the new plan. >> reporter: another sexual assault in oakland's lake merritt area. the fourth one in recent months. we'll tell you what police are saying about it coming up in a live report. >> also will cal wipe out five athletic programs? good morning. i'll explain what is at stake for cal sports and why a decision could violate federal law coming up in a live report. >> a look outside, problem in the south bay. we have rain in the forecast. christina will tell you when to expect that. we're halfway, about, to the weekend, on "today in the bay." >> good morning everybody. thanks for joining us. i'm brent cannon. >> i'm laura garcia-cannon. let's get things started with a look at the forecast and the cold start we're talking about with christina.

>> good morning. yes, it's a very cold start, about 15 degrees cooler this morning than where we were at this time yesterday morning. and we're going to continue to drop off through the next hour and a half, two hours. so grab that heavy jacket on the way out the door. lots of sunshine and temperatures in the low to mid-60s. we do have a rainmaker on the way. i'll let you know when and how much rain we're expecting. if you can hold off washing that car i recommend doing so. we'll talk about that coming up. >> haven't done it in weeks anyway, thanks. it's 5:31. a safety warning this morning, another woman is recovering from an attack close to one of the popular parks in the east bay. police are looking to see if this is connected to four other assaults that happened near the park last year. christie smith is live from lake merritt with more on how women living and working out around the lake are feeling. i would imagine scared. >> reporter: they are. they are saying that they are cautious, they are going to be

careful but not necessarily going to change what they do. it's a popular spot for runners. we have seen them out already. there are restaurants around here. the peace has been shattered with yet another sexual assault. at the lake merritt area. police are warning women to be very aware. on monday night a woman was sexually assaulted walking home around 10:00 p.m. a. man followed her into her apartment building in the 800 block of jackson street, then assaulted her and brutally beat her. it's the fourth sexual assault since september in the lake merritt area. police are looking into the possibility of a connection but they say there may not be one. >> method of operation appears to be different. the motivation in the other appears to be mainly focused on robbery, that's different here and also on the other side of the lake, the others were in the east lake area off lake shore

avenue. >> reporter: at this point there's not much of a description but opd considers this case high priority suggesting that women be aware, don't be distracted by your cell phone or ipod. also suggesting that women stay in well-lit areas and certainly be alert when you're coming and going. that's the latest. christie smith, today in the bay. >> students in the east bay are waking up knowing they may only have a few more months in their current school. next year they have to attend someplace else. the mt. diablo board decided to glows glenn brook and holbrook. the closures are necessary to save the district $1.5 million per year. the board decided to keep sequoia elementary and middle in pleasant hill open as well as monty gardens in concord. the district is still dealing with the budget shortfall,

another meeting is set for february 22 where the board is going to look at other ways to try to finish closing the gap. >> sharing the wealth. a bay area city delivering millions to local schools. the council is supporting a proposal to give local school districts more than $13.5 million over the next three years. the money is coming from the shoreline community tax district which typically uses property taxes for city improvements and maintenance. the council says the proposal will need to be tweaked before a final vote. new construction projects might have to wait if it's approved. >> cal might decide to save several sports on the chopping block including baseball. but that could mean problems with title 9. marla is live in berkeley to explain what cal faces. >> reporter: good morning, brent. it's the fourth quarter, 30

seconds to go and on the line five sports programs at cal. the men's baseball team, men's and women's gymnastics, women's lacrosse, and men's rugby, all face elimination. if they are not saved they would be gone after this school year. like most moves these days, it all comes down to money and saving money. reducing the number of intercollegiate teams from 29 to 24 would save the university about $4 million a year. but eliminating two women's teams, gymnastics and lacrosse women's teams, would put cal in violation of title 9 which calls for genter equity. it is a federal law so that is a big element that the chancellor is taking into consideration. the chancellor is facing his decision on two main criteria. that $25 million is raised to pay for the operating expenses

for the program for five to 10 years, two, that the university has a plan to build an endowment to fund the program long term. supporters have formed a group called save cal sports which reports that the five programs have saved about 10 to $12 million so far. they raised that much so about halfway to the $25 million mark. robert is expected to make his decision and announcement tomorrow. live in berkeley. >> san jose is taking another shot at shutting down what is called the most dangerous nightclub. attorneys will return to try to permanently close club west. in the last 10 months police have been called 100 times for disturbances. the most high profile call new year's morning when a woman was severely beaten.

the club refused to call an ambulance and tried to cover up the attack. >> east bay mayors and council members are now teaming up opposing the governor's recent plan to eliminate funding for redevelopment agencies. we've seen several do several things. now the mayors will gather near the fox theater to announce their opposition. they say those cuts will bring financial benefit to the state but are going to destroy 29,000 east bay jobs and billions in economic activity. more b.a.r.t. riders question if they are saving by taking public transit. the latest survey reports 64% of its passengers say b.a.r.t. is a good value, however, though that's good news it is a drop in 7% from the previous year which was 2008. 15% said they do not think that b.a.r.t. is cost efficient.

that's down 4 points from 2008. since the last survey b.a.r.t. increased fares by about 6%. >> it would be nice if we could increase the temperatures this morning. >> it is a cold start. we have been spoiled but it looks like normal temperatures will persist. we're looking to ending up in the low 60s, some upper 50s in some cities and this morning some 30s. below freezing in gilroy. we still have additional cooling before the sun rises. at about 7:15 this morning. 62 degrees today in oakland. 67 degrees in concord and 62 in fremont. a lot of sunshine throughout the day today. don't let that sunshine fool you. it's going to be cool. cooler than where we were yesterday. as we head through the week things are going to stay mild. we're going to climb to 69 by sunday. monday, the showers arrive late.

making for a romantic atmosphere. 62 degrees, the heaviest rain we expect will take place on tuesday. we could pick up an inch of rain in some cities. big time weathermaker on the way. more about that coming up. let's talk to mike inouye about what's plaguing your drive. anything? >> you know, it's called cars. the commute is on for westbound highway 4, the first to see the slowdown right on time but the speed is higher than predicted. i thought it would be below 30. we have a lighter volume owe veer all. a couple of schools are on vacation. not a big vacation week. we're sorting things out. the altamont pass, 14 minutes, but could get longer approaching because of one accident blocking the fast lanes. as you get on west of there, livermore avenue or airway, over to 880 a live look shows you the

>> good wednesday morning to you. you're halfway through your week as we take a live look outside this morning. camera shaking a little bit. cool, clear start to the day. grab a coat if you're headed out. >> it's about breakfast time. as you try to figure out what you're going to eat consider an egg. turns out they may not have as much cholesterol as we first thought. and they may have more vitamin d., brian moore is live in washington with new changes from the u.s. government. you going with scrambled? >> reporter: well, scrambled of course. set your egg timer for how long it's going to take for the egg industry to get commercials out on this one. great news for egg lovers and great for egg producers. california, fifth largest egg producing state in the union.

and of course they are going to get this news out, believe you me. cholesterol is down 14% over the last decade. that's what the usda found when it tested eggs from 12 locations. also they found out that vitamin d is up 64%. why? it appears that these hens are getting better food, they are getting better feed and also getting vitamin supplements and that of course is having a trickle down effect. but medical experts say the advice is going to stay the same for now. you got to do everything in moderation and they say, one egg is enough. >> so like the three or four omelet thing i make is too much? >> when i put the half pound of cheese -- >> there you go. >> reporter: yeah. >> we can do breakfast. thanks, brian. >> a federal judge is looking

into whether lethal injections can resume in california. it will hinge on whether the judge is satisfied with the state's $900,000 death chamber at san quentin prison. the judge says he will hold at least three additional hearings on the matter before making a decision. and coming up, tonight at 11:00 i'll take a closer look at what the death row wait is in the state of california. there have been no executions in five years. last year the state put 28 additional people on death row. there are 717 inmates total so far, a new housing facility could cost the state $400 million. a closer look tonight at 11:00. >> time is 5:45. good morning. thanks for joining us. i'm brent cannon. >> we have big changes coming to the forecast. christina is going to join us to make sure we're ready for it. we've gotten a little spoiled with the spring temperatures.

certainly feel how cold it is. >> you can feel the chill in the air. 28 degrees in gilroy right now. 34 degrees in santa rosa. and temperatures are going to drop as we head through the next hour so. just count on cooler than normal conditions for the morning. but as we head through this afternoon we'll end up about where we should be for this time of year. in the upper 50s, low 60s. so, make sure you grab that jacket, that cold air is going to hit you in the face when you walk out the front door this morning. but hopefully you don't have problems on the roadways to worry about. right, mike. >> at least one less. we'll take you out to livermore for the update. i told you about the accident, just past that off ramp, that has cleared from the roadway. that's the good news. but then my sensors show you, actually slowing approaching the scene. the travel time now eeking up 15 minutes, with the road cleared we should see a normal build as folks head over to central livermore. we'll see the speeds.

but that's no big surprise. heading out to sunol, an easy clear drive. down into the south bay we have the sap open. the northbound route is clear, i did hear about a new accident in fremont, northbound 880, i'll check that out and bring you an update. >> speaking of moving along, this morning california's high speed rail plan could be chugging along thanks to billions in federal funding announced by the vice president. bob redell joins us live at the station. vice president biden says the money will help keep pace with countries like china. how does it affect us here? >> reporter: those are countries that have or already are building extensive high speed rail systems. california's high speed rail system t one that is scheduled to go through the station here in san jose, it's still in the planning stage. construction not expected until next year. there are questions where all of

the money for the $43 billion price tag will come from. vice president biden announced that president obama wants to invest $53 billion in high speed rail over the next six years with california receiving an estimated $16 billion of that amount. still critics wondered why spend so much on the 800-mile-long project to connect the bay area to los angeles when air travel is faster and relatively inexpensive. proponents point out that high speed rail will create as many as 100,000 construction jobs in the state over the next five years alone. >> it's only going to become more critical tomorrow. we're going to add 100 million people in the next 40 years. >> reporter: the president still must convince the republican-led house of representatives to go along with this proposal. that can be very tough.

given that the recent calls for cutting the budget when it comes to discretionary spending. we should learn more details about what this federal investment would mean when the high speed rail authority, california's high speed rail authority, holds a news conference later this afternoon around 1:00. bob redell, "today in the bay." >> thanks, bob. president obama will host house gop leaders today. he's going to meet with house speaker john boehner. eric captor and kevin mccarthy. it's the first big meeting since republicans took over the house in january. they are going to focus on the economy, spending and the president's proposals that he outlined in his state of the union address. >> students in a district are in danger this morning. someone is giving kids drugs disguised as dessert. the albany district is investigating four instances in two weeks, total of six students ate marijuana brownies.

two had severe reactions that landed them in the hospital. parents who see albany as a safe district are shocked. >> kind of alarming, actually. how did it get there? what are they doing there? no, i think it's crazy. >> police are looking into who is supplying the marijuana brownies. the principal thinks a student is providing that potent dessert. he sent out a message, we plead with those students engaged in the sale or distribution of these drugs to cease and desist. the health and safety of our students are in jeopardy due to these actions. >> the hero of the hudson is suing sonoma bank. captain sully sullenberger and his wife are suing the former sonoma national bank for fraud. they say they were tricked into overpaying for a property and they want to cancel their loan. the broker says the former pilot is using his celebrity status to bring about a lawsuit without merit. >> some dramatic video to show

you. look at this video recorded by a cell phone. an 83-year-old man is spotted driving his truck on the wrong side of interstate 5 last week. the driver runs out of road and crashes into a guardrail. the truck was torn nearly in half by the impact. remarkably, the driver survived with no serious injuries and no other drivers were hurt. the driver was cite forward driving the wrong way and driving with a suspended license. >> that is scary. having a lonely hard may have long term health consequences. social activities or lack of they will can impact overall health. researchers at ucla looked at nearly 1,000 adults and found that genes that are over expressed in lonely people can cause the body to trigger an inflammatory response. that can contribute to health problems such as cancer. >> people struggling to find a job could get much needed

financial help. two congress women will introduce a bill to help people out of work for a long time. it would provide additional 14 weeks of benefits to 99. people who used up the 99 weeks of unemployment benefits. and as of october there were 1.5 million people who had been unemployed for 99 weeks or longer. >> you think a smaller cubicle at work is cramping your style. >> the last 15 years space has dwindled from 90 square feet to 75. office workers are not the only ones feeling the squeeze. senior executives have seen offices shrink by almost 20 square feet. smaller stations are cheaper to maintain and people can get up and work out of the cramped confines of their cubicle. >> why are we at the little kid's desk? >> over there. >> he has a window with a view.

>> one of those big executives. >> if you own an ipad you may not miss much when the new one hits stores. >> right. several reports out say that the ipad 2 is actually in production at chinese factories. the device pretty much the same as the old. same display, lighter and thinner, maybe one or possibly two cameras so if you are one of the 15 million who have one of these, the original ipad, if you can continue to manage without a camera you should be fine. computers, remember the palm phones, hewlett-packard picked up palm. they are going to show off some of the technology that hp inherited. they rebranded it because palm smacked of the 1990s. we expect they will show aus tablet computer of some sofrmt perhaps some sort of smart phone. the question is not is it cool or fun to play with but will app

developers develop it. that's what makes the iphone cool. it's all the things you can do with. will they do that with this? >> we wanted to have you say palm picked up purchase -- >> purchase of palm. >> that was crazy. >> impressive. >> super hero like. >> if you were a super hero what power would you have? >> one college found that the ability to read minds tops people's lists. 28% say they would choose mind reading. 28% say they want to travel in time. 16%, they want to fly. 11% prefer the ability to teleport. and 10% would like to be invisible. >> i'd rather be sleep man. have the power to sleep. >> i was going to say the opposite. i can keep going which is what i feel like i do. >> i don't know.

dream big. you know what i would do, i would have the power to read a man's mind. i do not understand how -- you know what, you're probably right i don't understand how that operates. 40 degrees in concord. not complicated when you walk out your front door, it's cold out. 34 degrees in santa rosa, 47 in napa. big time changes on the way. the fog will be back tomorrow. what we're picking up this morning is something that has been for sometime, that's marine layer. the ma lean layer is back but not at the coast. high pressure is driving all of that cloud cover out to sea. a system of low pressure is going to push that marine layer back on shore. and then as we wake up tomorrow we're going to see fog. big range of temperatures the next couple of days. you'll notice the biggest change for us in the south bay, south bay temperatures will be really
