popular park. four women were assaulted in five months in the area. christie smith is live there with more on the investigation. good morning. >> reporter: good morning to you, laura. we've been talking with women exercising out here this morning. they are very aware of the sexual assaults going on near lake merritt. but are they going to stop what they do? well, no. this is a very popular spot for dog walkers and runners but the women telling us they are going to be more cautious. still, this is the fourth time in five months that there has been a sexual assault in the area. on monday, a woman reported that she was sexually assaulted on her way home in the 800 block of jackson street. that was monday night. not only sexually assaulted but brutally beaten in the common area of her apartment complex. we spoke with two women out for an early morning walk. they heard the news of this last night and they were startled.

>> we talk together, you know. we watch our environment. and we try to go on with our lives. we recognize you have to be cautious, but you know, we don't want to just give up. >> reporter: oakland police say the same person may not be responsible for all of these attacks. the last incident there's not much of a suspect description. we can tell you that police are warning women to be very careful when they are out in the area, certainly don't be distracted by things like your cell phone or ipod. i asked the women if they had pepper spray or anything to protect themselves. they pointed down to their fanny packs and they were ready for whatever would happen. christie smith, today in the bay. >> thank you. >> supporters of the man accused of assaulting a priest will rally this morning. supporters of william lynch say even though he beat up father gerald lindner, lynch is the

victim. lynch say he and his brother were sexually assaulted when they were 7 and 5 years old. lynch does have a pretrial hearing set for this morning. >> a south bay neighborhood is trying to protect his house after a spring of burglaries. they are centered on a number of homes in san jose's ever green area. they are all in a few blocks of each other. the latest happened monday afternoon. the family asked nbc bay area not to identify them. they say the burglars broke in through a bedroom and took lap tops, video game systems and jewelry. >> it's extremely upsetting to think you had somebody walking through your house and touching your things and the kids are frightened now, and my daughter didn't want to sleep in her room last night because this is where they'd come through. >> the family says they will install a security system. the community is talking about setting up a neighborhood watch. >> we have new details about what happened as a man died during a run. bay air firefighters who saw what happened say they are

shocked and angry that nobody came to help the man after he had collapsed. san francisco firefighters who happened to be running in the half marathon say that the event had no medical staff or basic life support equipment near the finish line at golden gate park. the firefighters say they tried to revive the man and claim they waited 22 minutes for a city ambulance. they say nobody on the scene identified themselves as a medical worker. event organizers say there were emts near the finish line and they tried to help the runner within five minutes of his collapse. the man eventually did die. >> guantanamo bay detainees coming to the bay area, that's the plan floated around right now by the berkeley city council. marla is live with more on the story. good morning, marla. >> reporter: good morning. no surprise the berkeley peace and justice commission is behind this latest controversial move.

the commission has drafted a resolution that essentially invites a couple of detainees to come to berkeley to live. in all, 38 detainees have been cleared of the crimes they were held for. of those, the resolution invites two of them to live here in berkeley. the first is a russian ballet dancer who converted to islam while serving in the russian army. he was arrested in pakistan while trying to hide from the kgb. the other invited a former algerian chef. after his work visa was not renewed he moved to canada but was not granted asylum. he was arrested trying to make his way from afghanistan into pakistan. neither man was ever charged with a crime but both were tortures while at guantanamo bay according to the center for constitutional rights.

this could fall through because president obama recently signed an act that prohibits the u.s. from funding the relocation of cleared detainees. the peace and justice commission says that the moves would be solely funded by volunteers and donations. now the berkeley city council will vote on this resolution next tuesday, february 15. live in berkeley, marla tellez, today in the "bay area living." >> protesters are camped out in cairo's main square. we checked in the twitter feed of richard engle in kye red sox he says people are striking in an attempt to stop big industry. the strikes are at places, newspapers and hospitals. he says that friday could be a big day of protests. they have been protesting, now it seems it's changed. there are nuances. >> and we're talking about the

google executive. he could cause headaches. >> we were checking the twitter feed on that. let's talk about this egyptian executive. we've seen him on the news several times, in fact, here is video of him on egyptian television talking about some of his struggles. one of the things that's curious for google they are in a rock and a hard place. they have been quiet mouthed who this man is other than a marketing executive but he is turning out to be a major force in the revolution there in egypt. he talked about how he doesn't want folks to have the google logo associated with him yet he wears a google deshirt. others spluft eyes on him, the columbian law professor that took a job with the federal

trade commission. wu seen here on a recent taping invented the phrase net neutrality, a frequent critic of apple. wu once said apple was the biggest athlete free internet. >> pg&e executives say there are no other pipe lines like the one in san bruno in northern california. pg&e has not been able to find any other gas pipes with large sections welded together. faulty wells may be to blame for the san bruno incident. >> pg&e executives say the utility has not punished employees in connection with the blast. if any one is punished it will happen after the ntsb releases its report in march. >> two bay area mothers arrested for blocking a fleet of energy

christina. 6:14 now. >> vice president joe biden is urging u.s. cities to get a grip when it comes to building a high speed rail network. he says that he is prepared to spend billions to get the job done and bob redell is live at san jose's deardon station. san jose could stand to get a good chunk of money. >> reporter: it could be as much as $16 billion according to one estimate. that's more than a third of the total $43 billion price tag for the 800-mile-long project that would start north of san francisco, south through the deardon station in san jose, on to the central valley and eventually to the final destination of los angeles. we should learn more about what this federal investment would mean when the rail authority holds a news conference. yesterday vice president joe biden announced that president obama wanted to invest $53 billion in high speed rail.

this taking place over the next six years. investment biden says is not only good for infrastructure but the economy as well. >> the fact is public infrastructure investment raises private sector productivity and creates jobs. >> reporter: remember this is just a proposal. president obama must convince the republican-led house of representatives to go along with this. there are many californians who wonder why the state needs high rail. it's expensive. that's assuming the cost doesn't increase which some analysts and critics believe will. then there is a question of who is going to use high speed rail. when you can fly between the bay area and los angeles at speeds faster than a train, at a relatively inexpensive cost. reporting live, bob redell, "today in the bay." >> 6:16 now. first lady michelle obama says her husband has kicked his smoking habit. she told reporters the president

you can see the guy going the wrong way down the interstate. look at that. he eventually runs out of road and slams into that guardrail. the truck was nearly torn in half. the driver survived without serious injuries. police say the man was driving with a suspended license. he caused a 7-mile traffic jam. again, he wasn't kill and he's okay. >> a woman is dead after police say she had a botched cosmetic surgery inside a hoyxt investigators say the woman is a british college student. she went to philadelphia to get injections, basically a butt lift. the surgery happened at a hampton inn around noon on monday. paramedics got the call yesterday morning after the woman complained of chest pains. >> we're not sure right now if that person who performed that procedure is licensed or unlicensed. >> police say two women were involved in the procedure. they are now looking for them.

>> the irs is offering international tax evaders a chance to come clean. they could avoid jail and pay reduced fines if they come forward before august 31. the irs is in the middle of a crackdown against american who is hide assets overseas. this offer is similar to one in 2009. back then 15,000 tax evaders took advantage. >> it's happened, there are now more new computers in pockets than on desks. >> good morning. we kind of expected this. still worth noting. for the first time more smart phones have been sold than pcs. perhaps verizon helped push it over the top. in the last quarter factories shipped 100 million smart phones but 92 million computers. families are going to buy both. you can't type a paper on a smart phone. smart phones have the upper hand. >> good news if you own an ipad.

the latest reports say the new ipad 2 pretty much the same. a bit lighter and thinner with at least one, possibly two cameras. if you are one of the 15 million who have one of these f you can manage without a camera you should be fine. "the wall street journal" says it's in full production. they haven't announced but but they have this timing with steve jobs taking time all ill so we've not had the expected announcement about the ipad 2. >> we'll wait for it. >> winter not finished, pounding parts of the country. >> take a look at this live look at oklahoma city. a foot of snow has fallen. no one on the groods. another storm from texas to kansas. a lot of cities still digging out from a massive snowstorm that you recall blanketed most of the u.s. last week.

feeling. >> reporter: good morning. i can tell you that women here are very aware of what's going on. they say it's disturbing but they are partnering up with their friends. they won't stop coming. lake merritt is a popular spot for runners and dog walkers. this is the fourth time now that there has been a sexual assault near lake merit. a fourth time since september. the last one monday night around 10:00 p.m. a woman tells police she was not only sexually assaulted but brutally beaten in the common area of her apartment complex. oakland police say that the man followed her as she was walking home. they won't give up their morning walk. only a brief description of the attacker. police say all of these attacks may not be done by the same person. the motive is different. they say in other cases the women were robbed. oakland police putting out a

warning to be very careful, make sure not to be distracted by phones or ipods and suggest that you be very careful, specifically when you are out and about. here is one of the women that we talked with this morning. >> last night on the way home from work, frightened me a little bit. >> reporter: oakland police also putting out another piece of information, reminding women to be extra careful specifically when you are getting in and out of your car. live in oakland, christie smith, today in the "bay area living." >> san jose has taken a shot at shutting down the most dangerous nightclub. attorneys will return to court to try to permanently close club west. calls to the club 100 times.

new year's morning a woman was severely beaten by a group of people. the club refused to call an ambulance and tried to cover up the attack. >> a judge is looking into whether lethal injections can resume. it depends if he's satisfy with the new death chamber. the judge toured that facility yesterday and says that he will told more hearings before he makes a decision. >> coming up tonight at 11:00, i will take a closer look at what the death roy rowe situate in the state. there haven't been any in the past five years. last year 28 additional people were put on death row. the new housing facility that the state is considering could cost $400 million. >> a closer look tonight at 11:00. 6:33 now. east bay mayors and council

members from a number of cities are teaming up. they are opposing the plan for redevelopment. the mayors will gather near the pops theater to announce opposition. they say the cuts will bring financial benefit to the state but permanently destroy 29,000 east bay jobs and billions in local economic activity. >> they claim the hospitals will force nurses to take a deal that the union shot down back in december. that deal includes pay raises for nurses but it also includes a new career advancement system and that makes nurses meet certification and academic requirements in order to get promot promoted. the union says it will make it more difficult for them to get top level jobs and even some would be demoted. >> several sports on the

shopping block may be spared but before fans can celebrate may be a legal issue. it has to do with title 9. marla has the reaction to the new information. it's emotional for a lot of folks. >> reporter: it certainly is. the bay area loves its sports and cal baseball is an institution here. but the golden bears could lose its teams despite being ranked in the top 20. on the line in all five athletic programs at uc-berkeley. that's men's baseball, men's and women's gymnastics, women's lacrosse and men's rugby all could face elimination, they are facing elimination. if they are not saved they would be gone after this school year. and like most these days it comes down to money. reducing the number of intercollegiate teams from 29 to 24, which saves the university about $4 million a year.

but eliminating two women's teams, the gymnastics and lacrosse, would put cal in violation of title 9. that's the federal law that calls for jenter equity. one fan i spoke to says you know what, it all comes down to cal football and paying the head coach. >> if they didn't have to pay the money for those programs and put them in the academic school part of the school. that's all cal is doing. the programs that don't generate a lot of money. for the schools. >> i did research and i found the coach makes close to $3 million a year. chancellor is making the final decision. that $25 million is raised to pay for the operating expenses for the programs for five to 10

years. the second criteria, a plan to build an enjoument to fund them long term. supporters form add group and according to the group the five programs have raised so far between 10 to $12 million. so about halfway to the 25 million mark. robert will make his announcement on his final decision tomorrow. >> we'll have an update. thank you. >> students in the east bay are waking up knowing they may have a few more months. next year they have to attend someplace else. the school board decided to close glenn brook and holbrook. board members say those are necessary to save the district about $1.5 million per year. the board decided to keep sequoia open. as well as monty gardens in

begin until next year. there have been questions where all of the money will come from. yesterday vice president joe biden offered hope, announcing that president obama wants to invest 53 billion in high speed rail throughout the next six years. with california receiving an estimated 16 billion of that. critics wonder why, spend so much on an 800 mile long project that would connect when air is faster and relatively inexpensive. propotents point out that high speed rail would create as many as 100,000 construction jobs over the next five years ago. now, president obama must convince the house to go along with this. that could be a all the odd given the calls for budget cuts. we should learn more about what this proposed federal investment means. when the rail authority holds a

staff sergeant hinton says he is going to leave to continue his education. the army says he's going use the gi bill. the medal of honor in november for killing a fighter dragging away another wounded soldier. >> berkeley is known too break the molds. but looks like the city is at it again. the city council is set to vote on a resolution that would bring detainees who have been cleared, to berkeley. good morning. >> reporter: good morning. the berkeley piece and the jefferson commission is responsible for this. the commission drafted a resolution that invites a couple of guantanamo detainees to reside here. 38 detainees have been cleared of the crimes they were held for.

of those the resolution invites two of those people to live in workly. the first is a russian ballet dancer. he was arrested in pakistan while trying to hide from the kgb. and the other a chef who works in vienna after his vee ka was not renewed. this morning i found one man who says berkeley should just take care of its own and not play caretaker. this whole plan could call through, though, because president obama recently signed an act that prohibits the u.s. from funding the relocation of cleared detainees. the peace and justice commission assures the council that these moves would be paid for by volunteers and donations. the council will vote on this

next tuesday, february 15. >> thanks a lot. be on guard around oakland's lake merritt. that's the message from police after another woman was attacked near that park. police are looking to see if this attack is connected to several other assaults last year. christie smith is live from lake merritt with how women who live and work out around the lake are feeling. >> reporter: i can tell you that women here have heard the warning from oakland police loud and year, to be extra careful around beautiful lake merritt. it's such a popular spot for runners and dog walkers, a lot of restaurants, a lot of women are saying hey, i'm not going to stop coming here though this is the fourth sexual assault since september. the latest a woman on jackson street apparently followed to

her apartment and assaulted and beaten in the common area. two women out for exercise say it's disturbing. >> walk together, watch our environment. we try to go on with our lives. we recognize you have to be cautious but we don't want to just give up. >> reporter: oakland police are saying that the same guy may not be responsible for all of these attacks and the other cases, the women were robbed and they were in various areas around the lake. only a vague diskripgs of the subject but oakland consider this is a high priority case. christie smith, today in the bay. >> we have a remarkable piece of video to show you that might help san francisco police catch a bugger. the attack happened sunday afternoon.

look at that. a man attacking a woman throwing her to the ground before making off with her wallet. a neighbor who lives in the area heard the scream, grabbed his camera and was able to get that video. police say the victim was from out of town. she met her attacker in union square that day and were hanging out together when the attack happened so if you have information on who that person is or you saw what happened, contact police. >> how brazen. 6:54. students in an east bay school district are in danger this morning. administrators said someone is giving kids drugs disguised as dessert. the albany district is investigating four incidents. total of six students ate marijuana brownies. parents who see albany as safe are shocked. >> kind of alarming, actually. how did they get there? what are they doing there? i think it's crazy. >> police are looking into who
