would have been asleep in his bunk bed if she hadn't gotten him up to change his pajamas. shots fired antioch police found a man down, possibly shot in the head. he was taken to the medical center. his condition is unknown at this hour. we have calls into antioch police. the mom didn't want to go on camera, but here is what she told us. >> i don't know what real gunshots sound like. i thought they were false. i was in my room, my son was in the living room having dinner. he said did you hear that? i said they are just fireworks. that's what we thought. >> at least three bullets may have went inside the unit where not only did she have a 9-year-old boy, but an infant in there as well. she recently moved here from

hayward to escape the violence in her neighborhood there. christie smith, today in the bay. >> thanks. flags will fly at half staff in honor of this soldier killed in afghanistan last week when he was attacked by enemy forces. as a medical technician, he was treating a fellow soldier. his remained will arrive in the bay area today. his family will hold a private service. harry lue died on sunday. he graduated from santa clara high school in 2008. he was known for artistic skills, break dancing, singing and drawing. the 21-year-old and his unit had been in afghanistan for five months working with afghan security forces. the u.s. marine corps has not said how he died. >> it's hard. anytime we lose someone so young

it's much more difficult to deal with. >> he was a fourth armed service member to die in the line of duty in the past five weeks. a teenager is in custody this morning accused of raping a jogger in a popular san francisco park. it happened off geneva. 18-year-old xavier neil is in a san francisco jail for raping a jogger on friday. he forced the victim to a grassy area behind the park away from busy playing fields. people who use the dog run say police need to step up patrol. >> they generally patrol the other side. the probability of something happening down there is less than it would be up here because of the isolation factor. women who play soccer at the field say they try to avoid the isolated areas of the park. the attack is a reminder to keep

their guard up. a business is raising money to pay for medical expenses of a giants fan attacked. bob redell is live with more to bring the suspects to justice. good morning, bob. >> reporter: good morning to you. an attack that took place after a dodgers game. the dodgers committed $25,000 to the pot which means there's a $50,000 reward to find the man responsible for attacking brian stow. he was an emt that works at a downtown location. the aren't chain will hold a fund-raiser for stow. he's in critical condition in a los angeles hospital. his neurosurgery team is expected to update us later today on his condition. stow, a giants fan was leaves last thursday's game against the

dodgers in los angeles with two men dressed in dodgers attire beat him in the parking lot. his condition is so severe, he was put in a medically endeuced coma to help him recover. pizza my heart will donate 30% of today's sales at all the locations to help him out with medical bills. >> putting his life on the line all the time. as any business owner should do is step up and help the people that help uls. >> treated everybody with the utmost respect. when you see this happen to people like that, it breaks your heart. >> reporter: there's a lot of love out there for him. tomorrow, there will be another fund-rais fund-raiser. that's an amr, the company where he works as an emt. bob redell, today in the bay. >> thanks, bob. the man accused of killing two workers on fisherman's wharf

is expected in court today. police say he killed to two workers at a competing business on january 30th because he resented the competition to his store. he's pleaded not guilty and is held in a safe unit at the jail. he's considered to be a risk to himself. the utilities commission is meeting over gas pipelines. they want to hear testimony related to the pipelines. cpuc is holding three meetings starting today at 5:00 in san bruno. the meeting is held at the city center. other meetings take place next month. city leaders make san francisco more appealing. the big business, the board of supervisors sup mitt a proposal. companies that move into certain parts of the city's mid market and tenderloin neighborhoods.

that proposal was first brought up as a way to lure twitter into the city. san francisco will lose $22 millions and get more businesses in the area. let's see if we are going to lose temperatures this morning. are things dropping out there? >> yeah, they are dropping like potatoes out there. temperatures have fallen ten degrees. it's chillier still, though. we are in the 40s and very, very low 50s along the peninsula. yesterday, we were closer to 60 degrees in some areas. not so much the case this morning. we are going to see a nice day as we are still on the warm side of a front. you can see the front draped across northern california and areas in the pacific northwest. it will bring about shower activity as we head through the midsection of the week. the best chance of rain is late thursday and friday. the bigger concern is the falling temperatures. you can see the cold air mass pulling in.

on the east shore freeway. a live look across the bay. this is the san mateo bridge. problem free from san mateo to the south bay. it's just showing a few more cars now. alarming findings near the nuclear plant in japan. samples of sea water show radiation levels several million times the acceptable limits. other measurements show lower levels all though they are still 1,000 times the legal limit. radiation dissipates quickly in ocean water. it's unclear what effects a large amount of contamination is going to have. 21 miners killed in a west virginia mine. production is going to halt today and a safety stand out to honor the victims. at 3:02, a one minute 29 second moment of silence to reck nice the moment of the first blast.

it was the deadliest coal mining disaster since 1970. a deal in silicon valley made a lot of people richer. i'm not one of those people. check in with scott. what's going on? >> good morning. normally, when you buy a company you offer shareholders a bonus to sell to you. if the stock is worth ten bucks you offer $13 a share. when texas instruments offered to buy this company, they offered a 78% premium. one of the biggest we have seen. texas instruments really, really wants them. it's a $6.5 billion deal. meanwhile, when i tell you the nasdaq was up 2% or down 3%, what i mean by that is when you look at an index of 100 companies on the nasdaq exchange their movement was up 2% or whatever. some companies get a bigger

influence than others. nasdaq decided apple is too big. now shares of apple count for more than 1/5 of the index. it's going to change apple's influence and make it smaller. why do you care? fund managers have to change their funds based on how they are weighted on the nasdaq. that will temporarily cause volatility. >> thank you. san francisco police are still looking for suspects after a string of violent attacks over the weekend. >> reporter: the reward is growing for a man violently attacked during a dodgers game. this as a local business steps up to help him out with medical bills. the stadium is not built but santa clara is talking naming rights for a new home for the 49ers. take a look at the south bay

five are accused of four murders in 2008 in san francisco. they are members of a gang based in the mission neighborhood. defense attorneys told them, violence and murder increase their stature in a gang. the barry bonds trial continues today. the witnesses will be technicians from the ucla olympic analytic laboratory. they should wrap up testimony today. yesterday's testimony was canceled because a juror was ill. there were court moves. prosecution moved a long missing tape between his former business associate and his orthopedic surgeon. the judge has not ruled if it's admissible for most of it is irrelevant. antioch police are looking for a shooter this morning after one person they shot and stray

bullets hit a nearby home almost hitting the family inside. christie smith is live with an update. >> reporter: good morning to you. we are talking with neighbors in antioch. they definitely heard the gunfire erupt after 9:00 last night. for one family, it came dangerously close with bullets flying into their window. a mother telling us this is very close to where her 9-year-old son would have been sleeping in his bunk bed had she not gotten him up and given him something to eat. it's on sycamore drive where a man was shot and taken to the medical center. we are trying to get an update on his condition this morning. the mother didn't want to go on camera but said it sounded like fire crackers at first. >> i came in and saw the thing broken on the ground. i said why did you break this.

he said i didn't touch it. i looked in the window and saw three bullet holes. i looked across the closet and saw the holes in the closet. i panicked and went outside. i saw the cops and said i think somebody shot through my son's room. >> reporter: she also had an infant in the home at the time. everyone is shaken but okay. we had a call in for the search of the status and the victim. christie smith, today in the bay. >> thanks. san francisco neighborhoods are keeping careful watch after a string of violent attacks last saturday night at 11:00. three teens were arrested for robbing an elderly woman. then they robbed a 20-year-old woman. police are still looking for them. police are still at 11:00 p.m. on sunday, two men punched and

robbed a 56-year-old man. an early morning robbery 26-year-old man was beaten up. the attacks appear to be unrelated. the national transportation safety board is ordering emergency inspections on 80 boeing 737s. the hope is to find weakness in the fuselage. some inspections have begun. southwest airlines cleared 64 aircraft to resume flights. three were found with cracks. other airlines are going to check their planes as well. last friday, a five-foot hole opened up during a flight over arizona forcing the pilot to make an emergency landing. the section that tore is being examined at a lab. inspectors found widespread cracking and fatigue on the plane's joints. cracking and wear and tear is

normal and one of the reasons inspections are mandatory. earthquake experts want to build an early warning system on the west coast of the county. representatives will meet this afternoon to discuss the plan. we have the technology to build one similar to the one japan uses and could save lives after a big trembler. the city council is expected to vote on a plan that would give the 49ers exclusive rights to market the name of a new stadium. the naming rights are common for stadiums and arenas such as the hp pavilion or oracle arena. there are no front-runners right now. let's check the forecast with christina. >> good morning to you guys. good morning to you at home. we have another gorgeous day shaping up. in the 70s today. you'll want to saver the moment.

welcome back to you. a good tuesday morning taking a live look outside from the east bay today. enjoy the day, we'll tell you why, coming up. the federal government will shut down if lawmakers do not reach a budget deal by friday. however, under new rules, whatever plan they come up with has to be in writing by tonight. tracie potts is live in washington, d.c., where president obama will become the middleman of sorts today. tracie. >> reporter: good morning. that's why the president is inserting himself in the center of this capitol hill controversy. democrats and republicans disagree today. he's bringing congressional leaders from both sides of the senate and the house. both sides, democrats and republicans to the white house to talk about these issues to see if they can come up with an

agreement before friday's deadline. republicans say that $33 billion compromise we have been hearing about isn't really a compromise. they never really signed on to it. democrats are concerned that deeper cuts could mean more difficult times for the poor, more difficulties for working families this this country. the tea party standing firm on what they believe should be deeper cuts to keep the budget balanced. the white house hosting the meeting isn't a line item veto, so to speak. they are looking more at a framework under which to come up with an agreement. if, for some reason they can't. two things. the white house budget office already warned government agencies to work at the con tin generality si plans. republicans on the hill are suggesting a one-week extension that would include $12 billion in budget cuts. back to you, brent.

there may soon be no free ride in walnut creek. they will decide if the city will continue to pay for the free ride downtown trolley bus. they spend $200,000 a year to fund the program. they have three options including charging a fare or stop funding the trolley and have the county decide the feat. there's going to be a meeting at 7:00 tonight at city hall. we want to check the commute with mike inouye. >> good morning. no such thing as a free ride at the bay bridge. we have a smooth drive. 18 minutes off the carquinez bridge. if you are heading toward it, that's coming off highway 4, eastbound 88 you won't be able to access that. the skyway is the way folks get there out of martinez. willow avenue is a good option as well.
