good morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm brent cannon. we want to get you started with christina and a look at your forecast. >> good morning to you. grab an umbrella this morning, we have some showers out there and they're moving pretty quickly. it's going to get a little more steady as we head throughout the afternoon and particularly towards this evening. we'll break town your entire forecast for you, but first let's get you to work with mike inouye. >> good morning, christina. yeah, the maze looking just fine. the construction that cut off the posey tube has cleared so the overnight work, rejoining folks no problems at all. a wind advisory for the benicia bridge. that might be why some of the rain storms are coming through so quickly. sprinkles throughout 680, 580 and highway 4 but right now for major issues through the east bay. back to you. president obama is in the bay area today.

among other things he'll do a little fund-raising, but not before doing something that no other president has ever done. he's going to visit facebook headquarters in palo alto. marla tellez is live with a look at what's ahead today and the impact that facebook has on world politics. marla? >> reporter: good morning, brent. right now it is sort of a lonely place to be here at the facebook headquarters on page mill road, but i can assure you in just a few hours, this place is going to be covered up with security and these roadblocks over here are certainly going to be put out, all of course waiting for the president's arrival. as brent just mentioned, this is a first for the president to take to facebook to hold a town hall. now, the president posted on his facebook page a recorded invitation to his more than 19 million facebook friends. yes, he has more than 19 million friends on facebook, asking them to attend today's town hall, which will be streamed live on facebook, 1:45 our time, moderated by facebook ceo mark zuckerberg and coo cheryl

sandburg. talk about reaching an internal audience. facebook first launched as a way to connect the younger generation, meet people and share photos. it is quickly becoming a communications tool in the political world, revolutionizing the way candidates campaign. we got some perspective on this from people here. we found many who say the president, he would be making a mistake if he did not embrace the social networking world. even one older gentleman who has never even logged onto facebook, he tells us he is well aware of its power, though. >> if they're not on a pda or iphone or not on the internet, you know, where are they getting their news. people are online. if he wants to get out to a large population, that's where they are. >> i don't see anything wrong with that. it's a high-tech world and anything he can do is great for us. >> reporter: president obama used facebook and twitter to get to the white house. well, now he's using it to stay

in the white house. just this month he launched his re-election campaign on facebook and already close to 150,000 people like that page. now today's questions for the town hall will be pulled from the president's facebook page. questions posted by his friends and then selected by the facebook folks here. now, i checked out that facebook page this morning to get a sense of the questions that the president will be asked today. they range from everything regarding high gas prices to legalizing marijuana. but the president is making it enclosure that today's town hall is all about the economy and getting america back on its feet. >> all right, thanks a lot, marla, we appreciate that. by the way, as we mentioned, he's going to make some fund-raising stops, three of them during his stop in the bay area, all of them will be in san francisco. for a complete look at president obama's schedule and how you can catch his facebook address, go to nbc bay area morning news on facebook. you can become a fan there and

we have a link to all the information that you need to know. this morning oakland police say a dangerous man could be lurking somewhere in the east bay after he tried to sexually assault a woman returning home from the store. police say the man followed the woman into her home on third avenue yesterday and then ordered her to take her clothes off before he ran away. it's unclear if this case is connected to a series of sexual assaults that have happened near lake merritt within the last seven months. two richmond police officers are without jobs this morning after an fbi investigation found that they had been running a private security firm on the side as well as hiring and arming youngsters with handguns. the department fired danny harris and ray thomas. they had been put in charge of the explorer organization, which is a youth training program. two explorers, 19-year-old sergio rios and 20-year-old orlando torres say they were given glock handguns when they became security guards. ray thomas has taken his case to

court so he remains on paid leave. bart has three new deputy police chiefs this morning. they were sworn in on a move recommended by outside police experts following the fatal shooting of oscar grant. they wanted to reorganize the department so commanders are not overloaded with work. each deputy chief will be in charge of specific operations. two of them are veterans from oakland's police department. the other worked in bart for more than 28 years. another budget crunch may lead to another five-day furlough for teachers in san jose. the district held the first of three community meetings last night. they told concerned parents and teachers that the district needs to cut $349 per student. that money would have to be made up in cuts or furlough days. teachers say they already took five furlough days back in october. >> i definitely think the students suffered. obviously we're coming into our cst testing now. we should not be having furlough

days at all, we should be adding instructional time. >> san jose unified favors approving tax extensions or allowing voters to approve them. and then there were ten. san jose city council has voted to allow just ten medical marijuana dispensaries in the city. a maximum of two clubs will be allowed to operate in each district. permits will be handed out by the end of the year. the council has also voted to require each club to grow their marijuana onsite. opponents say ten clubs is not enough to serve a city with almost a million people. bryan stow, the giants fan who was attacked at dodgers stadium is reportedly still in a coma but is making very slight progress. his family says he is showing some signs of brain activity. he will be in a medically induced coma at least another few days. doctors tried to bring hem out over the weekend but he suffered seizures and they had to put him back in. once he stabilizes, doctors hope to remove him from sedation. in the main time a bay area

nursing home is hosting a fund-raiser for stow. he often visited mission skilled nursing center when he came to check on residents when he was a paramedic. they are going to hold a barbecue in his honor. the center is in santa clara on north winchester boulevard. it's next to mission city memorial park and the event, barbecue today, is from 11:30 this morning until 4:00 this afternoon. do you know the law when it comes to distracted driving? can you text and drive? can you dial your cell phone while driving? can you even touch your cell phone when you're behind the wheel? >> can you see the smoke rising out of my ears? today in the bay's bob redell joins us to look at the rules of the road in a new study on distracted driving being released this morning. >> reporter: good morning, laura and brent. in a few hours the state will give us a sense of how much we as californians talk and text bhooin behind the wheel. they have sent people throughout the state to observe distracted

driving, specifically when it comes to cell phone use. the results of that survey will be released in a few hours. we'll also learn how many people have been cited for distracted driving statewide. you might recall law enforcement has been in a zero tolerance enforcement mode as part of national distracted driving awareness month. the state points out driving and texting is right up there with speeding and alcohol as leading causes of serious accidents, especially when you consider that on average illegal cell phone use can take the eyes off the road for five to ten seconds. most crashes have less than three seconds reaction time. so what constitutes illegal cell phone use? that is a good question. we all know you're not allowed to do this, you have to be hands-free, be on your speaker or have an ear piece. you can sit there and be dialing a phone number. you can even read a phone number. that's legal. but let's say you're at a stop sign, stoplight, your car is not

moving, this texting is illegal. something else. if you are, let's say, trying to get onto your ipod, one officer tells the mercury news i can sit here, i've got my iphone, my ipod pulled up. i can go through my play list -- >> while you're driving? >> reporter: anxious it's fast. this is one officer. >> what do you mean as long as it's fast? >> reporter: anxious you do it quickly. >> see, bob, this is where the problem -- laura has a story to tell. >> we don't have time for my story. >> reporter: there's a couple of other things. you cannot do this. you can't go on google maps and look up where you're headed but you can do this. you can have a portable gps device set up on your windshield and you can do that, you just can't do this. >> so if your phone does the same thing as the gps, it has the same interactive map and everything but it's not technically a gps device, is that illegal?

>> that is my understanding. >> how will the officer know if you're on ipod getting your music or gps? >> reporter: that's a good question. i take it right now the first offense is $159? >> i wasn't on other one. i picked it up and looked at it, bam, i got a ticket. >> reporter: the law is relatively new. there's a lot of clarification that needs to be done, but unfortunately right now it doesn't seem like there's any effort on behalf of state legislators to change the laws. >> we'll check back with you throughout the newscast. it, it's very complicated to understand. >> i think the drivers are trying to understand but i also think each officer, you could probably get stopped by a number of different officers and have a number of different understandings of what the law is. >> it's interesting. and it is, you've got to be safe on the road but when you're not talking and you get one anyway, i don't know. and i know i talk a lot. >> hopefully you'll play it safe no matter what you do. >> right now it's just safe to

make a comment about laura talking on the phone. highway 4 still showing speed at the limit, so that's good news. we have another 20 minutes until that shows any slowing. the antioch bridge is cleared so there should be more traffic flowing. we had overnight construction, they have traffic control as needed across that bring and we still have construction eastbound 580 around summersville. that will go on almost another hour but it's opposite your commute. the westbound direction will show that slowing in 20 minutes. westbound 580 should not be a problem but yesterday we had an accident that lasted much of the morning so right now we just have a 14-minute drive for livermore, although there's some sprinkles through the area. christina will tell you a little more about that coming up. no problems through the south bay. these are the east bay freeways, i pulled up the wrong travel times. they're about the same for the south bay. very clear flow of traffic. marla told you the president comes to facebook off of california avenue between 280 and 101, that will be an issue through downtown palo alto.

a live shot of the golden gate bridge. he also comes to nob hill so watch the congestion in the area. clear shot right here but how's that day look? there are changes. >> oh, yeah, we've got some changes happening already this morning. good morning to you. things are looking okay for the first part of the day. by this evening the action will become a little more steady. as you can see we've got a system of low pressure right now pushing onshore. that's going to provide some pretty good rainfall totals up in the north bay. i don't think we'll see a whole lot in the south bay today, but this is what's happening right now. livermore getting a little light shower activity. the same goes for san jose. it's very spotty, kind of all over the place this morning. and not widespread and steady yet. that will happen later on tonight, by about 6:00 p.m. the bulk of the moisture starts to push into the bay area. that will bring about some pretty steady rain for several hours, at least up in the north bay. clearing by the time you break out for your morning commute tomorrow so clearing by 6:00 a.m., maybe 7:00 a.m. tomorrow

in july. that means the new iphone will likely start shipping in september. from what we hear, it's going to run with a faster processor, but it's going to look a lot like the iphone 4. for the rest of your news before the bell this morning, nicole lapin is live at cnbc headquarters. nicole. >> reporter: brent, there's no other news. that's it. iphone 4 is the news. no, honestly, that's what we're most excited about, but it's also very exciting in terms of equity markets this morning. if you're looking at futures, they're significantly higher, thanks largely to some of those upbeat earnings from intel, ibm and yahoo! reporting. a rise in commodity prices, oil is above $109 again. asia rose overnight on the back of our gains and tech results, so then europe is also higher and that is pushing us higher as well. but we do look ahead to some existing home sales numbers after some positive but pretty flattish housing numbers yesterday. and earnings from at&t, united technologies and wells fargo,

apple, after the close today. the dow rising just to recap 65 points yesterday to 12,266. the nasdaq composite edged up 9 to 2744. also this morning toyota is extending production cuts at its north american plants through early june as it deals with parts shortages from japan. the company will idle some plants on mondays and fridays, but they are promising there will be no layoffs. guys, that's the latest news out of cnbc, back to you. >> thanks a lot. i'm glad she came up with a couple things. >> she's fabulous. it's 5:17. here's an idea that could grow on many many san franciscans. the board of supervisors voted to allow small-scale farming in residential neighborhoods. now commercial farmers in san francisco can grow and sell produce in gardens under an acre in size. the cost of a permit is only $300. it used to be $3,000. san francisco mayor ed lee is expected to sign in the new

urban farming legislation later this morning. now, i don't know if that includes the livestock and chickens and whatnot. the fog horns and a little chicken. a little cluck cluck. the time is coming up on 5:18, we want to check the forecast with christina. >> good morning to you. grab that umbrella, yeah, we've got some showers out there this morning and we're going to see a little more action as we progress throughout the day. low-pressure system pushing into the bay area. right now we already have spotty action and it is getting a little bit more intense right now, some showers now coming down over the peninsula whereas earlier we just had showers in the east bay. so watch out for slick conditions this morning, make sure you give yourself plenty of time. by the time you make your way home from work, the bulk of the moisture arrives up in the north bay spreading to the south as we head throughout the evening and overnight hours. i think we could pick up up to a quarter of an inch to half an inch. our temperatures are pretty mild. 52 in napa, 51 in santa rosa and 52 degrees in san francisco.

people and starting an oil leak that lasted 87 days. even today the fight against oil continues. jay gray is live in venice, louisiana, this morning, one of the hardest hit areas by the tragedy. how is the region recovering so far, jay? >> reporter: good morning to you, laura. it's been very difficult for so many who live and make their living off of the water down here in south louisiana. look, there's still oil in the water, but a bigger problem now seems to be perception. a lot of the fishermen that used to come to this area, the tourists that go to the beaches in florida, mississippi and alabama are staying away right now. they have seen the pictures of the oil. they don't know about the cleanup and they're not spending their money here. the current estimate is that the loss in tourism revenues will reach $22 billion. that's about a "b" by next year. that's really crippling to this region. there is also the problem of the seafood industry. they are beginning to catch

seafood. the fishermen, the shrimpers and the oystermen, but the customers aren't coming back to the table at this point. even though it's the most rigorously tested food in the world right now. we're now beginning not the end of the first year but the second year of the recovery, laura. >> a lot of healing and understanding needs to take place are. >> reporter: yeah. >> thank you very much, jay. it is 5:24, we want to check the morning commute for you. here's mike. >> good morning, laura. i told you the south bay was clear now let me show you the south bay in earnest. the speeds verifying the northbound commute not a problem right now although we might see wetter roads a little later on, pretty soon from what christina is showing us. we're looking at construction 880 at 92 that has cleared up and no problems onto or off of that san mateo bridge. the bay bridge looking really nice. the toll plaza, a live look shows you very light volume. of course no metering lights, no

major problems as things continue moving down through the east shore freeway. look at the maps, 18-minute drive off of the carquinez bridge down to the area and no problems past the richmond-san rafael bridge. wa watch all your bridges because overnight they issued a wind advise foe for the benicia bridge but we'll extend it throughout the rest of the area because that could be the case. everybody knows laptops are out, tablets and smartphones are in. smart mcgrew says silicon valley investors accept that as fact. >> the company that makes chips for laptops but not so much for smart phones won't make much money, right? hold on a second, that's not true. intel has investors doing a double take this morning saying chip sales jumped in the quarter and the company's earnings jumped 29%. apparently american businesses are buying computers again and servers too. now, this is big news not just

for intel investors, but silicon valley in general. meanwhile, maker of smartphone and tablets, apple reports its profits this afternoon and we expect apple to actually do quite well. its ipad 2 flying off shelves. in fact if apple has any problems, it's finding enough raw components to build more. we'll listen for indication disruptions in japan are causing trouble as well. a hoax is floating around the internet claiming japan has decided to quit whaling. a website that specializes in fake news started the story, which was picked up by lots of bloggers and twitter users. we can't find any evidence that mainstream outlets went with the story, but we certainly remember back when there was that ge hoax, that ge was going to start paying back its taxes. that caught a lot of actual mainstream media offguard, including "usa today" and the associated press. >> there have been a lot of those stories from time to time. 5:26 right now. in case you haven't heard, the president is coming to town.

the last few minutes is starting to clear. the first few cash lanes just off of the car pool lanes, from time to time there you see it. on the peninsula as well as the city we've got a pretty high profile visitor. you guys will talk about that. >> that's right. the president is actually touching down at sfo in just a few hours. he's scheduled to arrive around 1:00. after landing, president obama heads straight to facebook headquarters in palo alto. that is where he will hold an online town hall meeting. from palo alto to san francisco, where there will be two campaign fund-raisers, the nob masonic center and then a private dinner in pacific heights. $35,000 a plate. tomorrow morning president obama stops at a fund-raising breakfast at the st. regis hotel before hopping back on air force base one and flying to reno. the president's visit is not just exciting for us, it's actually making history. no other sitting president has used the internet to address the

masses the way mr. obama has. today he will use facebook to address millions. marla tellez is live in palo alto with how a bay area company is changing how the world communicates. good morning. >> reporter: good morning, laura. it is pretty remarkable to think that this company here on page mill road in palo alto, facebook headquarters, of course, launched initially to connect the younger generation, to make friends, share your photos, i'm sure many of you at home right now have a facebook page. well, now it's being used as a very effective communications tool for political candidates. for instance, president obama has just launched his re-election campaign on facebook. already close to 150,000 people like that page. now he used the social networking world during his run for the white house in 2008 and it proved beneficial. and today for the first time in presidential history, he will host a town hall meeting from facebook that will be streamed live on the website. 1:45 our time, moderated by

facebook ceo mark zuckerberg. and he has invited his more than 19 million friends to attend. now, interesting to note, thomas jefferson, he used newspapers to win the presidency. fdr relied heavily on the radio. jfk used television to his advantage and now president obama is making the most of the online world. >> you can't get everybody's e-mail addresses, i don't think, and facebook is just -- it's one of the -- i think the benefits of facebook is you can pass something along and it will go viral. >> reporter: what do you think about that, that you can like his re-election campaign? >> i think that's a good way to get young adults involved. >> reporter: the president says today's town hall will focus on the economy and getting americans back to work, but he's going to be taking questions. questions that are posted on his wall from his facebook friends and those will be selected -- the questions will be selected by the folks here at facebook.

one of those, young ceo mark zuckerberg. now for more on mark zuckerberg and his interesting voting history, we turn to scott mcgrew. >> mark zuckerberg for all of his influence on world politics, from egypt to america, doesn't vote very often. in fact reporters looking at his voting record, which is public, says he's only voted once in his life. the bay citizen says it found evidence he's registered to vote in his hometown in new york state. never voted there. then moved to california, registered in santa clara county and voted just once. now, that was in november of 2008. now, we have no way of knowing, obviously, who he voted for nor is that any of our business, but that ballot would have pitted then senator obama against john mccain. brent and laura. >> very interesting. 5:34 right now. and for everything you need to know about the president's visit, become a friend of our facebook page, nbc bay area morning news. we will have a link to the

president's schedule and how you can see his address. two people are recovering after a harrowing ordeal in the bay near san quentin. they had to be rescued after their row boat sank. christie smith is live at san quentin prison where an inmate actually helped with that rescue. >> reporter: good morning to you, brent. it's not often that people inside of san quentin prison have to leave the grounds and help pluck people out of the cold bay water, but that's exactly what happened here overnight. a tower guard apparently heard something around the bend coming from the water. it was quite dark, around 1:30 in the morning. that's when he spotted two people in the water, a man and a woman, yelling for help. their small boat had capsized. and the current, the water had pushed them toward the prison. we're told they were in that cold water for at least 90 minutes. local firefighters were called in to help out. it was quite a large group. but so did those behind the

walls, they helped out too. >> again, we have a fire department that's staffed by a staff firefighter, along with inmates. we have inmates the who are trained first responders. and so they were actually the first on scene and actually rescued those individuals from the water this morning. >> reporter: the inmates the helped? >> both staff and inmates here at san quentin, yes, ma'am. >> reporter: they physically got in the water? >> they physically got in the water and helped remove individuals from the water, yes, ma'am. >> reporter: we should stress they are clearly low-risk inmates that helped out. they are trained as first responders. now, it's believed that the man suffered cardiac arrest. firefighters, paramedics helped perform cpr on them. both were taken to marin general. it's believed the woman suffered hypothermia. highly unusual what's going on here at san quentin. lieutenant robinson tells us that while this rescue was going on outside, inside they had to make an emergency bed check, a count of all the inmates,

thousands of them here, to make sure nothing unusual was going on inside. reporting live at san quentin, christie smith, "today in the bay." it's 5:36 right now. this morning shock and disbelief in the east bay as a family struggles to understand why someone would shoot and kill a 33-year-old mother. flowers and balloons mark the spot where bea tris burton was killed on union street in west oakland. her family says the bullets were meant for someone else. she was hit several times. her boyfriend didn't wait for an ambulance, he tried to rush her to a local hospital where she died. her most recent job was at berkeley's oxford elementary school where he worked in the cafeteria. starting in may pg&e will begin testing the pressure in 150 miles of natural gas pipelines that are similar to the line that exploded in san bruin oh they will do water pressure testing to determine if the lines are safe and reliable. many of the pipes to be tested

are under highly populated neighborhood in the bay area. the first tests will be in antioch and mountain view because they are most similar to the line that exploded in september killing eight people. as profits for one water agency are going down the drain, more than one million east bay residents could soon may more for their water. rates could go up by 12% over the next couple of years. east bay municipal utility is facing rising costs and diminishing revenues. that loss in revenue is due to rising gas prices for the company's trucks and the fact customers are using less water than expected. a two-year proposed budget will be presented on may 10th. if the board likes what they see, a public hearing and vote will take place on june 14th. a 6% rate hike could kick in july 1st. you might soon get a ticket for going too fast across the bridge on your bike. early suggestions for a speed limit include a 10 miles an hour speed limit on sidewalks and 5

a new set of rules are on the way for the airline industry designed to protect passengers from a slew of travel headaches. kristen dahlgren is live in washington, d.c. kristen, the new rules will help from everything from lost baggage to oversold flights and

hidden fees. >> reporter: that's right, brent. passengers are pretty excited about the changes. listen to these numbers. last year the airlines lost more than two million bags, they didn't make it on time when the passengers got there, but they collected some $3 billion in fees. and so passengers for a while have said that's not really fair and now under these new guidelines, they will have to reimburse you if your bag doesn't get there. they'll also have to tell you all the fees up front so they'll have to tell you on the website when you're booking or talking to them about any baggage fees, about any taxes, about any extra charges for things like food. so you'll get all of that up front. also if you're involuntarily bumped, if you go, they have a ticket and tell you sorry, we've oversold, you can't get on the flight, you're going to get more compensation. if you're delayed two hours getting to your final destination, you can get two times your ticket price up to $650. if you're 38 delayed more than that, you can get four times, up
