>> per good morning and thanks for joining us. >> more on the top stories in a moment. first traffic and weather. christina is pulling double duty this morning. mike sounded sick yesterday. she has a look at both. >>a i great way to haze the new kid. welcome to you. hazy out there with dense patchy fog in the north bay. let's go through the hour by hour forecast. i can tell you we are warmer, about 5 to 7 degree warmer than at this time yesterday. 40 degrees in san jose over to 58 degrees under a mostly sunny sky. a few more clouds than yesterday. we will tell you what's on tap for the big weekend, coming up. >> a mi tear jus story in san francisco this morning. elevated levels of carbon monoxide in a popular hotel is making several people sick. marla tellez is live outside of the marriott at fourth and mission street with a look at

what's happening. >> reporter: it started about 11:30 last night when firefighters responded to a call coming from this marriott here on fourth street. several people reported feeling flu-like symptoms. firefighters were dealing with a total of six people. two were taken to the hospital for carbon monoxide poisoning. all six were staying on the fourth or fifth floors. that's where firefighters pinpointed their search and detected elevated levels of carbon monoxide i'd. they zeroed in and it checked out okay. the bizarre element here is they did not find a source here. published reports say these people are flight attendants with singapore airlines and they all worked in the same plane recently. about 2:30 this morning, firefighters gave the hotel the

all clear and cleared the scene. at no point was the hotel evacuated. the investigation has been turned over to the hotel engineers who are monitoring the situation. they have their own system to detect carbon monoxide. as for the two people taken to the hospital, they are not saying condition this is morning. we will continue to follow the latest developments. live in san francisco, marla tellez, today in the bay. >> looks like things are okay there now. the owner of the wet nightclub is defending the hot spot. mike hammond said accusations that forced the closure were overblown. the club's entertainment lps is under a 30-day suspension because of a new year's day fight when guards refused to call police for an injured woman. it's the third time since 2009 that the license was pulled due to unreported violence. you are looking at video at the

first incident at the club. the city attorney will seek an injunction to close the club for good. a san diego man made famous for saying don't touch my junk will number court today. he was arrested in the san diego airport for not completing the security process and recording the incident on his iphone. police handcuffed the man when escorted him through two terminals in his underwear. he was not charminged with any federal crimes. a news conference to announce legislation to prevent california employees from receiving larger pension benefits. it applies to employee who is make more than 2 their dollar 245,000 a year. the move comes in reaction to a lawsuit made by some of the uc's highest paid executives aiming to fatten retirement benefits. the conference kicks off at 11:00 on the steps of the state office building.

>> cools across the state face an emergency in anticipation of govern nor jerry brown's budget cuts. the superintendent of schools has pledged to find ways to help districts stretch their dollars, but many leaders fear that's not nearly enough to counter their deep cuts that are expected. monday govern nor brown will address a $28 billion budget shortfall. they have cut over the past three years to. add to that trouble, the "new york times" said the federal government is investigating color. securities regulators are looking into whether the state broke the law by failing to disclose risks. the california public employees retirement system suffered deep losses in the financial melt down. the value plunged $160 billion in 2007. it has recovered about $60 billion since then. a possible insurance rate hike may be over before it

started. state insurance commissioner dave jones said he will challenge the hike by blue shield. >> many californians are still struggling to make ends meet. we have 12.9% unemployment and our economy is lagging. we have seen these rate hikes year after year after year causing a real problem for californians and california families. >> two rate increases are already in place and the third is set for march 1st. the three successive hikes amount to an increase in premiums for many policy holders. they like the power to reject the hikes and will push for a 60-day delay of the increase. >>ar bay bay area market is closing down after 63 years in business. they will close on february 8th. they are getting too old to run the business and say it has become difficult to go head to head with other specialty chains

>> the board of supervisors will try to appoint an interim mayor. the supervisors could not come to a vote earlier this week. that's expected to change today. the city administrator ed lee is expected to be voted into office today. he reluctantly said he is willing to serve if he is selected. they cannot vote on him during the last meeting because he was out of town and the supervisors wanted to speak to him. >> the jim har bah watch continues. steven ross hopping back on his jet without a deal in hand. he met with har bah, but nothing doing. the niners are making another serious push. there is a horse that is reentering the race. the cardinal and they have an ace in the hole. andrew luck is returning to stanford and said he values his time, teammates and his education so he will not go pro. he is passing out the possible multimillion-dollar deal. he would rather finish his

degree in architectural design. >> the giants start spring training and they will be out without the services of the world series mvp. edgar renteria is signing with the reds. dusty baker is now with the reds. it's worth up to $3 million. >> today's voluntary spare the air day. the air quality managers are asking to refrain from burning wood. if you need to build a fire to keep warm, you can. weather conditions today could trap smoke slows to the ground, causing unhealthy breathing conditions. wood smoke is the largest source in the bay area. >> want to check in with christina. 5:08 and taking a peek at the air and the weather and the roads and what else? >> the big weekend. you guys have been waiting to take the triplets outdoors, you are in luck. looking good.

high pressure is the reason why we are asking you to voluntarily spare the air and refrain from burning the logs this morning. high pressure compresses everything, including the particulate matter left over in the atmosphere and the moisture. we have fog this morning. it's not as bad and widespread as it has been. we are seeing reduced visibility in fairfield or earlier we had three miles. now you can only see for a mile. it's hazy and still looking good along the peninsula and the south bay. dense fog reported in the santa rosa area. you have a half mile of visibility where as yesterday you were dealing with about a quarter of a mile. cool, but not as cold as it has been. about 5 degrees warmer than at this time yesterday because of cloud cover from the south. 39 degrees in concord and 40 in san francisco. today's highs will be warm relative to where they have been. temperatures will about 10 degrees between now and noon. you are looking at 50 degrees in

concord as you take your lunch break. maybe you are bringing your lunch. you can eat it outside. 59 in oakland and 58 in san jose. 55 degrees in gilroy. you want to take it easy in a couple of location where is the fog is pretty thick. we will talk about that when we get to traffic. look at the extended forecast. 59 on sunday. sun and clouds and not as much sunshine as we had, but that will keep the overnights more tolerable and warmer. let's talk traffic. the couple of spots we have fog, we want to let you know about. 880 through oakland with reports of lots of fog. you see the big rig making its way through and staying behind him. take it easy. not as bad as yesterday. not impacting traffic all that much, but we could see the situation worsen through the next hour or so. we are accident-free across the bay area. it's a get away friday. watch out for this as well. a bridge fog advisory for the

cover and the temperatures are a little bit warmer. despite the cloud cover and warmer temps, still seeing temperatures around the freezing mark. morgan hill 30 degrees. christina will have a full look in a few minutes. >> new video to show you. people had to leave home after a frayed train derailed and a tank car started leaking. it happened in vernon township about 20 miles from flint. it is leaking hydro chloric acid that is highly corrosive and is considered a toxic substance by the environmental protection agency. >> an act of diplomacy on the korean peninsula. south korea will send three fishermen back home today. the fishermen were rescued in december when the ship illegally crossed the maritime border. the south korean government investigated and determined it

was safe to send them back to the north. >> we're know what a possible predator prowling a campus may look like. police say this man assaulted a stanford student around 6:30. she was walking near campus and sarah street when the man put his hand over her mouth. she tried to bite the attacker and she was able to get away. if you have information about who this man might be, call the stanford department of public safety. >> hundreds of students are scrambling to get back in class after being kicked out of the university system although they did nothing wrong. they cent letters saying the students were on probation and could not return for the winter seg. ohm about 164 of them were supposed to be disqualified. 300 were still in good standing. the university apologized and said they will be allowed to return for the winter quarter. it was blamed on a mail code error. >> a vast number of californians

are depending upon a system that is under fire. scott joins us and said calpers pays everyone from teachers to firefighters. >> that means it's on the hook to pay a lot of money to a lot of people. cal pers is the largest retirement system in the nation with nearly a quarter trillion dollars under management. your retirement check is safe. they wonder if calpers has been totally honest about the risks it's facing. could the losses in the recession put the state on the hook for additional funds? your retirement check is safe, but the sec is not commenting specifically on the investigation. do watch for jobs number this is morning at 5:30 our time. the labor department will announce its unemployment rate. we will look for two numbers. the number of jobs gained or lost and also the unemployment rate itself. now, the more important number is the number gained or lost.

the unemployment can bounce around and get worse in a good economy as more people enter the job market trying to find the job. we will have the numbers for you at 5:30. >> we look forward to that. have you seen this video? it's amazeing for wal-mart. fighting with the store employee. the customers start chasing the employee down the aisle. it happened in tennessee. on the way, grabbed a jar of queso and hurled it. he missed and hit an unsuspecting customer in the face, knocking her down. it unfolded on the security video. the woman suffered a broken nose and other injuries. she may need plastic surgery. the chattanooga police are looking for him. >> the federal government is giving away free admission to national parks on several holidays this year. there 17 free days. the first are just around the corner.

is it's not as cold as it has been. we are seeing the upper 30s as opposed to the low 30s that we have been registering for the past couple of days. i think that you will enjoy the fact that cloud cover will keep the overnight lows warmer than they have been throughout this weekend as well. we have fog reported in the area, especially the north bay. you have about 2 1/2 miles of visibility. you are down to a half mile in santa rosa. not as much widespread fog, but you will encounter rough spots and heavy patches on the way to work this morning especially up to the north bay. keep that in mind and take it easy out there. i'm sure you know the drill if you are from the area. high pressure will keep our weather very nice and comfortable. temperatures in the upper 50s and a few more clouds than yesterday. a system of low pressure will drive the cloud cover up from the south. we are going to see mostly sunny skies by about 4:00 pem.

a beautiful sky overhead. 38 degrees in hayward and 40 in santa cruz. not as cold in the north bay. we are not worried about black ice or freezing fog. good news as well. by noon as you take your break, in oakland and 50 in san jose and gilroy. staying on the cool side and we won't have that much wind. light winds to breezy conditions out of the northwest. sustained at about 5 miles per hour. temperature-wise, we are talking 59 degrees in oakland. these temperatures are going to sustain as we head throughout the weekend. we don't have showers forecast until next thursday. a nice dry break conditions across the bay area. that will help out the commute, but we want to point out where the fog is. we have this video we picked up from 880 through oakland. brought way exit with reports of heavy fog. we want to tell you about an accident. this is the first accident of the morning. it's on northbound 280 if you are headed on the peninsula.

otherwise upper 30s in fairfield, napa and novato. you will notice temperatures about 5 to 7 degrees warmer in the morning, but we end up about where we did yesterday. at noon 51 degrees and oakland is 49. fremont if you take your lunch break, late or today look at the highs. 59 for livermore and staying mild. you will notice more cloud cover and increasing a little bit each day through the weekend. what will the temperatures be like? back to you. >> thanks a lot. new this morning, tense moments in hayward where they fired at a man. new video on the scene that happened after 11:30. a sheriffs spokesperson said when a deputy went into an apartment, the suspect turned around with a gun in his hand. the deputy fired and the man jumped out of a third-story building to escape. >> at this point it's pretty early to tell what charges she going to face.

we just captured him here so we are czechoslovakiaing him out medically and have to find out if he was struck by the bullets or not. that's where we are at now. >> deputies search the area for about two hours and found the man hiding in bushes. he surrendered peacefully. >> we know how rough state roads are. there is not enough money to fix them. an investigation shows there is more money, it's just not being used. bob redell is live with more on the story that has a lot of people wondering what's going on. >> it's remarkable. turns out that the state of california could have hundreds of millions more for road projects b you doesn't because of simple sloppy mistakes. this according to analysis relouised by the news and "usa today." they looked over earmarks, the pet projections that politicians

allocate. the study found that nationwide in more than 7300 highway projects, there is still money that remains unspent. in a majority of projects, not a single buck has been spent. when you add it up, we are talking about $13 billion that have been allocated for transportation throughout the country and the problem is that when you don't have this money, when huh it allocated if it's spent or unspent, it count against your state's share of federal highway funds. as a result this analysis found that california could have $568 million more for transportation if it weren't for the unspent earmarks. reporting live here in the newsroom, today in the bay. >> thank you, bob. >> it appears new governor jerry brown is jumping into the thick of things and getting to work. normally new governors start with a state of the state address. brown is not doing that. he is not set a date for the

address and sources at the capital said he may not deliver one. republicans are not happy with that idea. they say they want a clear vision and direction from the new administration and the state of the state is supposed to provide that. brown could get help from the homeless billionaire who assembled groups of businesses and heavy weights to figure out the best tax and budget reforms the state can use. the group reportedly includes condoleezza rice, gray davis and google's eric schmidt. the group would come up with a plan to get their ideas on to the ballot in the next election. the homeless billionaire earned that name after he sold off his home, most possessions and entire business empire. alameda sheriffs deputies shot and killed a hayward man around 5:30 near lindegaarden and west a street. they found the 24-year-old man lying on the side of the road.

investigators are asking anyone with information to call the county sheriff's office tip line. >> per police are investigating a shooting in richmond. the shot spotter alert notified before 10:00 last night and responding officers found shell casings, but they didn't find a victim until about 20 minutes later when a man who was shot showed up at kaiser medical center in richmond. the sheriffs department telepeople in discovery bay to lock their doors and windows. they are happening in an array of homes from apartments to ranches. the sheriffs department released this photo of a person that they would like to talk to. there he is. if you know him, you are asked to call the sheriffs department. >> this morning 335 california hospitals are under the microscope over their death rates. the state compared death rates between 2008 and 2009 for a dozen procedures like heart attacks, pneumonia and stroke.

the bart station. a jury convicted former officer johannis mehserle of manslaughter in july. >> the fight over gang injunks in oakland will head to court. there will be a hearing to disqualify lawyers to oppose the bid for injunction against the gang. the president is a partner in the firm and another partner is on mayor jean quan's transition team. she is not involved in the gang injunction case. >> china may be trying to muscle its way into the high speed rail project. they are reportedly eager to bank roll the project and provide the trains. they have more miles of high speed trains than any other country in the world. they have agreements with the state and the high speed rail authority. they want to share information and get a piece of california's business. china is the ideal partner for california because of the experience and cash. time now is 5:37 and time to

check the forecast and with christina. >> mike is off today and he's a little congested woochly will let you know where the congestion is on the highways. overall it's looking good. we will get into the traffic report in a moment. we have fog that could interrupt your commute if you are headed to the north bay. dense patchy fog out there in several locations. also the east bay valleys. take it easy. it's not as widespread or sick as it was yesterday. this is why. clouds from the south and they are not only keeping that fog formation down. they are also keeping the temperatures a little bit warmer than at this time yesterday. 38 in fairfield. at 40 in santa cruz and 37 degrees in santa rosa and novato. san francisco holding strong at 40. overall it will be nice. partly cloudy for the first half of the day and mostly sunny for the second half of the day by 5:00 p.m. temperatures registering in the upper 50s.

the new estjobless numbers are coming in and take a look at the jobless claims during the

month of december. scott is in the newsroom and has been gathering all of this. >> they look confusing. they are spectacular numbers. 103 thousanded this jobs compared to november. those are good numbers. the one you will hear about all day is the unemployment rate dropping to 9.4%. the biggest drop since 1998. we were at 9.7. there were a lot of different ways to interpret what happened there. it could be fantastic news and they did refiz the job members from earlier. but there will be a lot of political fallout. let's turn to brian for more on at least washington's view in all of this. >> you are going to hear the president say later that it's progress, but it's not nearly as much as he wants. he is essentially not happy with it. shock of shocks, you will hear
