to recovery, no question. >> it happened moments after the president and the first lady visited her hospital room. apparently giffords' right eye started to flicker, suddenly opened, another remarkably encouraging sign four days after she was shot in the head. we'll get the latest and hear more from the president about what he would like to see in the wake of the tragic shooting, straight ahead. six years ago he was one of the most powerful leaders in washington, earning the nickname "the hammer" on capitol hill. and now former majority leader tom delay has been sentenced to three years in prison on money laundering charges. for the first time since that sentencing, tom delay speaks out in a live interview. plus, did the kennedys get the plug pulled on a controversial mini series about their family just months before it was set to air? we'll have details on that. more on the memorial of the victims of saturday's deadly shooting rampage. lester holt is in tucson. good morning to you. >> reporter: good morning. it was simply a remarkable evening. the president's first stop, the hospital where he visited with

reflection and debate, as it should, let's make sure it's worthy of those we have lost. memorial service where the president spoke. there's been so much finger-pointing since this shooting about civility in this country and whether harsh political rhetoric somehow motivated the attack in tucson. how did the president do in addressing that debate? >> he said flatly last night, this is not the result of the absence of civil discourse and political talk. then he said, in a challenge to this country, but it is that civil discourse and talk that we need to face the challenges ahead of us in a way that will make the victims of this shooting proud. what he did by saying that, it seems to me, is to say we honor their memory if we all begin to change our ways here. most of this absence of civil discourse is taking place on the extremes, left and right. in the vast middle of the country where i spent a lot of time the last year and a half, people long for folks to get together again. these are reminders that for all the size of this country and its power, we can be reduced to one family on main straight, and i think that's what happened in tucson. >> there was criticism of the president in the way he

addressed the crowd, at times it felt more like a pep rally than a memorial, standing ovations several times. >> that wasn't his fault. we've seen this before, when paul wellstone died in minnesota, there was a rally around him among his supporters as well. it was a ticky piece for the president because he was trying to keep the mood of the crowd buoyant because she had opened her eyes at the same time he had an important message he wanted to convey. i would think on the political, what i call the political prose on both ends, it's probably time for the parents to say, time-out, let's take a break here for a couple days and reflect on what we've been through and where we need to go because there are enormous challenges out there across the board that really don't have as much of a political ideology attached to them as some would suggest. >> do you think his message will continue to play out in the state of the union address? >> i'm sure it will. i'm sure it will be an extension of that. with or without this shooting, this is a discussion we needed to have in this country.

on monday someone tried to shield delay's face from cameras as he quickly left a texas courthouse. the former number two in the house got frustrated with the handler as he tried to reach his car. >> don't hang on me. just let me walk. >> reporter: it was a different delay who was smiling when he walked into court on monday for his sentencing hearing. in november delay was convicted on money laundering charges. prosecutors say he illegally funneled corporate donations to candidates running for texas legislature in 2002. the goal to get more republicans elected to the texas house to help with redistricting. >> this is an abuse of power. it's a miscarriage of justice. i still maintain that i am innocent. the criminalization of politics undermines our very system.

sentencing, i can't be remorseful for something i don't think i did. you continued to say that these charges were politically motivated saying this criminalization of politics is very dangerous. very dangerous to our system. it's not enough to ruin your reputation. they have to put you in jail, bankrupt you, destroy your family. if you think the district attorney was politically motivated in bringing charges, what about the jury? what was their motivation? >> first of all, i was tried in the most liberal county in the state of texas and indeed in the united states. getting a jury -- the foreman of the jury was a greenpeace activist. i'm not criticizing the jury. the point is that this is a political campaign. it has everything to do with the district attorney who used six grand juries before he found one just sworn in to indict me on laws that don't exist in texas. >> do you think you were singled
7:19 am
out, congressman delay, for doing something quote/unquote everyone was doing or was the law in texas applied inappropriately in your case? >> actually, dick ought to answer that question. >> go ahead. >> this was a political prosecution. tom delay was prosecuted because he was so successful in bringing about redistricting in texas. the prosecution tried this case by making the jury hate politicians and politics in washington d.c. we went to trial on the very day that people across the country, voters rebelled against politics. that's the political atmosphere that this prosecution created. >> i think you made the comment we got tea partied and it didn't matter if it was tom delay or a turnip, the jury would have convicted. how do you appeal that and what
7:20 am
specific tactic or what specific grounds will you use for an appeal? >> that's a fair question. he didn't do anything wrong. there was -- the underlying claim was that corporate money was spent on political races in texas. that's not true. the money that came to texas from the republican party had been collected all across the country from individuals. there was no corporate money. however, the supreme court says that corporations have a right to participate in the political process and that will be part of our appeal also. >> matt, to have money laundering, you have to have proceeds from a criminal activity like drugs or things like that. they never proved that these proceeds were illegal. they were legally raised corporate funds that were sent to washington to be used legally around the country and washington sent legally raised funds back to texas. that's not money laundering. >> this is going to be an appeal

process that we'll follow because it will take some years. i wonder if i could turn subjects on you a bit and get opinions on things. gun control is a hot topic in wake of the shooting in tucson, arizona. do you today feel the same way about gun control that you did when you were an elected official? >> absolutely. i understand there's been a bill introduced that has thousand-foot barrier around an elected official so people couldn't bring guns. if i was still in congress, i would welcome and urge those that have license to carry to come to my town meetings. i would feel more safe having them there rather than shutting them out and letting some crazy come in and shoot up the place. >> so you would have -- >> i had a shooting in my office from one of these crazies too. >> no difference of opinion in terms of ban on assault weapons
7:22 am
that you didn't allow come to a vote in 2004? i'm not connecting dots that don't exist here, congressman. believe me. in that law would have prevented new manufacturer of things like extended magazines that was used by this alleged shooter in this case. he could have still gotten one. he could have gotten an old one. no rethinking of the philosophical idea of that? >> absolutely not. guns and people that carry guns are deterrent. happened right here in texas. we had a situation where people would bump into women in expensive cars and rob them on the freeway. the day that conceal carry went into law in the state of texas, that all stopped because the robbers didn't know if that woman they were bumping into had a gun or not. you know, this is all stuff that we shouldn't be talking about and what we ought to be talking about is the rhetoric in washington, what people ought to be -- how people should be treating each other civilly and

7:34 am
so now ted williams whose remarkable journey has played out in the spotlight has a chance to work on his sobriety away from cameras. >> george lewis, thank you. good morning to you both. last week when ted williams was on the show, you were here for another segment. you did speak to him off camera afterwards and you have had several phone conversations with him since. i know you cannot share those conversations with us but for someone in a situation like ted, susan boyle who goes from obscurity to this instant fame and notorietnotoriety, what doe attention do to someone who is already fragile? >> when someone is already fragile you are startsing wi st place with no foundation. you have to understand that it can explode and all this happens so quickly and there were so many people trying to pay attention perhaps not really to what was best for him.
7:35 am
there wasn't really a balance of what the opportunities were that were being presented to him with what was good for him for the short and long run. there's a risk. the direct answer to your question is it's risky business. >> as george said there's this slippery place. >> it's a very slippery slope. you kind of look at something which is the big picture of the fame and fortune but you are not paying attention to where he came from and what really needs to happen for him to be able to get to the place where he can handle some of this. not all of it. how many people could handle this if they didn't have this background? >> he says he told us it he had been clean for the past two years. you are shaking your head? >> i'm skeptical. i'm skeptical in situations like this. this is a man with a lifetime of substance abuse and alcoholism and criminal behavior. theft, forgery, robbery. he may not be telling the truth about many things. it's part of his personality is
7:36 am
that he's not necessarily going to be honest. >> because of the fact that he's an addict. >> addiction doesn't happen in vacuum. he had some personality problems. he's alienated his entire family and his mother. you can see in these interventions or when he gets together with his mother, they're not necessarily willing to give him a second -- america wants to give him a second chance. >> his mom was on the show with us and she was angry at him. >> he's had many second chances with the family. >> how important is it to mend those fences in order to lead a sober life going forward? >> it's very important to attempt to mend fences and deal with the issues that caused some of this disillusion of his relationship. it's not what comes first, chicken or egg, it's part of the process of getting out of the limelight and be able to heal and deal with his own personal issues some of which have played out with his relationships so that if you are in a private and personal and protected and safe
7:37 am
environment, you can talk about issues with counseling and with your own issues having to deal with addiction and deal with them and the whole thing being played out in front of the whole world is not really a healthy way to approach this. >> let's say he is being honest and he hadn't had a drink in two years. does the limelight trigger drinking that his daughter talked about? >> it's possible lots of addicts relapse when things are going well for them. they are afraid of failing or afraid of being found out a fraud or they're not comfortable with success and comfortable with chaos and things falling apart. success can trigger relapses. >> the other piece of it to what julie said is also there's an opportunity to just go, go, go without an opportunity to stop and just relax and in this situation as in many situations other people are running your life. other people are making decisions for you. you're not even involved in the decision making process. so on the one hand you feel as if you have control of your life and on the other hand you have
7:38 am
no control of your life. you are trying to make decisions that may be right for you about you you don't have the objectivity and distance and you don't have any opportunity to take a breath and figure out what's best for you. >> what happens when he gets out of this facility? that's the big question. >> that's a very important element when anyone is in recovery they need to be able to have a follow-up to have support, to have a program that they can rely on. >> a sponsor. a therapist. i don't know if this is his first rehab. he may just need individual therapy, family therapy. a lot of work to do. he needs to patch up a lot of relationships and get his life back on track. >> the best thing is he'll do it out of the spotlight. that's the most important thing. >> let's hope. this is really an important element of this. let this man try to build his life and have the life that he deserves to have and that would be right for him. >> thank you very much. let's get another check of the weather from al who is in boston

august body behind it. make sure the facts are not only there but they are updated. >> interesting because a lot of the things on this list are kind of sort of the things that journalists would use. >> exactly. >> to make sure they would go with information or not go with information. we've got questions now from our viewers. one is an e-mail from kristen in los angeles. she says, in her e-mail, as soon as the first symptom hits i go right to google but i end up self diagnosing and scaring myself into the worst possible sent ntheir row. at what point should i put down to computer and call a doctor? >> i say the rule of thumb is 48 to 72 hours. the only reason i'm laughing is because there's an old adage in medicine that a doctor who treats himself as a patient is a fool. at some point, yes, you cannot diagnose and treat yourself and then expect a physician to sort of clean up the mess afterwards. so give yourself 48 to 72 hours. do smart research. not the 2:00 a.m. oh, my god, i'm going to die crisis research because you'll overdiagnose yourself usually with something awful. >> we also have on the phone barren in pittsburgh.
9:10 am
you've got a question. hello, barron. >> hi, dr. nancy. any time i'm sick i use the internet to get information about symptoms which may or may not be related to my illness. are there any websites to receive good medical advice? >> there are a few i must admit i turn to. what ann talked about being a reporter and being smart about it, turn to a couple of favorites to start and i expect them to take me elsewhere. one of the good ones is the government, cdc.gov, i turn there because it gives you immunizations, recent epidemics, things that are happening that the government is watching. if you're a parent the american academy of pediatrics is trusted and it gives you a lot of places you can find a doctor in your community. if you're really looking for a solid citizen, you know, the backup go-to place, the mayo clinic remains a very high standard. >> conversely, barron, thank you for your question, probably worth asking how to know -- in other words, are there aefrs you want to stay away from.
9:11 am
you touched on that earlier. are there areas that we should really -- look, if you see a site that is sponsored purely by a new medicine or by people who you really don't think are credentialed, you can put down that information but put it to the side, verify it. you really have to think like a reporter. so keep thinking, i have to trust but verify and i have to have at least two or three sources to back up the same information. >> okay. all right. we've got a skype question from courtney. and she's actually -- what's your question? >> hi. >> hi, courtney. >> good morning. my question is a lot of the times when i'm looking for health information online i go to health magazines, like "shape" or "fitness," any of those magazines that i can pick up off the street. how reliable are these sources for health tips and dieting tips and even sports injuries? >> well, you know, courtney, i know courtney and she has a sports injury. she recently fractured her foot.
9:12 am
she's sort of been one of these people who looked everywhere for information. but it's a very good question because these editors end up on this show in fact a lot and they are friends of ours and trusted colleagues. i will tell you after having been interviewed by a lot of magazines they do have fact checkers call after they've done their homework to make sure what you say is true. none the less, they are entertainment magazines, not necessarily medical journals. so take it as one piece of information but not necessarily the be all and end all. >> we've also got lauren in denver, colorado. she basically is on the telephone. lauren, what's your question? >> hi, dr. nancy. >> hi. >> i'm constantly downloading apps for my phone and i noticed there are so many different helt-related apps. how do i know which ones are the best to use, are the ones you have to pay for better than the free ones? >> a lot of free ones. i have my ipad and here's one of my favorite ones called ice. put down your friend's name. here's my friend marion shippey who lives in california. i can go from there and i can
9:13 am
find -- i can -- if someone has it, finds this, they can know if i have certain allergies, if i have certain problems. it's a really, really good one. and one of the other ones i like is government. all the listings are the government. if you go further you can check drug reactions, all kinds of problems. so ice and what is this called, government news. and one of my favorite, medicine tracker. this is going to be a very important for a lot of older people because you can put down medicine a, b, c, d, check for interactions. so i think, frankly, most of the time free are 99 cents. you don't have to go beyond that. the government ones are all free. start with cdc.gov and i think ice is also a really good one. >> sounds like technology can be our friend if we use it smartly. >> you know, i just think it's extraordina extraordinary. not all of these are going to go for an iphone or ipad. you will know when you try to download the app but they are out there. use them. >> dr. nancy snyderman, thank
