for joining us. >> let's get you moving out there this morning. christina loren has a lock at the hour by hour forecast >> a lot easier to move, but it's not as cold. it's really mild. all three areas of the bay. the north bay at 49 degrees in santa rosa and the east bay is 44 degrees in hayward. 39 for livermore and in the south bay, you are in the 40s as well. we will warm up into the 60s and showers into the north bay and staying cool along the peninsula. you will really like what's to come for the weekend. lots of sunshine and temperatures close to 70 degrees. we will break it down coming up. back to you. >> here's mike with the commute. >> we will take you out to livermore where we have the slowing and it's starting to build up now. in the 50s as you come out of the pass and the early slowing that showed up, still hanging out as you pass by the airport. that's the 15-minute drive.

i will move you over to the maze. dublin interchange at 24 not a problem. coming past, you have never actually timed it out. no traffic or very little traffic. 15 minutes up to the maze itself. off of the bridge, an 18-minute drive right now. a look out there across the bay in san francisco, the traffic flowing past the scene at the toll plaza and over to the metering lights a clear view and a steady flow. we will get the sprinkles and that changes the flow of traffic. >> 6:02 and mixed news on the housing front. new this morning, foreclosures fell in 2010, but the numbers released may not tell the complete story. marla tellez joins us live to make sense of it all, county by county. >> the number of homes that were in some stage of foreclosure

here ni bat area fell by almost 5% last year. realty track.com shows a 4.7% decrease from 2009. this is good news from the crisis, but it is a mixed message for two reasons. much of what happens this year depends on the trend of unemployment. if more people head become to work, more will stay in homes. they don't factor in a backlog of homes in the process of being foreclosed or are already foreclosed and just aren't listed yet. realty tracks show for the month of december about 6100 homes here were in foreclosure. that's a 25.5% drop from december of '09. good news there and a 9% increase from the month before in november. county by county, here's a look in santa clara. just over 2300 homes foreclosed

in december. most in san jose. that's compared to about 1800 homes in alameda county that foreclosed last month. most in oakland. about 2500 in san francisco county. as far as how the bay area compares to the national scene, we are better off. that's because nationwide, almost three million homes are in a stage of foreclosure compared to a year ago and that is a record. encouraging news this morning, but you cannot forget one in 25 homes in california is currently in foreclosure and that is the stark reality. >> you see it everywhere. one week after a deadly shooting, they have suspects behind bars. four suspects in the shooting death of dewey tucker are in jail this morning. police say tucker was on the way to church when he was shot to death in his car on 880. they think he was killed with mistaken identity.

they accused raul vega, christopher man sinnas, hector bear began and-ier lopez of mistaken identity, shooting tucker thinking he was a member of a rifle gang. the suspects have been booked into jail on multiple changes, including murder >> approximate are a teen girl is in the hospital and a suspect still on the loose after a hit-and-run in san jose. the girl was walking home from a party near the intersection of come den avenue after 1:00 a.m. when she was hit by a car. video was rolling at the time of the accident. it's hard to make out, but you can just make out people running nearby to help the girl. she was rushed to the hospital and remains in critical condition this morning. police need help identifying the car and the driver. if you have information, call the san jose police. >> pleasanton police are trying to get to the bottom of a rash of burglaries. they believe an attempted

burglary monday fits a pattern of crimes under investigation. a man on cher il circle was in his bedroom about 10:30 when his door bell rang, but he did not answer. a man removed a screen and tried to get into the house, but he was surprised to see the man still home. the would be burglar ran away the crimes are happening in the sports park and neighboring areas. police are remining people to lock doors and windows and set alarm when is they are not home. >> san francisco police could have a new chief and a new weapon in the fight against crime. the new interim mayor will make a decision and stun guns could be introduced to the arsenal as soon as next month. the commission will meet to debate the plan and possibly vote on the issue. california gets disappointing grade when is it comes to public education. >> scott joins us from the

newsroom. >> we get a big c according to a watch dog group. that's the grade point average. we find out we have a d minus in achievements. we pulled an a minus and balanced it out for the c. california comes in 30th out of 50 states. let us say for a moment you don't have children. why do you care? it's a question of economics fewer moving to california. it's a negative number. fewer people are paying into retirement and taxes. the retirement systems say for public workers and firefighters and city workers and teachers. you will have to shoulder more of the cost. statistics say california is growing, but the growth is at lower income families. upwardly mobile families are not moving in they are moving out. schools could be part of the decision they are making as far as moving to other states. laura? >> thank you very much, scott.

>> a tour bus burst into flame that caused the closure of san antonio road. it spent five minutes putting out a fire that quickly spread up the rear of the bus and into the cabin. the drivers told firefighters that he heard a loud bang coming from the back of the bus followed by smoke from the nrnls. all 35 were evacuate and most of the luggage made it off the bus. no reported injuries 6:08 and we want to get the latest on the morning commute. checking in with mike inouye and a look at the south bay. >> we will look at the south bay where you have the first signs of slowing as is typical. right around the interchange, speeds around 40 and a reminder eastbound tully on the 101 with the connector ramp being closed for the long-term. you can take southbound from the westbound approach. that's a reround for the folks there.

the debris picked up and no major issues for the northbound through the south bay. the southbound direction is what we focus on. 101 at the limit as you come into menlo park. things dip down, but today with sprinkles, the peninsula gets affected. therefore there is a sprinkling going on. you watch christina naras well across the water here the tail lights are moving west and you can't make out the high-rise, but it's there and moving smoothly. the glow because there is moisture in the air like we have been talking about. a live look, i will get out of your way and see how things are flowing. no metering lights and another 15 minutes or so, but i guess the lights turned on on the upper and lower deck across the bay. >> explain the sprinkles to us.

>> i would love it. i'm going to break it down for you. waking up in the north bay this morning where you see the bulk of the moisture. it being loose like right now when the bulk of the moisture is coming through. santa rosa getting good shower activity. nothing heavy. this is very, very light and pushing to the east. antioch and places in the east bay, you are fair game for showers in the next 15 to 20 minutes. that could slow the commute and likely not see any action. the hour by hour forecast when it comes to the rainfall. right around noon. the activity will start to subside and only impacting places to the north of santa rosa. waking up in clear lake and showers last for you until about noon. by 4:00 p.m., a little cell trying to make its way onshore and novato geeing light rain and at 9:00 p.m., the entire bay area is nice and clear. skies clear tonight and that's going to make for temperatures a little bit cooler. right now we are at 47.

iraq can defend their own borders >> closer to home, we want to help you get out the door. >> definitely. if you are in the trivalley area, take good note. a lot to point out. we showed out the time. a 16-minute drive through livermore. speeds in the 50s. if you are heading to 580, it's a huge entrance point for a lot of folks a lost friend who is head down towards the area and reports of an accident there blocking the southbound lanes. traffic control at the scene and from what i hear is a good back up that will slow you down considerably. less than a mile before you get to 580. there is the slowing. 580 might hold up as far as the speeds, but out of northern livermore will be an issue. over towards the interchange, traffic does flow close to the limit, but the brakes get tapped over as well. the south bay where we showed you the earlier slow down

heading north on 101. we have slowing on tully. a live look out there, we will show you what things look like. brent andula laura, we have the typical build and the meeturing lights will be turned on any minute. >> it is going to start to get warm and perhaps by some people's estimations, hot in the bay area. . >> people come outside again. >> it is. we are not calling it fuego, but we have conditions that get people outdoor this is weekend. much warmer than the seasonal averages. right now we usually see an average of 57 degrees as we head towards the saturday. 67 degrees is the forecasted high. this is what we are looking at. light scattered shower activity into the north bay. reaching some cities as well. give yourself extra time for the commute.

electrics like as we head throughout the day, showers will subside. a big system of low pressure pushing into the pacific northwest. we have a big ridge of high pressure keeping things dry for the southern half of the state and the south bay. what will happen is this ridge amplifies and drives all the showers to the north. let's take a look at the timeline. by about noon, the only showers we expect is north in santa rosa and the commute home, most of the bay area is dry. a little cell trying to sneak onshore near novato. by 9:00 p.m., it clears out and we have another great day on tap. 61 degrees in san jose. let's break it down for you. what a difference a bay makes. showers to the north and cool along the peninsula. pretty good and headed to the north today. make sure you take it easy we are expecting heavy rain from lake port to chico. 63 degrees and sun and clouds

accident. >> i don't know what's happening here. too many guns. that's for sure. to have them in the kids's hands, i'm a a loss for that. >> the father is still alive at eden medical center in castro valley in critical condition. he was conscious and talking on the way to the hospital san jose police said three men have been shot to death over a kidnapping attempt. it happened at the mexicali club on oakland avenue in san jose saturday night. police think two of them who died were trying to kidnap the club's owner over an alleged debt, but they were confronted by a third secretary. police are looking for a third man that was with the alleged kidnappers it is 6:36 right now and lawmakers are looking for stuff to take after the tucson shootings. a live report from washington. the suspect's community college releases new details on past runins with campus police.

the bulk of the moisture is coming through right now, mostly impacting the north bay and spreading to the east bay. antioch seeing light rain and give yourself extra time. you don't want to go racing with foot conditions. looking good as you can see most of the activity is staying to the north and hay word making for nice conditions along the southern portion. as we head throughout the day, high pressure will amplify bumping all the showers to the north and that means we will see fair skies all across the bay area. a few showers to contend with. the only showers we expect were in the north bay. a mostly dry bay area.

good morning, everybody. a live looking shot and sdma south bay. a nice sunrise and look at the temperatures we are starting to have a nice warm trend. christine will check your morning forecast and mike has an update on the commute. coming up in a few minutes >> a local scam artist is waiting to be sentenced after taking thousands in aid for victims of the recent gas explosion. he pled no contest and could face a maximum of three years in prison. officials say he used a fake name and numerous addresses to

receive benefits like hotel rooms and rental cars and thens in gift cards. they say at least six people have been charged in similar cases since the explosion. she scheduled to be sentenced in march. time now is 6:45. we want to check in with mike for a look at the time saver traffic. i believe he is queueing up the latest. >> a time saver or warning you about the slow down. you can save time because the metering lights have been turned on for under 20 minutes. the back up in the lanes to about the mid-parking lot. the cash lanes are not too bad. this is thursday. before a holiday weekend, we should see a slower build. note the build anyway. further south, this is going to be an issue. south of 23rd, you are okay. approaching 23rd in the southbound direction, the nimitz slows and two lanes are blocked involving three cars non-injury. they should clear the quickly and crews don't have enough to

trucks to clear the road. just the two right lines. 580 is a great alternate if you take that. you are smooth through castro valley and livermore. eastbound no problem. westbound is a 20-minute drive. holding stead over the last 15 to 20 minutes. accessing 580 will be a problem. southbound we marked the accident. currently has a southbound lane blocked. emergency crews on scene. you will be directed around the flow and backing up and heading out of brentwood to byron. another accident here, injuries have cleared. they are sweeping up the debris and the expressway, both of the roadways have your left lanes approaching the intersection that are blocked by the clean up after an accident happened there about 20 minutes ago. still clearing in the south bay. we have a smooth flow on the freeways 87 starts to slow as well as 101 in patches. to be expected. back to you.

>> we will toss it over to christina. the sun brings everybody out. >> they are break out their short sleeve shirts. i saw quite a few at bus stop that's good news. you will get to do that more so. a little bit of shower activity to dodge in the north bay. high pressure is going to build in as we head throughout this afternoon. that will make for less cloud cover as we head throughout the day in the south bay. increasing clouds throughout the day for the north. it's one of the weird days with the microclimates. this is what you can count on. as we head towards noon, most of the activity will have cleared out of the area. as you head home, right around 4:00 p.m. tonight is when we are expecting everything to be cleared out. that's good news and a fast-moving system. maybe the formation of fog as high pressure condenses whatever moisture we pick up. that will be in the north bay. 52 degrees in santa rosa.

you hit your high today. temperatures will trend down as cold air comes into the area, but for the south bay. morgan hill hit 63 yesterday. 65 was the temperature in saratoga. not quite as warm there, but we are looking good, especially in the south bay. one of those days you are happy if you live in the south bay. the north could be problematic. from vacaville to chico. take it easy on 99. 63 degrees by friday. i really want to go into detail on the extended forecast. this is a really, really great trend that we are headed into. 66 degrees on saturday. plenty of sunshine and 62 on sunday. the sunshine will hold up for sometime. martin luther king,jr. day as we celebrate the doctor. it being wells like temtures will be really comfortable. a big event happening. the bay area proud event and you can clean up the area. we will talk more about that or

family of luis santos. the 22-year-old who was murdered in 2008 while away at college. he told the family he was sore for not telling them in advance he was going to commute the sentence of nunez who was involved in luis's murder. he was also the son of fab yen nunez. they said the apology is insigne seer and the result of bad publicity. >> we said we haven't heard from the governor and now he has written us. i think that's what it is. let's shut them up. drop the letter and send it out. >> they believe commuting the sentence is nothing more than a political favor. they are planning legal action against the state records just released on the arizona shooting suspect jared loughner said he had a series of runins with police at his

college. he was so disruptive that the dean called him creepy and he had a dark personality. they show campus police were watching him as early as february for his behavior. in one case, police say he launched into a rant during a poetry class, talking about killing people and strapping bombs to babies. the arizona shooting rampage has many members of congress fearing for their safety. some want to start carrying their own weapons. tracie potts has more on the proposed legislation. good morning. >> good morning. they're a parentally drafting legislation to allow the members of congress to carry guns in washington, d.c. where it's currently banned. he said in light of the shooting in arizona, they need protection. there has been a lot of discussion about that here on capitol hill this week. the police, the fbi and secret service all sat down with members to talk about not so

never in my lifetime did i think i could walk 60 miles in 3 days. 60 miles in 3 days-- i can do that. 60 miles compared to what a cancer patient goes through is a walk in the park. from the moment i registered, people started immediately supporting me. we had an outpouring of-- of support. i wanted to do something bigger than myself. the 60 miles-- it makes a statement. i know i'm stronger than i was before, both mentally and physically. i walk with my sister. our relationship has gone to a whole new level because of training together. you meet the most wonderful, inspiring people. i knew that there was something really special about this event. when you accomplish those 60 miles, it's truly life-changing. it was three days of hope. of love. of empowerment. it was three days the way the world should be. here i am, second year in a row, and i'm already signed up for next year's.
