grabbing so tightly in there. good morning to you. i have a nice warm baseball mitt. temperatures are not going to be that warm for today's game. you'll need a jacket and blanket if you are sensitive to the cold. we have interesting weather coming down in the south bay this morning. the pop-up thunderstorms, the lightning firing off from the satellite imagery. we'll deal with that for the next few hours. then the activity is slated to push to the south. 57 in los gatos, 58 in san jose and 57 in gilroy. now, coming up, we know that baseball, men love baseball. so do the ladies out there. we are doing something special for the female giants fans. we are going to show you the latest in giants fashion. the greatest new items that are just for you. even hair protection when it comes to hats and other cool things you will only see here.

first, let's get you to work in time with mike inouye. >> we use a trash bag for a poncho. we are looking at the south bay where you are talking act the wet roads. overnight hail that may continue. thundershowers here. slippery and 880 or 280 is where the accident christie smith is talking ability. we'll have details on that and more developments on the investigation. the speeds are looking nice throughout this area. we'll get a live look at the bay bridge toll area. not all the cash lanes are opened up. we'll see more heading into the city because the game is at 1:35 and gates open at 10:35. we have an update in an accident in san jose involving a chp officer. bizarre weather may have played a role in that accident. christie smith is live at the scene with a look at what happened and new developments.

christie. >> reporter: good morning to you. the wild weather likely played a role. since we have been here, we have seen heavy rain, hail, ice. in fact, hail on the ground right now along interstate 880. i have to tell you, it's still here. it hasn't melted yet this morning. i just got off the phone with chp and they have telling me a driver involved in this accident was arrested for driver under the influence. the accident happened on 880 which was temporarily shutdown overnight. an officer was trying to help a driver in a pick-up truck who slid on the ice. the officer was out of the car. apparently the driver having problems with the tire. that's when another driver hit the officer, knocked him in front of the pick-up truck. conditions out there were wild all night. >> we have had a couple calls on both directions here with the hail because it looks like it's

just basically in this area here. down the street, it's dry as anything. i don't know, just an isolated incident here. >> reporter: officers telling us they have been busy, busy overnight. the officer was taken to valley medical center and suffered a broken leg. i'm told it has been treated. fellow officers accompany him there. he is now in recovery and certainly could have been a whole lot worse. reporting live in san jose, christy smith, today in the bay. >> thanks. we could face a government shutdown by midnight tonight. there's no budget deal yet. president obama expects to have an answer as to weather or not there's an update. we want to check in with tracie potts in washington, d.c., where both sides are struggling to reach a deal.

i hear they are closer, but not close enough. >> reporter: apparently not. we are not getting great feedback today from either side about this possibly working out. a few minutes ago, an interview with harry reid on the senate side saying he's deeply disappointed. his aids here until 3:00 a.m. trying to work this out. they are back or will be back behind closed doors. democrats are saying the sticking point seems to be republicans who insist on restricting public funding for family planning, for places like planned parenthood. republicans are saying it's not about that at all. it's about the money and democrats who won't come off another $6.5 billion. that's where it stands as of this morning. the president saying he wants an update by noon. they have to notify 800,000 federal workers whether or not

they are going to show up for work monday morning. >> perhaps new developments this morning. thanks. the case against barry bonds is in the hands of the jury. closing arguments wrapped up yesterday. the eight woman, four man jury begins deliberations this morning. bonds is accused of lying to a jury. if convicted, they recommend between 15 and 21 months in prison. an i ledged kidnapping and child molester, filly garrido stunned the court when he pleaded not guilty. experts thought he would plead guilty. his defense attorney says the change came because of a problem with the composition of the grand jury that indicted him last fall. a trial could start as early as august 1. it means jaycee dugard could be called to the witness stand. emotions are running high now

that two baseball players are not liable and do not have to pay damages. they were sued for negligence and emotional damages. the jury acquitted the man. nine out of 12 have to agree. they didn't get that. the woman's claim she had been drinking at a house party in 2007 when she was taken into a bedroom and gang raped. we want to check the forecast with christina. she is live at at&t park. take a look at what we can expect. i know that you might want to wear say a beard to keep warm. >> that's exactly what's happening out here this morning. this beard, i know why men grow them out because it really is keeping me warm and it's delicious. good morning to you. we are going to have a good day today as far as clear skies. conditions improving as we speak. i can tell you right now, it's active in here.

parade. >> it's okay to be on the bandwagon. thank you for joining us. >> take care. >> now, let's look at the roadways. some of you have to start end the workweek. >> a lot of folks are heading where you are to see you and the rest of the team. no major slowing on the maps. the chopper shot over the scene of an accident on the upper deck. oh, they just moved to at&t park, where a lot of folks are headed. i'll show you the back up from the bay bridge over the toll plaza. let's get a look at that as you come up the incline. they are moving the shot. the incident just cleared. i'll get confirmation from chp. they just pushed the disabled vehicle off the roadway. there's the back up, going back quickly to the maze. the metering lights are on. slower than you would expect for a friday morning. this will likely last at least until the folks get in there to

the park. the gates open at 10:35. avoid the area if you do not have tickets. think twice before you open your door to strangers and lock up before you leave. that's the advice to police. most are happening in the east bay and along the peninsula. a woman recently left her home to run a few errands. when she came back, her front door was left open. burglars are posing as gardners. approach people at the front door to distract them while another person goes inside to rob them. >> i can't believe that. you have to be on your toes. you can't trust people coming to your door. >> police say to lock your doors, shut your windows and set your alarms if you are going to be out of your home for a short time. pg&e is fighting a case over broken pipes. they failed to track down

important records of the pipelines. the fines could have been bigger. a lot of people think the $3 million settlement is too lenient. they are scheduled to meet again to talk about the $3 million settlement. i want to check in with christina now, taking a peek at what the weather is going to be like. it's opening day. it's been cold overnight. >> yeah, it has. cold enough to wear a hat. as you may know, 70% of the heat from your body escaped from your head. if you get cold, but a darn hat on, especially if it's a giants hat. that will keep you warmer. they have a lot of momentum coming to at&t park. an even mah-up between the giants and the cardinals. my forecast is for a giants win. let's talk about the weather. you have a winning forecast for today. someone who does not like the rain, it's going to stay dry out here. looking around, we have mostly clear conditions. i am noticing back in the

folks are heading over there. this is what we expect to see for friday light. the bay bridge messed things up there after a couple stalls and an earlier accident. things are moving slowly, very slowly on high way 4 from a street to loverage. it's been holding at 50 for the last half hour. we are watching it carefully. back to you. >> thanks a lot, mike. we are on the brink of a shutdown unless lawmakers can come to an agreement. tracie potts is live in washington, d.c., where the president has to work on a compromise and also prepare to shut things down. >> reporter: he's got to give 800,000 employees a decision about whether or not they can show up for work on monday morning. they are negotiating a budget deal to prevent the shutdown.

the latest we have heard this morning is aids were here until 3:00 a.m. are back at the capital preparing or behind closed doors working on details for a budget deal. from what we have heard this morning, things don't look good. the senate majority leader is deeply disappointed at 4:00 a.m. after the negotiations. this morning, hearing from republican aids, they think the big issue is democrats who won't come down $6.5 billion. they have narrowed the gap to that. the big issue is republicans won't take out a requirement to stop public funding of planned parenthood. there are areas where they have agreed. these are not among them, the president looking for an update by noon which is just a couple hours, two and a half hours from now. we understand aids say they want to give them an update by mid-morning. no idea behind closed doors how the negotiations are going.
