contribute to dangerous conditions. highway 4, the typical slowing. 17 from a street towards the bridge. back to you. new this morning, a very scary night for three people on a 65-foot boat. their boat capsized off half moon bay and a coast guard had to be called in to help. marla tellez has more on what happened. good morning. >> reporter: good morning, laura. a night of crab fishing turned into a nightmare. before we show you the video we have of the scene from early this morning, i want you to take a look at the waters. we are live in pacifica this morning. it is high tide and not calm. the water is chop we the waves crashing against the pier here. a lieutenant told me it started this morning after they received a 911 call of an overturned boat

with three people on board off of half moon bay. they dispatched the helicopter and boat, but neither were needed. according to the battalion chief, the boat capsized in shallow enough waters that they were able to walk to shore. the boat named phyllis j. is essentially beach wrd it overturn overturned. >> woor he a fishing vessel that came aground with three people on it. we were not sure how they were getting off the boat. the three occupants were not immediately evident to us. they came out and were able to get off the boat on their own by jumping as the tide went. >> the chief said whoever was at the helm may have just fallen asleep along with the two others. that's when it overturned. all three are reported to be okay. the big concern is pollution. coast guard officials say the

boat is carrying 2,000 gallons of diesel fuel. at sunrise, pollution investigators with the coast guard will head out to see if any of that fuel leaked into the waters there. for now, we are live in pacifica this morning, marla tellez, today in the bay. later on, trial begins for a bay area man accused of killing his parents to try to get his inheritance. he was a professional poker player and prosecutors say he killed his parents in their pleasanton home to cover gambling debts. the bodies were found in their home in march of 2008. he could face in prison if he is convicted. defense attorneys say prosecutors do not have enough evidence. more on the trial in a live report at about 6:30. >> the federal government is telling pg&e to come up with accurate accounting and do it quickly. bad record keeping made leading

to dangerous decisions about what pipelines can handle. pg&e documents show it was seamless when it had welded seems. there is an urgent need to find out what level of pressure they can take before another one gives out. >> we still don't know why this happened. i am grateful to the ntsb for making the recommendations they made. clearly the pressure on this system cannot be increased. >> she is urging jerry brown to,a point two new commissioners who can keep a close eye on pg&e. >> they may also fate a fight in the north bay. people are fighting against those new smart meters. the county board may pass a law that would delay the installation for up to a year.

smart meters have come under fire after a lot of customers question their accuracy after the bill skyrocketed when they got them. others are concerned about possible radiation. this morning the san francisco board of supervisors has a big task ahead of them before they leave office. it is possible the board will vote today on who will take over the mayor's office until the november elections. the current mayor gavin newsom is leaving to take over the post in sacramento. newsom has delayed his inauguration until monday. today is the final board meeting for those who are all termed out of office. the california supreme court said police can look through your cell phone without a warrant. scott is joining us and lots of people have lots of secrets on their cell phones. >> that's the concern. many of us carry smart phones

with corporate e-mail access, but the california supreme court said if you are arrested, police can look through your phone the same way they look through your pocks. the state court said you lose your right to privacy if you are arrested. at least when it comes to items you carry on your person. you are not necessarily required to tell them a password. the decision runs cowner to other decisions including federal courts. we have not heard the last on this. when are cell phones really cell phones? smart phones are big in lock up and a lot of them are playing farmville made by peninsula's zinga. guards at san quentin said they found a cell phone in charles manson's cell. not only are prisoners using phones to communicate with the outside world, but to communicate with each other that worries the guards most. at least 9,000 phones were found in california prisons last year.

environmentalists are suing to keep a pesticide out of strawberry feels and orchards. iodine is buried into the fields to fertilize the soil. they proved that pesticide for use in california. the chemicals are known carcinogens and pose a health risk to those who work in the fields. it is expected to be used in monterey, santa and throughout the central coast. president obama should be landing in washington soon as laura mentioned after the vacation in hawaii. he will get right back to work by signing a new bill to increase food safety. it's an overhaul that gives the fda the power to force recalls. congress passed that bill late last year in response to several e coli and salmonella outbreaks. the house and senate swear in new members today. they will take control of the house and we should know if the

his parents for money. today in the bay's christie smith has what's ahead in court today. >> reporter: a new prosecutor on the case and we are expected to hear two very different versions of what may have happened two years ago. so far prosecutors have painted a disturbing picture of a man so consumed by death, he killed his parents to inherit $1.5 million. prosecutors say he was in deep financial trouble because of his gambling debts. the 32-year-old was living a very expensive lie by living in a million dollar home in orange count rea wife and child while dating other women as he played poker in las vegas. his parents were found dead in their country club home in pleasanton in march of 2008. his defense attorney said there really isn't enough evidence to

christina to find out what the daytime highs might be in a little bit. the new year in arkansas looked like something out of a horror movie. more than 3,000 buries came from the sky. biologists think loud noises or fireworks frightened the massive flock and they flew into building or other obstacles. they died of multiple trauma to vital organs. nearly half of police officers killed in car crashes over 30 years were not wearing their seatbelts. a study takes a look at more than 700 crashes from 1980 through 2008. in 42% of the crashes, officers were not wearing safety restraints. a report comes after a study that shows car crashes were the leading cause of death for officers on the job in 2010. 107 police officers have lost their lives since 1973, the largest number in the country. we have an accident to tell

waves crashing. the coast guard said they received a 911 call after 1:00 this morning of an overturned boat carrying three people at kelly state beach in half moon bay. the coast guard dispatched a chopper and 47-foot rescue boat, but neither were needed. they were able to walk to shore when the tide got low enough. according to the battalion chief, the fire department boat slipped in shallow waters. they are lucky the ocean did not dominate the situation. >> the waters are dangerous and luckily the surf wasn't that bad. you are taking your in your hands when you go out there. >> whoever was at the helm may have just fallen asleep. all three are reported to be okay this morning. the big concern is potential pollution. officials say that boat is carrying 2,000 gallons of diesel

fuel. at sunrise this morning, pollution investigators are going to head south to see if any of that fuel leaked into the water there. we are now in pacifica this morning, marla tellez today in the bay. >> thanks for the update. san francisco political icon nancy pelosi will give up the gavel has speaker of the house this week. the new members of congress will be sworn in later today and the balance of power will shift from pelosi's party to the republicans. they plan to dismantle a lot of work. tracy pots is live in washington, d.c. with a look at what's ahead. tracy? >> good morning, everyone. there is a vote scheduled for next wednesday, a week from tomorrow. whether or not the new majority will vote health reform out. they are taking a test vote this friday.

we will have somewhat of a sense of what that might be. they could pass the house, but not the senate where democrats hold a slim majority. you were talking about speaker pelosi who said that to repeal the new health law would be like putting insurance companies in charge of your health care. a couple of things could happen. democrats will fight tooth and nail to make sure it doesn't happen might try to force piece meal votes on this and not repeal the whole thing. force republicans to go on record piece by piece regarding which parts they don't like. republicans if in fact they can't get it done and it's really iffy in the senate may try to play around with the funding for health reform. this is not fully gone through the appropriations process. there parts of the new law where the funning is still in question and republicans are in charge of the committees. we will be making those
