>> good morning. thanks for joining us. >> we want to get you started with a look at the traffic and weather. we start off with christina loren. is it true? is it going to be balmy? >> i don't think balmy is the proper word, but i was right about the 63 yesterday. i'm glad i amped up the temperatures. it was a mild day. places near santa cruz ended up at 68 degrees. we had 63 in san jose and morgan hill was 63 and 65 was the big winner for the bay area in saratoga. we start out mild, not as mild as it was yesterday. temperature-wise towards the low 60s and a few showers to the north. we will let you know if you can expect that coming up.

>> the showers may affect the drive. things tend to slow down. what we are looking at right now, an accident that took place overnight, but there might be activity. chp is on scene a car went into a ditch by san bruno avenue. you might see flashing lights and a distraction. keep that in mind. the travel on 101 moving smoothly into the city and north of 92. north and southbound 101 on a normal schedule. we will slow around 7:00 or 7:30, we will see good slowing starting early. over to you. >> it's 5:02 and a funeral will be held for the youngest version of the arizona rampage. christina taylor green will be laid to rest. she was born on september 11th, 2001. a flag that survived the

collapse of the twin towers will be displayed at the funeral. she went to the gathering in hopes of meeting the congresswoman. >> days after being shot in the head, the congresswoman opened one eye. her other eye was damage and remains bandaged. two of her closest friends when giffords squeezed one hand and opened her eye. one woman said she felt like she was watching a miracle. >> sar palin is getting a lot of attention for the shooting. some say her rhetoric is partly had to blame for the violence. anti-palin posters are popping up in san francisco. as you can see, they have words saying enrage them with fear until they feel justified with their violence. while the anti-palin sentiment

is out there, new polls show not a majority of people blame palin and others for the violence. a gallup poll released found 53% of people think that politicians are actually using the tragedy to make conservatives look bad. 35% do think what happened shows how dangerous language can be. the poll also asked people if skrikter gun control measures are needed and 20% said yes, they would want those things and could have prevented the shooting. 72% said in this situation, tighter controls would not have made a difference >> a teen girl is in the hospital and a suspect is on the loose. the 15-year-old was walking home near the intersection after 1:00 saturday morning when she was hit by a car. we have video that was rolling at the time of the accident. it's hard to make out, but you can just make out people nearby running to help the girl who was

rushed to the hospital. she in critical condition. police need help identifying the car and the driver. if you have information, call the police department. >> mixed news on the housing front. foreclosures fell in 2010, but the new numbers may not tell the complete story. marla tellez joins us to make sense of it all >> the number of homes that were in some stage of foreclosure fell by almost 5%. that was good news released today. this was a missed mexage for two reasons much of what happens depends on the trend of unemployment. the thought is more people go to work and more people stay in their homes. they don't factor in a backlog of homes or are already foreclose and just not lifted yet. regardless realty track reports

shows over 51,000 homes were in a stage of foreclosure and 2010 is a 4.7% decrease from 2009. for the month of december, about 61 human human homes were in foreclosure, a 25.5% drop from december of '09. a 9% increase from the month before in november. nationally it's a different story. a record number of homes are in a stage of foreclosure compared to a year ago, 2.9 million homes. encouraging news, you but 1 in 25 homes in the state is currently in foreclosure. that is the stark reality. coming up in the 6:00 hour, i will break down the new numbers county by county and get a sense of what's happening in your neighborhood >> good to note. a tour bus carrying japanese business men burst into flame,

causing the closure of san antonio road in palo alto. it start ntd imagine com part and spread up the rear of the bus and into the cabin the driver said he heard a loud bang from the back of the bus followed by smoke from the engine. all 35 passengers were evacuated and most of the luggage made it off the bus. there were no reported injuries. san francisco police could have a new chief and a new weapon in the fight against crime. ed lee will make a final decision on the next police chief. stun guns could be introduced as soon as next month. the police commission will meet on february 9th to debate the plan on vote on the issue. one of the largest cruise ships in the world is setting course for san francisco. the carnival splandor is set to drop anchor at pier 70.

crews will repair damages caused by engine fire from last november. the thunder was sailing off the coast of mexico when the fire swept through. 3,000 passengers were left for four days. the port executives say the job could take a month to complete. pier 70 is the only one who can handle the massive ship. 5:08 and we want to check with the morning commute. >> a lot of us like to get up and think about getting on the treadmill. i don't, but i think about it. i get my clothes off that were hanging on there. you want to remember for the next 20 minutes or so, westbound 92. the second lane as you head off of 880 and over towards the san mateo bridge. there is a light volume and chp should have a steady flow with the tail lights heading over. keep that in mind over the next

musician is in jail. tucker was on the way to church when he was fatally shot in the car on westbound highway 80. he was apparently killed in a case of mistaken identity. they believe the suspects mistook tucker for a member of a rival gang and shot him. they have been booked into the sonoma jail for changes of experience to commit murder use of a firearm that resulted in the death. police say one of the men charged in the deadly shoot suggest accused of another murder in sonoma county. the district attorney said raul vega murdered 20-year-old man over the weekend in a dispute between rival gangs. vega allegedly stabbed a man and they linked vega to the murder. in richmond, police are biz ingest vating two shootings that

happened within 20 mondays of each other. it was near the intersection of 24th street and mcbride avenue. a woman who was outside was grazed in the head by a bullet. after 9:00, someone ran up to a man walking on south 47th street and fired several shots. a man was shot in the leg. most victims are expected to be okay. police are searching for the shooters a 15-year-old boy shoots his father in the head and hayward police want to know how and where he got the gun. police say the boy's mother, father, and grandfather got into an argument before the boy shot his father. officers found the teen in a nearby park with the gun. neighbors want to know if the boy meant to shoot his dad or if it was an accident. >> there too many guns, that's for sure. to have it in kids's hands, i'm at a loss for that. >> the father did not die.

he is at eden medical center in critical condition. he was cautious and talking on the way to the hospital. >> a local scam artist is waiting to be sent after taking thousands of dollars in aid after the san bruno gas explosion. he pled no contest and could face a maximum of three years in prison. he used a fake name and numerous addresses to receive benefits like thousands worth of gift cards. they say at least six people have been charged with similar cases since the explosion. he is scheduled to be sentenced in march. san francisco students will testify about issues affecting the latino community including voting rights, education and employment. they will testify before a commission from the american bar association which includes former new mexico governor bill richard and emile yon esteban. they make policy and

recommendations based on hearings. >> the holidays have come and gone and nice to hold on to the spirit throughout the year, it is time to trim the tree. tomorrow is the last time you bring those to a better greener place. workers will gather up trees in the regular trash pick up tomorrow. they will take the trees to a waste energy facility that will turn it into fuel instead of dumping it into a landfill. if you missed a pick up, you can drop off the tree at the city's dump on tunnel avenue near visitation valley. another drop off at seventh and barry streets will be open this weekend. >> bad news for drivers. oil prices are at a two-year high and the higher the price, you more you pay at the pump. a leak in one of america's largest pipelines is partly to blame. the transalaskan pipeline is running this morning, but not at full capacity. oil is leaking along that line

and won't repair it for several days. until then, the pipeline cannot function fully. to help you save, we have a look at the cheapest gas prices in the bay area. according to gas buddy.com, the valero on san pablo avenue has gas for 3.17 a gallon. the arco on willow pass and one on monument boulevard are charging 3.17. in san francisco, the cheapest gas is redwood city. the costco on middlefield charges $3.21. it's 33.19 on mo's top and at the gas and shop as well. now the lovely laura garcia canyon. >> i remember when i used to wash your windows. >> major slow downs throughout one city. a series of planned power outages in fremont and they will affect key routes through the

city. the following intersections will be affected. auto mall parkway from 8:00 to 3:00 p.m. at highway 880 between 8:00 a.m. and to 2:00 p.m. the traffic signals will be flashing red. every car will have to stop before going through the intersection. a little heads up if you are getting through that area. watch out. it will be a problem. we will check in with mike. the latest look at the commute. >> we were trying to straighten it out. it's confusing. at fremont boulevard right in between ax 80 to 880. i marked it on the map north of mission boulevard. it getz crowd and a lot of folks use auto mall parkway. that will not be a great alternate today before 3 p.m.

has many members fearing for their own safety. some lawmakers have to carry their own guns. live on a controversial new bill that could allow them to do just that. good morning, tracy. >> there is a republican from texas who is draffing legislation and said that would allow members of congress to carry their own firearms. there was a hand gun ban in place, but he said members need to be able to protect themselves like things we saw in arizona over the weekend. there have been lots of discussions here since last weekend about how members of congress can do that. they had a security briefing with the police and the fbi. they don't like this idea of members carrying weapons, but when they were in places like san jose, they may need to contact local offices when they are hosting the events to see if they can get local officers to

provide extra protection. they are still talking about whether the political climate here in washington might contribute to this. there is a lot of discussion and disagreements many democrats saying they need to tone back. many republicans saying it's inappropriate to assign that to this particular incident and it was a disturbed individual, a lone gunman who was responsible, but to put politics in it is not appropriate at this point. >> thank you very much, tracy. >> meantime the nation paused to remember the victims of the shooting. thousands packing the public arena the at university of arizona and tucson to honor the fallen, reflect, and to heal. president obama delivered the main address in a moving and uplifting service. 26,000 people attended the president paid tribute to the six kill and spoke at length about 9-year-old christine
