cooling quickly towards this evening, leading us toward's a mother's day forecast today. we'll let you know what you can expect for your weekend plans coming up in a few minutes. new this morning, san jose police dispatchers say two people are unconscious and not breathing and another person is injured after an apparent triple shooting in san jose. it happened just before 5:00 this morning at mt. rush more and mt. prieta drive. police are not sure yet what happened so they're not releasing any suspect information. this morning surgery is on hold for brian stow, the giants fan who remains in a coma in l.a. after a beating at dodgers stadium more than a month ago. stow's family posted that overnight upsight on the website support for brian stow. stow is still in an l.a. hospital. snow's family says doctors are continuing to lower one medication at a time very

>> that was the vice president joe biden on sunday telling former presidents bush and clinton that bin laden was killed. in the new video, it also shows are clip of president obama congratulating lead advisors and these new pictures are from inside bin laden's compound in pakistan. intelligence officials in abbottabad says the compound is now clean washed of all evidence of sunday night's killing. bin laden was far from being retired and was still the operational leader of al qaeda. inside the compound they found details of terror plots from around the world. this morning's nbc's ann curry is on the ground in pakistan with reaction from al qaeda. >> coordinated protests announcing the u.s. raid that killed osama bin laden struck multiple cities in pakistan today. as al qaeda reacted for the first time, threatening americans on its official media website. quote, soon with god's help, we shall flip their celebrations into sorrow and their blood

just like all of the other teams, they cannot practice or even show up to their headquarters because of the ongoing lockout. so they're holding secret practic practices organized by the players themselves. we can't tell you where we shot this video for security reasons, but we can tell you that we spotted alex smith, patrick willis and others showing up. the players are also getting together on their own outside the lockout. a pioneering legend of golf has passed away after a long battle with cancer. ballesteros died in spain. he made his professional debut in golf at the age of 19 and he was also one of the original members of the european ryder cup team.

the power to order your car impounded and towed even if there's another driver licensed and ready to take your car? here's the story of a family who claim their car was towed illegally and their legal challenge has changed the way now police operate. >> reporter: june 27, 2010. lupe and her family are heading through mountain view on their way to sunday brunch when a mountain view officer pulls them over near this intersection. the police report shows the stop was for a nonworking taillight and modified exhaust pipe. >> he just told him to get out of the truck. >> reporter: lupe says the officer immediately asked the driver, her boyfriend, if he was in a gang. her boyfriend was arrested for driving without a license, but lupe says when the officer ordered her and her sister out of the car along with their four young children, things went south. >> they didn't check my papers, they didn't look at them or

anything. to see if i was the owner of the car or anything. >> did they look at your license? >> huh-uh, no. >> reporter: she says within minutes a tow truck arrived and took her car to an impound lot where it stayed for 30 days and cost $2,000 to pick up the car. that's when lupe sought help. >> this officer was the person that caused the taxpayers of mountain view to cough up $15,000. >> the attorney represented lupe for free because he says it was a case of an officer acting badly. >> even though my client provided registration and provided a license and said i could take this vehicle home, that was when he crossed the line. the law on this situation is very, very clear. it's called a community care taking function. that's the only reason a police officer can impound and toe your vehicle. >> basically what that means is that in most cases an officer

can only order your car to be towed and impounded if it poses a danger to other drivers, for example if it's blocking a road. but if your car is parked in a safe and legal spot or you can have someone else safely move it, then your car is protected from being towed. the family claims that when the cops took their car, they violated their fourth amendment rights. >> it was illegal, it wassism proper. >> while the police do not admit wrong doing in this case, they did settle with lupe for $15,000 and they sent this memo to officers telling when toeing a vehicle is proper. it says the vehicle should be released to another driver at the scene. the officers may impound the car of any driver who has previously been cited for driving without a license. it doesn't tell officers to stop towing cars, but -- >> they stopped towing cars. >> jeff owns one of five

companies towing companies for san jose pd. >> we're talking tens of thousands of dollars, yes. >> reporter: does that mean officers were calling for too many tows in the first place? the city declined our request for an oncamera interview. we do know that mountain view took in $85,000 in tow fees, that's up from $72,000 in 2009 and nearly double what it was before. >> unless your car is disabled completely, they don't seem to be towing any cars. >> towing in nearby cities has also gone down drastically. he worries it's creating a public safety risk. >> i think any officers i talked to are frustrated i think is the best term in that they know that this same car is back on the road. >> lupe stands by her charge ll saying people should know about their rights and speak up when they're wrong.

it's cloudy outside, maybe not the best day for baseball, depending on who you are, pitchers or hitters. >> you weather guys have an interesting way of looking at just about almost anything. there are thousands of games that researchers looked at from the american meteorological society. 1987 to 2002. and you guys found out there's definitely an advantage. >> statistics, baseball's all about statistics and they looked at 10,000 games and said here's the numbers they came up, with cloudy versus sunny, as you're about to see with some of these numbers. you can see that cloudy skies are better for batting and fe t fielding. it's tougher if you're not familiar with the ballpark and the glare on the baseball makes it better for pitchers to strike out batters. the strikeouts higher on sunny days than on cloudy days. now here's a statistic that actually jumps out the most, for your home team on a sunny day, you'll win 56% of the time.

the visitor only 44%, compared to 52%, almost 50/50 on a cloudy day, but a higher advantage relatively speaking on a sunny day. so you would want the sunny days if you're the home team. >> well, i don't know, you also want big hitting, so if you're a fan, you want to root for clouds. >> in that case we start talking about places like chorus field that have the lower atmosphere and other things. the wind resistance also comes into play. for us we would want that sunny day to get in the home team with the giants. our temperatures this morning, they have been fairly cool. we have had the winds, i think around first pitch, we could be in the 50s today and we will see partly cloudy skies heading on into tonight. temperatures this morning, we have got 40sz and 50s outside. that is a good, healthy sea breeze, no real worries about rain, other than the fact we do have some drizzle. but the sierra, that's where the

interesting weather is going to be to wrap up the weekend today, near 60 degrees in the high country. but tomorrow, if your mother's day plans include sierra locations, look out for snow near 5,000 feet, but back to the bay area, i don't think we're going to see anything like a washout for tomorrow. but we'll certainly see some cooler temperatures and maybe a stray shower or two. we may get more drizzle tomorrow morning and kind of a cool finish to the upcoming weekend. high temperatures quite a bit cooler than the last couple of days. we'll see temps close to 60 in around san francisco. and you can in. those numbers ay, running an. those numbers lot cooler. 60s and 70s today, so windy and cooler today, we're going to get the clouds filling on in. as we get the clouds tonight, and cool mother's day for now, a business breezy and we'll see that all those showers stay off to the east of us.
