today we begin with out maneuvered. the three-week standoff in wisconsin over a measure that would deal a huge blow to public unions has come to an abrupt end after a stunning move by republicans. until yesterday, republicans state senators couldn't pass governor scott walker's proposal because under the rules they were just one democrat short for the vote to happen. that's because all 14 minority democrats had fled the state in order to prevent a vote on the measure which would strip nearly all collective bargaining rights from public union workers. but on wednesday, republicans managed to push the plan through by resorting to a procedural maneuver that removed parts of the proposal related to nonspending measures. using that tactic, republicans contend the vote could take place without the missing democrats. assembly minority leader peter barca tried to fight the surprise move, arguing there wasn't enough notice. >> representative barca --

>> yeah. >> the gavel. >> clerk, call the roll. >> no. >> any doubt as to whether good cause exists the governmental body should provide 24 hours notice. this is clearly a violation of the law. you've been shutting people down, it is improper for you to move forward with this is a violation of the opening meaning law. >> barca says he will refer the maneuver to the attorney general and will meet with democrats to seek other ways to stop the action. the passage prompted crowds of protesters to swell into the capitol. for union workers, the bill means they will have to pay more towards their pensions and health insurance. the governor claims it's necessary to balance the budget. elsewhere, severe thunderstorms are threatening portions of the mid-atlantic and carolinas today with some areas expected to be battered by up to four inches of rain. further south, the governors of alabama and louisiana have both declared states of emergency after a strong system, including tornados, tore through that region. nbc's kurt gregory has the latest.

>> reporter: a line of violent weather ripped through the deep south. tornados reported in mississippi. michael bankston was inside his house when tremendous winds struck. >> it didn't take but a couple of seconds when i started hearing the windows blow out that i knew something major was going on. all the windows just started blowing out. >> reporter: three-quarters of his house was destroyed. in alabama, more reports of tornados near mobile. a gas station and grocery store sustained heavy damage. up to 17,000 people without power.cc1: three twisters reported in louisiana, including one that threw a woman from her home. she escaped with minor injuries. more than 3 inches of rain in 30 minutes flooded streets in new orleans. and flooding is on the minds of many in new jersey. residents nervously watch and wait. >> what are you going to do, you know? you can't fight with mother nature. >> the passaic river has chased

good morning, and welcome back to "early today." i'm lynn berry. here are some of your top headlines this morning. the senate has rejected a house budget plan with deep spending cuts as well as a democratic alternative with milder reductions. white house officials say the votes should turn a page and lead to more productive talks to fund the federal government for the rest of the year. illinois has become the 16th state in the country to abolish the death penalty. governor pat quinn signed the landmark legislation into law yesterday and then commuted the sentences of 15 inmates who had been on death row. six other states are currently considering a similar move. the dalai lama says he will give up his political role in tibet's government in exile, shifting that power to an elective representative. the 75-year-old, who will retain his more significant role as the movement's spiritual leader, made the announcement on the 52nd anniversary of the tibetan uprising against chinese rule.

french police say they've recovered about $20 million worth of jewelry stolen from a harry winston jewelry store in paris in 2008. the julgs were found at the home of the robbery's suspected mastermind in a drain pipe. and a smithsonian volunteer has uncovered what the museum believes are the first and perhaps only color photos of san francisco after the massive 1906 earthquake that nearly leveled the city. the never-before seen images were taken from the roof of a hotel several months after the great quake. here's a a look at how wall street will kick off day. the dow opens at 12,3213 after a shedding a point yet. the nasdaq dropped 14. taking a look at overseas trading in tokyo the nikkei sank 155 points in hong kong the hang seng fell 195.

stocks stumbled wednesday as investors worry about the long-term effects of a possible oil crisis. investors still on edge about the conflict in libya pushed the price of brent crude above $116 a barrel overseas. here at home an increase in u.s. supplies kept oil prices in check wednesday. still, some investors were optimistic on the two-year anniversary of the market's bull run since hitting historic lows in 2009, the s&p has more than doubled. it turns out to be a big day for ibm. big blue stock hit an all-time high thanks to an analyst upgrade. retailer bon ton jumped 10% after reporting a sales bump in stores open for at least a year. american eagle outfitters added fourth quarter cc1: earnings estimates. texas instruments took a 3% hit after a weak quarterly outlook after the bell tuesday.cc1: wall green shares got a boost of1: itsouncing the salecc pharmacy benefit management business for $525 million.

plea deal. the same website reports tomorrow will be mel gibson's day in court for plea bargaining. he will reportedly plead no contest to a sim. battery charge stemming from an argument from his former lover last year. in doing so, gibson would avoid jail time and a prolonged court battle. and finally, it's big change from tina fey. hbo announced it was cast the recently oscar nominated actress julie ann moore to play sarah palin in "game change," an account of the 2008 presidential race. where sarah palin was john mccain's running mate. what do you think? >> she's a great actress. i'm sure she can pull it off. i think the access has to be tough. >> you bet cha. >> i think they're going to be able to do her up and make her look the part, but it's going to be interesting whether or not she's going to be able to pull off the nuances, you're right. this comes to us from kxas, nbc 5 in dallas, texas, where

firefighters had to dig deep to save a dog trapped in a peculiar place. rescuing molly was not easy. the yorkshire poodle got stuck after crawling 15 feet under the concrete deck of the family's pool. using high-tech, heavy duty equipment, fire fighters pinpointed her location and spent the next few hours clearing out cement and dirt to free molly. of course bringing lots of relief to a family that thought they lost her. you have a dog, ginger, so that -- >> i do. >> hits close to home. >> he's done weird things too. had a tuna fish can lodged in hours.th for 12cc1: >> 12 hours? >> his tongue was compressed in there. i was at work. when i came home there was tuna drool everywhere. >> poor thing. i'm lynn berry, this is "early today," your first stop of the day, today, on your nbc station.

counting sheep just got a little easier in canada. that's where quintuplets made their debut monday morning. the mcphee family got quite a surprise when one of their sheep cherry, a triplett herself, gave birth to five babies. and something must be in the water there. cherry already had two sets of triplets.cc1: that's left the family with quite a flock to care for. more proof robots are gaining ground. a slew of students in china showed off their robot inventions. some are used for detection and reconnaissance on dangerous terrain, others made for faster assembly lines and even one with bionic skills allowing it to climb walls like a gecko. the breakthrough is all due to
