you even now at 6:00 in the morning. we're looking at a 6:30 turn-on for the meters lights. no problems as far as visibility across the bay bridge. the golden gate bridge also looks pretty clear but further north in santa rosa, that's where christina is talking about very thick fog and low visibility. so use caution for highway 101 in the north bay. back to you. thank you very much. police dogs are trained to help officers take down criminals, but a family in brentwood says their pet dog was attacked and killed by a police canine. a san leandro police talk and his handler are under investigation after the dog attacked and killed a 6-year-old finish spitz walking along a trail the day after christmas. the police dog was walking with the handler's wife and other family members. >> she just started yelling "i can't control him. i can't control him." the next thing i know the dog is pretty much right on top of

chloe. >> the owner of the off duty police dog paid the close to $2,000 in medical bills. a police lieutenant says there are rules that exist when it comes to caring for police dogs in their home environment but did not elaborate on what those rules are. the dog and his owner are both working during the investigation. this afternoon san francisco police will show off a use of force simulator designed to train officers when to shoot and when not to shoot at armed suspects. the training comes after police shot and killed a man in a wheelchair armed with a knife. the police chief shared this shaky amateur video recorded by a witness. police say they spotted a man in a wheelchair said morning on howard street stabbing the tires of city cars with a buck knife. moments before the camera started rolling, investigators say the suspect stabbed one of the officers in the left shoulder. after using pepper spray and a bean bag gun to disarm the man, the officers opened fire. that investigation is ongoing.

both the wounded officer and the suspect are expected to recover. stanford police are asking students to walk in pairs and pay extra attention to their surroundings as officers investigating an assault on a student. a graduate student was walking this week when a man came up from behind and placed her hand over her mouth. the man took off after she tried to bite him. she ran to an emergency phone and called police. pay area police are looking for possible victims of a former church leader. the man was a former group leader around a lot of children. he was arrested in las vegas less than a week ago because of a warrant issued by san jose police. officers in san jose say he molested two junior high school age boys. he was a volunteer youth minister at a san jose chump and had access to a lot of kids inside the church. police are worried there are a number of other victims out there. he is still in las vegas this morning and we don't know when

he'll be extradited to san jose. a former medical marijuana dispensary owner is now heading to prison today but not on drug charges. the drug enforcement agency raided the san francisco pot club in 2005. all the drug charges were dropped, but he was convicted of tax evasion for not paying his federal taxes. now, he says there's no real way to pay those taxes because he made the money selling medical marijuana, which is legal in california, but violates federal law. he says two years in prison will take him away from his young son. >> he's young, but i want him to know me. i want him to know me as a daddy, not just some guy who just came up when he was 2. >> medical marijuana advocates say it is time to change tax laws for operators in states where marijuana is legal. the medical cannabis industry says several members of congress have asked the irs for some kind of new tax policy. people in redwood city might have to pay 20% more to get rid

of their trash and recyclables. the city council is set to vote on a rate hike, but people can fight against it. marla tellez is live in redwood city to explain how. marla? >> reporter: good morning, brent. yes, trash pickup and getting rid of those recyclables could cost people here in redwood city 18% more as early as next week if the city council approves the rate hike. now, the increase would also affect businesses. what this breaks down to for the average homeowner is $2 to $3 more a month. you can blame the rate hike on new collective bargaining agreements for waste collection workers that were reached last year and the need to pay off almost an $11 million debt owed to allied waste, a previous service provider. now, there is a way to fight this. according to city officials, if enough written letters of protest are submitted to the city by monday night, by law the city council cannot increase the

rates. now, monday is the deadline because that's when the city council will take up this issue. that meeting is open to the public, so you are welcome to attend. 7:00 p.m. monday night in the city council chambers. if in fact the city council votes in favor, the 18% rate increase for your garbage and recyclables will take effect next tuesday, the 11th. reporting live in redwood city this morning, marla tellez, "today in the bay." it looks like gavin newsom will be mayor of san francisco for the foreseeable future. the lieutenant governor-elect wants to know who will take over the city before he moves on to sacramento. the trouble is the board of supervisors can't figure it out. the board held several rounds of voting yesterday but could not come up with a majority needed to elect an interim mayor. they'll meet again on friday to try again. san francisco chronicle reports the board already has a mayor in mind, they're just waiting until he gets back in town. the paper says city from ed lee has enough votes to be picked as interim mayor, but he's in hong

kong an some supervisors aren't comfortable voting for him without talking to him first. lee had earlier said he did not want the job, but the mayor's office says he would serve if asked. now, if elected, lee would be the first chinese american mayor in san francisco history. drivers in the south bay may be in for a few bumps in the road today. recent stormy weather is causing lots of problems. there are potholes popping up all over the place. monterey road in san jose, for example, looks a little more like a mine field. this is a fairly minor one but they do get pretty didn't chunks. crews are expected to be out there to begin repairs today. caltrans says the days after the storm are often the busiest ones for road workers. it could also be the slowest for the drivers because they'll see a lot more lane closures. we mentioned the south bay and monterey road but this is going on all over the bay area. >> mike showed us on 880 yesterday they had a big pothole

problem that affected traffic. >> yesterday they were taking advantage of the break in the weather northbound 880 at high street. there was enough wear to see the rebar and the roadway beneath. since yesterday evening's commute things have been smooth for the nimitz. so 880 this morning nice. 580 no problems coming through oakland. 580 approaching the castro valley y. the volume of traffic starting to build. that water main break i marked is just off of 580, actually underneath 580. castro valley boulevard comes underneath the freeway so the freeway not affected but you'll see sheriff's officers there. there's three or four inches of water because of the water main break but traffic can get through so there will be a distraction but no major delay as you head through that poergts of castro valley. westbound 14 minutes out of the altamont pass. heading out of livermore we see slowing with speeds in the 50s heading towards 205. that may be attributed to some of the fog because i-5 and 99

have dense fog advisorieadvisor. here, the south bay, northbound 101 with slowing showing up between 680 and 880. that will sort itself out. we'll see a dip at tully as well over the next half hour. there are commuters back from new year's. back to you. >> thank you very much. we also want to check in with christina. we're not going to get any more rain. at least for a while, and no more new potholes. >> yeah, no more potholes showing up with rain, that's good news. but this morning we have something we don't usually see around the bay area, mostly confined to the north bay. we're talking about freezing fog. you've got temperatures at or below freezing in many cities in the north bay and in combination with that we've got really dense fog out there. basically what that means is fog could freeze on contact. that means you could find black ice on the bridges and overpasses. you want to take it easy and watch out for reduced visibility. especially if you're headed to sacramento or down south toward l.a., we've got a lot of fog.

republicans officially take over the house of representatives today. john boehner will now lead the charge as he takes over the speaker's gavel from nancy pelosi. the 61-year-old republican is expected to be formally chosen as the new speaker when the new congress convenes starting at noon. boehner and fellow republicans now want to cut $100 billion from the government's budget this year and repeal the president's health care reform law. the next chapter in the immigration battle will unfold today. lawmakers will question whether american birth certificates should be given to babies born to illegal immigrants. a group of lawmakers from arizona and other states will unveil its plans to change birth right citizenship today in washington. the group wants to create two kinds of birth certificates in the united states, one for children of u.s. citizens and another for children of illegal immigrants. federal attorneys will likely sue to block the measures because the power to determine

citizenship belongs to the federal government. california's most veteran senator will not be an capitol hill when the session opens today. dianne feinstein is getting ready for knee replacement surgery. the 77-year-old will not be able to travel for about three weeks and she plans to recup in her home. he will work from home on important issues. if it hasn't already, your child's school must tread lightly when it comes to asking you for donations. bob redell is live in san jose to explain. good morning, bob. >> reporter: good morning to you, laura. unfortunately many schools throughout the state or the country for that matter are in the situation of having to ask parents to donate to the schools because of the burdens they are facing in terms of budget cuts. many schools ask mom and dads to donate for textbooks, field trips, uniforms for sports activities, which is fine as long as that request is voluntary. it becomes a problem when the

school requires of this patients. that's why the state is now asking school district throughout california and here in the bay area to review their policies to make sure that they are complying with the law, not forcing parents to dig into their wallets. the aclu recently sued the state because of instances where students were humiliated in front of their classrooms for not paying required fees by putting their names on the black board, for instance. the argument being that that's unconstitutional since school education is supposed to be free in this country. the state has settled this lawsuit. as a result, school districts now who violate this decades-old law have to reimburse parents charged illegal fees or face a fine. parents also now have 30 days to protest those fees and moms an dads should be receiving notices regarding their rights, what they are required to and not required to do as a result of this lawsuit. again, schools can still can for donations and most likely will

still ask given the financial hard times we're in but schools are now in the position of darned if they do, darned if they don't because they do need the money. this could mean if they aren't allowed for or feel pressure not to ask for this money that some programs could end up being cut. bob redell, "today in the bay." the big facebook investment may turn into a big investigation. scott mcgrew has business news. >> reporter: good morning. the "wall street journal" reports the securities and exchange commission is looking into the way big investment bank goldman sachs is investing in facebook. as we reported, goldman will take facebook shares that it bought and sell them to its own customers. now, the way the deal is structured, it could skirt laws that come into effect when a private company has more than a certain number of investors. the concern is the way that facebook and goldman are doing this, other companies might try to copy it and make these

regulations irrelevant. earlier this week goldman sachs bought a piece of facebook for nearly half a billion dollars. speaking of facebook, brent mentioned the new congress takes its seat today. the whole swearing-in process will be live streamed on facebook, and republicans say they're going to push for new requirements to post bills on the internet before they're voted on so that people can see what congress is considering ahead of time. now, the website news.com points out that's pretty similar to what democrats, most notably president obama, had promised back in 2008 but they have been rather inconsistent, both in the executive and the legislature, in actually doing that. now, "today in the bay" traffic with mike inouye. >> all right, folks, 6:19. you're really starting to see more folks on the road and that's why speed is dipping just a little bit and your travel time from the carquinez bridge down to the bay bridge toll plaza, 19 minutes. the approach on the berkeley

curve just fine. the toll plaza approach, folks are backing up now. we should see folks in the cash lanes backing up to mid-parking lot in some of the cash lanes but not all of them. a little break over towards the 880 crossing and the fastrak lanes a big advantage. we're looking at metering lights in the next 10 to 15 minutes. you do see slowing out of westbound highway 4 where there's a new accident reported at summersville so that will add to the slowing coming out of antio antioch. 680 itself smooth through walnut creek. 580 over to the dublin change, also a nice drive. look at sunol southbound out of that area, we do have fog creeping through those hills. back to you guys. >> thank you very much. fog is creeping in but the sun also coming out too. >> yeah, yesterday ended up being a beautiful day. mostly clear skies. that's going to be the case today once again, but we've got to get through a foggy, frosty start. livermore hoegd strong at 33

summersville, that's actually providing a little benefit heading towards pittsburg and bay point because folks are slowing at the scene but it's going to cause more slowing. we'll watch that, all activity off to the shoulder, though. as you're moving over towards the maze, pretty nice flow through the walnut interchange. the metering lights have just been turned on at the toll plaza. we'll show you a live look at the backup. slowly but surely building. to the end of the parking lot in the next few minutes. that's the only major delay in the east bay aside from highway 4. back to you. a murder that shocked many communities on the peninsula is now being laid out in a courtroom. an ex-convict gunned down this summer at a local mall. now we're getting a look at the defense for the man who turned himself in. marla tellez is live outside the court house with the latest developments. good morning. >> reporter: good morning, laura. yes, it was back in june that david lewis of east palo alto was shot to death as he was getting out of his car at the

hillsdale shopping center in san mateo. now, for more than six months police didn't have any leads on a suspect. that was until december 18th, when they received a phone call from 58-year-old gregory elarms, an acquaintance. yesterday he was here in a courtroom where he pleaded not guilty to a murder haurj that carries a special circumstance allegation that he lay in wait, which essentially means that he was waiting for lewis to arrive at the mall that day in june. the charge carries the possibility of the death penalty if convicted. now, 54-year-old david lewis was a drug abuse counselor, described by his peers as a model citizen who had once served time and only wanted to help others in his situation. in the meantime, elarms is being held without bail and police still don't have a motive for lewis's murder. reporting live in redwood city this morning, marla tellez,

"today in the bay." tragic ending to a search for an injured motorcyclist who called 911 for help. the chp says they found the body of a santa rosa man last night. about 3:00 yesterday afternoon that man had called to say he fell off a cliff in sonoma county. he told the dispatcher that he was south of the ross state park, but he could not give an exact location. rescuers searched for six hours before eventually finding his body. the man's identity has not yet been released. police are reporting an unusual spike in baby formula thefts. tracy police say at least four cases have been reported recently. officers say formula can be used to cut drugs like cocaine, but it's also possible that the thieves could be stealing it to resell it later on. a group of public schools are suing san mateo county to try to get back some of the $20 million lost in a bad investment with lehman brothers. the school and the county should have seen all the signs point to lehman's downfall.

it also says the county put too much of its funds into one account. the funds were meant to be used for construction and educational needs. lawyers for the county call the lawsuit misguided and without merit. pg&e will continue installing smart meters after county supervisors passed a moratorium. tuesday's unanimous vote came on the heels of several tense board meetings. critics of the smart meters argue they are inaccurate and could pose a health hazard due to radiation. pg&e says the state public utilities commission, not the county board, has the jurisdiction over those meters. cheers, whistles an even a standing ovation followed the passing of the one-year moratorium. the federal government is investigating claims of snow cleanup sabotage in new york city. "the new york times" reports the u.s. attorney's office in brooklyn is looking into whether or not sanitation workers purposely slacked off during the post-christmas blizzard. a lot of streets didn't get cleaned for several days. a queens city councilman said

republicans formally take over the house of representatives today when the 112th congress is sworn in. there will be 89 new republicans, 9 new democrats. topping the gop agenda is repealing president obama's health care legislation. san francisco's nancy pelosi will give up her speaker's gavel. tracie potts is live on capitol hill this morning with what the change in power might mean. good morning. >> reporter: laura, good morning. good morning, everyone. in fact just a couple of hours now we expect that nancy pelosi will turn over the speaker's gavel to john boehner. he'll be the new speaker of the house and the head of the republican caucus in the house of representatives. as you said, they have got a pretty aggressive agenda. they want to roll back health

care and make major cuts in federal spending among other things. in addition to pelosi, another san jose area lawmaker is losing power. southeast lofgren is now out as chair of the ethics committee. they we lofgren was criticized by a republican from alabama for playing politics, he said, putting rangel's trial after the elections and in fact that republican, joe bonner, is now going to be in charge of the house ethics committee as the republicans take over. more republicans in the senate as well, although democrats still hold a slim majority there. they'll all go into session at noon our time, just about two hours from now. laura. >> thank you very much for the update. meantime, checking your morning commute with mike inouye. >> let's take you out there to the maps. we're looking athe a problem. a new accident, three cars and a

semi truck southbound 880 at eastbound 92, so southbound 880 is your commute direction. eastbound headed over towards hayward. anything at that interchange will be a distraction so this will cause additional slowing. we already see speeds are below 50 coming out of san leandro all the way to highway 92. further north, though, 880 and 580 close to the speed limit. a nice flow of traffic heading to the bay bridge toll plaza. this slowdown should start to clear up because the metering lights are on. a live look shows you now the cash lanes back to the 880 overcrossing. for most of the cash lanes you still get a little break and of course fastrak a lot faster. we'll get another live look out there at the golden gate bridge where we see the approach into san francisco. it's very clear at the golden gate bridge but as we've been telling drivers, the north bay very foggy also heading towards the central valley, sacramento and even l.a., we have issues with dense fog around the area. >> oh, yeah, major fog in the

san joaquin this morning and we're actually seeing more fog develop in the east bay. right now you're down to about a quarter of a mile visibility in livermore, quarter of a mile in novato. for the most part in the south bay we're getting a break from the fog. frost will likely be a factor. if you park outside exposed to the elements, give yourself a little extra time to get that frost off your windshield. dense fog advisory in place for the entire san joaquin valley stretching all the way from yuba city to bakersfield. if you're headed into the valley, take it easy or postpone your travels until after, i'd say, 10:00 a.m. and then the fog will break apart and lift out of the area. here's what you can count on today, just a few more clouds courtesy of low pressure. you can see that's already happening right now. we are firmly under control of high pressure. and for us that means another beautiful afternoon. clear skies for the most part. 33 degrees right now in livermore. just take it easy out this, it's a little on the chilly side.

as we head through about noon today, i think temperatures will gradually rise up into thor for, low 50s. by 5:00 p.m., pretty comfortable conditions, lots of sunshine, 58 grows in san jose today and 55 in santa cruz. a little warmer as we head through your thursday. we'll keep up by about a degree. more clouds on the way saturday into sunday. we are looking at the chance of another rain shower but that doesn't look like that will be the mace, just mostly cloudy skies. it is 6:49 right now. this morning cisco systems is expected to enter the race to combine internet, video and television. today at the consumer electronics show in vegas, the company is expected to show off its new set top box that combines online videos with live and recorded tv programs. the box will compete with similar products from apple and google. at&t cell phone technology is about to make its way to your

medicine cabinet. the "wall street journal" reports at&t is starting a service called glow caps. it helps people remember to take their medicine. the caps will send data to the manufacturer when the caps are open and that information is shared with doctors and family members. the caps also flash a light, play a ring tone and can call your phone to remind you to take your pills. move over farmville, there's a new game in town. cityville is now the biggest facebook game ever. the game had 84 million monthly users this past weekend and one blogger says it continues to grow by two million mayors a day. 84 million is already enough to surpass farmville. cityville is also a game made by the same company, so it's not like the bay area company is losing anything. they're gaining. cityville allows users to build their own city full of rez tents, businesses and civic buildings. well, good morning, everyone. one of the things we're looking at on the markets this morning

is atheros communications out of santa clara. we had heard that qualcomm out of san diego would buy that company and indeed qualcomm says they have for $3.2 billion. it's a 22% increase over the original share price. so about a thousand people at atheros, presumably a lot of them have shares in their own company, a lot of richer people in santa clara this morning. so another multi billion dollar deal in silicon valley. they make wireless chips, mostly wi-fi and bluetooth. well, it looks more olympicolympic -- likely the oakland as will not get a new stadium in their home city. there may be no money in the governores new budget. christie smith will explain. >> reporter: good morning to you. well, it certainly sounded good, a new ballpark by jack london square near the water. just last month the city council approved $750,000 to study it.

the key to making it all happen was redevelopment money, about $100 million for land and infrastructure work. but governor brown, who's just settling into the job, is looking at getting rid of local redevelopment agencies altogether. he's got a massive deficit in front of him of about 25 billion for the state and without $100 million for the oakland stadium, it looks like nothing can move forward and we're not even talking about the $450 million for the stadium itself. it was called victory square with a 39,000-seat stadium, retail and office space. the as have pushed for a san jose stadium but it's unclear whether brown's decision would impact that. certainly the schwarzenegger administration has already taken millions of dollars in redevelopment money from san jose. if more is taken, it would be difficult to complete a downtown stadium there. reporting live in oakland, christie smith, "today in the

bay." automakers are trying to rev up the cool factor when it comes to the chosen vehicle of suburbia, the minivan. honda is using rock music by pands like judith priest to give its odyssey a tougher edge. chrysler, the original creator of minivans, will roll out a performance version of its 2011 dodge grand caravan. they're going to call it the man van. and ford is going to reenter the mini woman market with its c-max. you can get your man van and drive it in your man cave and we'll put flames on the side. >> do i get a man cave? do i get one of those too? 2011 is looking sweet. >> christmas in july. >> what about mike, do you have one of those man vans? >> i don't. but i'm ready for us. >> we need a man bus at our house. >> let's look out to the roadways, you guys. this large vehicle over here southbound 880, there's not a

minivan but we do have an issue with regard to a semi truck that was hit involving an accident with two smaller vehicles there. it's all the way off to the right-hand shoulder but it's a distraction at that interchange. so that's slow but also continuing down toward the dumbarton bridge. the castro valley y moves smoothly but there is a heavier volume of traffic today than last week at the same time. we're looking at 580, a 19-minute drive coming out of the altamont pass. eastbound, the earlier slowing cleared up but you'll have issues continuing toward stockton and the central valley. dense fog there heading towards i-5 and highway 99 going to be a problem if you're heading down to l.a. or fresno even. slow through antioch but clear boy the time highway 4 hits 680. the east shore freeway slows around the berkeley curve and approaching the bay bridge toll plaza we see a better flow of traffic. the metering lights have been on since 6:30 but the backup only to mid-parking lot.
