in a live report. and a live look outside at the beautiful bay bridge this tuesday morning. we are going to get a break in the rain as well. what's with all the b's? it is tuesday, march 22nd. this is "today in the bay." sometimes tuesdays are harder for me to wake up. >> yeah, the residual rest from sunday then tuesday. >> we'll get through it. >> good morning. i'm laura garcia-cannon. >> i'm brent cannon. is the speak-easy on these days? we have showers pushing through the east bay right now, but take a look at this. very spotty in nature. this is all residual moisture. it will come to a close before this morning is over. i think in about a few hours we'll see sun and clouds and a mostly dry bay area. that will last until about 5:00. then our next storm system arrives in the bay area.

this one is packing a punch. we have a stronger one on the way for tuesday. we'll break it all down for you, but first we'll get you to work with mike inouye. thank you, christina. we'll take you to the overview of the maze. a lot of concern for the folks this time of the morning, but no reason to be concerned. aside from one factor we have been showing the bottom of the screen, 880 coming up from the coliseum, the live shot shows you what things are like right now. the taillights we saw jammed up at the coliseum just in the last five minutes or so. the rolling traffic past the coliseum, i chapped with our partners at chp, they are moving construction at 23rd. just watch for a little slowing heading into downtown. we'll also watch the effects of the weather in the reports coming up. certainly, mike. with the rain one of the other things we are keeping an eye on is the napa river. the past few storms dumped a lot of water into againville and the napa rivers. it has saturated the ground and the river levels are being closely monitored. levels are considered normal right now. however, around midnight last

night the weather service had the napa river at monitored stage. the river has flooded before. in 1986 two people were killed, 400 homes were destroyed and hundreds of others were damaged when the river overflowed. the bay area is not the only place experiencing some strange weather. take a look at this video of a funnel cloud in the skies just north of sacramento. several schools were put on lockdown yesterday afternoon but were not evacuated. so far there are no reports of significant injuries. there are still some questions about the sanity of a bay area teenager who attempted to kill the teacherses at his former school. 18 yield 18-year-old alex ushock never thought about taking ten pipe bombs and a samurai sword to his high school with the intent of killing teachers. the prosecution begins its rebuttal tomorrow. if he's found guilty of any charges then the same judge and

jury will have to determine his sanity. closing arguments are expected today in the case of the professional poker player accused of killing husband own parents for inheritance money. ernie scherer iii claims he was asleep on his couch in southern california instead of killing his participants. he is accused of driving from las vegas to pleasanton in 2008 and beating his parents with a baseball bat. he was deeply in debt and wanted to claim his $1 million inheritance to pay the debt. scherer says he's not guilty. turning to the latest in japan, work resumed at the fukushima nuclear plant. workers are hooking up electrical systems and trying to repair damage to critical cooling units. officials say restoring electricity will not automatically solve all the problems though it will, in theory, run the motors and valves that keep delivering cool

water to reactor cores. in the meantime, japanese nuclear officials figured out what caused steam to erupt from the plant yesterday. high temperatures in the spent fuel pool have apparently caused the steam. it is another complication. if the water in the pool bubbles away and exposes fuel rods, more radiation will be emitted. the big quake hit off the coast of japan early this morning. a 6.6 struck just after midnight. about 182 miles east/southeast of sandai. no reports of injuries. the numbers out this morning show 8,900 people were killed by the quake and tsunami that originally hit. 12,600 people are missing although police say the two numbers can kind of be confused with each other and overlap to some extent. they do expect the final number of people killed to exceed at least 18,000. escaping the dangers from the japan quake, hundreds of families living in japan will

touch down this morning landing at travers air force base. christie smith is joining us live from the base this morning. that's a lot of families coming in. >> reporter: yeah, good morning to you. the first flight from japan is expected to arrive here in 30 to 45 minutes at travers air force base carrying hundreds of service members families. they evacuated voluntarily from japan. they are going to be met here this morning by military representatives from travis air force base who will help them with the temporary placement and food, that sort of thing. trying to get them settled. this is all part of the ongoing efforts to try to reduce the demand for food, water and fuel, electricity, that sort of thing following the massive 9.0 earthquake in japan that has displaced hundreds of thousands of japanese citizens. and many service members feel it is just much safer for their families to be here with the ongoing nuclear crisis in japan.

the u.s. is still sending supplies to the japanese region to help them recover. and many service members are staying there to help unload those supplies. now we are told the air lift to travis is the second u.s. location. residents have been arriving in seattle since saturday. two chartered flights are expected in here this morning. the first at 5:45, the second at 9:00. and we are told that these flights will be ongoing for the foreseeable future. reporting live at travis air force base, christie smith for "today in the bay." thank you, christie. people in tokyo are trying to get back to usual as commuters return to work after a week-long disruption that followed the quake and tsunami. many of the 13 million people in the city stayed inside last week because of radiation concerns. tokyo also suffered from rolling

power outages. we hear at nbc bay area would like to take time to thank you for your support during the friday telethon for japan. new count this is morning show we raised a lot more than first thought. almost $768,000. we appreciate all your help. the need is ongoing, though, and if you could not help on friday or still want to give, you can. the american red cross is accepting donations. you can go to redcross.org or text redcross to 90999. each text will donate $10 to the red cross's humanitarian efforts. san jose is the largest city in the u.s. without fluoride in its drinking water but that could change today. the water district will hold a hearing today to talk about retrofitting the water system. lit cost $23 million to do it but proponents say it will save more than $100 million in dental expenses. water customers will pay for it if it happens through an increase in their monthly bill. the time is 5:07.

is spotty activity. definitely enough to get the roadways slick, especially in the east bay where the moisture has been coming through over the last hour or so. the major storm arrives tonight and will push into the north bay heading through 6:00 p.m. tonight. and that rain will spread south as we head through the overnight hours making for a really dangerous commute tomorrow morning. when we are talking about accumulations we have another storm on the way. when it comes in on thursday, look at what we are expecting. this is no joke. this could potentially cause flooding because the two storms back to back are going to produce up to five inches of rain in some spots. as you can see here it is not just the north bay that's going to get a lot of the rain, it is the south bay, the peninsula will see heavy rain as well. so you just want to keep this in mind. as i said before, clear out your storm drains if you haven't done so already. we are going the tell you when this rain is expected to break. and i've got good news for you. high pressure builds in next week. we'll see a dry spell next week. we'll detail that and the two storms coming in coming up. right now we'll get you to work

on time with mike inouye. good morning, christina. we are talking about work, i'm glad you think high pressure is good for weather because we are not focusing on the pressure at work, we are focusing on getting there. antioch is showing a 65-mile-per-hour drive through elle street. yesterday we had an accident near harbor, but no accidents here in the south. we could see wet roads for 580 out of the altamont pass. speeds are dipping near 53 coming into livermore. so in the upper 50s as you approach airway boulevard and vasco road. the zero through sunol, you see a flash of. that that's not accurate, that's near 60 coming up across the bridges. the dumbarton construction in the eastbound direction has picked up. the san mateo bridge, we'll take a love look out there. a little trouble with the camera, but not a big issue.

here's a live look at the sunol grade. things are moving smoothly through the area, but we have things to show you concerned the commute. we have more on your weather in just a bit as well. a recent report says over 10% of california schools are in financial trouble. the state's superintendent released a report that shows 13 school districts have negative certifications, meaning they may not be able to pay their bills through the end of next year. hayward and johns worth in the east bay were included in the list. emory and diablo were able to stay off the list for now. the state takes over financial duties when a district is given a negative certification. news this morning that the state's largest health insurer is going to lower and delay its plan rate increases this year. a move that should save

policyholders $40 million. anthem blue cross will push their rate hikes scheduled to take effect april 1st back three months to july 1st. it will also reduce the rate hike from its original proposed 10% average increase to about 9%. the changes are expected to benefit about 600,000 policyholders. the move comes days after blue shield of california abandoned its proposed hikes for the whole year. >> a national debate over collective bargaining rights is the focus of a three-day convention that starts today in detroit where 1,200 united auto workers are going to gather to talk about contracts that expire with gm, ford and chrysler this fall. cnbc's courtney reagan is following all the news developing throughout the day that will affect the money this morning. we want to check in with her who is live at cnbc headquarters. good morning. >> reporter: hi, good morning, brent. futures are trending high they are morning following yesterday's nice rally when investors cheered the m&a action

with at&t buying t-mobile and charles swab buying up energy express. crude oil is hovering near $103 a barrel. the last time i peeked over here we were just about 5 cents below the mark amid the continued unrest in the middle east. well, some of the worries over libya and japan's nuclear crisis also appear to be fading, at least slightly. japan's market shook it off rising more than 4% today. europe is now mixed but we were higher earlier. the dow rose 178 points monday to begin trading today at 12,036. the dow did have the best three-day run since september. the nasdaq added 48 points to 2692. well, it is back to the future, sort of, for the world's largest retailer. walmart has been seeing a sales slump the past two years losing market share due to smaller dollar store rivals. they plan to fight back by

bringing back walmart's every day low prices formula. he also hopes to raise walmart as a one-stop shopping destination by adding more products. hard to believe they can do that, but i guess they can. uniteded and continental are raising flights on u.s. flights by $10 roundtrip. sound like a broken record because that's the eighth attempt by u.s. airlines to hike fairs this year. if it holds it will be the seventh successful one. they wouldn't give a reason for the hike, but most of the hikes have been blamed on the rising price of fuel. back to you. it is costing us more in everything. thank you, courtney. >> $10 here, $20 there. >> everything is going up, except for my check. let's check the forecast right now with christina. >> good thing you have three little ones to pull that chariot for you eventually. i saw the cutest pictures of the

triplets yesterday. hopefully we'll get them on the website so you can meet the triplets soon if you have not yet. we are looking good in terms of what we are expecting today. finally a dry break, not just yet, but we have to wait a couple hours before the residual showers subside. as you can see, it is already clearing. san francisco, you have this little cell bull's-eyeing your area. but for the most part showers have cleared the east bay. a little bit of moisture coming down over the east bay hills just to the east of antioch this morning. but we are going to continue to see clearing. that will last for today. then there's rain on the way for tonight and a lot of it. we have two systems on the way. this one is a strong system to bring maybe two inches of rain at best to the north bay. it is the second one that's right on its heels coming through on thursday. the two combined could create some pretty bad flooding around here. we'll watch these very closely for you. go ahead and keep in mind dangerous commute tomorrow morning with a lot of rain coming down overnight. 43 degrees in san mateo. 46 in sunnyvale. turning over to the upper 50s

people who use a north bay transit system may soon have to dig a little bit deeper into their pockets. the golden gate bridge highway and transportation district will meet today to look into increasing fares 25% over the next five years. they hope to close an $89 million deficit. if that plan passes, then buses

and ferry service would start to see higher fees as early as july 1st. and it would be the 14th straight year of fare increases for the district. >> across the board fare increases it seems like. i want to do a story that says, hey, folks, you are going to get some money back today. maybe look in your coat pocket. >> you get a ferry ride. you get a ferry ride. >> yay! all right. well, i can't be quite that dramatic, but we do have a nice flow of traffic through the south bay. you have a sensor, you get a sensor, all of them are close to the speed limit coming through the south bay. and the santa cruz mountains get a break like christina is talking about. we are watching out tomorrow as the rain coming comes in. construction has picked up here, but there could be a slowdown near the chick let. the peninsula drive is moving very nicely. crossing the bay from oakland,

this is a shot from the toll plaza. volume is picking up over the last 10 to 15 minutes. the east shore freeway, the time we are looking at, it is just an 18-minute drive off the cartinas bridge with a smooth drive for interstate 880 as well as 680 down to the walnut creek interchange. the wider view of the maze shows you no major slowing including coming through the walnut creek interchange. and 24 out of lafayette is a nice flow so far. again, this is just as the commute is kicking in. we are also watching the east bay commute. back to you guys. a stronger show of force could make its way to the libyan conflict. the british parliament is supporting the use of armed forces to enforce a u.n. resolution to use all necessary measures to protect civilians in libya. the u.n. also rejected libya's request for an emergency meeting to stop the air strikes. in the meantime, the u.s. is looking to extend the reach of a no fly zone to the capital of tripoli in the west. ed to today marks the third

straight day of air strikes on the country. not everyone is onboard with air strikes in libya. china is calling for an immediate cease-fire and talks to end the violence. it was one of five countries to abstain from last week's vote on the u.n. resolution authorizing force. president obama's tour of latin america continues this morning. he will meet with el salvador's president today to talk about several issues but the main focus will be on immigration. el salvador has one of the central american highest rates of immigration into the united states. an estimated 2 million of them are in the u.s. currently. you can see how much radiation is leaking from the stricken nuclear plants right on the web says scott mcgrew. >> a company out of portland put this website together matching up google maps with radiation

weather. an update is next. and a live look outside at the bay bridge this morning. hey, look at that, no rain, at least for now. it is tuesday, march 22nd, "today in the bay." and good morning, everybody. thank you for joining us. i'm brent cannon. >> i'm laura garcia-cannon. let's get started with a look at the forecast. i think we are getting a break in the storm, right? yeah, we are going to get a little bit of a break today. good morning to you. we do have a little bit of residual activity coming through the bay area right now, but it is not by any means strong. we don't have any thunderstorms to tell you about. and just a little cell here headed towards san francisco, a little bit of activity lingering in the east bay. but overall, we are continuing to see that clearing effect. that's good news because this morning we are going to get a nice break. it will last until about 3:00 p.m. or 4:00 p.m. for the north

bay. in the south bay you'll get a break until 5:00 p.m. then our next weather maker moves in. i'll let you know just how much rain we are expecting and when it is expected to hit your city coming up. but first, we'll get you to work on time and show you what shower activity we have right now with mike inouye. good morning, christina. we know when the slowing will hit this city, antioch. the chiclets changed before the average speed sensor changed near horizon lane. we are zooming in to see this area from g street over to mar boor street. that means speeds are near 55 getting closer to 50. this is the 5:30 kickoff we typically see. we are watching for slowdowns as well as the san mateo bridge. we are watching for changes here. a smooth drive with volume picking up. a wind advisory for the bay bridge could mean problems for the san mateo bridge later on. back to you. opening statements today in the highly-anticipated case of barry bonds. damian trujillo is live outside the courthouse in san francisco

with more on today's events. >> reporter: good morning. the opening statements begin at 8:30 this morning where the prosecution lays out its case against barry bonds. and they have the birden of proof. they have to prove to all 12 jurors that bonds intentionally lied to the federal grand jury. now, not much drama during yesterday's selection of that jury. the process that normally takes days, not hours. both sides selected four men and eight women to try barry bonds. he's not charged with using steroids. bonds is charged with lying to the grand jury looking into the balco steroids investigation several years ago. bonds has hired a high-powered defense team led by san jose's alan ruby who said there's nothing difficult about selecting this jury in less than a day. >> the process was impeccably fair. and i look forward to trying the case starting tomorrow before this jury. >> reporter: greg anderson will be here today around 11:00.

he's bonds' personal trainer who is again expected to refuse to testify. that means he could go back to jail for that refusal until this trial ends. barry bonds usually arrives a half hour before the trial is set to begin. and usually it is with a heavy security presence. live outside federal court in san francisco, i'm damian trujillo, "today in the bay." thank you, damian. testimony could begin today in the high-profile trial of two men accused of shooting and killing oakland journalist chauncey bailey. one prosecutor says the case against former leader of the black muslim bakery yusef iv is on trial and it is expected to last three months. now to the latest on what's happening in japan this morning. crews are back to work after

smoke triggered an evacuation yesterday at the nuclear plant. a storage pool holding 2 tons of older spent nuclear fuel is heating up forcing teams to divert water on other reactor there is. if the pool begins to boil radioactive steam could spew out. nerves in japan are on edge after another quake. a 6.6 magnitude quake struck just after midnight our time. about 182 miles southeast of sandai. no reports of new damage or any injuries. we are also getting new numbers out of the disaster area this morning. 8,900 people are dead. 12,600 are missing. police estimate the final number of people killed will exceed 18,000. and the body of a 24-year-old english teacher from virginia was found in the reckage of the tsunami. taylor anderson could be the first american casualty found in japan. people are going to gather

2006 but work has not yet started. highway 1 in big sur won't be open until the middle of april. the state department of transportation will take until at least april 16th to repair the roadway. last week a portion of the roadway crumbled just into the ocean. look at that gap hole. the road was closed just north of big sur 15 miles southeast of caramel. drivers should take highway 101 and highway 46 to get to big sur from the south. the sierra has been getting pounded with lots of new snow, but that means travel into the high country is nearly impossible in some places. in fact, the yosemite valley is cut off, you can't get in or out. all roads leading into the national park are closed. they have seen snow, ice, mudslides, fallen trees, downed power lines, just about everything. the latest winter storms have dumped more than 3 1/2 feet of snow in the yosemite area. visitors stuck inside the park were finally taken out yesterday. there is no word on when any of

those roads might reopen. but the snowfall is still coming down in other parts of the sierra as well. look at that. some places are trying to figure out where to put it all. ski resorts are seeing impressive numbers. heavenly in south shore has 61 new inches of snow in the past week. north star in lake tahoe is reporting 52 new inches. interstate 80 and 50 are open, probably because of things like the video you are seeing here where they are clearing the roads. but do keep in mind if you go up there you will need chains or four-wheel drive. i know lots of folks who tried to get up over the weekend and couldn't make it up. partly due to the snow and the accidents. >> i think you need a snowplow to make it through. >> and snowshoes and cross-country skis. then make maybe you can get through. let's check the forecast now with christina. >> if you go up there today you have the chance of not being able to get back out of the tahoe area because we have two

really strong spring storms on the way. both are packing a punch. the first one moves in later tonight. meanwhile, we are still seeing the aftermath of this storm that came through yesterday. a little bit of residual shower activity this morning pushing into san francisco. san jose had a little bit of a sprinkle. now all the activity is winding down. we are still on track for a bit of a dry break today. that's what we are expecting between the hours of mostly 9:00 a.m. and 3:00 p.m. up in the north bay. maybe 5:00 p.m. in the south bay. that's when you are going to get a dry break. if you have been putting offthe outdoor plans, you can attend to a couple today before the showers move back in. san francisco is getting a little bit of rainfall pushing over to you in oakland. if it is not already raining at your house in oakland, count on that in the next five to top minutes. the low pressure system, a strong one, will bring two inches of rain to the south bay peninsula and the east bay. maybe three inches in the heaviest spots in the north bay.

the big concern is we won't have any time to dry out. maybe about five or six hours between the next system, a stronger system that pushes onshore as we head through thursday. today let's focus on the good. the here and the now, the dry break we are getting. 43 in san francisco and san mateo. turning over to the mid-50s later today. the upper 50s in the cities that get the most sunshine. after that the rain moves in tonight. it will be a stormy evening. then tomorrow morning we have to get to work through all of that. mike, what are we facing out there right now? with the drive on the roadways for the cartinas and venetian bridges, i take you up here. note the vallejo ferry. the 7:00 and 8:30 a.m. ferries are out of service. you'll be provided with a vallejo transit bus instead. keep that in mind, the corresponding 4:00 and 5:15 ferries are also canceled through the area. the traffic flowing on the bridges is moving nicely in the commute direction, westbound for

it is 5:42 right now. after another night of attacks over libya, many are wondering why the u.s. got involved in this conflict. and this morning the president is under attack for what some are calling an unclear mission. "today in the bay" ice tracie potts is live in washington with the very latest for us. good morning, tracie. >> reporter: hey, laura. here's the latest news, first of all, the f-15 fighter jet that went down last night in ben ghazi, both pilots ejected safely. they are in u.s. custody with minor injuries and it was a mechanical failure, not that the plane was sht down. here on capitol hill president obama is facing criticism from democrats and republicans over what they call an unclear mission. lots of questions, like what is the purpose of this know fly zone, how long will we be there, is our mission to take out moammar gadhafi?

the president said he must go, but that's not the point of this mission. and who are the rebels we are assisting? could some of them have fought against american soldiers in iraq? lots of questions being asked this morning, not to mention lawmakers frustrated that president obama did not come to them first. some democrats and republicans say he overstepped his congressional authority. finally, after a third night of attacks the u.s. commander on the ground there, the u.s. commander there in libya, is saying that they are now looking at expanding that no fly zone towards the capital of tripoli. >> so much going on and so much to watch. thank you, tracie. a south bay shooting has become a murder investigation now. the man shot outside a crowded mcdonald's has died. reuben cortez jr. was shot in the chest at point-blank range wednesday afternoon in the parking lot of the mcdonald's near san jose city college. the gunman is still on the loose and police have not arrested any suspects but they believe the

shooting was gang related. what looked like a pipe bomb in a livermore neighborhood turned out to be something completely different. livermore police shut down a local street for two hours yesterday morning after a neighbor reported what looked like a pipe bomb lying in the street. talking all necessary precautions, they determined the pipe was not filled with explosives but rather marijuana. pg&e faces fines of a million dollars per day for failing to turn over safety records. and this morning the utility says it may take the rest of the year to track down those documents. pg&e made that surprising announcement yesterday. the california public utilities commission had asked for the records at the beginning of january. there is a hearing scheduled for monday to discuss the proposed million-dollar fines. this past september the pipeline explosion in san bruno killed eight people and destroyed 28 homes. one way or another there will be tax extensions and increases on the june ballot. that is the word from governor jerry brown this morning. at a dinner last night brown

called out republicans for failing to vote for the tax package. just two republican votes are needed in each house to place the proposed measures on the june ballot. so far no republicans have stepped forward. during last night's speech brown said, quote, if you're not going to vote to extend taxes, if you're not going to vote to cut, if you're not going to vote to eliminate redevelopment, so what the hell are you going to do? by the way, if you're not going to do anything, why do you take a paycheck? that's jerry brown, in end quote. there's no official stadium deal for the 49ers, however the city of santa clara is handing out cash to the team. city leaders gave $4 million out yesterday so that prep work could start in the great america parking lot, which is the proposed site of the new stayed gym. they are rushing things along in order to try to protect money from the state. funds have been set aside for that project for several years.

however, under governor jerry brown's new budget plan the state could then raid those kinds of funds. santa clara plans to pay for part of the $937 million stadium project with redevelopment money. i want to check the forecast now with christina. a little break in the rain, but still a rainy week. >> yeah, a little break for today. overall we are looking towards a lot more rain heading through tonight. another storm pushes in early thursday, both will impact your morning drive. so as we can see right now, things are looking pretty good considering what is to come. we have temperatures right now in the 50s in some spots in the east bay. you are at 50 in oakland. 46 degrees in concord. upper 40s in hayward. all of these numbers aren't going to be able to climb all that much today because we are going to see a fair amount of cloud cover. however, we are going to stay nice and dry for the most part today, which is great news. we do have more showers on the way. and rain intensifying as we head through tonight. 58 degrees, sun and clouds.

tournament taillight. tipoff for the game is 7:00 this evening. on the women's side of the ncaa tournament, how sweet it is to be a cardinal fan this morning because stanford women are headed to the sweet 16 for the fourth time in a row. they dominated st. john's last night. so the lady cardinals will play north carolina coming up on saturday. good for them. we have an update now on the family's trapped by a landslide on the santa cruz mountains. bob redell is here with more on the progress to clear the roadway. >> reporter: for roughly 60 people who live on the other side of this rock slide, the only way in and out is by foot. no cars and it could be this way for several days. we should get a better idea later this morning when a geology is expected out here to assess how to remove the mess here on the road. the problem is the slide could still be moving and more rain is on the way, which would further delay the cleanup. the slide started yesterday

morning with a few rocks. then early in the afternoon this happened. as seen in this iphone video, the slide escalated taking out a large tree and power pole. the movement was so fast, so immense, people hauled out of there because they weren't sure where it was going to stop. when the rumbling was over, everyone was safe. the slide, though, had completely covered the roadway. from a helicopter view you get a better sense of the power. by one estimate, the slide rose to 30 feet in height at 200 feet in length. >> it was so powerful. and the sound was horrific. and it is just unbelievable to see that amount of rock and trees and just trees dropling like matchsticks. >> reporter: for the people living in the homes behind the mud slide, this is that patway i was mentioning to you.

an environmental organization is celebrating half a century protecting and restoring the san francisco bay. save the bay will hold a memorial planting for one of its founders along the oakland shoreline later on this morning. that organization was formed back in 1961 to stop massive bay-filled projects dumping raw sewage into the bay and protecting local ecosystems. save the bail recently worked with the city of san jose to ban single use plastic bags. 5:54 right now. let's check the morning commute now with mike. >> good morning. we'll take you to livermore where we see a slowdown on the other side of the screen. it is on the right side of the altamont pass. 15 minutes registered on the travel times. overall, the 60s are holding nicely near the dublin interchange. this is highway 4. the 20 is registering at l street with the extension of the slowing over to love ridge. typical build for that portion of highway 4 as folks come off the antioch bridge.

as you get over to the bay bridge toll plaza itself, a pretty smooth drive at the toll plaza. the volume is targeting to pick up. no major backup and no metering lights are coming down the east shore freeway. we also have a nice flow off the cartinas bridge. an 18-minute drive, but i want to call out the ashby sensor. you are tapping the brakes down through berkeley through emeryville. from the south approaching the bay bridge, oakland is looking good. 880 is picking up the volume. a little slowing near high street. but that's typical for the area. no major issues. back to you. what's in a word? scott mcgrew says a lot if the word happens to be app. >> yeah, you think app is one of the high-tech words nobody can claim, but apple says it is all apple's, at least when you are talking app store. apple is suing amazon over the phrase appstore and in the process giving amazon a lot of publicity. did you know amazon had an appstore? now you do.

meanwhile, microsoft is suing barnes and noble saying many ideas behind the nook are microsoft's. it was unable to come to a licensing agreement with the book seller and was left with no choice but to send in the lawyers. and we are not done yet, a bunch of former netflix users are suing that company claiming netflix keeps users data, including credit card numbers and what movies they rented after a user cancels his or her netflix account. offhand this may not sound like such a big deal, but records of what videos you rent are actually protected under a special law which was put in place back in 1988. somebody got aheld of a supreme court nominee robert bourke's rental history and published it in the newspaper. congress passed a specific law saying that you can't do that shortly thereafter. >> interesting. what you rent is private. the time is 5:56.
