issues. a nice drive north, these two lanes. once you get there, i want to show you before you get to the waldo tunnel we do have reports of a disabled gas truck. still being helped off the roadway. watch that activity as you approach the rainbow tunnel. you'll see the rainbow painted over there. toward novato at 37 there are reports of a tree on the roadway. a crew will head out there. i'll follow this. so far there is a little blip that shows up after the report was filed. no major issues off 37. we're looking at a smooth drive off the carquinez bridge. moving nicely in your commute. the heartbeat of the morning, on the east bay freeways, how clear the view is from san francisco all of the traffic, no metering lights. that's what we can see. the san mateo bridge, the clear

all of that dense patchy fog. this morning we have temperatures that are rather mild in the places that have cloud cover, some high and mid level clouds over santa rosa keeping temperatures mild. 55 novato, turning over to the 60s today. 67 degrees is your forecasted high in fairfield. we'll let you know when changes are on the way. i think you'll like what i have to tell you today. let's find out about what's happening. let's sended back to you now. >> thanks a lot. new details in an officer-involved shooting. san pablo police say a traffic stop turned deadly. christie. >> reporter: good morning. i spoke with san pablo police. they tell me this did start as a routine traffic stop on that corner right there, san pablo dam road. one man in the car had other plans. the car pulled over here. it came to a stop at the gas station. one man inside apparently got

out, started running around the parking lot. he ran over these bushes here, stumbled and kept going. police are saying he pulled a gun on an officer that was loaded and cocked. police say he was a parolee at large with an extensive criminal history. this started about 8:15 near san pablo dam road and ventura. a patrol officer pulled over a vehicle. the officer ran a check and when he returned to the car a man in the front seat had bolted with a back pack on him. the officer ordered the man to return to the car, instead he kept running and reaching for his waist band. the officer apparently shocked him with a taser one time, maybe more. the man kept going. there was a struggle. he broke free of the officer. >> the officer ordered the suspect to comply with his orders. the suspect then reached for his

handgun in the waist band and the officer fired his weapon. and struck the suspect. >> reporter: that officer was by himself during this ordeal. the officer called for medical help but the man died at the scene. they have not released his name but the district attorney's office, the sheriff's department and police are all investigating. the officer is on administrative leave which is routine. the other two people in the car, they went down to the police station to answer questions overnight. reporting live, christie smith, today in the bay. >> thank you. 5:33. what started as a drug bust ends with the discovery of five explosives in the east bay. crews cleaning up gunpowder at the storage unit on south bound interstate 680 south of highway 4. contra teams say they got a tip about the possibility of the

drugs being at the storage unit. they checked, they found a back pack with five pipe bombs. they used a robot to blow up the bombs. a woman renting the space where the pipe bombs were found has been arrested on bomb charges. two others were arrested for drug charges. >> the owner of a hotel is charged with plotting to burn down his property to try to get insurance money. 44-year-old richard earl stinger is accused of hiring somebody to burn down the hotel menlo on 13th street. singer is held without bail. that hotel is in civil litigation because of claims that it is uninhabitable. >> a judge will allow a device plant bid police to be used in a murder trial that left an oakland journalist dead. data shows the car was parked outside the apartment of

chauncey bailey hours before she was killed. this after denying going to bailey's apartment. the former ceo in oakland is charged with ordering two men to kill bailey to stop him from writing about the bakery's financial troubles. her lawyers argue that electronic tracking is a violation. >> the family of a danville soldier is mourning his death. evan died january 12 after a medical emergency at a base in afghanistan. he wasn't feeling well and went to a hospital where he likely died of a heart attack. he was a logistics officer and about to complete his year-long tour of duty. he was set to come home in about two weeks. he leaves a wife and three teenage children. >> several schools will find out why they are targeted for closure. a committee will present their recommendation to the school board at a special meeting. they have three scenarios, each

includes the schools. the cutting block includes glenn brook, silver wood, all book elementary, wren avenue elementary, monte garden elementary, and sequoia. trustees expect to vote february 8. >> napa state hospital workers are going to rally for new safety measures. not enough has been done to improve safety. a patient is accused of killing a psychiatric technician during a driner break-in in october. the patient is awaiting trial. less than two months later another patient was arrest ared on attacking a rehabilitation therapist. >> 5:36. economic realities might put limits that the council is willing to fund. council members put off

discussing a $20,000 fund to help city employees pay for sex change operations. insurance plans won't pay. in 2007 when they voted to include sex change operations as part of the employee benefit backage. his two health care providers haven't gone on board. kaiser could not provide a sexual reassignment surgery benefit. health net said that would spike premiums. the issue is on hold until at least february. >> we are learning more about the sudden end to kusf, the radio station with a cult following. the station went off the air yesterday morning. the university of san francisco sold the license for 90.3 fm but it didn't tell the deejays or staffers. it was known for introducing underground music. now an on line format.

it's time for the kmorning commute. >> they are rolling but slower. true to form, the slowing has kicked off. coming off of the antioch bridge. unusual for that. typical showing, then another blip. the volume should be lighter than it was yesterday. i skipped to the map. let's look at the pay bridge. i wanted to show you the volume slightly increasing here as it will throughout the east bay. then livermore. you'll see a heavier volume. now back to the maps. the tease. a smooth drive. 101 no problems passing 92. north on highway 1 reports of debris along the coast, the pacific coast highway an issue. christina, though there's not a lot of fog you might encounter a

patch or few. >> yes. probably closer to sunrise. 7:21 this time of year. you want to be careful. you can damage the bottom of your vehicle. you can see for ten miles in places like mountain dew. we have nothing like what you were confronted with yesterday or even monday morning. we're looking really good this afternoon. high pressure is going to dominate for the next seven or eight days. all these clouds up and around the ridge of high pressure. you can see the clouds coming in as i zoom in. and the places that are getting the most cloud cover are actually a little warmer, more mild this morning. 55 degrees in novato, 52 san francisco, warming up to the 60s later on with lots of sunshine, especially in the south bay. 67 degrees in los gatos, 66 in san jose and 65 degrees in gilroy. a little breezy for the mountain

whether the repeal vote stands a chance. tracie. >> reporter: well, it does in the house, probably not in the senate though. we've been talking about this, today is the day the vote scheduled likely to happen late this afternoon after several more hours of what has been a much more civil debate at least in tone between democrats and republicans about whether or not the health law as it was passed by congress will work. republicans say not only do they want to roll it back but want to replace it with something that they have not yet made public but will include, like limiting malpractice awards, patients who get large jury awards for suing doctors or hospitals, that they say is driving up the cost of health care. they also want much more restrictive language prohibiting taxpayer funding of abortion. so after this vote republicans will begin the process of writing what they call their replacement legislation for the current health law. the big question will be, can they get it to cover the 30

million uninsured americans that will be covered when the new health law fully kicks in, if so, they say it deserves a fair shake, a fair hearing and fair vote. >> thanks a lot for the update. >> after 24 years in office looks like connecticut senator joseph lieberman is getting read the hang up his political career. sources close to the senator says he will not seek re-election to a fifth term in 2012. lieberman has scheduled a news conference today in his home city of stamford to announce future plans. his term is up in january and is rumored to announce his retirement rather than face a difficult campaign for re-election. >> 5:45. good morning everybody. i'm brent cannon. >> i'm laura garcia-cannon. we're going to get to traffic and weather for you in less than three minutes. but we're talking about livermore. they might see more lead feet. the council is looking at changing the city speed limit but not in the direction you might think. nbc bay area's bob redell is

live in livermore, joins us now with the details. good morning. >> reporter: good morning. city engineers are recommending that the city of livermore raise the speed limit on 20 segments of road through the town, of course they can't do that until they hear from the community. there will be an opportunity for that tonight at city hall. i'll have more on that. the bay area news group reporting that the city is considering raising the speed limit by 5 miles an hour on 19 sections of road, 10 mimes an hour on a 20th section and reducing speeds on six others. the city is supposed to specify the exact locations of the proposed changes later today. why the need for the change? state law requires it. california requires cities to every so often survey the true speeds drivers are driving. it's a random sample. let's say the average speed is 23 miles an hour. in the old days the new speed limit would be rounded down to 20 miles an hour.

because of recent changes in the law that limit must be rounded up. so in this example, 23 becomes 25. hence the reason we're seeing recommendations for increases in the speed limit. that meeting starts tonight at 6:00. this wouldn't go before the city council until a much later date. we did get a chance to speak to a driver. the first thing popped into his mind over these recommends was the safety issue. especially since how many kids would cross the street and could be more in danger by cars driving faster. bob redell, today in the bay. >> thanks so much, bob. >> kind of interesting. if we all drive super fast it's going to be 90 miles an hour on the highway. >> it seems like it any way. speaking of the commute i want to check in with mike. >> speaking of speed. never. look at the roadways where traffic and the volume will

allow you to go at the limit. i suggest the 70 that shows up on 85. it's clear but watch the speeds. we're looking at the south bay. travel times moving smoothly. we'll continue up on the approach to the bay bridge toll plaza. the volume continues to build and a live look will show you the build-up of the traffic and some of the cash lanes we're seeing a slowdown. christina, we saw fog yesterday. this morning not so much. pretty warm temperatures considering the time of year. >> we ended up at 67 degrees in san jose yesterday. and today actually looks warmer for some cities in the north bay, along the peninsula as well. and we're starting out much clearer this morning for two reasons. some clouds and we actually have wind. places that are getting the most cloud cover and wind this morning are actually seeing the fair temperatures for this time of the morning. throughout the day today i think we'll see patchy fog, probably

along the peninsula. and probably toward the south bay as well. right now we are clear, we're going to talk about where the day time highs are headed later on in the week. i think you'll like the numbers that we're working with this week. back to you guys. >> mexican police have arrested the alleged drug dealer. an anti-drug yu night arrests him in mexico city for the shooting of superstar soccer player salvador. he allegedly shot cabanes in the head after an argument over his performance in a mexican soccer league game. balderas was detained. >> the husband of congresswoman gabrielle giffords is giving more details about her recovery from the recent shooting in arizona. mark kelly says he loves his

wife's spirit and strength in the face of terrible injury. we talked about how she was able to reach out to his hand, touch their wedding ring and feel his face. kelly has been by her bedside and feels optimistic. >> she's getting better each day. she's going to recover. there are six folks that don't get that opportunity. >> kelly says he's been so focused on seeing his wife recover that he had to ask somebody what the shooter's name is. he hasn't had time to watch the news or read newspapers. six people were killed and 13 injured when a gunman opened fire at a town hall meeting in tucson. >> watching the silver screen could be bad for your health. researchers say seeing smoking scenes in a movie triggered reactions in smokers. the scenes increased the brain activity that's linked to the hand they smoke with. they say the action on screen

patient and the care person are recovering from injury. but the patient in the wheelchair could have been hurt worse. >> a lucky break for some shoppers at a british grocery store. you'll see it here, coming up, it plows through the glass. amazingly no one was hurt. the store owner says the crash caused thousands of dollars of damage. the driver says she isn't sure how that happened. >> nasa is getting involved in the airline business, and it's unveiling what the planes of the future are going to look like. nasa awarded contracts to hock he'd martin and boeing. they are trying to find new airplanes. they have to according to nasa each be able to reach 85% of the speed of sound, that's 668 miles per hour, they have to cover up
