>> i'm brent cannon. as we mentioned, it is friday, the weekend is here. we are looking forward to a nice looking forecast, and i think christina can deliver this morning. oh, i can deliver. i can deliver, but i think you are giving me some sass on a friday. laura, are you going to let hims is a me like that? we are talking about temperatures at 44 degrees in san jose. mild conditions. turning over to 62 in san jose for lunchtime. a little cooler in the north bay today, but temperatures will be breathing down the neck of 70 degrees in santa cruz. los gatos today, 70 degrees. 66 in san jose. we'll let you know when we are expecting rain in the forecast coming up, but not for a while. we'll check the commute now with mike. good morning, christina. no sass on the commute from me or in the commute. we have construction on the golden gate bridge. crews were moving the cones earlier this morning. a live shot at the bridge itself shows a construction crew at the toll plaza. it is a little early for the right lane to be blocked approaching. we'll keep an eye on things but

very light volume. we have a hit-and-run report for westbound 580 near livermore. no major slowing but there's activity on the shoulder. no injuries as well. we are looking at eastbound highway 4 coming out of pittsburgh. there's still reports of a disabled frito lay truck. i have been known to eat those from time to time, and that's an area of interest for you as well. 5:01 this morning. saving caltrain will be the main topic of a meeting today at stanford. the transit is facing hard economic times and commuters in the bay area could have fewer options to get around. marla tellez is here with what caltrain is up against. marla? >> reporter: brent, what it comes down to is a $30 million deficit for the next fiscal year. that's about 30% of caltrain's $100 million annual budget.

as a result, caltrain is planning massive cutbacks to services. roughly 42,000 people rely on caltrain every day during the workweek. it currently operating about 90 weekday trains between san jose and san francisco. under the current budget scenario cuts count mean more than 40 routes and would be dropped leaving commuters to choose from just 48 weekday trains. again, down from 90. weekday service outside peak commute times, weekend service and service south of this station would be eliminated altogether. part of the problem is caltrain relies heavily on passenger fairs which accounts for 44% of its operating budget. >> caltrain is the only bay area transit agency that doesn't have a dedicated source of funding. so every year we have to scramble to come up with funds. and our partners are going to reduce their contributions to

caltrain this year. >> reporter: so today the silicon valley leadership group whose number one priority is to save caltrain. it is holding a summit at stanford from 9:00 to 12:00. transportation leaders and representatives from santa clara, san mateo and san francisco counties are expected to attend, including san jose's mayor chuck reed. the meeting will work to identify and come one a solution to the train's fiscal challenges. if you would like to give your public opinion a public meeting is scheduled for next weekend, that's saturday, january 29th. that public meeting is scheduled to take place at the sam's trains offices. marla tellez for "today in the bay." the search continues for a 4-year-old boy triggering a statewide amber alert. police will continue to serge search a canal outside of paterson at first light this morning. they will also bring in an

expert to examine tire tracks near the canal. they are looking for juliani cardenas who was kidnapped by his father. crews have found one car in the canal but it is not the toyota corolla jose rodriguez owned. >> a federal judge will exam evidence and hear from witnesses in the case of barry bonds. test results and other materials were seized in raids during the investigation. the 46-year-old bonds is accused of lying to a federal grand jury in 2003 about his use of performance-enhancing drugs. bonds has pleaded not guilty. his trial is expected to start february 21st. 41-year-old maurice conwell

is still behind bars even though his conviction was jof turned last month. he was sentenced to 27 years to life in the shooting death of judy acosta in a drug deal gone bad. now two men affirmed in writing conwell was not involved in the shooting. he was initially convicted after a neighbor who saw the shooting identified him as a gunman. initially she claimed she was not sure who the killer was. the woman died in 1998 but they plan to use transcripts from her in the new trial. the judge overseeing this next trial starts on monday. joseph yay iv will give his

testimony then. the jury selection will begin monday. opening statements are scheduled to happen about march 21st. no parole for one of three women involved in the share and tape murder. the california panel denied parole to patricia crenwrinkle yesterday. the charles manson follower is not eligible for parole again for seven years. the parole panel says dozens of letter came from all over the world asking for her to remain incarcerated. she was convicted of seven murders in 1969. crenwrinkle has been in jail longer than any woman in california. a man is being charged with public trespassing after scaling a san francisco skyscraper back in september. 55-year-old daniel "dale" godwin who called himself spider-man used suction cups to scale the skyscraper. it required police and fire crews to respond.

goodwin admits to climbing the building but will plead not guilty to the charges. a head-to-head showdown for the top cop job in san jose. anthony bass and chris moore are set to be the two finalists. more than 30 people applied for the job. many people believe bass to be the favorite due to his track record. oakland's crime rate has dropped steadily even though his department has slunk from 800 to 656 earlier this year. a decision will be made early next month. president obama is getting ready to address mayors from all over the country, including ed lee and jean quan. they will attend this conference in washington, d.c. they know each other from their days at uc berkeley. lee and quan were two of the mayors who attended the state

dinner on wednesday night in honor of chinese president hu jintao. this kicks off in less than an hour this morning at the white house. we want to check the morning to commute. the folks are getting an early start on their wikd out there. >> i'm thinking about the weekend, so that counts, right? we are looking at the westbound direction where the commute has not started yet. i told you about the hit-and-run. the person hit is still on the side of the road. no injuries but they are waiting for chp. there's activity out there getting into livermore. that's about it. eastbound heading out of the area folks could be heading over to the sacramento area or heading across the have a knee that venetia bridge. so far your commute is looking fine coming into the area. out of the north bay through the east bay a smooth flow through the maze. no delays right now. yule see slowing there at the

a live look outside from the south bay, san jose this morning. a nice start to the day. nice and clear. might be a little chilly, but i think we have a pretty good forecast for friday and your weekend coming up. this morning congress wam gabrielle giffords will continue her recovery from a gunshot wound in the head. a team of specialists will assess giffords before she can start rehappen rehab. >> we have to think of think things like, are there infections to worry about, are there fluid problems, and we have to start the comprehensive rehab program. this is an emotional recovery. >> just yesterday giffords' husband stood by the congresswoman and was taken outdoors for the first time. the back yup --

the wake for sargent shriver is set for tonight. thousands of people are expected to attend tonight in washington, d.c. the outpouring of support following his death on tuesday prompted them to open both his wake and funeral to the public. the wake will be held at holy trinity catholic church in georgetown. the funeral mass will be held in maryland. shriver will be buried at the cemetery in hyanas, massachusetts. we have a few big moves in the tech front to tell you about as well. co-founder larry page is taking over ceo. he'll become ceo on april 4. the current ceo, eric schmidt, will become google's executive chairman and will focus on deals, partnerships and customers. also, meg whitman is uh returning to a lead role in the silicon valley company. she'll join hewlett-packard's

board of directors. the company is beginning an internal review of the actions of mark herd. hp's board drew widespread criticism for the handling of the scandal of herd. scott mook grew is here with our continuing coverage. >> just a couple weeks ago the chip company said good-bye to its ceo in a surprise move. if you are a ceo of a major company right now, make sure you know where the rip cord is on your golden parachute because all these sudden jobs are making things less stable. don't forget jobs. apple's ceo said it was for health reasons, but he stepped down this week as well. quite the week this week. the head of general electric will also work as head of the president's new council on jobs in competitiveness.

paul volker chaired a similar panel. he'll work hard to bring jobs back to america he says. ge is selling nbc to comcast. he's still by boss, so i want to be upfront about that. president obama's developing relationship with big business has been interesting to watch. he met with the president of china earlier this week. wall street is not usually associated with the president, but he has clearly been reaching out. thank you very much. the bay area city is being recognized for something it probably wouldn't have. they are making the list for rudest cities in america. >> san francisco comes in at number 14 according to travel leisure surveys.

taking the obama agenda head-on. eric cantor will be on "meet the press" to talk about what's in store for the next two years. and joining me this morning is the host of "meet the press" david gregory. >> good morning to you. thanks for having me. >> what do you expect to hear from the president? >> i think he'll focus on jobs. nasa really the focus of the administration. this morning we are learning the president named the ceo chairman of general electric to head his economic advisory board. another embrace of the business community after the november election to say that this country at large is focusing on jobs, turning the economy around. this is where the president needs to be politically and for the major public policy issue that he's facing, and that is a recovery that appears to be a jobless recovery. i think that's primarily what he's going to talk about as he gets into the business of political discourse and working more positively in divided government with republicans in

power. that's the real focus. >> right. there's so much talk of stability and that we'll see more of it. will it be a reality? >> well, i mean, you always want to hope so. i think this was a real moment in the country and certainly in washington in terms of political discourse and the demonization of the other in politics. it has to be a lesson taken to heart here. no matter if we are talking about a traffic did in tucson that appears to be the works of a mentally ill person. nevertheless, the health care debate this week reflected a tapping down of that tone. and i think you'll see the president do what he did in tucson, which is try to carry that message forward and try to set a different tone for how they are going to work with each other, thou white house will work with republicans in the house and in the senate. >> yeah, i think the nation has a whole would love to see it, the united states once again. david, thanks so much. >> thank you. the time is 5:25.

than where we were yesterday at this time. 37 in santa rosa. 38 in napa. we have patchy, dense fog forming in the north bay. take it easy on the morning drive. overall, we'll see temperatures climb as we head throughout this afternoon to the 60s by noon. then today rounding out the day right around 67 degrees in places like san jose. your forecast is coming up. right now we'll send it back to you. thank you very much. 5:30 right now. a disturbing letter about sex acts in the second grade classroom is going home to parents at marcum elementary school in oakland. "today in the bay's" christie smith is live with this morning. >> reporter: the letter going home from the principal expresses not one but two reports of a sexual incident in a second grade classroom. the letter is one page, and the first incident it says involved several students who undressed partially while acting

disruptively in the classroom. the second incident concerned two students who engaged in sexually explicit behavior also in the classroom. the letter goes on to say that upon hearing these reports we immediately launched an investigation while suggesting that the reports do have merit. the second incident involved a second grade boy and girl. all this happening in the exact same classroom. "the tribune" report that is the teacher was present at the time but not aware of any such incident going on. this all happened last week at marcum elementary school? east oakland off 73rd avenue. apparently it came to the principal's attention on wednesday after a student came forward to an aide explaining what happened. the letter said the teacher won't be returning to the school's site pending the results of the investigation. and that counselors are now helping out. reporting live in oakland, christie smith, "today in the bay." thank you, kristy.

a 4-year-old boy is now recovering from dog bites from three pitbulls. his father had to fight the dogs off trying to save his son. it happened in union city. the father says the pitbulls attacked his son after the boy hopped a fence to chase a ball. he says the boy was with him. he just turned around for a moment and then the boy was gone. >> i seen three dogs on top of him. one of them had his head in his mouth. the other one had his legs. they were trying to shake him like a rag doll. i tried to fight them off. i tried punching them, that didn't work. i grabbed a 2 by 4 that was laying around in the backyard and started hitting them with that. >> he was trying to throw him up to me. the first time i caught him and he had blood all over his face. then the dog just ripped him from the grip of our hands. >> one of the dogs bit miguel under his eye. doctors have blue glued it shout to heal better. the owner of the dog was not home at the time of the attack. he says he is sorry for what

happened. the boy's family now wants the three pitbulls to be put down. a reminder to double check your doors to make sure they are looking looked this morning. a vallejo woman was sexually assaulted by a burglar who got in through an unlocked door. the suspect caught the woman by surprise as she was preparing to go to work. it happened yesterday morning about this time, 6:00 in the morning. he had a gun and drove off in a dark blue 2010 hyundai, elantra. the tennessee license plate is 070xqz. in the past many schools have had different scores to different parts of the application and tallied them up later.

recents regents say the new system takes the student's background into account. for example, if that student's grade should fall because of something like a family emergency. today berkeley's humane society will reopen after last week' devastated fire. the building is not completely rebuilt but part of the building is usable. they will use the back end of it to start serving berkeley and the east bay. the shelter administrators are so excited they are celebrating today with the community in an open house. >> so at the moment we are using one small portion of this facility for adoptions on the weekends, which we'll be doing every saturday and sunday. then we are also fully operational in our hospital so we are providing all the medical services we were before. >> the berkeley humane society is also reopening its weekly spay and neuter clinic for low income pet owners. the bay area scores big with new transportation funds meaning we could see a few big improvements. caltrans will spend a billion

dollars on new projects. some goes to extra lanes on highway 101 near university and marsh lane. $30 million be fund hov lanes on 101 in marine county. and $21 million for synchronized lights in alameda and contra costa counties. the giants are bringing the world series to new york. check out these foe foes photos posted on facebook showing the team president with the trophy on the flight to new york city. wow, first class all the way. the giants will take the trophy to the site of the former brown stadium where the team played. willie mays played there at the start of his career. >> i hope he's wearing gloves. you are not supposed to touch that. 5:35. the storybook days for a young hockey player who got to be a pro for a day. it happened when the sharks were short a goalie last night.

too. >> i just want to drive the zamboni. folks at chp, we all want to drive the zamboni. webb highway 4 is slowing from eighth street to verizon lane. and another showing heading off the screen from bay point in to concord. that's typical for a friday at this time. the walnut creek interchange no problem, but lighter commute near 680 this morning. at 8:00 that will kick in. as far as slowing we do have a good flow of traffic. 24 is a little slow at highway 15. a typical pattern is approaching the bay bridge. no problems near the toll plaza. the upper deck is a smooth drive. good spacing between the cars, but we'll see the metering lights turn on in an hour as the east bay drives over to the city and it starts to build up starting in 20 minutes from now. right here no problems with construction clearing. 880 at 92 is a smooth drive to the san mateo bridge.

a steady drive to the peninsula. 101 here near the golden gate is looking good to the north bay. that's great news, guys. oaf to christina with a beautiful view out there. a beautiful view right now because it is dark, but as soon as the sun rises in the east you need the shades. it will be brilliant sunshine as soon as we hit 7:25 this morning. high pressure firmly in control of our weather pattern. it is going to maintain control possibly throughout the rest of the month of january. that means we could see a cool start and warm afternoon, you know, for this time of the year. at least for the next ten days. it is really nice with a nice pattern. we picked up so much rain last month we met our standard when it comes to annual rainfall. we are not worried about the drought. that's good news. we'll enjoy the warmer than normal conditions as long as they last. 49 in san francisco. 40 degrees in sunnyvale. 42 degrees right now in san jose turning over to 62 as you take your lunch break.

moderate breakfast that will work better for you. german researchers followed 400 people for two weeks and found that those who ate a really big breakfast, a high-calorie breakfast, tended to eat other high-calorie meals, lunch and dinner all put together, not a good way to lose or maintain weight. but people who ate a small to moderate breakfast, it was a trend or habit they also tend to eat a small dinner. therefore they end up staying within their weight goal. breakfast dictates the size of your other meals as well, at least in this german study. now, here in the united states, the problem is a lot of us skip breakfast. about a quarter of us are keating eating breakfast three times a week or less. and we are sort of wolfing it down as they say eating breakfast in 15 minutes. men and young adults are more likely to skip breakfast which is dangerous because a statistic shows people who don't eat

"today in the bay's" bob rezell is live outside district court this morning where the defense will try to get key evidence thrown out. good morning, bob. >> reporter: good morning to you, laura. the federal prosecutor is trying to prove that when barry bonds appeared before a grand jury investigating pro sports he lied about his own steroid abuls. and to help make their case, the prosecution needs to present testimony from bonds' former teammates, players said to have taken steroids by his trainer,

greg anderson. anderson is willing to go back to jail on charges of contempt. so today bonds' lawyer will try to have the testimonies thrown out arguing they would be mute without anderson's testimony as well. the judge this this case has thrown out documents seized from his house since anderson won't testify about the authenticity of the documents. today the prosecution will ask her to re-evaluate that decision. the case is scheduled to go to trail in late march. bonds said in the past he never knowingly took performance-enhancing drugs. reporting live outside federal court in san francisco, bob redell, "today in the bay." thank you, bob. >> all right.

5:46, you guys. looking at the roadway right now out of san francisco, you have a little bit of slowing on southbound 101. we have an accident with debris. a car hit a tree on the side of the road. one of the branches could be blocking the slow lane. watch for that on the 101 we are change, interchange. we are seeing typical slow drives this morning. 57 on the map coming across the bay bridge, a clear drive. and all the way across the bridge we can see the shot of the toll plaza. no metering lights. but the shot from the san bruno mountains shows a clear view and no shaking of the camera. this shot is not a heavy wind there. you know what, it is kind of those interesting winds that we see in the east bay hills and the north bay hill that is we are seeing right now. they are gusting and tend to calm down. that's going to be the case today. yesterday we had some pretty strong sustained winds out of

the northeast at 15 miles per hour at this time. and that kept things more mild. there's a lack of downsloping winds. chilly conditions in the north bay right now where we are in the 30s. 36 degrees in novato. 36 in fairfield. a little more mild in haywood at 44 degrees. and 41 in santa cruz. as that sun comes up it will warm up rapidly. we are talking about temperatures at 57 degrees by noon. 62 in sunnyvale at noon. and then daytime highs max out near 6 degrees. 6 degrees. 67 degrees. once that sun goes down, temperatures drop light like a rocket. 65 degrees for your forecasted high for friday. comfortable afternoon. so you want to tee off, afternoon tee times are ideal. 63 on saturday with a little bit more wind. and 62 on sunday. laura, you have been noun to swing the club around, huh?
