new this morning, an officer-involved shooting in san jose sends one person to the hospital. i'm marla tellez. i'll tell you how it all started with a home robbery coming up in a live report. big changes are coming to a peninsula city where several people are hit and killed by trains. rain is letting up, but we're still feeling the effect and cleaning up. we will show you the damage this morning. and a live look over the bay area right now overlooking the bay bridge. 6:02 on wednesday, december 29th, "today in the bay." from nbc bay area, reporting what matters to you, this is "today in the bay." good morning to you. i'm laura garcia-cannon. >> and i'm brent cannon. we want to check in with meteorologist christina loren this morning. she nailed the timing of that rain overnight and now has a look at our hour-by-hour forecast and what we can expect today. >> good rning to you. take a look at the monster storm

that passed through the bay area bringing over 2 inches of rain to oakland, over 1.5 to san francisco and just under an inch to san jose in just about a 24-hour period. some light scattered showers are pushing south, mostly south of gilroy. as we head throughout the next few hours, we will clear by about 8:00 a.m. nice break from the rain. a new residual showers expected around noon in the north bay ano then the cold blast moves in. temperatures dropping into the 30s overnight. we'll let you know what that means for your forecast for the holiday weekend coming up. back to you guys. >> thanks a lot. meantime, pg&e is looking into why more than 40,000 customers lost power. >> the outages happened last night up and down the peninsula. most of them were in daly city where about 37,000 people lost power. we just checked and found out nearly everyone should be able to check their lights this morning, should be able to go on. >> getting back to normal. right now we want to see if the remnants of the storm are

affecting the morning commute. with those power outages, you might come to an intersection where the lights don't work so be aware of that. >> when you come to an intersection with no signals, treat that as a stop signal if you can. we'll head back to the south bay where you talked about issues as well. coming down the peninsula we have winds as well as the south bay some ran and flooding reported for te101, 680, 280. you see some slowing now for 101 coming past the airport as well as around the 680 interchange so the volume of traffic picking up just a bit. yesterday it sorted itself out between 6:00 and 6:30. we had wires down here at redwood gulch road. the roadway was blocked but now just mud and rock in that area. now power lines down industrial parkway and some flooding at the 880/92 interchange, so more to watch out for in the east bay as well. now to an update this morning on developing news in

the south bay where police shot and injured a man after a home invasion robbery near a popular children's museum. marla tellez is live in san jose with the latest on the overnight shootout. good morning, marla. >> reporter: good morning to you, laura. any minute now police are expecting to release new information about the home robbery that took place right behind me last night as well as the officer-involved shooting that followed. now, we do have a crew at the police station getting briefed for that new information. meanwhile we're staying put, hoping to talk to the victim of the home robbery. now, we can tell you that this robbery took place at this home on locust street, around the corner from the children's discovery museum. now, this street is a dead-end street. this is the last home on the block. police, including the crime scene unit, are still on the scene this morning. a spokesperson tells us that this happened about 11:00 when officers responded to reports of a robbery. now, once here, they found the

suspect's vehicle near the scene on west reed street. that's west reed street just outside downtown. that's when and where the shootout happened. right now that area is also taped off with officers on scene. the officer was not shot, but he is hurt after some sort of assault. we do not know the extent of his injuries this morning. the suspect, on the other hand, was shot by police who was taken into custody, actually taken to the hospital. that's where he is this morning. we are told he is expected to survive. now, officials tell me that there could be more suspects involved in this case. there could be more suspects but that has not been confirmed yet. again, we are getting new information as i speak. a crew at the san jose police station getting that new information for us, hoping to bring that to you in our next live report. reporting from san jose this morning, marla tellez, "today in the bay." a patient charged with attacking a therapist at a bay area hospital may be let go on

bail. 24-year-old shawn michael bochy faces felony charges. the 60-year-old therapist was escorting him and that's when he was attacked and injured. back in october, a technician at that same hospital was allegedly killed by a psychiatric patient. those attacks have now prompted hospital employees to demand better security for staff members. it is 6:07 right now. rescue crews are waiting until first light to try to find a snowboarder lost near tahoe city. a woman went missing yesterday afternoon in alpine meadows ski resort. she was last seen snowboarding away from the resort, passing through ski area boundary signs. the national weather service says overnight temperatures were in the low 30s with winds gusting as high as 45 miles per hour. caltrain is about to begin a safety improvement project at train crossings in palo alto. it means that there probably will be a few overnight lane

closures. the improvements include wider sidewalks, additional guardrails, metal fences and new pedestrian and vehicle gates. informational and warning signs will be posted to help drivers an pedestrians and that work will happen sunday through thursday between 8:00 in the evening and 4:00 in the morning. there are as many as four intersections that could be impacted, so that work could be finished sometime by mid-june. governor-elect jerry brown's budget blue print is coming with deep cuts to state services. when he takes office next week, brown is expected to take aim at public universities and welfare programs. it's also likely we hill ask voters to extend temporary tax hikes. he may offer multi billion dollar incentives for projects. microsoft will give schools vouchers worth $5.31 per student. the schools are in santa clara

and san mateo counties. schools can use the vouchers to buy tech gadgets and programs. in 1999 businesses and consumers accused microsoft of engaging in unfair business practices. the company settled with software users for more than a billion dollars. the unclaimed money from the settlement was placed in a fund that benefits underserved schools. we want to check the morning commute with mike this morning. we have a lot of pathology out the -- pooling out there. how are we looking. >> devil's slide, i told folks about it but highway 1 as you're coming through devil's slide, a mud slide overnight has caused a closure. don't expect that to reopen until 10:00 a.m. locals know you go north. you take sharp park heading over to 280. if you're south of there come down through half moon bay, over the hill. 92 takes you to 280 and that's your alternate. 280 past the scene. 10:00 a.m. at the earliest they'll reopen that because

likely they'll wait until the daylight hours to tart to clear that. highway 92 moves smooth through the san mateo hills. the camera hashaking here. high wind advisory for the san mateo bridge. hold on tight because slick conditions combined with high winds could be an issue. we had an earlier issue with wires at industrial but flooding reported for all connectors between 880 and 92. a vacuum truck has to head over there. with the vacuum truck heading over, i can officially say the commute is not good. back to you guys. >> easy there. thanks a lot. you know who is good is christina. you really nailed when we were going to get this storm. >> well thank you, i appreciate that. good morning to you. well, the storm is hitting southern california right now. for the most part we are clearing out. let me show you what's next to come. you see these spotty clouds. that's a very cold air mass that will pull into the area as we head through the next few hours. temperatures today already about

as high as we're going to get in some locations. in fact san francisco right now, you're at 53 degrees. let's take a look at your futurecast for temperatures. 8:00 a.m. holding strong at 53 degrees. even with the full force of the sun later on, we'll see the sunshine today. i don't think you're going to warm up any more than that and you're going to start to drop off at 4:00 p.m. so temperatures are going to drop, turning cold for the second half of the day. make sure you bring that jacket with you on your way to work even though it's relatively mild out there right now. we're also going to see a windchill factor with the light breezes this morning and today. 49 degrees for tomorrow, 36 degrees overnight. you'll want to bundle those little ones up tomorrow. you might still have a break for winter but if you do have to get the kids to school tomorrow just make sure you've got the warm bots a boots and big puffy coats ready to go. another cool new year's eve for us. ladies, you'll have to bring the shawl. just account for that for your outfit this here.

good morning, everybody. coming up on 6:14. a live shot across the golden gate bridge. we do see all the way across. the last few days we've had some fog but this time we have wet roads. we'll check your traffic and weather conditions coming up in just a little bit. we're also keeping tabs on developing news this morning out of downtown san jose where police were involved in an officer-involved shooting. we were expecting a news briefing right now, but now police have pushed that back to about 8:00 this morning. we'll of course keep tabs on that developing situation there. some of southern california's ritziest beach front properties are now completely destroyed by flooding and mud. city leaders in laguna beach say last week's storms have caused more than $10 million in property damage.

rain will hit again today. a frightening ordeal for skiers in maine thanks to that winter blizzard that began hitting the northeast over the holiday weekend. rescue crews say wind gusting up to 40 miles an hour caused five chairs to fall some 25 feet off of the gondola there injuring at least seven people. >> i was scared that the whole chair lift was going to fall. in philadelphia the eagles took on the vikings for sunday night football but it was really on tuesday night, 48 hours after the snow. this again is more of that ski wreckage there. then the football game, the vikings went on to win that, sunday night football on tuesday. now on to florida where farmers are trying to save citrus crops from the ice. the blizzard is forcing airports all around the world to kind of get passengers back where they need to be. the cold weather costing airlines as well. analysts say the storm could cost them $150 million. more than 5,000 flights have been cancelled at the three main

airports in new york. about 1,000 flights were cancelled yesterday alone. it's that time of the year again. pg&e is offering customers a chance to get a credit on their spring bill. the automatic credit will kick in if you reduce your gas usage in january and february. if you reduce that gas use by up to 10%, you'll get an equal percentage of your credit on your spring bill. if you conserve more than 10%, you'll get a 20% credit, so bundle up. first facebook and now twitter. san francisco-based company is the latest social network to roll out a new look. you can see it here. your timeline is now on the left-hand side of the screen. when you first log in, items like trends and who you follow are on the right. as soon as you click on a tweet, the right-hand side gives you more information on that tweet like people who have retweeted it and more tweets from that user. groupon is looking to raise some money. its board is authorizing the site to raise $950 million in equity financing. it's going to sell stakes in the

company for a little more than $31 a share. that means the company is now valued at between 6.4 and 7.8 billion dollars. it's 6:17 right now. apple sold eight million ipads over the holidays and now buzz is building about the next version of the popular tablet. this morning the word is that the second generation ipad could be available in three separate versions. according to the "l.a. times" each version would offer a different internet connection option. in the meantime a report by the website digitimes speculates apple's next tablet may go into production as early as next month. google could be added to a lawsuit already seeking damages from apple. we first told you about a suit filed in san jose that accused apple of letting iphone and it pad apps violate customers' privacy. now one of the attorneys that filed the suit says his firm is

also looking at google's android platform. the lawsuit alleges that apple sends info to users to third parties without them knowing about it. several people from the bay area showing their support for military whistleblower brdly manning this morning. he's accused of giving dozens of classified u.s. documents to wikileaks. manning is a 23-year-old army private first class who had access to those documents. this morning protesters from veterans for peace, code pink and more will show their support for manning outside the marysvi of sacramento. a bay area online security company just released a list of some of the ways that you're most likely to be hacked in the upcoming year. mcafee labs predicts social networking services that let you check in at places you visit are going to be a target for hackers, as will url shortening devices. mcafee says smartphones are also

at risk for hackers because cell phone companies are slow to encrypt data. apple is another target for hackers, although the mac os platform is well known for fending off cyber criminals. mcafee says mac-targeted malware is getting more sophisticated every year. a green light for the red bull's-eye. mayor gavin newsom says target has all the permits it needs to open its first store in the city. construction will begin next month at the corner of 4th and mission street. that store is set to open in 2012. well, target is opening, a store is now closed. the 8600 square foot shop opened in 1998. the small kenneth cole store will remain open. 49ers team president jed york is not wasting time. he's already interviewing people for the general manager's job. lawrence scott takes a look at who york has already talked to

but also who he plans to talk to this week. >> reporter: a very good morning to you. the talk of the bay area sports scene here, just what direction the 49ers are planning to take with football operations. team president jed york says he'll first hire a general manager who will then find the right coach. they may just be looking for a coach, though. we'll explain. but first, yesterday york began his part of the process interviewing candidates for the gm spot. here's the first. former rams vp of personnel, tony softley who spent the last fur years in st. louis before being fired in june. softley interviewed here in the bay area yesterday. it also takes care of the league rule, the rooney rule, stating that the 49ers have to interview at least one minority candidate. next on the list we're hearing is this guy, former broncos gm ted sundquist. the niners will interview him later this week. last night on the broadcast, the eagles/vikings came, peter king saying the talk about former

raiders head coach jon gruden returning to the 49ers is not happening. king says gruden is not a candidate for head coach but is hearing that the nines are in fact very interested in stan toerd head coach jim harbaugh. this we've expected and king says it's going to start a trend of young, hungry, first-time nfl head coaches joining a variety of franchises. but again the niners say they're talking general manager first and pro football talk, an nbc sports affiliate, reporting that the new gm is already in the building and trent balke will be elevated into the role. he is currently the vice president of player personnel for the niners. if all of these interviews are simply window dressing, we'll soon know. that's a look at sports, have yourself a great morning. >> thanks, loerngs. we do have some good news for the 49ers. two players are headed to hawaii to the pro bowl. patrick willis and justin smith. smith was an alternate last year. willis will be the first 49er since ronnie lott to be named to

the pro bowl in each of his first four seasons. pretty good stuff there. as for the raiders, cornerback nnamdi asomugha, richard seymour and shane lechler are headed. lechler and seymour are making their sixth pro bowl appearances. asomugha is making his third in a row. in about a year people will be able to rent and ride bikes throughout the bay area. transit agencies say they envision the program as a checkout program that could one day include online reservations and smartphone apps. the bulk of the money is coming in the form of an environmental grant from the metropolitan transportation commission. according to the bay area air wallet management district, 200 bikes will be in palo alto and mountain view, 200 in san jose and 500 available in san francisco. the time is 6:22. we want to check your morning commute. there are a few things to watch out for this morning, even though the storm is moving out, mike.

>> one you have to reroute because you're watching out for the mud that caused a problem. folks are being rerouted off highway 1 over towards 92 and 35 where now we have report of a disabled truck in lanes just off of skyline. so that's going to cause an additional problem for folks who are south of devil's slide, using that as a reroute. that means devil's slide is closed. a mud slide has caused the highway to be closed until at least 10:00 a.m. they can't begin to clear that until daylight hours so we'll get an update around 8:00. sharp park is your alternate to the north. locals are very familiar with this option. right here in the east bay there's an issue as well. pleasanton sunol road just south of castlewood golf course, a big tree across the entire roadway. christie smith just arrived on scene. she said chp has lit it up with lights. if they didn't, you'd run smack into that tree. 680 is a great route there. you don't have to use an alternate because it's so clear

what matters to you, this is "today in the bay." good morning, everybody, thanks for joining us. i'm brent cannon. >> and i'm laura garcia-cannon. we want to check in with meteorologist christina loren with our hour-by-hour forecast. we need to know what's coming. >> traditionally we warm up throughout the day, but most cities in the bay area are going to drop in temperature right around 3:00 p.m. when the cold air, you see those spotty clouds headed our way, that's a very cold air mass that will pull into the area as we head throughout the afternoon. we'll see a few showers, though. by 8:00 a.m. a little scattered shower activity in the north bay. that will clear out of the area and the cold air moves in by 5:00 p.m. i'll let you know how low temperatures are expected to drop, but we're talking the 30s, guys. so, yeah, many people tomorrow morning waking up with frost on the windshield. get ready for that. and then another storm on the way for new year's. that's all coming up in your

extended forecast, so stay tuned. >> thanks. now, the latest storm is moving out now but the overnight rain and gusty wind did create some dangerous situations administrat. >> in one neighborhood a huge tree toppled over. christie smith is live there. >> reporter: good morning. i've got to tell you, this is one big tree, completely covering the road here. i wanted to give you sort of an idea of how soggy the ground is. this is what it came from and it's just completely saturated from all the rain. this is pleasanton sunol road. it's completely blocked both north and southbound directions. sort of an alternate route to get around the pleasanton area. i talked to a chp officer here this morning and he says it was around 4:15 a driver phoned in and said to the chp you've got to get out here, there's an 80-foot tree across the road. it's thick too, they're thinking about 10 feet in diameter, just

680. we'll talk about pleasanton 680. my maps are having a problem but 680 is your alternate to that alternate. usually folks get off of 680 because of the heavy traffic flow. but evidence of the light volume of traffic coming to the bay bridge. we also have another issue -- two other issues. the water on the roadway and the water splashing up on cars behind them. that will be a factor for your morning commute. we have flooding all over the bay but those are starting to clear up. high wind advisories for the san mateo and dumbarton bridge and caution for the bay bridge as well but hold on tight as you are crossing the water. back to you. it's 6:33 right now. morgan hill police stumbled upon a bizarre find in the back of a nissan sentra. a malnourished but live goat hog tied in the trunk. police pulled the driver over christmas eve morning after he cut off an officer. he was driving without an license and the officer found meth and open bottles of beer in

the car. there were also two passengers inside the car as well. while searching the car, the officer heard noise coming from the trunk and found the goat. police think that the men planned to eat the goat. the animal is now at an animal shelter. a bay area city with with a reputation for crime is now seeing a dramatic drop in homicides and shootings. the east palo alto police department says the number of homicides and shootings decreased by more than half this year compared to 2009. there have been 39 shootings this year, down 54% from the 85 that they saw in 2009. and they're seeing the lowest homicide rate since 1999. however, all four of the homicides that they did have this year are currently unsolved. california is the latest state to be affected by an outbreak of salmonella tied to tainted alfalfa sprouts. the centers for disease control and prevention says the case count is now 94 in 16 states. more than half are in illinois. there have been no deaths. food and drug investigators are

asking the public not to eat alfalfa sprouts made by the tiny greens organic farm in urbana, illinois. the warning also includes a mix called spicy sprouts, which contains radish and clover sprouts. starting january 1st, the meat you buy at the grocery store will come with nutrition labels. the new labels will list calories, total fat and cholesterol for 40 of the most commonly purchased cuts of beef, poultry, pork and lamb. nutrition labels were first required on many foods in 1993 but labels for meat were not mandatory. activists just wrapped up a gathering at the united nations plaza in san francisco to protest the sale of live chickens and other game birds. they say selling live birds in an urban environment is cruelty to animal and a risk to public health. they say they have documented local, state and federal law violations at farmers markets at the plaza. they accuse vend yors of selling sick and injured birds from

take a look at the sierra nevada right now. they are getting slammed by the same winter storm that brought over 2 inches of rain to oakland yesterday. also saw over an inch and a half in san francisco. just over an inch in san jose. but it looks like for the most part showers will continue to push into southern california as we head through the next few hours. it's a fast-moving system. this is what's left of the showers in our area.

just a little activity on the western-facing foothills just to the south of san jose. so overall things are getting a lot better around here. the winds are also relaxing substantially. let's take you through your hour-by-hour forecast for today. at around 8:00 a.m. we'll see a nice break from the showers. just a few pop-up showers as we head throughout the afternoon, mostly exacting the north bay. and then as we head into this evening, cold air moves in and i'm talking about temperatures in the 30s tomorrow. so if you're waking up in places to the south of san jose and the outlying areas, gilroy, morgan hill, for instance, just get ready for a thick layer of ice on your windshield tomorrow as your windshield gets much colder than the surrounding air. so even with 36 degrees in places like livermore, yeah, you can count on frost on your windshield tomorrow morning as well. 48 degrees, that's our daytime high for friday. it's going to be a cold start to the new year, 52 degrees. a few spotty showers. another system bringing more rain saturday into sunday. back to you, brent and laura.

>> thank you very much. a president from california, some characters created right here in the bay area and an author will all get their own stamps in 2011. the u.s. postal service revealed its commemorative stamps for next year. here's a look at ronald reagan's stamp. he would be turning 100 years old next year. he died back in 2004. that stamp will go on sale in february. pixar is getting its own series of stamps. five in all featuring cars, toy story, up and wally. you won't be able to get your hands on those until august. finally here's a new stamp for author mark twain. twain having a resurgence in popularity lately. the first volume of his autobiography came out last month. that book topped the best seller list. it had been in cal berkeley's vaults for the last 100 years. all new first class stamps will be marked as forever

release more information about president obama's birth. the president is vacationing in hawaii right now. the democratic governor says he was a friend of the president's parents and knew him as a child, so he feels like he has a personal interest in proving the president's citizenship. now he will work with the state's attorney general to see how much can legally be released. prices at the pump just keep creeping up and there doesn't seem to be any end in sight. brian mooar is live in washington, d.c., with how this all could impact the fragile economy. brian? >> reporter: well, brent, i don't have to tell you how bad gas prices are right now. there in california, you have the highest average gas pump price in the lower 48. well, for the rest of us, it's right around $3.05 a gallon average and there are a lot of concerns that this could slow down our economic recovery at a very, very delicate time. there are also some experts who believe that gas prices could

push up to $5 a gallon by 2012. one analyst says that the bottom line here is for every penny these gas prices go up, it's costing us $600 million in lost money that could be going to creating jobs, but instead very literally is going up in exhaust smoke. live in washington, i'm brian mooar, nbc bay area news. brent. >> thanks a lot, brian. we did check gasbuddy.com for the cheapest gas in the bay area. in the east bay it's $3.13 a gallon and you can find that at the stations that we have listed on your screen, a lot of them. in the san francisco area, the lowest price for a gallon of gas is about $3.16. you can check the costco in redwood city and the valero on marsh road in menlo park. in the san jose area it's $3.19 a gallon. chevron on monterey road and the costco, both of those in gilroy. and also in san jose, the city itself, check the arco on tully

road and there are two costcos, one on center road and one on auto nation parkway and they also have cheap gasoline as well. kind of an interesting thing too. it may not be reflected, but we go to safeways. if you've got a safeway that does gas and you get your point, they chop off about 10 cents a gallon, so even though the price listed may not be the cheapest in the bay area, you can get it cheaper. >> hopefully you're not idling out there losing a lot of gas on the roadways. there's some hazards but devil's slide now cleared, mike? >> that's right. that's great news for folks. highway 1 is cleared a lot earlier than i thought. great job caltrans. they were able to get out there and clear that mud slide that had been out there since 11:00. great news for folks. but we had an issue, also a truck, a disabled truck was blocking part of highway 92. that also cleared. better and better for folks along the peninsula. 280, 101 not really showing any problems. 92 over the water, let's get a live look at the san mateo

bridge camera that we have. we still have to deal with high wind gusty conditions from time to time. you also see there's a mist in the air and some recommemnants that storm we had overnight. w wet roadways continue here. a note for the dumbarton bridge in addition to the high winds, you might have some issues, maybe some flooding as you're coming past the radio towers. keep in mind, very low roadway through that portion of highway 84. the south bay, all the flooding cleared up. we still have standing water on the off-ramps but the morning commute looking good after the storm has cleared the major part, right? >> oh, yeah. take a look at where it's headed now. southern california getting slammed with heavy precipitation this morning. if you're headed that way, just really want to take it easy this morning or postpone your travel. this is a fast-mover. should be out of the area of so cal i'd say before noon tomorrow. here's what we're expecting for us today. spotty clouds behind that system that passed through, over 2

inches of rain to oakland. those spotty clouds indicate cold air that will move into the area as you head into this afternoon, you will notice it turning much cooler. temperatures tomorrow morning about 20 degrees cooler than where they are right now. take a look at what's happening. this is what we're expecting at about noon. just a few residual pop-up showers, mostly in the north bay. then the cold air moves in right around 5:00 p.m. a cold blast dropping temperatures into the 30s overnight. yeah, you'll probably have a layer of frost on your windshield. if you're wayning e wayning -- windshield gets much cooler than the surrounding air. 49 is your temperature in san mateo, 53 in san francisco. we'll look at where temperatures are going to head throughout the day today. right around noon, 53 degrees holding steady in san francisco. about 4:or 5:00 p.m. when we traditionally hit our daytime highs, that's when temperatures

will start to drop. you'll want to bring out the blankets that you've tucked away since last winter. here's what you can expect, 34 degrees, even cooler for thursday into friday. a.m. frost, widespread, throughout the bay area friday morning. it's going to be a chilly, chilly new year as well. 52 degrees, 37 overnight. back to you, brent and laura. we have developing news in the south bay. police say an officer is injured after an overnight shootout with an armed suspect. marla tellez is in san jose. marla, we understand police say this all started with a home invasion robbery just a few blocks away from the children's discovery museum? >> reporter: that is right, laura. good morning to you. yes, we are learning new information about the home robbery that took place right behind me here. we're on locust street right around the corner from the children's discovery museum. police tell me three people were home at the time. they are currently being interviewed at the san jose police department. we don't know if they were hurt or if they were targeted. now, a neighbor who lives

directly across the street on locust street tells me he heard a lot of commotion about 11:00 last night. at the same time police arrived after getting reports of a robbery. >> i didn't really think too much of it. it was just kind of noisy. my girlfriend looks out the window and she's like, no, it's a fire truck. i see a guy holding his head over there. it looks like he's bleeding or something like that. >> was that your neighbor? >> i'm not too sure. we don't -- we're not too familiar with who lives there. it's a pretty quiet street. >> reporter: now, this morning the crime scene unit is still on the scene on locust. the officer-involved shooting involving the home robbery suspect happened on west reed street just outside downtown about a mile from this scene where we're at this morning. now, the officer was not shot, but he was hurt after some sort of assault. we do not know the extent of his injuries this morning. the suspect, on the other hand,

was shot by police. he was taken into custody. he's currently at the hospital and we are told he is expected to survive. now, police are said to be releasing new information this morning at an 8:00 briefing. we will be at that briefing to bring you the new information later on. reporting live in san jose this morning, marla tellez, "today in the bay." it is 6:52 right now. bay area lawmakers are not giving up on a billion dollar bill to restore san francisco bay wetlands. the bill died in congress last week but representative jackie spears says she will reintroduce it next year. the restoration would have provided habitat for endangered animals like the california clapper rail. there are only 1200 or so left of the birds along the san francisco bay marshes. the second harvest food bank received 11,000 pounds of food donations from a pot dispensary in so cal. that dispensary offered a free joint for every four cans of food. it ended up giving away 2,000

free joints. let's see how the morning commute is looking out there. we were talking about a lot of hazards out there on the roadway. how are we looking now, mike? >> overall the commute as you might expect between christmas and new year's, very light volume of traffic but that rain played havoc on our roadways. the flooding starting to pick up. we still have pleasanton sunol road blocked by a tree. christie smith is live on scene. she'll show you the pictures. it is a frontage road which is often an alternate to 680. you can't use it this morning. 680 is clear so no need for that but foothill road is just a little to the west if you want to get south of castlewood through the surface streets. westbound 24, a couple of lanes reported with debris in the lanes as you approach the orinda exit. that's not a problem as far as speeds go because of the light volume heading toward the bay bridge. a live shot at the toll plaza, shows you the wet roads. from time to time the camera

shakes with windy conditions. checking your forecast this morning, the big rain happened overnight, moving out, but we've got more stuff to watch this morning. >> yeah, a little more activity expected throughout the day in terms of light rainfall, nothing heavy, and mostly impacting the north bay. after noon i think most of the activity will really start to drop off and the cold air will start to pull into the area dropping our temperatures by 15 to 20 degrees. it's going to be cooler tomorrow even than it is right now. this is where we are right now. 73 fw 53 degrees in san francisco. temperatures will struggle to climb up 5 degrees today. at noon holding strong with 53 degrees in san francisco. right around 4:00 p.m., typically the warmest time of the day for us, that's when we'll see temperatures really drop off, into the 40s in many locations. so even though it's pretty mild out there right now, make sure you bring a nice coat, jacket.
