what matters to you, this is "today in the east bay." good morning, everyone. i'm scott mcgrew. it is 4:30. let's check your east bay forecast with christina. it has been getting warmer and warmer and warmer. >> yes, it has. and i have good news for you, mr. mcgrew, it's going to continue to get warmer. let's start, though. you may have felt a little jolt in your sleep last night in the east bay. we had a minor rumbler, a 4.5 earthquake that took place near hollister. the epicenter was actually located eight miles southwest of hollister, 45 miles south-southeast of the san jose city hall. 4.5 earthquake is definitely strong enough to wake you out of bed and probably strong enough to knock a few books off the book shelves and pictures off the wall. that's what happened so we'll find out more information about how the impact was felt in this community but in the east bay you probably didn't feel it. things look really good in the east bay. we've got really warm temperatures compared to where we started out this week and we

do have a warming trend on the way. we'll see temperatures in the mid-60s as we head into tuesday, so today is looking beautiful, 58 degrees in the tri-valley. 60 degrees in oakland. good day to get on outside, scott mcgrew. >> all right, sounds good. mike, i know you've got a bunch of breaking news here, but first will bart slow down because of this earthquake? >> you know, they would slow down if it were local to the area, but being down in hollister and a 4.5, likely no effect. i've heard nothing from them. we didn't even feel it further north in the east bay. i'll let you know and monitor that. they would normally stop for a routine check. northbound 880 is a problem coming through oakland. just got a little better. they just reopened all lanes northbound at haggenberger after a major injury accident had two of the four lanes blocked about half an hour heading up past the coliseum. i was suggesting 580 as an alternate. now you may continue on 880.

so that is a problem for oakland. south bay we have a major injury accident just reopening westbound 237 at lawrence expressway. i'll bring you pictures and that deadly in sunnyvale in my next report. back to you. an east bay doctor who has treated patients more than four decades is in trouble with the law this morning charged with sexual battery. christie smith is live in alameda where the doctor practiced. good morning. >> reporter: good morning to you, scott. yeah, the clinic is here on central avenue and weber in alameda. recently a 28-year-old woman came forward with a very disturbing story that her doctor touched her inappropriately during an exam. now alameda police, they are urging the public, anyone else who thinks they may have been a victim to come forward and contact them. the doctor is 73-year-old ernest sims. the district attorney will prosecute him on suspicion of felony battery following his

arrest at his home in oakland. the woman is not identified. she is from alameda. she says that this disturbing incident happened on december 29th at aai health services where sims has been examining patients six years. he was taken into custody and alameda police have notified the state medical board. that is required by law in these situations. again, anyone who thinks they may have been a victim is urged to call alameda police. that's the latest from here. reporting live in alameda, christie smith, "today in the east bay." racial hit list or smart police work. police are putting together a list of the most dangerous gang members so why is it creating such controversy? cheryl herd spoke with a man who says he's being targeted. >> reporter: one man we talked to says he is being treated unfairly. >> i go to work, i come home.

does that make me a violent person? it's kind of hard, you know, like why am i on the list? >> reporter: he doesn't want to show his face or release his name, but he says he's on a list of 40 of the most violent street gang members in oakland's fruitvale and san antonio neighborhood. >> i have no violence whatsoever. >> reporter: are you a gang member? >> i'm not a gang member. >> reporter: you ever been a gang member. >> i've never been a gang member. everybody in oakland knows people. >> reporter: and his associations may have landed him on this list. the oakland city attorney -- police linked the alleged gang members to murders, rapes and crime in the city. the city attorney -- >> reporter: members of the community packed a meeting at city hall telling committee members to block the injunction they call racial profiling.

>> the preliminary findings were that it increased crime. if we know this doesn't work, why not listen to the community and look at some of the things that we value, like education. >> reporter: police have a different take on gang injunctions. they say it's a tool to address violent crime in oakland. >> this is a tool that residents wanted. people in those communities asked us to do something proactive to keep violent crime away from their neighborhood. >> there's people out there committing real crimes and they're just running out there like nothing and you're trying to focus on somebody that works, tries to support their family? it makes no sense. >> reporter: oakland city council members will hold another public hearing on this next month. in oakland, cheryl hurd, "today in the east bay." funeral services today for a mother and 3-year-old girl who died in an oakland apartment fire. the fire broke out december 30th in a four-unit apartment building. investigators say an overloaded extension cord may have started it.

28-year-old ruth and her daughter died in the fire. immigration officers are going to bring the father of the little girl to the funeral today. afterwards he'll be deported to el salvador. he was in the country illegally. the fate of the little girl is up in the air. right now she's in custody of child serves. today several groups will hold a candlelight vigil for the congresswoman shot in tucson. east bay young democrats and other civic groups as well will hold the vigil for representative gabrielle giffords in downtown oakland. they are condemning political violence and will announce a new program to fight violence. the vigil is set for 5:00 p.m. a flpolitical firestorm in hercules. the mayor is stepping down from his post before being recalled. he made the announcement last night at a city council meeting. he is accused of approving

several million dollars of no-bid contracts and supporting sweetheart development deals. last night he told the council he plans to spend more time with his family. let's turn to mike. mike has a couple of different traffic incidents going on. mike, take it away. >> this is the part of my job that i absolutely hate when i have to report a deadly accident. this is what's affecting traffic in sunnyvale. eastbound 237 is currently closed, but the westbound direction just reopened minutes ago after an accident closed both sides. it's a divided freeway. let me show you video. about 2:00 in the morning there was an accident between at least these two cars. looks like there's a third on scene as well. look at the major front end damage there. someone has died as a result of this accident or shortly thereafter. more details still coming from chp. they have reopened the westbound lanes, but eastbound coming out of mountain view heading over to 880 to milpitas, fremont and the rest of the east bay is still closed. again, this deadly accident

under investigation. they also have to clean up the debris and oil on the eastbound side, that's the reason for the slowing. they will affect you heading over towards 880 and 680, your access further north into the east bay. the second issue in oakland, we have the update here. all lanes now opened here passing by haggenberger. there's only slowing to about 50 miles per hour. so 580 no need for the alternate. two big accidents affecting folks. now both are starting to clear but that deadly investigation continues in sunnyvale. we'll follow that and i'll send it back to you. >> well, at least we have nothing on the roads to worry about. christina joins us. >> yeah, it might be a little slick from yesterday's showers, but most places only picked up a couple hundredths of an inch. we are now in the upper 40s along the peninsula. 48 in sunnyvale. 47 degrees in san francisco right now. take a look at san jose, 52

degrees. so it's a really mild start. we're going to warm up because we're starting out so warm, i'm expecting temperatures close to 60 degrees later on today and that's just the beginning of a warming trend that will us to 62 by tuesday. clear conditions, though, as scott mcgrew pointed out. you can see for miles along the peninsula. no problems up in the north bay when it comes to fog. we are concerned about the development of fog because we do have remnant moisture hanging around and high pressure building in which tends to condense all that moisture, so fog is a possibility. we'll keep an eye on that. otherwise, though, take a look at this. 64 degrees on tuesday. it's going to be a beautiful holiday weekend, staying nice. lots of sunshine. oh, yeah, you might want to start gardening, scott. i don't know if you do that. >> i could start start gardening. there you go. the nation continues to mourn the victims of the arizona shooting. we'll take a look at what's

donate blood and answer the sponsor code after the firefighter's fist name, scott. pg&e smart meters do not pose a risk to your health. that according to an independent report on the health effects of those devices which found they put out smaller levels of radio frequency exposure than cell phones or microwaves. it found no significant studies that confirmed negative health effects from emissions. one researcher said more research is needed. pg&e is installing those smart meters throughout northern california, but the fear is those meters, by some, increase the risk of brain cancer. the eastern part of the country bracing for another powerful winter storm. flakes started falling last night in philadelphia where forecasters are calling up to 5 inches to fall by tonight. boston, hartford, could see a foot of snow on the ground by tomorrow. meanwhile, in washington, flights at reagan national are

either cancelled or delayed because of snowy conditions in the northeast. i read somewhere on the internet, christina, that 49 of the 50 states have snow in them. the exception, hawaii, because of the volcano. the exception is florida. so 49 of the 50. >> pretty outstanding, it really, really is. yes, florida the big winner. that's why we live in california, right? we like our seasons. things look good right now. it's actually really, really warm to start you out. 52 degrees in san jose could make for a day in the mid-60s today. we're starting out warm so it's going to be a beautiful afternoon. high pressure has regained control of our weather pattern and for us that's good news because we'll gradually climb in temperature each and every day all the way through tuesday. right now fog isn't a factor. we do have a little bit of reduced visibility in livermore so if you're waking up in livermore headed over to concord, watch out for patchy

fog. fog could become more problematic the next couple of hours. the places that picked up the most moisture yesterday, especially the rural areas, will see the fog this morning, probably close to sunrise. high pressure in control, you can see these clouds arcing up and around a big ridge that's going to amplify the next few days, which means we'll stay dry and climb in temperature as we get closer to the holiday. 62 degrees on monday, 64 by tuesday. back to you, scott. >> thank you, christina. mike joins us. mike, it's been a rough morning but things are clearing up. >> quickly starting to improve. at least for oakland we have the flow northbound. we had an accident at haggenberger that's cleared now. all lanes are cleared heading up north and that's good news for the maze. i showed you improvement and now we're back to the 69 -- well, 65 the speed limit let's just say for 880 and 580 heading up through oakland. toward the maze, no problems coming off of 24. the east show freeway a very

clear flow to the bay bridge toll plaza. i'll show the toll plaza. it's a pretty steady flow of traffic and that's what keeps things flowing steadily. but no metering lights and light volume so there's no backup. we'll look for a 6:30 turn-on for the metering lights. eastbound 237 is closed after an overnight deadly accident. the westbound direction has reopened but eastbound is closed at fair oaks. you can enter at lawrence expressway. chp will escort you off the freeway. back to you. now that verizon and apple are hitched, rumors are flying you'll soon be able to get an ipad that can access verizon's network. google will unveil a new version of its android phone. the new system reportedly code named ice cream, it does keep with google's tradition of launching new android operating systems with dessert nicknames.

there was cupcake, doughnut and eclaire. nicole joins us from cnbc headquarters. good morning. >> reporter: a very good morning to you. futures are positive this morning. a little bit of carryover from yesterday's wall street gains. stocks are rising of course on upbeat earnings from alcoa and higher commodity prices. we also get data on import prices this morning, and the fed will put out its latest beige book report this afternoon and that could really provide this road map of sorts for the fed's next policy meeting that's coming up in two weeks. the dow rose 34 points on tuesday to 11,671. the nasdaq composite added 9 to 2716. we are watching oil prices very closely this morning here at cnbc. they are holding above $91 a barrel this morning. that's after the operator of the transalaska pipeline finally got government permission to temporarily restart production. this is a big, big teal because there is this 800-mile stretch

of pipeline that has been shut down since early saturday because of a link at the pumping station. the aim is to warm things up, prevent ice from building up on the line which could cause even more damage. this, by the way, is the longest shutdown since the pipeline started operating in 1977 and it accounts for 12%, 12% of all u.s. output. so we will watch that, scott, no doubt. and just because we can, just because we can, a little bit of this. >> 21 giga watts? gigawatts. >> what the hell is a gigawatt? >> reporter: and a little bit of "back to the future" envy by gm. general motors is looking to apply the technology from its new chevy volt electric cars to a wide range of vehicles

tomorrow. washington begins its official mourning today for victims of the arizona shootings. president obama traveling to tucson, while congress honors a colleague still fighting for her life. tracie potts has a preview from capitol hill. >> the country as a whole -- >> reporter: aides say president obama's speech at the university of arizona tonight will focus on the lives of those who were hurt. >> a gunman stepped from out of nowhere in a minute, he took away six loved ones and took away our sense of well-being. >> reporter: they're expecting a packed house. security will be tight. supreme court justice anthony kennedy, homeland security secretary janet napolitano and attorney general eric holder will accompany the president. >> threats against public officials, whatever form they take, continue to be cause for concern and vigilance. >> reporter: in washington this morning, members of congress will get a briefing on their own safety. >> last year we had 49 threats just in the senate.

house. taking regular breaks during the weekday could help your heart and waistline. rchers in australia tracked the movement of 5,000 adults. each person underwent a physical exam. those who took the most breaks from sitting had smaller waist lines, lower levels of a protein which is a maurker of inflammation. standing for one minute, anything that breaks a sedentary routine, can help your heart. heart failure patients may benefit from omega 3 fatty acid supplements according to a study published. researchers assigned more than 100 heart failure patients to high doses of the supplement. some got placebo pills. they found those taking the supplement had an increase in heart function, blood oxygen, exercise time and spent less time in the hospital. researchers do caution more studies are needed. patients should not start high doses of omega threes by just
