milpitas. 880 through fremont and hayward. earlier construction and all construction at 92 and 880 picked up and a smoother drive to the san mateo bridge. we have slowing through antioch. 16 miles per hour now. that's the slow portion, but over towards consword, a smooth drive. there might be sprinkles through the area and the crowd is starting to build in the cash lanes we will look for the metering lights at about 6:25. a heavy commute and looking like a good one. >> folks heading back to work. the contra costa county cool board will look for ways to deal with a shrinking budget. christie smith is live with more. good morning. >> good morning to you. this is a school district that is in financial distress. they have been talking about closures and don't know which schools, but they have been borrowing to meet financial obligations. the governor's new budget plan

he talked about yesterday may be considered good news for the mount diablo unified district here in concord. he said yesterday that he felt k-12 took the brunt of cuts and would like to keep the current funding level as it is. tonight the school board meets and we should get a clearer picture of how this will affect the bottom line here locally. one of the hurdles was by governor schwarzenegger who said the state would no longer give funding for mental health costs. local districts would be forced to pick up the tab and that's more than $2 million in money they don't have. the district made three budgets trying to play defense depending on what governor brown laid out. each leaves them with a multimillion-dollar budget deficit looking forward. as for the closures, there study

sessions coming up and public comment the board expected to make a final decision sometime next month. live in concord, christie smith today in the bay. >> governor brown out lined his bunl skpet it includes deep cuts across the board and higher taxes. many schools will not get the help they hoped for, but they also will not lose funning either. only k-12 education is spared. he wants the cut of medi-cal by $2 billion and welfare to work programs would lose 1.5 billion. the university systems could lose money and face cuts of up to $500 million each. brown expects voters to extend taxes for five years and they were set to expire in july. coming up, we will have a live report taking a specific look at what the taxes are and what they involve. >> a san francisco nightclub is

facing increasing aims of scrutiny. the san francisco entertainment commission is set to announce any action to the temple nightclub. a number of fights broke out. four men were injured and one was declared brain dead. no arrests have been made. >> san francisco nightclub is seeing the city claiming it closed the club to protect the americas cup bid. jelly's nightclub near at&t park faced eviction since a fatal july shooting. sewage from the port would flood into the club's kitchen. jelly's owners said they asked the port to fix the problem and claim requests were ignored. the lawsuit claims the sewage issues could have kept the city from earning the bid to host the 34th americas cup in twen 13. >> san jose police are trying to figure out who killed a popular jewelry storeowner. they need your help. george kiriyama looks at what's next in that investigation.

there is a meeting in san jose to discuss the selection of a new chief of police. the chief rob davis's retirement prompted the search. advocates are asked to release the games. city manager claims that confidentiality prevents her from naping any of the candidates. a new san jose chief could be named as early as next month. san francisco's interim mayor will be sworn in. ed lee will meet this afternoon and will be formally sworn in. the city administrator will be the first chinese american mayor of san francisco. the 58-year-old served as the director of the differently public works and the human rights commission. it will take place at city hall this afternoon. >> a popular measure used in cars could be taken to the skies. officials are considering placing air bags in small planes. the ntsb will review a study

about the air bags. air bags have been required in cars since the mid 90s, but not in small planes >> people in redwood city are paying 18 percent per more for garbage pick up. they approved the rate hike yesterday and it goes into effect today. they didn't have a choice. if they had not approved the increase, they would have exposed themselves to a lawsuit. the average customer will now pay about $24.73 a month for garbage pick up, up from about $20.96. >> we will see if traffic is picking up, but sounds like there is a new accident. >> also traffic volume is picking up. a heavier volume than yesterday and based on yesterday's volume of traffic that hit the road. here's that incident that you are talking about. northbound 280 at el monty road through the los altos hill area.

traffic picking up across the bay areas as a lot of folks head back to work. we will check the commute and the forecast. >> mass will be held for the victims of the arizona shooting in tucson today. people gather to remember the six who were killed in saturday's mass shooting and pray for the 14 people who were injured. democratic congresswoman giffords is in critical condition this morning, but she is able to respond to verbal commands and even managed a thumbs up. there will be a memorial service for the people who were killed president obama is expected to attend. we will have more details on what he plans to say at 7:00 on today. >> the tragedy in arizona has many people questioning whether getting a gun is just too easy. would restricting firearms have prevented the bloodshed? gun supporters say firearms are not the problem. >> many say guns are not the

for the safe streets. even with the up tick in crime, bay area law enforsment will tell you they would rather see less guns than more >> we have to determine if the gun is loaded and we have to think of officer safety making sure the gun is loaded or not. >> most who see a firearm that may think something of it are generally now going to be met with questions while talking about the actions of that individual. >> people say they do it for two reasons. one to protect themselves and to protect their community. in san ramon, cheryl hurd. 10 people have been arrested on suspicion of espionage. it comes a day after iran arrested suspects in the assassination of a physicist a year ago.

bad. >> governor jerry brown said any tax increases will have to have voter approval. that's the case for his new proposal. he has to get california out of a hole. health care and education face the biggest hits and you could be paying more in taxes. marla tellez has a look at the tax proposals. particlea? >> extensions rarely farewell, but if they reject tax extensions, governor brown could mean the proposed cuts will double. they had a series of tax increases that were passed as part of the budget solutions in '09. they include a quarter percent surcharge on each income tax rate. a reduction in the credit for dependents from $227 down to $99 a 1 percentage point increase in

the state sales tax to 5% to 6%. vehicle licensing fees of 1 to 2% of a car's value. they want to change how they calculate the car's taxes and do away with benefits. all of this would bring in $12 billion over a year and a half. keep in mind voters rejected the package of tax extensions in may of 2009. we will see if they have a change of heart in june. governor brown wants californians to think about if voters don't agree to extend taxes. the already cash-strapped k-12 system could face an additional $2 billion in cuts. as mentioned, california is facing a $25.5 billion deficit. the governor's proposed budget slashes spending by $12.5 billion in the fiscal year. a long road ahead of us. >> 6:33 and the deadly start to

the year continues in oakland. a 29-year-old man who died monday is the sixth murder victim of the new year. he was shot near 98th and san leandro avenue. friends drove him to the hospital where he later died they are offering up to $10,000 leading to the arrest of any killers call with tips. a police dog helped catch a man suspected of robbing a bank with a bomb. danville police said a 37-year-old man walked into a wells fargo and threatened to blow up the building unless he was given money. the teller handed over cash and the police dog followed the man sent to an apartment complex. officers used video and witnesses to identify the robber and found the missing cash and other evidence in the apartment. >> two brave women are recovering after fighting off purse snatchers that happened in front of the hampton inn and

suites. they were walking back to the hotel when three men approached them. one of the women was punched in the face while fighting them off. police found two men who matched a description given by the vehicles, but the women couldn't positively identify them and they were released >> money for as many as 100,000 people who need a hand in paying rent. the oakland housing authority said they will start taking applications for section 8 vouchers at the end of the month. you can sign up at oakland public libraries or the oakland housing authority authoritying january 25th. families have to meet certain income requirements to be eligible. >> we're are checking the traffic report with mike. >> we will take you to the maps and give you an update. northbound 880 and fifth. the sand barrels had been hit and there was debris. the barrels were knocked over

ammunition had over 30 rounds, much more than gun control advocates say anyone needs they are hoping to restrict that type of ammunition. it was outlawed several years ago in the united states. it was in the mid 90s when president clinton signed the assault weapons ban. that expire and they are back on the streets. here on capitol hill, there at least two law makesers who say they are drafting legislation that would ban this type of ammunition in the united states. a handful of states do so, but there is currently no federal ban. the work of congress has been put off until at least next week as members of congress come become to honor the victims today. the house plans to meet in what's called a performance session where they won't conduct business, but members get the opportunity to speak. many of them undoubted about about what happened in arizona. live from capitol hill for today in the bay

safety. it happened on karlmont drive a few hours ago around 3:00 this morning. the fire was in the back of a unit that spread to the third floor. more than 20 people live in that building. firefighters rescued four people off balconies. of the 22, six were injured. >> six were transported bearing injuries. four were transported to kaiser with smoke inhalation and two were transported to stanford with fractures or bricks from jumping from the balconies to get out of the fire. >> no word on the cause of the fire or estimate on the damage. investigators plan to return to the scene for another look in daylight. right now we want to check in with mike. he has a look at the traffic. >> things are shaping up to be heavy this morning. i will show you the evidence. highway 4 has shown the early slow down since about 5:30.

slowing through pittsburgh and bay point has been evident. indicating a heavy volume for that portion of highway 4. a little scattered rain out of the north bay. here 580 continues to slow and speeds near 40 for much of the travel. a new accident will make it tougher in that direction. heavier volume out of the pass through the sunol grade into the south. 101 and 87 and 85 to speeds below 50 miles per hour. right around tully road it's going at 30 miles per hour in spots. a live look shows a quick build holding steady. the cash lanes to about mid-parking lot. an early burst and another burst coming up in about 15 minutesful a slow drive to the peninsula as well. 15 to 20 minutes. back to you. >> i wonder how long we will be clear from the rain too.
