and today is going to be one of the nicest days in sometime. nicer than yesterday if you enjoy the warmth, we're talking about temperatures in the mid 70s to low 80s. we're going to break it down, let you know how warm it is expected. you might want to grab a jacket. we're in the low 50s. let's see how fast you're able to drive at 5:00 a.m. now with mike inouye. >> hey f for legal purposes i'll say 65. that's how fast. look at this, 67 and a 68 showing up through this portion of your east bay commute. antioch hasn't shown that. lighter volume but yesterday was light. highway 4 not showing that yet. the earlier sigalert at the castro valley it's cleared but that's a hot spot. we'll follow that and this construction on 92 set to clear. i'll wait for confirmation on that. >> mike, following breaking news out of san francisco where a fire injured several people at

an apartment building at 19th and lawton where our christie smith s. what's the latest? >> reporter: good morning. that overnight fire forced dozens of residents right out into the street where we're standing with just the clothes on their backs. they were huddled and blankets standing around waiting for word. in the last ten minutes or so they were let back in the building to check on their units and gather belongings if necessary. this is a three-story apartment building on 19th and lawton. firefighters say it was a single alarm fire caused by a pot left burning on a stove. damage was actually contained to just that one unit. when they arrived they say just about everyone evacuated. most of them but not all. >> able to keep about it 500 gallons to do the actual knock-down of the fire. it was pretty uneventful once we

got to the seat of the fire. fortunately there was no extension beyond the unit. >> what was it once you got inside? a pot on the stove? >> yes. it appears after talking to the residents that there was a pot left on the stove. >> injuries? >> we have one transport, smoke inhalation, and then we have two other people that we looked at and recommend that they get medical attention. they are going to go on their own. >> reporter: at this point a few units we should mention had doors broken in by firefighters to make sure that everyone inside got out. there are 30 units in the building and red cross is helping those who might need it. that should be the a small number because the fire was contained. lawton behind me, shis blocked at 19th avenue. 19th is back open and they should be out of here in about

30 minutes. reporting live, christie smith, today in the bay. >> thank you. the governor is expected to end the state's drought emergency today. he will make the announcement after the final sierra snow pack report. even though the drought order is being lifted the state says that people need to continue to conserve water. >> a neighborhood cut off after another mud sly took out the only drivable road into a small neighborhood on croix road west of downtown morgan hill. huge red wood trees, mud blocking the path. people can use a four-mile-long fire trail on the top of the ridge. >> we're in for a sunny stretch, the rain has laeft dark cloud. san jose homeowners on edge because of a land slide. marla is live with the woman's story and what the county is

doing. good morning, marla. >> reporter: good morning, laura. we're on almaden road in almaden valley. they live on a deadend hillside road, probably five to ten homes. this woman is at a hotel out of fear of that land slide. look at this. this is the problem in this neighborhood, pg&e crews have been out here, this is a ruptured exposed gas line. you can see the cones put up. neighbors say this has been an ongoing problem. the latest last night when the folks called about this exposed gas line. they called santa clara county about the threat of the land slide. crews got on scene to find this line but they say it's just a water line. so pg&e cleared the scene. neighbors ended up calling crews out. this is a gas like.

this time they came out here again deemed the area safe. but the woman who grew up on this hillside. she's at her wits end. she is fearful of all of the mud in her back yard and convinced there is a gas leak. she packed up and checked into a hotel last night. >> i have had gas leaks where they evacuated the whole hillside several times, they were out again sunday and they keep watching it and that's it. patch it, call them, they come out again. nobody's doing anything. >> reporter: sue tells us everyone she speaks to keeps passing the buck. no one has taken pont. clearly santa clara county and pg&e crews, something needs to be done to patch this road and figure out what's going on. the other thing that threw a wrench in her plan, she planned to put her home up for sale.

by the looks this could be a hard cell. >> no kidding. thank you very much. it is 5:05. the trial of the two men accused of killing chauncey bailey will remoom. a judge delayed the trial because of a sick juror. broussard has testified that the bakery owner ordered him to kill bailey to stop a piece being published. we know that alexander yousef is guilty but the jury has to decide if he was sane at the time. jurors return monday. doctors say he was sane during the attack though the defense has to prove his insanity.

>> this morning an east bay mom was arrested for being home while her teenage son threw a rowdy party down stairs. no charges have been filed so far. they found carolyn asleep in her home on friday while 60 teens were down partying with alcohol. departments thought she was drink and arrested her, being under the influence of a controlled substance and violating probation. but her lawyer said she was not drunk and did not condone the party. >> she had some prescription medication, went to sleep, her son, ultimately ended up with a big party. >> the sheriff's office did serve her with a civil summons for allegedly violating the

social host. >> it's 5:07. we've got an update on the weekend bombing. the 85-year-old man injured in the explosion is getting better stut is still in the hospital. the man's right pinky finger was partly blown off. his arm, side and leg were burned. police are working with the federal government to try to find the person who planneded the bomb. >> workers are still trying to stop a radiation leak. radiation in sea water near the plant is at its highest level. more than 3300 times normal. they say it does not pose a athlete human belt but still is a concern. workers have not been able too turn the plants back on which would help keep the reactors cool. today residents over a plan to

>> welcome back. you're looking at the bay bridge. it is 5:14. >> we have an update on a proposed ban of the yellow pages in san francisco. the board of supervisors asked for a formal study of an ordinance designed to deliver the books to only people who request them. the discussion will resume on may 10th. if approved the pilot program would start in may of next year. >> the bill is in the works that would require utilities to get

one third of their power from renewable energy sources in the next ten years. it would be one of the most ambitious energy standards in the nation. nicole lapin is following that. good morning. >> reporter: good morning, scott. futures point to more green at the open today. stocks closed higher yesterday in thin trading, low volumes and the traders really believe that stocks will continue to rise and ignore all of the bad news on the belief in large part that the fed will keep pumping money in the market through the latest stimulus spending. asian markets were up. japan rose. europe also in the green at this hour but a big report out today, private sector hiring came out, up 201,000 which is slightly lower than expectations of

205,000. that could be a precursor in the non-farms payroll expected at 195,000 and that's the end of the week. after two years of improvement airlines had more problems last year making sure your checked luggage arrived to the same place you did. a new report shows that 29.4 million bags didn't get to the place you were going to. 12 per 1,000 passengers we're hearing, up 6% from 2009. also news out of cnbc, bp says a lap top containing personal information of thousands of people who filed claims related to the gulf coast oil spill has been missing for about a month. it was lost by bp employee on a business trip. now scott, bp sent letters to 13,000 people and now offering

you want to do outdoor activities you can't be what we have in store for you. 53 in san francisco. if you're tough you can get away with wearing something like a sweater but you'll want to dress in layers. look where we're headed by about 1 p.m. 78 degrees. 53 in san mateo and 66 in san jose. about noon when it's going to start to climb our temperatures end up in the 80s and some south bay cities. great beach day. 84 in santa rosa. 76 in oakland. the ridge gets stronger so i think 90, i'm not backing down from my forecast. 82 otherwise. east bay the 80s likely. 80 on gri, we're going to hold on strong, we're going to warm up overnight. our lows so warm easy to hit 80 on friday. changes for the weekend. a little system drops in to the

the bay area's biggest city is tightening the leash on dog onners. the council has approved an ordinance changing leash law, prompted by the 2009 death of a woman who became tangled in a leash before falling and hitting her head. under the leash law, leashes must be 6 feet while on city trails. owners and pets are required to move along to the right of the trail. first time violators get a warning, repeat violators face increasing fines.

with the giants and the a's playing a lot of folks can't resist. >> no kidding. that will be a good one. classified briefing on the military mission in libya is being held on capitol hill. monday president obama laid out his decisions to the nation why we are in libya. this morning the president sent key members of his staff to capitol hill for a face-to-face meeting with members of congress to inform them of the progress so far in libya. the supreme court seems to be leaning to blocking a sex discrimination suit against walmart. if it does it could be harder for other workers to bring class action claims. the suit was filed 10 years ago by a bay area woman. she says walmart favors men over women. if the suit proceeds walmart could lose billions. india and pakistan over cricket.

>> i don't know that much about it. i do know however that pakistan and india's prime ministers are at this match and 100 million people are watching it. this is happening mostly on the internet through espn but this is a tremendous game. they hope it will build good will between both countries but if you have some co-workers this morning who are bleary-eyed this happened over night. there you go as far as that goes. there's a website called dptwatch, created by a civilian who says he is fed up with the ticketing in san francisco. put in your citation number and a batch number and he is going to sort of figure out if perhaps one meter made in particular is

>> plus, crime on one east bay high school campus is on the rise. one county official says it's time to be worried. >> and the latest on efforts to save homes in hercules as the hillside continues to move. >> live look outside. beautiful bay bridge, gorgeous temperatures in the works. it's wednesday, march 30th. this is "today in the bay." >> good morning everyone. thank you for joining us. i'm scott mcgrew in for brent cannon. >> i'm laura garcia-cannon. thanks for joining us this morning. let's get started taking a look at temperatures for today. nice. >> they look great. this morning we're starting out relatively cool, mild, depending on your threshold for the cold. if you wake up in san francisco you don't need the jacket. 53 degrees there, 50 in oakland and we're on our way to the 70s and low 80s today. we're going to let you know how

warm it is expected to be and how warm the record-breaking temperatures are going to last. let's get you to work on time at 5:30 in the morning. >> good morning. a lot better than last week at this time. drier roads and we do have a disabled vehicle reported north of the golden gate bridge. that's what you would see as you approach. i'll let you know what chp says. the maze, a build, right now 5:30 should be slowing in antioch. i'll show that in the next report. >> we're following breaking news in san francisco where a fire injured several people at an apartment building at 19th and lawton where christie smith s. christie, this could have been a huge tragedy. >> reporter: it really could have. the good news, though, is that everyone is back in. i want to show you what is left of the unit. it was one unit. firefighters got pretty much the burned stuff out there and it's in front of the door, about 50 people came running into the

streets with the clothes on their backs. a few of them firefighters are saying actually didn't leave and they had to break down their doors. they are back inside after the single alarm fire in a three-story building that started while everyone was totally asleep. 3:25 in the morning. someone fell asleep with a pot on the stove and that's the cause and where the damage is. one neighbor says the alarm sounded but at first he wasn't sure about it. >> the alarm wasn't that loud, but i woke up and went to the bathroom and i heard it in the hallway, went to check. a lot of times people just you know, will accidentally stet smoke alarm off. i went in the stairway and there was smoke so i got my wife and my son and got out of there. >> reporter: firefighters knocked this fire down quickly. only 500 gallons of water was poured on it. during that time neighbors spent about an hour outside.

some of them getting assistance from the red cross. one person, a neighbor was taken to the hospital for smoke inhalation. two others suffered minor injuries. firefighters are saying no matter what the lesson when you do hear the alarm, you want to get out of the building. christie smith, "today in the bay." >> thank you. 5:33. >> aging gas pipe lines in the east bay are ticking time bomb, that's the conclusion of a study. a former lab worker will announce the results of the study. among his findings that some pg&e lines in the east bay pose a greater risk than the one that exploded in san bruno in september. the retired lab employee was given a federal grant to study jet fuel lines.

>> an investigation after a 14-year-old girl says she was kidnapped and assaulted. she claims the attack happened around midnight monday night close to the east mont shopping center. the teen says three men abducted her, drove her to a second location where she was assaulted. she says they were driving a blue lexus, a $10,000 reward is offered. >> a disturbing find in a livermore neighborhood. police are investigating the circumstances surrounding the discovery of a woman's body on kingsbury drive. she was found yesterday. police are treating this as a suspicious death. >> the berkeley school district is meeting to find ways to make one of its high schooling safer. it will go over a report on crimes at the school. an official says armed robbery is rampant and students bring

weapons to school. there have been six gun-related incidents. the district is thinking of installing metal detectors. one student says the unlocked gates makes it easy to enter that campus. >> mostly clear skies and sunshine. the future of one neighborhood is hinging on last week's wild weather. some homes are on the brink of a landslide. homeowners the threat of a gas leak as well. >> reporter: a neighborhood nuisance, good morning, this is almaden road, it's a hillside dead end street, maybe 5 to 10 homes on it. here is part of the problem. neighbors say this is a ruptured exposed gas line. you can see crews have been out digging it up trying to patch it and all of the cones that line

the street. there is a home up here on the hillside. the woman says she's not taking chances so she left. neighbors tell us this has been a problem. the latest happened last night when the people called pg&e about this exposed line. the crews said you know, this is not, this is a water line so they did the repair work and took off. neighbors called pg&e out again last night, san jose fire and pg&e came out and they said it is a water line. the woman who has lived here since the 1970s, she's convinced it is a gas leak and that's not her only problem. she is fearful of a land slide threatening her property. she checked into a hotel. >> falling apart. i have trees falling on my roof. i can't get up my road. i have had gas leaks where they evacuated the whole hillside. i don't know when i'm going to

go in the house and turn on the stove and my house is going to blow. >> sue tells us pg&e has been out several times. the county has been out as well and checked and says all is fine. no one is taking responsibility. clearly the county and pg&e they have work to do to repair this road. the other thing to keep in mind this woman who lived here since the 1970s had planned to sell her family home after all of these years, which it could be a hard sell given this current situation out here. >> thank you, marla. >> all of the land slides from the recent rain are creating problems for homeowners all the way from hercules to san pablo. now they say they don't want what's happened to them to happen to you. dozens packed the council chamber.

three homes in san pablo had been yellow tagged. real estate agents say if you might buy a home 18 slide zone you need to do your home work. >> i'll ask questions of the neighbors. how is this house? how long have you lived here? i'll request the seller, banks excluded, that they order what's called a natural hazards disclosure report. >> meanwhile, this morning yellow-tagged homeowners in san pablo are awaiting help from the state. san pablo city leaders declared a local emergency and the city is working with the county sheriff's office and other emergency leaders to get that help. the yellow-tagged homes on hill crest and wyman street and can only be accessed for a limited basis. >> 5:38. santa cruz county supervisors declared a local state of emergency because of damage. the state of emergency will help secure some state funding.

there's $8 million in damage in santa cruz. $10 million in capitola and the harbor, more than $28 million in damage. >> it's 5:38. let's check win christina and an actual hot day. >> yes. people are going to break out the fans. you can give your heater a break. even the overnight lows in the 50s. the upper 50s as we head into thursday morning. we're talking about a really nice warm break that's going to last probably through friday. but this morning we're seeing our low temperatures about where our highs ended up. enjoy this break, 53 in san francis francisco. this is what's happening. we have a ridge of high pressure building and you can see clouds arcing up and around that amplifying ridge. then a system of low pressure to the north. that's going to spill cloud cover through the ridge of high pressure. only the highest clouds will be able to make their way through.

the high wispy clouds again. at noon we're talking about temperatures around 77 degrees in santa rosa. 70 degrees in livermore and 84 degrees is where we're headed later today. santa rosa tomorrow, 90 degrees is the forecasted high if you can believe it or not. why it's going to be so much warmer and how much longer this is going to last. let's get to you work on time with mike inouye. >> did you say santa rosa 90? >> yep. >> wow. i believe you. i call this 33, we've seen speeds dip. now the 30s. dives down about this time every day. livermore steady but the average pulling down closer to 60, more on the roadway, still a 14-minute ride to 680. the debris cleared. that had some on the roadway. chp is not concerned. look at that a smooth drive. crossing the bay.

this morning a transition of power in the fight to keep the peace in libya. nato is taking the lead to enforce a no-fly zone over the troubled country. tracie potts is live on capitol hill. the u.s. no longer in charge of the mission. why is the president saying it's going to be a bumpy ride? >> reporter: because at this point we're still involved in the mission, laura. he is going around giving

interviews in person, trying to make the case for, first of all, why we're there and also what his strategy is at this point to get moammar gadhafi out. today he's sending secretary of state hillary clinton and the defense secretary robert gates here to capitol hill to talk to lawmakers who are none too pleased about the fact they didn't get a chance to vote on this. but also they have a number of questions and they'll meet face-to-face 18 closed hearing. the president echoing what we heard the secretary of state saying in london yesterday, that they want to apply political pressure, diplomatic solutions, use sanctions to try to, as he put it, tight at any noose and get moammar gadhafi to step down. some republicans don't think that's a good strategy or a strategy at all. the house republican leader said that hope in terms of hoping that he steps down is not a strategy. they still have a lot of questions, some they hope to get answered today. >> it's very interesting to watch. thank you.

this morning new information about the safety record of an east bay retinery that caught fire early yesterday afternoon. or morning. we know that refinery newark has been fined 10 times since october for leaking odor in the air. newark city manager says it's too early in the investigation to link the company's record of leaks with yesterday's fire which broke out at 5:30 in the morning and injured one employee. but firefighters do know what caused that fire. it was equipment failure that caused the release of flammable hydrocarbons. the refine have i used to purify used oil so it can be used again. experts say the fire did not pose health risk to people nearby. >> it is 5:45. more revealing testimony expected today in the barry bonds trial. the defense will cross-examine marvin benard. yesterday jason giambi took the stand and testified that bonds' personal trainer sent him

steroids. he added that anderson sent instructions when to use them. giambi has already admitted to using steroids. earlier the former head trainer took the stand. he says that bonds gained significant weight in 1999 and he noticed acne across bond's back and shoulder, a common side effect of the steroids. >> oakland's chief is reiterating he is here to stay. anthony batts says his quest for a new job is over. he is completely he says focused on oakland. batts' commitment was called into question when it was revealed he was a finalist for san jose chief. that job went to chris moore. batts also dispelled rumors that he and the mayor are clashing. >> in a 6-5 vote the board allocated $1.3 million in the

public financing program. supporters say it's necessary to fund the program for this year's november mayoral race and also the following year's supervisor elections. >> san francisco faces $380 million in deficit. >> baseball trying to make a comeback at uc-berkeley. cal's direct ser hopeful the program will be reinstated. former players have been meeting with the university's chancellor. reporting over $9 million in private donations have been raised to save the program. the chancellor set a target of $10 million to keep baseball for the next 7 to 10 years. five sports were eliminated to save the universities millions. >> that's a lot raised in a short amount of time. >> cal baseball. >> they could be in the top 10. good news for them. 5:47. i want to check the forecast. i'm a little bit afraid we're
