good morning, i'm kris sanchez, coming up on "today in the bay." street geyser, a soggy day in the bay for an east bay burger joint. and fire rips through las vegas. and sony on the rebound after its hacking disaster. but is your personal information any safer? and on your mark, get set -- go. the bay area's wackiest foot race is getting under way for the 100th time today. it is sunday, may 15th, this is tod"today in the bay."
7:01 am
take a live look at lots of blue sky over san francisco this morning. but we're going to see rain, still, in the forecast. thanks so much for joining us, i'm kris sanchez, along with meteorologist rob mayeda. that's a nice sight to see. >> but the weather may be as wacky as some of the outfits we're abo to a see on bay to breakers. it's chilly, we've got cool air in. mid 40s for temperatures for most of the bay area right now. it's a little breezy, but things are relatively dry. as the race continue throughs the morning, we're still calling for the slight chance for a few showers mixed with sunshine. and by late morning, there's a chance for some thundershowers. now most showers you're seeing now aroundnd summit of highway 17, a few around san jose and the santa clara valley. the east bay relatively dry. we'll see a few isolated showers crossing the bay area. in the meantime, look at the sierra, stage one of the amgen supposed to get started at 10:30 this morning. it's snowing like crazy now. hour by hour, we're going it
7:02 am
someday cool, highs upper 50s, low 60s. our chances for thunder and hail today and the in-depth view of the sierra forecast and see if they'll get the amgen under way this morning. thank you very much, rob. this morning, two men are dead after a shooting near park and san francisco's vernal heights neighborhood. this happened last night on appleton avenue next to holly park. police say they found the bodies of a 21-year-old man and a 26-year-old man in the street and a nearby court yard. a 30-year-old man was shot, but is expected to survive. police do tell us that they questioned and detained several people at the scene. also this morning, san francisco police want you to look at this picture -- investigators want to track this man down. because they suspect he is using the bank accounts of an elderly homicide victim. police say they have spotted the man on surveillance video accessing the accounts in san francisco and throughout the bay area. the accounts are in the name of
7:03 am
74-year-old joseph williams, who was found dead in his apartment on fulsome street two weeks ago. police are treating the death as a homicide. but so far, they are not saying how he died. and legal troubles for the oakland unified school district now for which is being sued in federal court for a deadly officer-involved shooting outside a school van. the lawsuit was filed by the mother of the victim's unborn child. the victim, 20-year-old rahim brown, of alameda was sitting in a parked car with another man with the car's hazard lights on on the night of the dance on january 22. police say that's when they approached brown, he tried to stab an officer with a screwdriver and the officer shot in self-defense. the car had been stolen earlier in the day and brown's mother said her son was likely going to use the screwdriver to start the car, no the to stab the officers. this morning fire crewing are mopping up an in and out

parking lot after someone clipped a fire hydrant. water shooting up into the sky, nearly submerging the entire lot in oakland. it happened near edgewater drive and hagenberger road. the water is shut off but the clean-up continues. tomorrow, injured giants fan, brian stow is expected to return to the bay area more than a month since he was beaten outside dodgers stadium. we expect an update on stow's condition in just a fewer hours from the neurosurgeons who are treating him in l.a. he is zabl enough to be moved to san francisco general hospital, perhaps as early as tomorrow. stow was taunted, beaten and kicked by two men outside dodgers stadium on opening day. his attackers remain at large. san jose's medical marijuana businesses are proving lucrative for the city but the cash flow will be short-lived. voters approved a 7% tax on marijuana sales and in the first month the taxes were due, about 70 collectives paid about $290,000.
7:05 am
however, the revenue will drop as the city council voted last month to cap the number of collectives in the city to just ten. the city of san jose is grappling with a $115 million deficit. new this morning, sony is beginning to restore its online playstation video network three weeks after hackers stole personal information from millions of users. sony said it's beefing up security measures with increased encryption levels. the company also says it will offer a welcome back package to users that includes some premium content. and they're off -- the 100th anniversary of the bay to breakers just got under way. more than 55,000 people are registered to run the 12-k event. but this year it's going to be a little bit different and we'll get to that the video in just a little bit. we don't like to take it live, i think you know why.
7:06 am
a hospital a few minutes ago, a new peninsula hospital opened its doors after 11 years in the making. the mills peninsula hospital is no ordinary hospital, it's designed to withstand an 8.5 earthquake. also this morning, mother nature is meddling with another major race in california. the amgen tour of california bike race is supposed to start today as rob mentioned at the hechely ski resort in tahoe. the first leg is scheduled to go around the lake. but snow is falling right now as we speak. so organizers may have to scrap the first day and instead start on monday from squaw valley heading towards sacramento. either way, the race will likely cruise through the bay area for stage four. bicyclists are scheduled to ride from livermore to san jose on back roads towards mount hamilton and then the race heads south heading towards thousands oakes and then to southern

7:09 am
if you are in san jose, you may not care what the weather is going to be like, because at 5:00, the sharks are taking on the ice, they're playing the canucks in canada. well an international sex scandal under way this morning and its epicenter is here in the bay area. as nbc's katie tour reports, one of the world's top financial leaders is under arrest this morning, accused of sexually assaulting a manhattan hotel maid. >> police sources say a 32-year-old hotel maid claims dominique strauss-kahn emerged naked from his bathroom, threw her down and tried to sexually assault her. before she was able to break free and run out of the room.
7:10 am
the hotel was abuzz with activity overnight as rumors a scandal between the head of the international monetary fund and a hotel maid spread. police say they found his personal he cans in the hotel room. the nypd and the port authority police took the well-known politician after an air france flight at jfk just minutes before takeoff. the 62-year-old father and husband has had a history of sex scandals, apologizing in 2008 for an affair with a monetary fund staffer. >> that was the report from new york city. early this morning, strauss-kahn was charged with attempted rape and unlawful imprisonment. his lawyers say he denies those charges. and this morning, water is spewing through a mississippi river flood gate and thousands of people are bracing for more flooding. over the next few days, towns like the swamps of the cajun country in louisiana will be under 10 to 20 feet of muck
7:11 am
thanks for water flowing through the flood gate that was opened yesterday to ease pressure on the mississippi river and prevent flooding in large cities like new orleans. one or more flood gates may also be opened today. eventually more than 3,000 square miles could be covered with water. and new this morning, in las vegas, more than champagne dreams and savings are going up in flames just before 1:00 this morning, an electrical transformer exploded near the monte carlo resort in las vegas. parts of northbound i-15 were shut down because there was low visibility from the heavy smoke. authorities on scene report no injuries among guests and hotel workers, but in las vegas, one more sight to see. the list of republican presidential hopefuls is a little shorter now. former arkansas governor, mike huckabee, said he will not run for president in 2012. he made that announcement on his fox news show last night, saying he appreciates the encouragement from his supporters, but his heart says no.
7:12 am
recent polls shows huckabee at top or near the top of republican field of candidates. he and former massachusetts governor, mitt romney were within a point of each other as the party front-runners. much more ahead on "today in the bay." still to come, great heights, a local climber takes on mount everest. and some nfl players golf while they're on lockout, but chad ochocinco is riding bulls. you would think there would be a clause about that, rob. >> a bit of sunshine, ome te w showers lurking and a chance for thunder later on today, your forecast is coming right up.
7:14 am
7:15 am
drunken behavior. so if you're headed out there, do behave. now to a follow-up story we brought you in march. we first met 53-year-old tech executive mitch lewis as he was training to summit mount everest. part of an even bigger personal goal. >> run marathons on all seven continents and climb the seven highest summits on those same seven continents. >> we're happy to report that about 8:30 thursday morning, mitch lewis reached the summit of mount everest. >> this morning, at about i think around 8:30, mitch lewis and lafa neru sherpa reached the summit of everest. >> now he's in the history books. lewis already summited five of the other summits, seven in all, that he wanted to. and he ran marathons on all seven continents. so when he returns to santa
7:16 am
clara, lewis will start training for antarctica's mount vincent. he would have gotten good weather training here in the bay area for that kind of weather. >> you got to be in amazing shape to do that. congratulations as we watch the cold temperatures here relatively speaking. we had good rain event overnight. a lot of this falling from 11:00 last nye to 4:00 a.m. of the most places around the south bay pick up a quarter-inch of rain. san rafael, a half-inch of rain. in san jose, rain off to the west. oakland, winds off to the west, winds southwest at 16. this is the trend of the day. sunshine at times, roaming showers at other times, with the heating of the day we may get some isolated thunder later on. right now around highway 17 you can see a shower. east bay hill tops, around the altamonte pass, we've had a shower this morning. san francisco looks add, but let's widen it out, you can see to the west, later this morning some showers lurking offshore
7:17 am
will cross over the peninsula. where all the action is right now unfortunately for the amgen folks is for snow around the sierra. we'll see a clearing line approach later this morning. it's still a game-time decision, they'll make the the decision at 9:00 whether stage one will get under way. around the bay area, it will be a mixed bag, but don't let your guard down. we'll see some scattered showers around 3:00 this afternoon, these may include some thundershowers, given the cold air aloft. for your tomorrow morning commute, we'll probably see some areas of light rain across the north bay. the evening commute tomorrow looks petty sloppy. more rain coming into tuesday morning, and then scattered showers and the second half of the week looks better in terms of the warmer temperatures and drier forecast on the way. today, even with the sunshine, it will be cool, upper 50s, near 60 for the high. around san jose, cooler around san francisco, all day we should be in the mid 50s around the
7:18 am
peninsula. and look for the high for truckee, 37 degrees. needless, to say with four wheels, it's tough driving. i don't know about two wheels and high-performance bikes. next round of rain and thursday and friday, 70s coming back. showers lingering into wednesday. so this is hockey weather with the sharks coming up. >> it's too bad they're not playing at home. it's perfect hockey weather. thank you very much, rob. the sharks continue their quest for stanley cup today. for the third time in its 20-year history, san jose is playing in the western conference finals. we caught up with the team at their last practice before heading to vancouver yesterday afternoon. >> think if you're at home or on the road you're thinking, get the first game, get the first game, and then that's what we're looking for, yeah. >> game one is tonight at 5:00, go sharks. chad ochocinco walks the walk and talks the talk on the field. but can he take the bull by the
7:19 am
horns off the field? >> just like that, chad ochocinco -- up and out of there. >> from cowboy up to cowboy down, a locked-out wide receiver gets bucked in one and a half seconds. i think ear supposed to hold on for eight, right? ochocinco manages to make it safely, narrowly, avoiding getting stomped by the bull. although he couldn't hold on to the rope, he's holding on to his sense of humor. >> i don't have the words to describe the power coming out of that gate. i think if you tied me to the bull, i still would have failed. >> ochocinco did raise thousands of dollars for charity and also got to cross bull-riding off his bucket list. i thought there would be a clause about doing that sort of thing in the off-season. much more ahead on "today in the bay." still to come, does the flunking state budget crisis have local kids bailing out of public schools? we grade the state's school system with our political analyst, larry gerston, just
7:20 am
ahead. good morning, i'm mike inouye and there's lots to do from "today in the bay." i got a shout-out that bart is starting early to accommodate the extra crowds heading to san francisco for the 100th annual bay to breakers race. new for 2011, alcohol and floats are forbidden. but infamous centipedes are not just allowed, but encouraged. and the seven and a half-mile tradition where racers run and run amuck is guaranteed to have throngs crossing the city and more than a few will likely be crossing the line. wearing nikes, that's what they'll be doing there. then we'll transfer to nike herself, the greek goddess of victory, she'll say you're winning at the oakland greek festival. with greek music, greek dancing and greek food. they'll be shouting opa! and serving flaming cheese and i'm sure you can strike up a
7:21 am
great conversation about columns, i find that interesting. it's if all greek to you then maybe the auto cross is your language. the dual at deanza is a competition that focuses on car handling and driver's skill rather than all-out horsepower. i hear it's one of the largest and oldest auto cross events in the country. you could see some of the largest and oldest autos in the area. i'm getting older and larger
7:23 am
that's what's going on "today in the bay." you have yourself a great one. taking a liven look at the preps for bay to breakers, you can see the costumes out in full force. in order to run you have to have a racer's bib. 55,000 people are registered. if you are not, you can still show up on the sidelines. cheer them on. and this morning, it is
7:24 am
front-page news, california public schools could go forgo five weeks of instruction this fall unless democratic governor jerry bround and the legislation reaches an agreement on the state's $14 billion budget deficit. for more on this let's bring in nbc bay area's analyst larry gerston. they don't believe this is real. this just seems very surreal. five weeks of instruction loss. >> and nothing in this state gets to people more than the future of education. not only because of the lack of instruction in this case we're talking about. but also, what do i do with my kids after school, this kind of thing. we've got a very real issue that's right before us. there's no question because of the relationship, kris, between the state budget and school funding. by law, by law, schools in california must receive 40% of the state budget. okay. we've got a $14 billion gap. well, that $14 billion gap means a loss of $5.6 billion in state
7:25 am
aid. look, the math here is pretty simple. each week of instruction costs roughly $1 billion. $1 billion a week for k-12, okay? how do parents cope with this? this is a real problem here. >> how will they do it? are we talking about now, subsidizing our public school system? i know in some schools, one school, parents at the beginning of the year write a $150 check. there are fundraisers and all kinds of things. >> some affluent districts have done incredible jobs. beverly hills the other day in one week raised almost $1 million. but not all districts are bevelly hills, right? here we're seeing a couple of things here. read between the leaves, if you will. what you see is a sizeable spike in private school enrollments. this past year, the number of kids in california private schools soared from 513,000, to 673,000. that's almost 10% of the entire
7:26 am
school age population. that is a huge change, chris. >> and but there's a shift, too. when you start going into the public school, your kids are not in the same you know -- social group as they were before. >> yes, that's again, you got to read between the leaves here. what we see is a great difference in composition. ere's no question about it. about half of the kids going to private schools now. are white. well, only 25% of the kids in public schools are white. so there's a big difference. now none of this should be a surprise. if you look at the median personal incomes of whites, it's $35,000. compare it to $28,000 for asian americans, $26,000, for african-americans. $19,000 for latinos. you put it together and you see some are clearly more affluent than others. but the bottom line here, the bottom line is that the lack of state support for public education has yielded a new segregated pattern in california school system. people don't like to say that
7:27 am
word, but that's exactly what's emerging. >> well we'll keep watching this one for sure. thank you very much, larry. starting a little bit early today is our business and technology show, "press here." scott mcgrew has a plea view. well thank you for letting us have a half an hour of your news tomorrow. we'll run ""press here" at a special time. to make way for toker. steve levy is a top tech author, he spent two years behind the scenes for google for his book, "in the plex." and "u.s.a. today" reporter john schwartz will tell us about facebook's embarrassing week. the company's pr firm tried to bully reporters into emphasizing google. we want to thank you so much for making us part of your morning. we'll have more local news for you tonight at 5:00, 6:00 and 11:00, and any time of day on
