"today in the bay's" christie smith is live in berkeley where a man is dead after an overnight standoff with police. she has a look at exactly what happened and what the situation

is like at the scene right now. >> reporter: good morning to you, brent. we have new information. i just spoke with berkeley police again. they initially told me about 30 minutes ago that this started with reports of shots fired inside of a home. now, they were initially thinking that all the shots remained inside of the home, but now they are telling me that they believe that the first responding officers were actually fired at by that man inside of the home. now this is at the alameda and marin in berkeley, the 1800 block. this is kind of near the solano shopping district if you know the area. this started around 7:30 last night when the first calls came in. police backed off when the man fired at them and they evacuated immediate neighbors for safety. they then brought in hostage negotiators who made contact with the man who was inside the home alone. then just after 4:00 this morning it didn't end well.

they entered the home and found him dead of a self-inflicted gunshot wound, but they tried for hours to resolve this. >> we do everything possible that we can to try and resolve this peaceably. if that means talking to somebody for hours that's what we'll do. we'll sit out here and try to continue to negotiate to bring about a peaceful ending. >> reporter: a berkeley policeman telling me that oakland police came in to help them out with this case and brought in canine units. this morning they are saying some neighbors still aren't back home yet. it could be a couple hours before they actually return. they are also telling me that this intersection here that you see blocked off, well, you can see they are taking the tape down right now. and so it looks like it will be opening soon. but they are telling me investigators will be on the scene for several more hours. that's the latest from here, reporting live in berkeley, christie smith for "today in the bay." >> because things are changing we'll check back in with you

later on. we want to get a look at the forecast now with christina. >> it is going to be a really nice day today, tomorrow even better, but we have drizzly fog out there. low cloud cover so dense it is creating a mist this morning, especially in the south bay where we have the densest fog right now. if you are traveling the highways you will likely find slick conditions the next couple of hours. but for the second half of the day we are in store for a spring-like treat. i'll talk all about that and tell you when the next system will arrive coming up. we'll check your drive right now with a serious situation in livermore. 580, i'm just checking the chp update, they just updated the location. the sigalert which we had called for westbound 580, that was the location for the similar why semi accident with a yukon truck. the backup quickly formed to the interchange. if that has cleared it will sort out in the next 20 minutes. the maze is looking all right as

we get a live look at the golden gate bridge showing the effects of the mist and drizzle from overnight. watch out, it is slick. thank you very much, mike. with the unrest in the middle east continuing this morning gas prices all over the country continue to rise. no one is feeling the pain at the pump worse than us here in california. aaa says the average price for regular gas in california is $3.89 this morning. the bay area cities are seeing higher prices, just pennies under $4. no end in sight and many are turning to alternative fuels as a way to offer relief to their wallets. one bay company is at the forefront of that movement. marla tellez is live in fremont this morning where tesla motors is expected to roll out a new electric car that is expected to be the best yet. good morning, marla. >> reporter: good morning, laura. i guess deciding if it is the best is up to the consumer, but i can tell you this, you get what you pay for being the best. it comes with a price tag. the first version of the new

tesla sedan that will be produced here at the former plant here in fremont will cost $77,000. so no chump change there. it is called the model s signature series sedan. it is the second car ever to be produced by test tesla. the first was the roadster. it comes with a 300-mile battery. drivers can get 300 miles out of one charge. that's above and beyond anything else on the market, particularly as competition has it with the nissan leaf that goes up to 100 miles on a single charge. the leaf is said to be the most affordable all electric vehicle priced in the low to mid-$30,000 range. if its signature series is out of your price range, tesla is offering a base model about $20,000 less at $47,400. the basic model has a driving range of 160 miles. tesla also plans to produce a

230-mile option, so three options for this sedan. each vehicle, though, comes with a $7,500 tax credit. and you are looking at the video here. i think it is a pretty slick looking vehicle as far as the exterior is concerned. and it is no plug, either. it says zero to 60 in less than six seconds. the new model sedans will be produced in fremont. 5,000 will be rolled out next year in 2012. the first 1,000 will be the signature series, the expensive top of the line version. live in fremont this morning, marla tellez for "today in the bay." thank you, marla. now tesla may boast long range but they have to compete with the world's most popular high ready. toyota claims they have sold more than 3 million prius hybrids since 1997. it was the first mass-produced hybrid in the world. toyota is trying to rebound from a series of recalls over the past few years that tarnished

their image. we continue to get a better idea of what's happening in the trial of barry bond. the hearing this afternoon will decide if jury questions will be released publicly. when the march 21st trial starts former teammate bobby estella and ex-girlfriend kimberly bell are expected to testify. they are expected to say bonds admitted to taking steroids. other baseball players are expected to say anderson gave them steroids. santa clara is scrambling to save redevelopment money that has been set aside for the proposed 49ers stadium. city leaders, the stadium authority and the redevelopment agency will hold a special meeting tonight. they are expected to move assets from the redevelopment agency to this stadium authority. that will protect the money if the state decides to shut down local redevelopment agencies and take that money for its own. the full senate and assembly will vote on the state budget proposal coming up tomorrow. several san jose city

council members want to limit the number of medical marijuana businesses and will bring up the proposal today. vice mayor madison nguyen and three council members say the problems of having many of the shops outweigh the benefits. council members point to an increase in crime, a drain on city services and the gray area of the law it operates. they want to limit the number of marijuana collectives from over 100 to 10. the city council in san jose will vote on a new contract with the firefighters. the firefighters union nonapproved the new contract this weekend and the city is expected to go ahead and approve it today. the contract cuts firefighters pay and benefits by 10% and reduces the number of firefighters on fire trucks from five to four. mayor chuck reed is now calling on the city's 11 other employee unions to strike similar deals. 5:08 right now. sad news out of afghanistan where a san jose soldier was killed. army staff sergeant mark wells died on saturday when he stepped on a hidden bomb in the helmand

province. wells was deployed in august after a 14-month tour in iraq. he leaves behind a pregnant wife and toddler. a funeral service for wells is expected to be held on st. patrick's day in phoenix where his wife's family lives. the time is 5:09. we want to check in with christina. it is very misty out there as you head out. >> yeah, definitely the appropriate word of the morning, the mist is out there. and it is enough mist to actually get our roadways nice and slick. so you want to take it easy out there, even though we don't have heavy rain or light rain coming down, it is enough mist and dense fog that is so heavy it is creating the misty situation. probably for the next couple hours. after that we'll see improvement as high pressure gapes control of our weather pattern. and that's going to be the case today and tomorrow as well. but as you can see here, a little bit of green sneaking into the bay area. that's actually really dense low cloud cover creating the drizzling effect in san jose.

morning, but they continue to skyrocket and that is impacting early trading. "today in the bay's" courtney reagan is live at cnbc world headquarters with the news before the bell this morning. good morning. >> reporter: good morning, brent. futures right now are up and that's despite oil prices still trading above that $100 a barrel key mark. we are down slightly for the day. this is after worries of rising oil prices dragged down the major indices yesterday. we are seeing a bit of a pull back from the 2 1/2 year high. after reports that opec members are increasing output to hold become prices. european markets are trading higher following asian gains. the nasdaq was down 39 points to 2746, which is where trading begins today. the most expensive town in the nation isn't beverly hills or the hamptons. it is aspen, colorado. the median price for single-family homes in this

mountain town stands at $4.6 million. despite the housing market, prices there are still going up. figures show the average home price in aspen has increased over the past four years to $6 million in 2010 from $5.4 million in 2006. well, the rate of airline cancellations are going up. the new federal figures are showing that u.s. airlines canceled nearly 4% of flights in january, up from 3.7% the previous month. that makes january's capslation rate the 13th highest on record. winter storms did shut key airport hubs across the nation, but airlines are also blaming a federal rule that penalizes them for long tarmac delays. as a result, they are just flat-out canceling instead. i don't know which is worse. back to you, brent. >> boy, they leave you hanging there. thank you, courtney. we give bob redell all the toughest assignments and this morning he has one of the toughest of them all. >> he's live in new orleans with a look at fat tuesday in the big easy. you have the biggest beads i

have seen. i don't want to know how you got them. >> reporter: and on advice of the counsel, i can't tell you, brent. some people were traumatized, i apologized to them, and i'm told that the therapy should get that image out of their brain. i die digress. the city has been doing cleanup here. i bring up that amount of time because it takes long to clean up a party you have here in new orleans. we have thousands of people up here, mounds of trash. so they are cleaning it up so in a few hours from now more people can come out here to trash it again later because today being fat tuesday. what's interesting this year after talking to the city con sense visitors bureau, they are saying this could be one of the largest mardi gras celebrations ever. now, to give you some idea of what i'm talking about, last year with the super bowl win, they had over a million people. they think they can top that in part because of the weather.

it is child mild. i'm standing in flip-flops here. and mardi gras is later this year coinciding with spring break. you have college kids who decided not to go to the beach and instead came out here to stand on a sticky sidewalk on bourbon street. co who can blame them, right is this. >> this is good news because they have reeling since hurricane katrina. to see big crowds on fat tuesday would be good news for them. >> reporter: it is, absolutely. i talked to the city and convention visitors bureau. they said the fact you are seeing a lot more people coming back is testament to the fact that the message is getting out there that new orleans is rebounding from the hurricane. of course, the more recent gulf oil spill as well. fat tuesday is the culmination of what's been a couple weeks of mardi gras celebration. tonight at midnight it ends. it is not like last night when the party dies down.

it ends at midnight. police come out to shut the street down and get the people out in time for ash wednesday, which is the beginning of lent. >> all right. it is not over until the fat lady sings is how they say it. >> have a good time out there, bob. we know you will. >> reporter: you are killing me. there will be lots of ways to take part in fat tuesday fun. and you can do it here in the bay area. >> yes, fillmore street will be filled with fat tuesday revelers. there's a parade, live jazz music, face painting and beads. the free festivities kickoff at 5:00 and run into the night. and in the south bay the port house bistro has special music in honor of fat tuesday. the tribute to meters will play from 5:00 to 9:00 tonight. but they do expect pretty big crowds because the sharks are also at home. and the poorhouse bistro is a little ways down from the shark tank. and the big easy will be unleashed in oakland tonight.

the zydeco band will be there at 8:00. we are starting off misty and cool here for fat tuesday. >> where bob is in new orleans right now, 65 degrees. that's where we are expecting to end up later today in the heat of the day. but we have a little bit of shower activity, more so for him in new orleans than we are seeing in our neighborhood. boy, i'm happy to not be bob redell's wife this morning. we are looking really good locally as we have some showers pushing into northern california, but they are going to stay out of our area as high pressure is fully in control. you can see this area of clearing. we are going to see a really nice spring-like day across the bay area once we get rid of all the cloud cover and dense fog out there this morning. it is so dense that it is creating a mist in some cities. so you'll probably find slick conditions out there for the next couple of hours. i would say by about 9:30 a.m.

the roads could be a little slick out there, you could see fog, too. >> our thoughts go out to the sokoi family. he was a great guy. we have slowing out of the altamont pass. this is an accident clearing to the shoulder like it says at north flip road. that's the backup out of traci and stockton off the 580 interchange. the dublin area and pleasanton are seeing a benefit with a lighter volume there near the interchange. a smooth drive to the bay bridge. no problems over the bridge itself except for slick conditions from the fog and mist overnight. misty conditions and foggy conditions here as well as 92 heading over to half-moon bay and north to highway 35. thick fog along the coast for highway 101. further in the south bay green indicators are showing speeds close to the limit and above the limit. watch the slick roadways through the south bay. a look at the golden gate, slick

conditions through the north bay. so far, visibility is okay through san rafael. back to you. 5:24 right now. a big insider trading case goes to trial in new york city this morning. scott mcgrew has a lot of silicon valley ties with this. >> it brought down one silicon valley ceo. the guy on trial is roger rotnum. he's one of the richest men in america. he was arrested there. the feds say he paid people here for insider information. his investment company made stock trades in google and e-bay before big news broke. several people in san jose who worked for or for consultants for companies like intel got involved. roger rotnum also got secrets from chip maker amd. its ceo at the time, hector ruiz, just completed a big spinoff. ruiz left the company as the feds discovered the leaks. mr. ruiz has not been charged in

celebration on "today in the bay," march 8th. good morning, everybody. thank you for joining us. the time is 5:29. i'm brent cannon. >> i'm laura garcia-cannon. there's a lot of mist out there this morning. yes, a lot of mist out there. enough to saturate the ground and create sick conditions along the highways. but the bulk of the moisture from the system of high pressure bringing rain showers to northern california is way off to our north. high pressure is in control of our forecast, but what's happening is it is compressing the remnant moisture from the showers we had yesterday morning over the weekend. so we have really dense fog in the south bay where we are not so accustomed to it. temperatures are in the 50s to upper 40s. it is pretty mild. later on today we are looking at some beautiful spring-like temperatures near the upper 60s in some cities. but you have to get through the fog this morning. we'll see what it is doing for

your drive this morning with mike inouye. the fog and mist will be an issue through the east bay sections here of concord and antioch, but the big effect is the volume of traffic at 5:30. we see that kickoff to 40 miles an hour. that's highway 4 in antioch. typical pattern there. the accident is clear here on the shoulder. tow trucks are arriving on the scene, and it is a distraction. 16 minutes before you get into livermore. you are fine heading to the dublin interchange. a live look shows the bay bridge toll plaza. no drama there yet. back to you. in the meantime, we have another update on developing news that we are following in the east bay. an overnight standoff with police in berkeley has ended, but neighbors are still reeling this morning. this after a very long standoff between police and an armed man in the home. police are still outside this morning where it happened. here's what we know. this started yesterday evening around 7:30 with reports of shots fired at a home in the 1800 block of marin. when berkeley police arrived they tell me that the man inside actually fired at them as they backed off and evacuated the immediate neighbors for safety. they called in help, oakland police came out and hostage negotiators established contact with the man to calm him down. they won't say why he was so distraught in the first place, but they entered the home just after 4:00 and found him dead from a self-inflicted gunshot wound, a suicide. they worked hard for a better ending. >> we do everything possible that we can to try and resolve this peaceably. and if that means talking to someone for hours that's what we'll do. we'll sit out here and continue

to try to negotiate to bring about a peaceful ending. >> right now berkeley police say they are still waiting for the coroner to arrive. and they are not releasing the man's name. they will tell us that fortunately no one else was home and no one else was injured. so at this point things are getting back to normal. they are telling me that investigators will be on the scene for several hours. reporting live in berkeley, christie smith, "today in the bay." thank you for the update there. >> 5:33 right now. the fbi is looking for a serial bank robber in the east bay. agents say the chase bank in danville was robbed yesterday and the man got away with $20,000. authorities say a man matching the robber's description robbed a credit union and a hayward bank last month. the family of a murdered traci girl is honoring her memory by reaching out to the community. today would have been sandra

cantu's tenth birthday. they are planning a city-wide event called celebrating traci's children. they will hold free clinics this morning for children 14 and under. two years ago a neighbor killed can true. she is currently serving a life sentence. east bay's law enforcement scandal could impact several court cases. one suspect who is accused of dealing drugs could be back on the streets this morning. the man is charged with selling marijuana and is scheduled to appear in court this morning, but his case could be thrown out because narcotics officer norman welsh investigated the case. he is accused of stealing drugs from evidence lockers and selling them back on the streets. this could be one of many cases that could be tossed. he is pleading guilty to reselling the drugs. he is out on $400,000 bail. this morning police are searching for a thief who went into an east bay church and took a backpack containing a man's ashes.

it happened as his widow prepared for his memorial service at the christ episcopal church in alameda saturday afternoon. marvin's family noticed the backpack missing about 1:30. >> reverend kathy turns to me and says, eleanor, where are the ashes? >> completely surreal. you know, it is the -- you showing up to your father's memorial service and the last thing you expect to hear is someone has made away with the ashes. you know, at the time all you can really do is laugh because going the other direction, it just takes you to kind of a dark place and you just really don't want to go there. >> hockabouts family doesn't know what the value is for the thief, but they just want the backpack returned. a girl was raped four years

ago at a house party, and those accused are free this morning. lawyers made a surprise decision to drop the civil suit against the two. seven other men are still on trial and five of them are former baseball players. the civil trial is underway. a music teacher could be singing the blues if the mount diablo school board plans to cut costs. the school board will discuss eliminating positions of librarians and music teachers. the move would slash nearly $22 million from next year's budget. trustees expect the governor's tax extensions won't make it to the june ballot or it will fail. in total 180 teachers and administrators will be let go if the state funding goes through. the trustees will march vote on march 15th. there could be a special election in june. the city of oakland faces a $46

million budget deficit for the fiscal year beginning in july. mayor jean quan hopes voters pass the $80 temporary parcel tax to help cover police and fire services, parks and recreation as well as youth services. last night five city council members agreed to put the proposed tax on the june ballot if the governor is seeking that. you may be paying more at the pump and not have a choice about it. this morning we have new information from one forward-thinking automaker that could change the way we drive. called the model s sedan. and there are various models to fit various pocketbooks. at the top it is the signature series sedan priced at $77,000. now, here's the kicker. it comes with a 300-mile battery. so that means drivers will get 300 miles out of a single charge. that is huge. now tesla says there will be a mid-level model that will last about 230 miles. then the basic model of about $20,000less than the top version running at160 miles. each comes with a tax credit. it is a slick looking vehicle. i like it. it goes from zero to 60 in less than six seconds. production here will start in

this morning lawmakers trying to avoid a shut down are shooting for a done deal. the white house suggests a two-week extension could spell trouble for business. "today in the bay's" tracie potts is live in washington with what a budget delay means for the economy. >> reporter: hey, laura. good morning. the white house is now saying that if, in fact, democrats and republicans can't come together to come up with a permanent way to fund the budget for this year, it is this year's budget

that we are talking about, then that leaves a lot of up certainty, continued uncertainty for businesses. and that is not a good sign for an economy that's already in a fragile recovery. so where we are right now, democrats today in the senate expect to vote on a plan to cut about $6 billion from the current budget from spending. republicans want to cut $61 billion. they have approved that in the house and will vote on that today in the senate. neither one of these is expected to pass. the white house has jumped in the middle trying to bring them closer together, but now that vice president biden is out of town they have senior staff overseeing that process. and interestingly, even some democrats say the democratic plan doesn't go far enough. but they don't like the republican plan either. so neither one of these are expected to pass today. it may at the end of the day be a situation where we are almost back at square one. >> thank you very much, tracie. new information this morning about how accusations against

san francisco narcotics officers is affecting several other court cases. city prosecutors now dropped the fourth case involving a group of narcotics officers who were seen in this new video. the surveillance video surfaced last week allegedly showing plain-clothes officers conducting illegal searches. the officers were accused of falsifying police reports. the fbi and the department's top members are investigating the allegations. this morning the catholic church is being asked to put a tighter watch on priests accused of child molestation. those abused by priests say dozens of the accused priests in california are living in monitoring near day cares and schools. they are calling for police to track them like sex offenders. church officials say since they have been removed from active ministry the church has no oversight for former priests. san francisco city leaders are trying to raise awareness about elder abuse. the new district attorney george

kas gascone will be joined by advocates of the elderly to launch the new public service announcements this afternoon. more than 17,000 cases of abuse were reported in san francisco county in 2008. 5:46 right now. today is election day for at least 3,000 people in the south bay. they are voting on a measure aimed to prevent overcrowding in the santa clara unified school district. the measure would levee an annual special tax of $19 on homes in select parts of the district. the money would help maintain neighborhood schools. the ballots must be received by 8:00 p.m. right now let's check in with christina and talk about the weather here. hopefully it will dry out later today, but right now it could be a little misty out there. >> yeah, but this is where we are headed. we'll bring you good news before the bad news this morning. we are talking about partly cloudy conditions. it is going to be a gorgeous day across the bay. in fact, we are transitioning into spring right now, the first official day of spring is on the
