good monday morning. thank you for joining us. i'm laura garcia-cannon. >> and i'm brent cannon. we begin with your monday morning forecast looking ahead to the week with christina. good morning to you. we have more rain on the way. we'll start with where temperatures are right now. very cold in the 30s. overall, 37 degrees in napa. 38 in hayward. 37 degrees in sunnyvale. we have another couple of hours of temperature dropping before we hit our lows this morning. we'll let you know how colder with expecting it to be and about some rain on the way coming up. definitely need the jacket, though. we'll check on the highways with mike inouye. we have accidents on both sides of the bay. we'll start over the peak there on the peninsula side. southbound 280 at serramonte boulevard. the accident just cleared from the lanes there. an easy drive out of daily city down to 380 for the peninsula commute. a smooth drive into the city as well. we'll take you to the other side of the bay, oakland getting onto

northbound 880 at high street there's an accident there. that's been going on since before 4:00. the car crashed into a sweeper truck. major damage to the passenger vehicle. fruitvale should be your solution through the area as well. we'll send it back to the desk. thank you, mike. 5:01 right now. we have an update on a strange case out of the north bay. an autopsy will be performed tomorrow on the remains found in the backyard of a novato home. there was growing speculation that it is the body of 74-year-old dale smith. neighbors haven't seen him for months. police consider evelyn smith, his wife, a person of interest. she gave them permission to search the home and mentioned the ground underneath a barbecue patio. that's where the body was discovered. a couple accused of kidnapping jaycee dugard and holding her hostage for 18 years is going to be in court today. his lawyers are asking for a

change of venue for the trial hearing. prosecutors opposed the request. criminal proceedings cannot begin until the issue of insanity has been settled. the yacht that won sailings biggest prize is passing underneath the golden gate bridge this morning as the city prepared to host the america's cup. "today in the bay's" marla tellez is live at the golden gate bridge with that story. >> reporter: good morning, brent. yeah, the yacht is scheduled to arrive underneath the beautiful golden gate bridge some time before 6:00 this morning. when it does happen we are hoping to bring you a live look of what a beautiful sight that's going to be. but because it is just too big it does not actually fit underneath the bridge. it is actually crated pieces aboard a freighter. it is headed for pier 80 where it will be stored until race time. it is the yacht that won the cup for oracle ceo larry ellison last year. the name of the yacht is "usa

17." the dimensions are it is 115 long with a 185-foot mast and 223-foot wing sail mast. the clearance for the golden gate bridge is 220 feet, so clearly it would not fit. it can reach speeds of 35 miles per hour. it will be reassembled and put on display for the public at pier 80. it will be raced once again by ellison's bmw oracle ray racing team. san francisco was named the host city for the 34th annual america's host chosen by ellison since he won last year's cup. the entire event is expected to pump more than a billion dollars into the local economy. so it is pretty exciting the first big attraction is scheduled to arrive later this morning. live at the golden gate bridge this morning, marla tellez for "today in the bay." >> thank you for the update.

that could be cool to see. the south bay city will soon have a new source of rev new. the finance committee will meet to talk about a new tax to go into effect tomorrow. medical marijuana dispensaries have to pay 7% of the growth tax receipts to the city every month. san jose has 100 dispensaries with no tax right now. >> we have over 100 of them now. i mean, that's one for every 10,000 residents. that's probably more than we have for doctors or oncologists. we have too many of them. i don't think they meet the legal standard. and i'm very concerned about the proliferation of them. >> opponents of the new tax say the city is taxing these businesses before considering whether they are legal. they also argue that taxes are an effort to change medical cannabis out of the city with the highest tax in the state.

the san francisco school district will send out more than 400 pink slip notices tomorrow to teachers, administrators and aids. normally most of the people who get a pink slip still end up having a job next year, but the district says if the governor's proposed tax extensions are not approved in june then a good portion of the layoffs this year will be permanent. mountain view police are reopening the files of a 7-year-old murder investigation. back in september of 2004 17-year-old alex hernandez was shot to death while riding his bike with frigid. several suspects drove off and were never arrested. the shooting was believed to be gang-related. now detectives are developing new information after recently reinterviewing witnesses. a $10,000 reward is still available if someone steps forward to lead investigators to those suspects. goodwill is trying to open a new thrift store in an upscale commercial district of berkeley, but merchants in the area are not too supportive of the idea. goodwill wants to open a store

like this one on solano avenue. they expressed interest last summer and submitted an application but the permit is still pending. solano avenue merchants don't want the goodwill store to move in saying the thrift store will change the character of the neighborhood. it is turning into a big stink in san francisco. there's a rotten egg stench near at&t mark and other areas in the city, and it may have something to do with san francisco's push for low flow toilets. "today in the bay's" bob redell is joining us live from san francisco to tell us how bad it smells this morning. good morning, bob. >> reporter: good morning to you, laura. well, i can't really complain about the cold, it is very brisk out here outside mccovey cove, but it is not hot enough to bring out the rotten egg smell people have been complaining about. i just got off the phone with the city's public utility commission, and they say this is what is happening. the city is pushing for lower water consumption is to blame

for this. all the stuff that goes through the pipes becomes more sludge ji and solid and emits an odor. it is partly due to the low-flow toilets and the fact that the people because of the economy haven't been using water as much. and also over the years because it has been wetter, more rain, they haven't had to use that. you have three factors contributing to lower water in the pipes. as a result, the city is having to spend about an extra $2 million on bleach. they normally buy bleach as part of the odor-reducing process, but because of the unusual issue they have had to spend a couple extra million on that. over recent years they have spent $100 million just to upgrade the overall system. some of that money, some, not all, but some of the money they weren't able to put their finger on the exact amount, has been used to combat the odor problem.

when i asked the public utility commission if it is worth it, they said absolutely. their annual consumption for water is down 20% just in one year alone. >> don't be mad if i say your reporting really stinks today. thank you, bob. happy monday. flushing it out for us. keep your eyes on the road because there's going to be major work on the bay bridge this morning. crews are going to lift another section of the new tower into place today. a little video of the work that they did on the third segment of the tower back in december. work on the fourth segment will start this morning. we'll have a live report on what to expect and when that work is going to be completed coming up. >> did you see that? is that how they put the bolts on? they just kind of twist them? wow. hire them for your next job. i want to check the forecast now with christina. we are coming off a very eventful weekend for some. >> yeah, it was an eventful

weekend. we had something we don't usually see around here, a little bit of snow. i know a lot of people got more excited than we should have for just a small amount of snow, but hey, it doesn't happen very often. 37 degrees in the forecast. it will be chilly in the east bay, you need the jacket. but probably something to peel off by noon as our temperature approaches 50 degrees. and 3:00 p.m. as you make your way home, 55 degrees. that's the daytime high today. the day him daytime highs will be in the upper 50s to low 60s. we have clouds in the area keeping temperatures a little warmer than they could be if we had completely clear skies. we would see temperatures in the north bay this morning in the 20s but our cloud cover is keeping things a little more mild this morning. that's the case for this afternoon as well. we have 33 degrees right now in livermore. 38 in hayward. turning over to the low 60s in most cities. 61 degrees is the forecasted high in napa. stick around, i have your

seven-day forecast on the way showing you when the showers are back. sooner than you might like, guys. back to you. you don't want me to intercept that again, christina, but i'm going to. first of all, we have the bay bridge here. a big concern for folks in the span. a live shot shows the lower deck here. i'll show you what we are talking about. christie talks about the construction and laura updated you about the construction off the bay bridge. you can see this span coming in from the lower deck. there it is, an easy drive. it is a clear flow, but once you get to the toll plaza, the center screen right beneath 880, there's an accident blocking your two fast lanes. stay over to your right if you can. back to the maps we are showing you the southern accident out of the city. high street, the on-ramp, i con firmed with chp the on-ramp is open but there's still activity because of a two car non-injury accident. it could be a spectacle to see passing by that small area.

the bell we go to nicole lapin live at cnbc world exchange headquarters. nicole? >> reporter: good morning to you, brent. futures are slightly higher this morning. this is, of course, after wall street comes off a down week. asian markets were mostly higher overnight and europe is flat lining right now. look, as the very busy week for economic data topped off by the big daddy of them all, the friday jobs report that could see unemployment rise to 9.2%. today we get a lot of economic data, personal income and spending, manufacturing, pending home sales just to name a few. the dow rising 61 points on friday, talk about resilience, 12,130 is where we ended, but for the week as a whole we were off 2%. the nasdaq composite also adding 43 to 2781 but lost 1.5% for the week. this is also as energy traders are eyeing the uncertain situation in the middle east and libya this week. swede crude is creeping back to the $100 barrel mark.

it is hovering near $99 right now. you are not dreaming, gas prices have vail really jumped a lot as of late, aaa says the average gallon of gas shot up 17 cents in the past week. 6 cents alone on friday. we are now at $3.33 a gallon nationwide. this is the highest level, guys, since october of 2008. analysts expect more increases in the upcoming days as prices at the pump typically lag trend in what we are seeing in the oil market. one expert told us that he estimates that every $1 rise in crude oil is equal to about 2.5 cents for gasoline. also making headlines this morning out of cnbc, warren buffett is saluting the american flag. in his annual letter to berkshire shareholders he says america's best days lie ahead. given buffett and berkshire own several economic sensitive companies like railroads,

insurers, housing, consumer product makers, his optimism could be an endorsement for the u.s. economy. he is also eyeing acquisitions. berkshire has $38 billion in cash on hand and his trigger finger is, quote, itchy. also making headlines, united and con innocent continental airlines will launch an interim campaign this week. they will start to change united's website to match its look, but that's not happening yet. that is set to launch later this week. brent, back to you. >> man, i keep thinking back to the low 3s for a gallon of gasoline. that's a luxury in the bay area. we are tipping $4 and some cases past that. >> reporter: yeah, forget those days, sorry to say. don't shoot the messenger this morning. >> it hurts. we have to get a bike. >> we have to get in shape, then. >> we have to get one of those

with four or five seats. >> as long as i'm in the back. we have to check the forecast. we need good weather, although it doesn't matter. just get out there and ride. >> you can always pull a wagon behind you. we are looking good this morning for any outdoor activity. weave we have good air quality, but protect your ears and hands. it is cold this morning, we are in the 30s. one degree above freezing in livermore. below freezing this gilroy, 31 degrees. more mild this morning. on the peninsula, 43 degrees. san francisco, 41 degrees. a little bit more moderate there because of the pacific ocean. as we head throughout the day today it will be fairly nice. it will be one of the nicer days of the week. as of tomorrow the showers are back in the mix, so enjoy the 61 degrees forecasted in san francisco today. 62 in oakland. and 62 degrees in san jose. showers arrive for the second half of your tuesday and wednesday looks like a washout, at least the first part. by thursday sun and clouds, plenty of sunshine through the

good monday morning to you. kind of easing into the monday morning thing today. >> getting ready to go, we saw the commute earlier, nice and light for now, but mike has the latest on where we are headed. and the reminder, it looks like the bay bridge has an accident besides looking out for the construction there. >> that's right. but that's a big note, brent. the construction christie smith is covering, she has shown us the north side there. progress is being made, but it is lit up very well. folks need to focus on the bay bridge itself. there's the distraction on the

shoulder. focus on the roadway. we are showing you the pictures. we have some on our website as well. here's the accident at the toll plaza as well as the one on 880. now getting to the toll plaza is an 18-minute drive down the east shore freeway. a live look at the toll plaza shows the commute direction clear as a bell right now. but getting off the lower deck there's an accident clearing from lanes. it should be just about cleared, but it was around the parking lot on the other side of the bridge. that's a concern for you. getting back out to the roadways, 880 also had an incident on the high street off-ramp. a non-injury accident, but a car has major front-end damage. the on-ramp is open now. a lighter volume is starting to build for 880 as well. further east, livermore has a smooth drive out of the altamont pass. a 14-minute drive that will start to slow and build over the next half hour. the south is looking pretty good heading down to san jose. no major issues in the northbound commute, but this

will build up more this week because schools are back in session. the u.s. is trying to persuade european nations for toucher tougher sanctions on the libyan government this morning. u.s. officials hope that sanctions would convince gadhafi loyalists to abandon his regime. secretary of state hillary clinton is in geneva for high-level talks with other foreign ministers. she is trying to bring the international community together to form a unified opposition to the libyan crackdown that has killed hundreds of its own people. actor charlie sheen is reportedly planning on suing cbs for $320 million for mental anguish after they dropped his show "to and a half men." they axed the show following a public rant against the show's creator. this morning jeff rossen has an exclusive interview with sheen. >> i am passionate. and everybody thinks i should be begging for my job back. i'm just going to forewarn them that it is everybody else that's going to be begging me for their

job back. >> you can see jeff rossen's entire interview with sheen at 7:00 this morning on "today." meantime, protesters are camped out right now inside the wisconsin state capitol. police are allowing hundreds of pro-union demonstrators to spend the night inside the building. protesters are fighting legislation proposed by wisconsin's new republican governor that would strip most public employees of the right to collectively bargain. the demonstrators began camping inside the building a couple weeks ago. yesterday police kind of gave up asking people to leave. they wanted them to get out so that the capitol could get its first thorough cleansing since the middle of the month. so far there have been no arrests for unlawful conduct but it is creating a mess in there. it is 5:25 right now. panic this morning for thousands of gmail user who is can't find their gmail. scott mcgrew, it is a serious problem. >> it is a serious problem. e-mail is the most common way to communicate in the silicon valley and to archive old

information. big trouble for individuals and businesses alike this morning. tens of thousands of people looking at their inbox and seeing categorically nothing. google says it is working furiously to figure out what went wrong. now they are a little fuzzy on the fix as far as a timeline goes. google says in the near future, but then it gets fuzzy about that saying the estimate could change. bottom line, they don't know. this is the sort of thing that companies that promote the cloud really do not want to hear. if your corporate e-mail goes out, you have a local i.t. guy. if your company's e-mail is managed somewhere else like in the cloud, google gmail, you are at the mercy of outside forces. google has more than one i.t. guy working on the problem, but one way or the other it is bad press for cloud supporters. other neck news, the game developers conference gets underway in san francisco, one of the city's largest conferences. it is all video games but it is also all business. thousands of people meet to talk about things like 3-d graphics

they need your help. and san francisco welcomes the world's fastest yacht. good morning, i'm marla tellez. we'll tell you how america's cup fever will be heating up at the golden gate bridge coming up. and a live look outside this time from the south bay this morning. another cold start, it is monday, february 28th. this is "today in the bay." >> good monday morning, everybody. thank you for joining us. i'm brent cannon. >> i'm laura garcia-cannon. we'll get started with a look at the forecast with christina. good morning to you. we have clouds overhead keeping things more mild than where we would be if we had completely clear skies. it is still cold out there. 37 degrees in concord. right now 39 in napa. and 37 degrees in san mateo. as we head throughout this afternoon our temperatures are going to approach the 60s. and then we have rain on the way as we head into wednesday and for the latter part of your

tuesday as well. we'll break down your forecast for the week and make you aware of what days are best to make those outdoor plans coming up. right now we'll check the commute with mike inouye. good morning, christina. we'll take you to the roadways where things are slowing down. the slowing in antioch, another issue as well, but first we have a disabled vehicle where it says 65. that's for southbound 680 in your commute direction, but northbound 680 at monument boulevard there's a disabled vehicle currently being escorted off the roadway, helped off the roadway. not a major deal because it is opposite the main commute, but we'll follow it anyway. we don't want problems out of walnut creek. the slowing approaching loveridge, we'll keep an eye on that. crews will be hosting a huge segment in place today at the bay bridge. christie smith is live at treasure island this morning. there's word drivers could get a little distracted. >> reporter: yes, it is impressive. with each piece that goes up,

this tower is becoming more and more the centerpiece of the new bay bridge. i want to step aside so you can see what's going on this morning. if you look over there near the bottom you can see that a part, a large part is being hoisted up this morning. when we last checked in an hour ago that piece was totally flat there. right now the tower is 374 feet tall, which is already taller than koyt tower in san francisco and taller than the tribune tower in oakland. this will be the fourth tower section for the self-anchored suspension span. when it is complete the whole thing will be 525 feet tall. the jacks hoist the section into place. the last time a section was installed was in mid-december. and this was a long and steady process. each section takes about 30 hours to lift and to bolt into place. the first tower sections went up last july. and progress on the new bay bridge is becoming such a point of interest that caltrans has

launched a facebook page about it. and this will bring it up to 480 feet when this new section is in place. but all this interest as we talked about earlier is a double-edged sword because caltrans is reminding drivers that you have to keep your eyes on the road when you pass it because they certainly don't want any accidents. reporting live on treasure island, christie smith, "today in the bay." >> thank you so much, christie. santa clara police are looking into the city's first homicide of 2011 this morning. officers found a man stabbed to death on monroe street off of the san thomas expressway at 7:30 in the morning. the 31-year-old was in front of the old orchard apartment complex and a trail of blood extended from a gas station across the street to the body. police have not identified any suspects and have not released the man's name just yet. a preliminary hearing gets underway if this morning for the man who is accused of starting a massive wildfire.

the man will head to court after being charged in connection with the 2008 summit fire that lasted for seven days in the santa cruz mountains. investigators say he left piles of vegetation burning for weeks unattended. the fires consumed over 2,700 acres and destroyed 132 structures. the push for the east bay memorial for the jonestown's victims will move to the spotlight today. supporters will hold a prayer vigil and rally at the evergreen cemetery in oakland at 10:30 this morning. they want a memorial for the 918 victims of the people's temple massacre in jonestown from 1978. cemetery management approved the plan for a granite wall but a coalition led by jim jones' adopted son opposes the idea saying that his father's name would not be inscribed on the wall. 5:34 right now. police investigators say street racing is to blame for the death of a 24-year-old driver. the accident happened early sunday morning at the university

avenue on-ramp at highway 101 near east palo alto. the driver died at the scene and the 27-year-old passenger suffered major injuries and was taken to stanford hospital. witnesses say the men were racing another car with speeds reaching over 100 miles per hour when the driver lost control of his car hitting a sound wall. a san francisco assemblywoman is getting ready to introduce legislation designed to protect filipino veterans. later this morning assemblywoman fiona mall will insure filipino world war ii veterans receive benefits promised by the federal government for their service. during world war ii the philippines was a u.s. commonwealth. filipino services in the armed forces were considered u.s. nationals. they fought side by side with american troops. the government later rescinded that promise. a local company is voluntarily recalling products

that contain broccoli this morning. they are often sold at safeway stores and could be contaminated. taylor farms pacific announced the recall after a random ag test came up positive for a bacteria that can cause sometimes serious and deadly infections in young children or people who have weakened immune systems. the broccoli is in cooked and fresh products. it is sold at safeway stores and is dated from february 7 to march 7. there have been no illnesses reported in connection with this broccoli at all. again, it is kind of a voluntary and precautionary recall. the 34th america's cup is still more than a year away, but it welcomes its first prize this morning, the world's fastest yacht. scheduled to arrive in san francisco underneath the gold up gate bridge. and a big freighter just passed below the golden gate bridge as it is making its way to the piers right now. and "usa 17" could be on this freight. we are calling to find out if this is, in fact, the one. now, it is not as sexy as you might think because the actual yacht is not in one piece. it is just too big and would not fit underneath the golden gate bridge. so it is in crated pieces aboard a freighter. again, we are seeing if this is, in fact, the freighter. it is headed for pier 80 where it will eventually be reassembled and then put on display for the public before race time. and it will be raced once again by ceo larry ellison's bmw oracle racing team. the dimensions are impressive, it is 115 feet long with 185-foot mast and a 223 wing-sail mast. clearance for the golden gate is

5:51 right now. a live shot out across san francisco. another chilly start to the day, but not as icy cold as we have seen. christina will update your workweek forecast coming up in a bit. let's check the morning commute right now. kind of light out there, people easing into the day. we'll check in with mike. >> we had a number of smaller accidents as you have seen. no major slowing here. we now see the slowing out of the altamont pass. there's westbound 580 right on schedule out of livermore slowing into towards the heart of livermore, but the other incident on the left side of the screen is at the dublin interchange. a big point of concern that is off to the shoulder. westbound 580 at northbound 680 heading up to dublin and danville. a nice drive on 680 itself. moving up to antioch, we'll see the slowdown coming out of westbound highway 4. the disabled vehicle marked over in concord is off on the median northbound 680 near monument boulevard. it is not really causing a slowdown but it is a distraction as more folks hit the road. here's the maze showing nice speeds through the maze itself approaching the bay bridge toll
