live in washington, d.c., this morning with how this could affect our very fragile economy. good morning, brian. >> reporter: hi, laura. well, congratulations, california. you have the highest gas prices in the lower 48. $3.25 a gallon average. across the country, it's running about $3.05 average. this is not just raising blood pressure and eyebrows, it's also raising fears that it could knock the economic recovery off track. there are a lot of analysts that believe we could be hitting $5 a gallon gas by 2012 or couple of years after that but there are plenty more analysts who believe that is unlikely. it basically involves a doubling

discovery museum? >> reporter: good morning to you, brent. yes, that's right. we're standing on locust street right around the corner from the children's discovery museum. now, this street is a dead-end street. it's about a block long. there are a total of i think i counted eight homes. the home behind me at the end of the dead-end street, this is where the robbery took place. you can see officers and the crime scene unit are on scene this morning. now, we don't know if the homeowner is inside or if this person was targeted. we are working to get more information. now, here's what led to the officer-involved shooting. a spokesperson tells me officers responded to this home shortly after 11:00 last night after reports of a robbery. now, once here they found the suspect's vehicle near the scene but not here. they found the vehicle on west reed street just outside downtown. now, that's when and where the shootout happened. right now that area is also taped off with officers on

scene. now, the officer was not shot, but we are told he is hurt after some sort of assault. we do not know the extent of his injuries at this point. the suspect, however, was shot boy police. he was taken into custody, taken to the hospital where he is currently this morning. he is expected to survive. now, officials tell me there could be, there could be more suspects in this case, but that has not been confirmed. and police are expecting to release more information, new details for us in the next 15 minutes, so i hope to bring you new information on this officer-involved shooting and home robbery case in our 6:00 hour. reporting live in san jose this morning, marla tellez, "today in the bay." >> we'll check in with you in a few then. a new report shows that this year is a particularly deadly one for officers on the job. deaths in the line of duty jumped 37% this year to 160,

according to the new national law enforcement officers memorial fund. there was also a spike in shooting deaths. 59 federal, state and local officers have been killed by 51 fire th -- gunfire this year. 73 officers died in traffic incidents last year. now, "today in the bay" traffic with mike inouye. >> all right. good morning, folks. we'll take a look at the roadway. 548 on a very light traffic flowing week. we do have a major issue for the coast. highway 1 is now closed through devil's slide. it has been closed since about 11:00 p.m. last night because of a mud slide. i don't think they can begin to clear that until the daylight hours so we are looking at a 10:00 a.m. reopening. sharp park to your north or highway 92 coming back over the hill to 280 are your two alternates to the north or south respectively heading out of that area. highway 92 moves smoothly through the san mateo hills. the san mateo bridge camera

shows you it's shaking so, christina, we have a little wind left over but i guess there's winds of change as far as the forecast goes. >> oh, yeah, winds of change blowing in cold air later on today, but for now we just have a few lingering showers. the activity has really calmed down overnight. right now you'll just find a little activity along the pacheco pass, 152 headed out to the east this morning might be a little slick so take it easy out there. here's what we're expecting in terms of our next big weather change. you see these spotty clouds. this is a cold air mass that's pulling into the area as we head throughout the day at that and that means you're going to want to bring a nice sweater or jacket with you on your way to work because temperatures this morning are going to be warmer in many locations than where we end up for our daytime highs today. keep that in mind. in fact we already hit the daytime high in san francisco. 53 grodegrees. then the cold moves in.

we'll talk about another system that will impact us on new year', stay tuned for that. rescue crews are waiting until first light to try to find a snowboarder lost near tahoe city. the placer county sheriff's department says a woman went missing yesterday afternoon at alpine meadows ski resort. she was last seen snowboarding away from the resort passing through ski boundary signs. the national weather service says overnight temperatures were in the low 30s with wind gusting as high as 45 miles an hour. crossing the street becomes do or die for a man who has to outrun a fuel truck to keep from being run over. this morning we have video of the tense moments. as you can see, the man is trying to cross the street during a red light for cars. but as he is crossing the street, the fuel truck starts to move forward. instead of quickly crossing by, the man tries to outrun the truck. eventually the truck slows down and the man throws himself to

the ground. you can see him there at the front of the truck. he is at the hospital this morning with minor injuries. police in peru say a vendor selling illegal fireworks, exploded in officer's faces burning them with shrapnel. seven officers are recovering from injuries. about 80 officers took part in the raid at the market just north of lima. police say they confiscated a ton of illegal fireworks during that raid. time is running out for billy the kid. the famed wild west outlaw died almost 130 years ago, but he could be pardoned this year. but new mexico governor bill richardson needs to act within the next few days. richardson has until midnight on december 31st to pardon the famed gun slinger. petitioners say billy the kid should be pardoned because he was promised a pardon by the governor at the time back in the 1800s but he never got it.

after a couple of rough years consumers are out of hiding but are still skeptical about the health of the economy. it sounds counter intuitive but experts say it makes sense. after all gas prices are climbing again with one former executive predicting pump prices will hit $5 a gallon in 2012. home prices in major cities are falling, 0.8 of a percentage point year to year in october. i think that you see a lot of people out there who are willing to spend money, at least on small items or relatively small items. i don't want to say a tv is always a small item. but you still don't have people willing to make the long-term commitments that buying a house represents. >> but the bottom line is jobs. unemployment remains stuck at 9.8% nationwide. ford is serious when it comes to keeping satellite radio

shock jocks away from teen drivers. the automaker will announce a new system that will let parents block 16 channels on sirius satellite radio. programs that could be blocked would include howard stern, playboy, hip-hop nation and raw dawg comedy. the feature will be added next year. it also lets parents limit the car's top speed and the volume of the audio. allstate says it's not really in good hands and is filing a lawsuit against country wide financial. the insurance company said it bought more than $700 million worth of toxic backed mortgage securities only to see those values drop rapidly. the suit targets country wide and bank of america, which bought the mortgage giant back in 2008. techies are abuzz with news that apple's second generation ipad could be available in three separate versions. according to the "l.a. times" each version would offer a different internet connection

silencing some critics of artificial turf sports fields. the study finds that there's less bacteria on turf fields compared with natural grass. researchers did find low amounts of lead and other heavy metals in the air near turf fields but not enough to trigger a public health risk. the turf fields are made of old tires ground into plastic blades that resemble real grass. now a bay area blood donor will become the first woman to make 500 donations at the stanford blood center. linda johnson has been giving blood since her college days 20 years ago. she donates through a special two-hour process, but that allows her to donate up to 24 times per year. the typical blood donor can only donate about six times per year. >> boy, she's really giving. >> she is. >> very nice. helping so many others. well, i want to check the forecast. we've been talking about the winds heard howling at night,
