this morning. good morning to you in the bay. low visibilities in the east and north bay this morning. you couple that with very cold conditions. head over to the overpasses and bridges. you want to take it easy this morning. the potential for black ice is there. that will be the case until about 9:00 a.m. by 10:00 a.m., we are looking towards the mid- to upper 40s across the bay area. by noon, temperatures climb into the 50s and the sun will be out in full force. back to you. a man is dead after being hit by the caltrain.

there was no kind of a crossing. it happened about 1:30 this morning. nobody on the train was injured. they had 30 or 40 people on the train at the time. that train that hit the man is the last southbound train of the night so that meant there were no trains running after that and they got everything taken care of. because of that, there is no effect on the morning commute. this is the first death on caltrain track this is year. 11 people died on the track. >> a new sketch could help students at stanford university find an attacker. a man attacked a woman near manz nitta field. a man came up from behind and reportedly grabbed the woman near campus drive and sarah street. now many students say they can't walk to class without looking over their shoulders. we will follow the story and bring you updates.

police are looking for victims of a 60-year-old man who is accused of abusing a south bay girl at a daycare center. police arrested campos who you see on the screen. the family runs the campos daycare for more than 10 years. officers have arrested campos on charges of committing lewd and lascivious acts on a child. they are looking into whether there could be other victims. campos remains in custody withoutdale. the man accused of raping jaycee dugard is expected to be in court. prosecutors are asking for access to tapes of a psychiatric interview with phillip garrido. the judge had initially sealed the tapes until the psychologist issued an initial report. garrido and his wife nancy are charged with kidnapping dugard. a party may be over at a

nightclub. the mercury news reports staffers did not call police or an ambulance for a woman who was choking on her own blood after being stomped on in a new year's eve party. it's the latest in a string of cover ups. they will ask jay to permanently close the club in a hearing on january 24th. they said the charges are overblowned. the nba franchises are the latest to be opened. will it happen? doeds in the bay's bob redell is live. the south bay is quite the sports magnet. >> it is and has been. good morning. we know about the discussions about bringing the 49ers and the a's down here, but moves like that is complicated by the fact that there no venues. they are venues that would be

expensive. the difference with an nba franchise is there is a venue that would exist. a couple of years ago the city came to an understanding with the owners of the pavilion that if an nba franchise were to move, they would be open to the team playing here in the shark tank and sharing the space with the sharks. yesterday a councilman said the path is clear for an nba team and we would welcome the opportunity to discuss an nba franchise moving here. the next question is, will oracle's ceo be able to get his hands on the hornets? yesterday at the americas cup news conference in san francisco, he denied offering $450 million for the team, saying there was $350 million and he was outbid by the nba. it's no secret he wants a franchise. he tried to buy the warriors who

play at the oracle arena and was revoked. that team did beat the hornets yesterday. experts think a move makes sense for the new orleans hornets. that franchise is struggling with low attendance and fewer sponsors. that could change here given the presence of the silicon valley companies and the bay area is a bigger tv market that would bring in more revenue. reporting live here outside the pavili pavilion, today in the bay. >> thank you very much, bob. >> almost 200,000 californians could see health care costs skyrocket. blue shield of california is looking to raise rates by more than 30%. if state regulators approve, the hike would take effect on march 1st. it would be the third increase since october. if it passes, humans of thousands of policy holders would see rates go up. more than 50s are% over five

months. >> one community is on alert after a mountain lion is suspected of mauling a deer in the middle of a residential neighborhood in hills borrow. officers responded to reports of a deer lying in the roadway in the 300 block of robin wood lane. they are advising people to keep an eye on small children, especially in wooded areas. new questions about what you should do if you are involved in a car crash after a series of crashes involving teenagers. the highway patrol told the mercury news that you should stay in your car, keep your seatbelt on and if possible drive to the shoulder. they advise that you not get out of your car. you call 911. the chp said staying inside the car gives you the best chance of survival if your car happens to be hit again by a passing vehicle. >> the police chief said the latest officer-involved shooting is a clear indication that the department needs stun guns. the chief said officers may not

have had to shoot a man in a wheelchair armed with a knife if they were carrying tazers. they tried to use a bean bag gun, but they ended up shooting him. the chief said he plans to push the stun guns again at february in a police commission meeting. >> managers are asking you to continue to go without your fireplace trying to keep warm. they want the public to voluntarily refrain from burning wood because weather conditions today and tomorrow may trap smoke close to the ground, causing unhealthy breathing conditions. a spare the air alert could be issued. wood smoke is the largest source of air pollution. a lot of fog. it's hard to see when you are in the fog. want to check the morning commute to see how it affects traffic. >> volume is so light. that is affecting speed and the

>> good morning. thursday morning already. light traffic so far this morning, but it is early. expected highs and lows across the bay area. a chilly start to the day. grab a heavy start. 5:13. >> puppies are dying and getting sick at the dogs for the blind headquarters. five puppies have die and 25 more are sick after a parvo outbreak. oldsmobile the youngest puppies that have not finished their vaccinations are the ones affected. >> parvo spreads very quickly. it definitely hits their intestinal tracts hard and they become very, very sick. >> a team of veterinarians from uc davis is helping to try to control the outbreak. they are hydrating the sick dogs and isolating thes that appear to be sick. as you heard them mention, that spreads pretty fast.

>> a doctor reveredas a medical pioneer is defending himself after linking childhood vaccines to autism. his work has been grossly distort distorted. 10 out of 13 are announcing findings at the journal that published the skparp is restraking it. the 1998 study is the first ever to link autism to vaccines against measles, mumps and rubella. they altered facts about the patients they observed. out of the 12 children studied who were normal before they had the mmr shot, five had previously documented developmental problems. researchers say the cases were misrepresented when they compared data from the medical records and dhrn's parents. measles surged because parents were afraid to vaccinate children. >> part the san francisco-based

>> good morning to you. clear o long the peninsula and san francisco. major fog on the east and south of the bay this morning. less than a quarter of a mile visibility and fairfield and up in the north bay this morning, you are dealing with freezing fog as well. reduced visibility and very, very cold conditions. that means turn your defrosters on in the car and take it easy over the bridges and overpasses. black ice there and that will be the case until about 9:00 until temperatures gradually rise. the good news is over 17. you should be okay. they are holding stead we 40

lunch break. temperature-wise, we will end up in the 60s. back to you. >> thanks, christina. the pipeline explosion in san browno is having a ripple effect. regulators have a stern warning to review and identify the pipeline risks. they also suggest that operators consider lowering the pressure in the pipeline. that comes on the heels of a review by pg&e on their system. that let to the discovery that the records were not always accurate and did not describe the san bruno segment of the pipeline. pg&e faces more lawsuits. seven new suits were filed in the last two weeks leading up to christmas. the lawsuits accused pg&e of nuisance and other claims. the september 9th blast killed eight people and destroyed

dozens of homes. people affected by the blast are asking where is the money? the survivors demanded that the city leaders handout roughly $400,000 in donations that pour poured in after the disaster. they are holing that money in an account until they can figure out how to give it to the victims. they need the money as soon as possible. the city council will meet to try to decide what to do next. >> a man who lost his daughter will attend funeral services before he is deported to el salvador. he was in the custody when an electrical cord sparked a fire on 82nd avenue in oakland as his daughters and their mother slept inside. nelson's 7-year-old was the only survivor. allison and her mother were in the country illegally. >> new into the newsroom, the

the constitutional reason behind it. it's going to have to be constitutionally justifiable. the clear suggestion is that democrats didn't care so much about the constitutionality of their laws and for that reason one new york democrat is calling this propaganda and ritualistic using the united states constitution for political purposes. there some democrats who don't quite agree. they want to get in on this. they want to join in the heading too and they will be allowed to do so. as they read the constitution, they will be reading every single word of it, including part of it that one republican wants to get rid of. it grants automatic citizenship to any child born in the u.s. >> interesting how they revisit the whole thing and hopefully learn from it. thank you. >> the secretary of defense will try to make a budget cut. robert gates is expected to announce the cost cutting

measures for the military. he could do away with the vehicles that bury troops to shore. that move is an attempt by gates to try to stop potentially deeper cuts by the white house or congress late or. the defense department is responsible for the biggest piece of discretionary spending in the annual budget. >> keeping an eye on the news out of the mideast. they are reporting iran arrested an american woman. the 55-year-old is accused of spying. the paper said she entered being iran from armenia without a visa and allegedly caught with spying equipment in her teeth. the woman told agents in iran she would be killed if she returned to armenia. they are working to confirm the reports. we are told the paper that reported the arrest is not known for reliable information. 5:43. good morning and thanks for joining us. >> we are going to check on weather if a few minutes.

it's cold out there. >> major road construction in the east bay this morning. drivers in oakland will see road closures and maybe detours and hear a lot of noise too. marla tellez is live along the embarcadero below 880 with what drivers need to look for. marla? >> reporter: good morning, brent. we are on embarcadero this morning. right behind me is fifth avenue. we are below 880. the construction you see here and equipment is all part of the fifth avenue improvement project that got started in the summer of 2009. about a year and a half ago. the whole point is to retro fit the bridge portion of 880. here's what's happening today. from 7:00 this morning until 4:00 this afternoon, fifth avenue between embarcadero and east eighth street will be closed. the detour signs are posted for
