love ridge. not a big point, but a little slow over to concord. by the time you are near 242 you are clear will there. heading to the bay bridge toll plaza we are clear. we probably won't see metering lights turned on until 56:30, 6:30. they are doing all the interchange work on the overcrossing. the slowing started early through the south bay, but that's the only slowing. near santa cruz more traffic could be starting this weekend because of the beautiful forecast christina is talking about. you have congestion heading to the beach areas, probably. it is going to be hot for january. back to you guys. 6:01 right now. a disturbing story out of the southeast bay. parents are upset this morning over reports of sex acts in a second grade classroom. "today in the bay's" christie smith is live with the school investigation. is this true? >> reporter: yeah, the letter that went home from the

principal to families suggests that based on the investigation they have done so far it looks like these allegations are true. we are not talking about one sexual incident but two in the exact same second grade classroom here at marcum elementary school near 73rd. two students, a boy and a girl, engaged in a sexual act during class time. then on a separate occasion children took off some clothing and started acting disruptively in the classroom. these incidents happened last week but it came to the principal's attention when some students came forward on wednesday and told an aide here what happened. the letter say that is the school launched an investigation still ongoing and has contacted the parents of those students that were reported to be involved. the question, of course, is where was the teacher in all of this? "the tribune" says the teacher was present but unaware of the

incident going on. the teacher won't be reporting to the school's site pending the results of the investigation. we are also told that counselors will be on hand to help out. reporting live in oakland, christie smith, "today in the bay." >> hard to believe. thank you. the search continues this morning for a 4-year-old boy who vanished earlier this week triggering a statewide amber alert. police will continue to search a canal just outside of paterson at first light this morning. they will bring in an expert to examine tire tracks that were found near the canal. they are looking for 4-year-old juliani cardenas and jose rodriguez. he may have driven into the canal with the boy. crews have found a car in the canal but it is not the same toyota corolla that rodriguez owned. federal prosecutors will retry a man convicted of murder 21 years ago. 42-year-old maurice codwell is still behind bars even though his conviction was overturned

last month. he was sentenced to 27 years to life for the shooting of judy acosta in a drug deal gone bad. now two men confirm that codwell was not involved in the shooting. initially a woman claimed she was not sure who the killer was. she died in 1998 but prosecutors plan to use transcripts of her testimony in the new trial. the two men charged with killing oakland journalist chauncey bailey will be charged together. that's the ruling of the judge overseeing the trial when it starts on monday. the black muslim leader joseph mackey iv and his lawyer say they cannot get a full trial. the judge doesn't agree. jury selection will begin monday. opening statements are slated much later coming up on march 21st. 6:04 right now.

congress woman gabrielle giffords will travel to texas to continue to recover from a gunshot wound to the hospital. a team of specialists will assess giffords before she starts rehab. >> we have to think of things, like, are there infections to worry about, are there fluid problems, how is the wound healing, we are eager to start the comprehensive rehabilitation program. we have to take into consideration not just the specific recovery but the cog cy zant and emotional recovery. >> just yesterday giffords husband stood by as the congresswoman was taken outside for the first time. president obama is getting ready to address the majors from all over the country today, including two from the bay area. interim san francisco mayor ed lee and oakland's new mayor jean

quan. they attend the u.s. conference of mayors in washington, d.c. they know each other from their days at uc berkeley. lee and quan were two that got to attend the state dinner in honor of visiting chinese president hu jintao. the president kicks this off in less than an hour. new this morning, a high-ranking british official resigned over allegations he tapped the royals. these are accusations at the highest level. >> reporter: this is a strange one. at the center of this is the communications director, the press secretary to the prime minister of england. he has stepped down accused of hacking into the voice mail of england's two young princes amongst others while working as the head of the newspaper news of the world. now, that's owned by news corps rupert murdoch. andy cullson has been accused of accessing the voice mail of the princes, soccer stars and other

reporters. these are not new allegations but they indeed did catch up with him this morning. now, similar accusations were leveled a few years ago as the board of directors hewlett-packard authorized the hacking of journalist cell phones. we got new faces on the board this morning. five directors are out. yes, that's meg whitman. she and four replacements are in after the previous board fired ceo mark herd paid in millions to go sparking another controversy and another shareholder lawsuit. as long as we are on the subject of this, we hear there's a wikileaks movie in the works. who exactly will play julian assange? we don't know, that's ironically a secret. it will be based on a book about assange called "the northeast dangerous man in the world." back to you. a meeting is underway today to keep caltrain on the right financial track. the silicon leadership group is

meeting at stanford later this morning to determine a long-term fix. caltrain is facing a $30 million deficit. the group says about a long-term funding fix caltrain may have to close up shop altogether. >> it is something to think about. there are people who do depend on public transportation like myself. i can't drive. >> later marla tellez will have more coming up in a live report at 6:30. here's a live look at the friday morning commute with mike inouye. >> regardless of funding, caltrain is running this morning with no delays reported. that's good news. up and down the peninsula right here, a look at 101 going along the caltrain line. that's moving smoothly as well. we won't see slowing until 7:30 when the sun also hits you in the eyes heading southbound through san mateo and through palo alto. that's the kickoff of the slow volume usually. a live look shows you the volume starting to increase in both

up there. it looks like as we head throughout the weekend, if you want to do golfing in danville, sunny conditions, mild afternoon. a really comfortable tee time if you want to get out there. we'll also see light winds with a high of 65 degrees. 63 for saturday. and 62 on sunday. yes, if you have been waiting to get out there and swing that club around, it is probably going the to be an ideal weekend for golf. we have a mile and a half visibility in santa rosa. calm winds, clear skies and fog is forming in the north bay. a little bit of haze in the east bay, but we are looking clear along the peninsula making for another beautiful day in the city. i know a lot of people who live in san francisco that are not accustomed to seeing this much sunshine at this time of the year. you'll bring more of that on today. 36 degrees in novato. 49 in san francisco. temperaturewise climbing to the 60-degree mark by noon across the bay area ending up closer to the 70-degree mark for places like santa cruz. 66 degrees today in san jose.

good morning, everybody. a live look outside at the bay bridge this morning. nice and clear to start the day. maybe a little bit chilly, but overall your friday and weekend forecast is not looking bad at all. we'll have updates on that and your temperatures throughout the course of the morning. new this morning, a san francisco judge will hear important arguments to affect the latest federal case against slugger barry bonds. bob redell is live outside the district courthouse in san francisco where the defense will try to get key evidence thrown out. bob? >> reporter: good morning to you, brentment they have already done that in the past trying to chip away at the case against barry bonds, their client. they will try to do it again

today at the federal courthouse here in assistance san francisco at 11:00. the prosecution is trying to prove that when he appeared before a grand jury for doning in professional sports, they are trying to show he hurt himself by lying in court about taking steroids. they want players identified as steroid users by his trainer, greg anderson. anderson is refusing to testify against bonds and is willing to go back to jail for that. today bonds' lawyer will try to have the testimonies thrown out arguing they be removed with anderson's testimony as well. anderson has been a headache for the prosecution. the judge has thrown out documents that allegedly chronicle bonds' steroid use since bonds won't take the stand to testify about the authenticity of the documents. today the prosecution will ask her to reconsider that decision. the government's case against bonds is scheduled to go on trial shortly in late march, so

a couple months from now. bonds has pled not guilty saying in the past he's never knowingly used performance-enhancing drugs, especially pursuing his home run records with the san francisco giants. reporting live here, bob redell, "today in the bay." thank you, bob. >> the giants are already putting up big stats before spring training begins. the mercury news reports the giants should spend $150 million on players in 2011. the giants president bobby evans says the team wanted to bring back as many members of the game-winning squad that they could and did a good job. only two members won't ruin, juan uribe and edgar renteria. the giants are bringing their world series trophy back to new york. check out some of the pictures that "virgin america" posted on facebook. larry, the people president

there, holding the trophy. they will take it to the site of the former polo ground stadium where the team played once again. willie mays played there at the start of his career. they will help to show off the trophy this morning. patdowns, long lines, high prices won't keep americans from traveling this year. travel experts say after a few years of having to be frugal leisure travelers are looking to let loose. same goes for business travel. businesses will look to cut travel costs by airlines and hotels may not cooperate for leisure travelers. industry experts believe vacation bargains to be plentiful, even in hot spots. >> places like las vegas, hawaii, cancun, we are also seeing new cruise ships launching this year. allure of the seas will be the largest caribbean cruise ship in the world right now. >> and more inventory should

mean lower prices. people are planning to take an average of two to three vacations this year. sounds nice. >> one of these days we'll take a vacation. the city of vallejo issued what they will do to get out of bankruptcy. scott mcgrew is here with a look at that. he says it could be a model for other cities. >> a model for other cities to see how useful bankruptcy can be, brent. vallejo tried to get its public employees mote notably the firefighters to take a pay cut. when that didn't work out they entered bankruptcy. now they are paying off its creditors at a fraction of what it owes, like 50 cents on the dollar going to most banks. and retired city workers are getting pennies of the dollar on what they were promised. this is awful but it also solves many of vallejo's financial woes. now, in a move that critics describe as mind-boggling, san francisco is prepared to do just the opposite. "the new york times" reports this morning that the city plans

to give retired workers big raises totaling $170 million despite the fact that they have a $360 million deficit. "the times" says the san francisco retirement system made lots of money in investments in 2010 and is passing the windfall on to retirees. at the same time, they lost a fortune in the economic crash a couple years ago. in many experts' opinions it is badly underfunded. the best analogy is you lose 50% of your 401(k) back in 2009, you earn 8% as the market gets better in 2010. take the money and buy yourself a plaza tv. >> what's wrong with that? oh. thank you, scott. more than 120 suspected members or associates of the mafia are in jail this morning. 800 federal agents completed a massive round-up in new york, new jersey and rhode island yesterday targeting alleged members of the mob. the u.s. attorney general eric

holder accused some of the people that were arrested of extortion, racketeering and murder. >> some of the murder victims were shot in a public bar because of a dispute over a spilled drink. >> the arrests are expected to weaken mob activity. holder says his ultimate goal is to eliminate the mob altogether. just getting word of a new accident in san francisco this morning. mike has the details for us. >> good morning, brent and laura. on northbound 280 out of daley city, reports of a four-car accident. we have a lot of details coming in with no injuries. that's better news than the initial report, but you'll see a lot of activity heading around the bend. here's a wider perspective of 280 and 101. no major slowdowns there, but the volume is building off the peninsula into the city. also, 101 approaching the golden gate bridge has a little slowing

there, but across the bridge the two northbound lanes are sparsely populated. southbound out of the north bay, a nice easy drive, 101 through the tunnel here. the maintenance crew is blocking this at the toll plaza. the bay bridge toll plaza is showing a clear view across the bridge. look at the incline, you'll more than likely see those metering lights turn on in ten minutes. we'll let you know when it does happen. thank you, mike. >> the warm up is going to start pretty soon. it is friday. we are looking forward to the weekend. it ought to be pretty nice. >> it will be very, very nice, whether you are sleeping in or headed out to the sunshine. i think that you'll enjoy the conditions. you probably won't even need to keep that heater on throughout the days ahead. as we head through the afternoon hours, starting around noon, temperatures will climb into the 60s. we have about a mile and a half of visibility up in santa rosa. as a result i do believe that it won't be quite as warm in santa rosa as yesterday when we hit 68 degrees. it looks like today is moving

more towards the low 60s with a bit of fog to break apart lifting out of the area. but overall, the peninsula is nice and clear this morning. you are looking for a high today in san francisco of 64 degrees. unseasonably warm conditions will prevail through this weekend. and the sunshine will continue as well. 38 degrees right now in napa. a little more mild along the peninsula. heading throughout this afternoon the mild start will lead you to 63 degrees at redwood city. we are talking about 67 degrees today in los gatos. it will be beautiful all across the board. and these conditions are going to hold up possibly throughout the remainder of the month of january. no change in the forecast. temperatures are hovering in the 60s. lots of sunshine. just a few more clouds on sunday. the big ridge of high pressure is starting to weaken a little bit to drop us down to 63 degrees by monday. overall, staying abnormally warm and dry for this time of the year. back to you guys. george clooney looking on the bright side of contracting an illness that kills millions of people.

everybody. the time is coming up on 6:30. i'm brent cannon. >> i'm laura garcia-cannon. we'll look at the forecast with christina. it sounds nice. friday alone sounds nice. good morning to you. temperaturewise, it is much cooler this morning in the north bay than where we started out at this time yesterday. we'll see temperatures climb towards that 70-degree mark in the south bay today. and as we head throughout this afternoon and this weekend, in particular, a lot of sunshine anticipated each and every day. 57 degrees in hayward. by noon we'll round out the day towards 67 degrees in fairfield. so we are looking good in the weather department. unfortunately, we have an accident this friday morning. hey, mike. good morning, christina. a lighter volume of traffic because it is friday, but still northbound 280 at geneva avenue we have a four-car accident. it is mostly on the shoulder but avoid that slowing coming around the bend. we see slowing on the southbound side heading into daley city around that area as well. keep that in mind. obviously, the volume of traffic is increasing. we may have a traffic break the

next few minutes heading to the lower deck as well. we have traffic patterns needing to be picked up. delays could be seen getting to the lower deck. the metering deck just turned on lights a moment ago. the toll plaza is not seeing a backup, but the backup has started for the east bay. it is there in full effect. back over to you. thank you. thousands of bay area commuters may soon lose one of the options, and that's taking caltrain. it is in so much financial trouble the big changes have to be made or it could be forced to stop dozens of trains in their tracks. "today in the bay's" marla tellez is live on the meeting today to try to save caltrain. marla? >> reporter: brent, what it comes down to is a $30 million deficit for the next fiscal year. and that's about 30% of caltrains $100 million annual budget. as a result, the train is planning drastic service cutbacks. roughly 42,000 people rely on

call traip every day during the workweek. it currently operates 90 weekday trains between gilroy and san francisco. now, under the current budget scenario cuts means more than 40 routes would be dropped leaving computers to choose from just 48 weekday trains. now, weekday service outside peak commute times, weekend service and service south of this station would be eliminated altogether. now, the idea of reduced service is not going over very well with commuters we spoke to this morning. >> that is unfortunate for a lot of riders. it is hard enough to catch a train. there are not that many available or anything, it is unfortunate. >> it will be a problem for a lot of people because we depend on it to get to work. >> reporter: a big part of the problem is call traip is the only local transit agency without a permanent dedicated funding source such as a sales tax, so it relies on c

contributions and passenger fares. the sill cohn leadership group whose number one priority is to save caltrain is holding a summit at stanford from 9:00 to 12:00. the meeting is going to come up with solutions to fix the train's fiscal challenges. now, transportation leaders and representatives from santa clara, san mateo and san francisco counties are expected to attend today's summit at stanford, including san jose mayor chuck reed. live in san jose this morning, marla tellez, "today in the bay." it is 6:33 right now. this morning a 4-year-old boy is recovering from dog bites and bruises after his father fought off three pitbulls in a neighbor's backyard in union city. the boy's father tells nbc bay area three pitbulls attacked his son after the boy hopped a fence to chase a ball. he says right before the attack his son left his sight for less than a minute while they both played many the backyard.

>> i had seen three dogs on top of him. one had his head in his mouth. the other one had his leg, they were trying to shake him like a rag doll. i tried to fight them off. i tried punching them, that didn't work. i grabbed a 2 by 4 that was laying around in the backyard. and i started hitting them with that. >> he threw him up to me, the first time i caught him he had blood all over his face. >> frightening. one of the dogs bit miguel under the eye where doctors glued it shut. the dog's owner was not home at the time of the attack. he didn't want to go on camera but is sorry for what happened. the boy's family wants the dogs to be put down. the humane society reopens today after a devastating fire last year. several cats were killed and the 80-year-old building is not completely rebuilt, but at least part of it is usable so it will reopen to serve berkeley and the east bay again. sheltered a min stray terrors

administrators are celebrating with a community open house today. >> at the moment we are just using one small portion of this facility for adoptions on the weekends, this we'll be doing every saturday and sunday. then we are fully operational in the hospital so we are providing the medical services that we were before. >> the berkeley humane society is also reopening its weekly spay and neuter clinic for low-income pet owners. the court battle is underway for trespass iing up a skyscrap for a man who used suction cups to scale the building. it required police and fire crews to respond. goodwin admits to climbing the building but pleads not guilty to the charges. the uc board of regents is moving to change the way it looks over applications.

it scores applications as a whole. in the past many schools assigned different scores to different parts of the application and tallied them up. uc berkeley and ucla use the new system. regents say the new system is better at taking a student's background into account for factors like if the student's grades fail after something like a family emergency. the bay area scores new transportation funds. caltrans will spend $1 billion in tunding funding for a new project. $33 million goes to extra lanes on 101 near university avenue and marsh lane. $39 million goes to fund the hov lanes on 101 in marin county. $23 million for hov lane and $27 million for those in contra costa county for new lights.

they have a 9 to 15-foot base depth of snow in mammoth. lots of sunshine anticipated there for over the weekend. right now the sun is struggling to make its way up in places like santa rosa with a thick deck of fog overhead. a half mile of visibility there. otherwise, clear conditions right now along the peninsula. san jose looks good. it is hazy in the east bay. concord has seven miles visibility. we'll update you on the visibility because we do think that we'll see more fog formation, especially getting closer to sunrise. temperatures this morning are much cooler in the north bay. you'll need to grab the jacket, but you'll want to take it off

topics such as free trade and invasion. the council will also look for ways to harness the power of international markets. emill is the ceo of ge that currently owns nbc. he'll keep that job during his time on the council. he'll be meeting with president obama who is going to new york today to talk about jobs and getting americans back to work as well as beginning to work on his re-election campaign. the president has, in fact, moved his senior white house staffers to chicago to work on his 2012 re-election campaign. president obama will not be involved in the campaign process for the time being as he deals with republicans and the abortion issue. >> the funding of electable abortion will not be the policy of this government. >> republicans introduce a new legislation that would ban federally-funded abortions affecting those on medicaid or other publicly funded programs and not people with private insurance. millionaire donald trump is not happy about the white house

state dinner for chinese president hu jintao. he says the u.s. should not hold dinners for those manipulating their currency. he thinks they in is laughing at our leadership saying the u.s. is letting it get away with murder. trump says if he was president he would tell hu to, quote, get off your plane, come to my office and talk. trump went on to say i would send him to mcdonald's if we didn't have a deal and tell him to go home. 6:48 right now. we'll check the forecast across the bay area right now. >> it will be beautiful today. beautiful, especially when you consider we are well into the heart of winter. we have no fog to report right now along the peninsula. it is looking nice and clear. we have patchy, dense fog up in the north bay. that could really hamper your commute this morning. take it easy out there. i think it will take a couple hours before the fog is able to break apart and lift out of the atmosphere. it won't be quite as warm in the north bay.

nonetheless, the peninsula, east bay and south bay are looking a little warmer than where we ended up yesterday. temperaturewise as you take your lunch break today, we are going to be approaching 62 degrees in sunnyvale. 59 in santa cruz. and 58 degrees in novato. turning over to the mid-60s heading into this afternoon. we are not going to see a lot of changes heading into this weekend. the big stump of high pressure is keeping things really mild throughout the bay area. and it looks like as we head through sunday that will be the last day of temperatures in the upper 60s. 57 degrees with a few more clouds. by monday the temperature goes down to 63 degrees for the tri-valley area. a few clouds on tuesday. it will be nice and dry next week, but this is abnormal this time of the year. you have been waiting to break out the short-sleeve shirts, you may want to do that later today. bring a sweater in case it gets

cold. a disturbing letter about sex acts in a second grade classroom is going home to parents at marcum elementary school in oakland. christie smith is live in oakland with much more on this story. >> reporter: good morning to you, laura. it really is shocking. two reports of sexual incidents involving children in the same second grade classroom. as you said, the principal sent home a letter to families this week saying basically that it looks like these allegations do have merit. saying the first incident involved several student who is undressed at least partially while acting disruptively in the classroom. the second concerned two students who engaged in sexually explicit behavior also in the classroom. that was a second grade boy and girl. the disturbing incidents happened last week at marcum elementary school in east oakland just off of 73rd avenue. but the principal was unaware until a student came forward wednesday of this week. she contacted the students

involved and their families. now, the district says some details about what really happened are vague but they do think the substance of what the kids are saying is true. the obvious question is where was the teacher when all this was going on? the tribune report that is the teacher was present but was unaware of any such incident. either way, he's not at the school site while the invest continues, and counselors have been placed here at the school. reporting live in oakland, christie smith, "today in the bay." thank you very much. barry bonds perjury trial will move forward in san francisco today. a federal judge will hear arguments to exclude crucial evidence and witnesses in the case. bonds' legal team wants the judge to disallow the use of drug calendar, test results and other materials that were taken in raids during the balko investigation. bonds is accused of lying to a federal grand jury back in 2002 about his use of

performance-enhancing drugs. bonds has pleaded not guilty. his trial is expected to start on march 21st. here's a prevailing notion that if you eat breakfast it will help you eat less calories throughout the day, but a new study refutes that. tracie potts is live in washington with the best way to keep the calories down. good morning. >> reporter: according to the study from germany the best way is to eat a smaller breakfast. we have been told breakfast is the most important meal of the day. while that stands, this particular study found that if you eat a big breakfast you also tend to eat a big lunch and dinner. by big we are talking all calorie intake. when they studied 400 people for two weeks those who ate a smaller more moderate breakfast tended to eat more moderate-sized meals throughout the day keeping their calorie count and weight in check. now here in the united states that was a german study, but here in the jits about 25% of us, one in four, eat breakfast

less than four times a week. almost half of us eat breakfast out when we do. young adults and men tend to eat breakfast less. in fact, they tend to skip breakfast more often, which is not a good idea because experts say you are four times more likely to be obese when you skip breakfast. the bottom line here from the research, don't skip breakfast. just eat smaller portions. laura? >> okay. health tips from tracie. thank you. walmart says it will lead the way to healthier eating. it says it will cut sodium and sugar in thousands of their store brands. and it promises to push suppliers to do the same thing. walmart also promises to reduce prices on produce and build more stores in lower-income neighborhoods that don't already have grocery stores. walmart is, by the way, the country's largest grocer. it is gadget friday. scott mcgrew is here with a look at today's gadget. >> let's talk about wall street real quick and get right to it.
