get ready to raise taxes himself. a live look outside. beautiful bay bridge on this tuesday, may 31. this is "today in the east bay." whatever it takes the lee-day weekend is over. it is tuesday. good morning. thanks so much for joining us. i'm laura garcia-cannon. let's see what's in store in the weather department. >> i would love to tell you it is going to be a beautiful day but it is just not going to be a beautiful day. i know. we got bad news for you this morning. showers passing through all over the east bay this morning. and also the peninsula getting hit hard. we are going to show you where the showers are headed and how long they are expected to last today and then get into our next round of rain which moves in tomorrow. let's check your drive now with mike. >> good morning. we will take you to the north bay where i have been following this accident. had a full closure of northbound 101 right around san antonio

road. then reduced to one lane. sounds like both lanes are open. but this is because of a deadly accident that happened. you are talking about rain coming through the north bay. it was not a factor as far as the report goes in the accident but there was still wet roads and accident early morning heading up through petaluma. smoother flow now heading past the scene and southbound side past highway 37. nicely down towards san rafael and golden gate bridge. live look shows thank you sheen on the roadway. it is still wet out there as christina has been talking about. >> take it easy as you head out the door this morning. more questions being raised this morning about the disappearance of a hayward nursing student missing since last friday bob redell joins with us an update. >> reporter: michelle le was studying to be a nurse. she was here in hayward friday night doing a medical rotation as part of her course work here at kaiser. she took a break at 7:00 with her class and left.

got in her car and was scene on surveillance tape at kaiser. they saw her leaving the parking garage as located on site. a while later police found her car parked in a neighborhood. just a few blocks from here. the car was locked and it was secured with some valuables left inside. but she does still apparently have her cell phone which she has not answered. that's one reason her family thinks this is suspicious. that's why they are putting up fliers and offering a $20 though thousand reward because they say that this would be unlike michelle to just get up and leave without telling anyone. her brother tells us she is very responsible and calls him on a regular basis. >> she's always been a better -- a better child, daughter, than i have been a son in my opinion. she's always -- protected me ever since our mom passed away, like ten years ago when we were -- when i was 11. she really became like a mother

figure to me. and almost overprotective because i'm -- i'm 23. she's still -- she still tries to take care of me as best she can. >> reporter: another reason for concern, michelle le apparently told her classmates on friday that after class, she planned on driving to reno to visit friends. something clearly she did not do. hayward police is investigating. what makes this case suspicious in their eyes is the fact that michelle did leave valuables in her car. that's not the m.o. of someone planning on running away according to police. reporting live here in hayward, bob redell in the bay. an accident that killed a pedessian in the south bay. closed part of an expressway for a time. a pedestrian was struck and killed on the expressway just north of bud avenue. officers say they found the victim around 11 cloak last might. southbound lanes closed to traffic as emergency crews responded to that scene.

those lanes have now since been reopened. the chp has not released any additional information about that accident. this morning, a horrific accident in the north bay. highway patrol is investigating a deadly crash on northbound highway 101 in marin county. it happened just after 1:00 near san antonio road. chp says the car reportedly crashed into the center divide and van then crashed into that car. the police are hoping to have more information this morning on the city's first homicide since wooin. officers found 43-year-old alfredo rodriguez on south main street with a gunshot wound yesterday morning. he died at a nearby hospital. rodriguez's family says the death is a huge blow, especially to his three children. one of them is just a few weeks old. they applause placed plowers and candles on south main street in his memory. police are looking at surveillance video taken from the nearby market to try to find

rodriguez's color. he had would -- milpitas had two homicides in 2009. police are investigating rodeo's first homicide of the year. christie smith is live in rodeo with more on the story. good morning. >> reporter: good morning to you. investigators will finally have a chance to go through the van that the victim was sitting in and say that could be key to figuring out exactly why this happened. they were waiting for the coronerer to leave which happened, shooting happened right up the hill there where you can see there's evidence markers all over the street here. here is what we know. neighbors called this in around 10:40 last night. reported hearing what they called a barrage of gunfire. when deputies arrived, they found the victim in a van who had been shot several times they are working on identifying him right now. they tell me, though shall at this point they only know he's a white male in his early 20s. they found nothing unusual outside of the van. they believe that the shooter may have come up on foot and

that the have been tim probably lives in the area. investigators tell me that shootings around here not totally unusual but homicides certainly are. this is believed to be the first one of the year. they are also telling me they are not getting a whole lot of cooperation from neighbors yet. so they will be back out here in the morning. seeing if they can make that happen. they are also going to have the streets around there closed down for at least another 90 minutes while they continue investigating. reporting live in rodeo, christie smith, "today in the east bay." it is 5:06. dozen of dui cases could be dropped because of a faulty breathalyzer. santa clara county prosecutors are about halfway done filtering lou more than 800 dui cases. so far, they dropped charges in one dui case and found just a small percentage of others and may have to be dismissed or wiped off the driver's record. the 42 questionable cases so far involve drivers that refuse to

take a second sobriety test at the police station. leaving the faulty breathalyzer as the main evidence. san francisco's sheriff is at odds with the federal government over a new immigration policy. under the department's plan, illegal immigrants arrested for petty crimes will not be held in jail longer than necessary. even if federal agents want to detain them for possible deportation. starting on wednesday, sheriff deputies will treat those eligible for release like u.s. citizens. they will be cited and will have to appear in court. the policy is the sheriff accident's way of complying with a city law forbidding police from aiding the government in nonfelony crimes. and the u.s. law requiring the police to share fingerprints with immigration agents. san francisco mayor ed lee wants a 1% sales tax replaced if the state can't extend it. lee is expected to propose putting it on the november ballot. a city sales tax measure when he

presents his budget plan to the board of supervisors this week. if jerry brown is unable to extend a 1% sales tax he would like san francisco to consider doing one of its own to make up the difference. he said a hatch cent sales tax would help pay for things such as health services. lee is also expected to propose cuts to city departments and programs when he lays out his budget plan next week. social services and the police department are the biggest targets as the city works to close a $306 million deficit. good news, however. increase in tax revenue and improving economy could mean no widespread layoffs, closed fire stations or political battles. we will see about that one. reports say that the city has a surplus of $62 million from tax revenue. no more political battles by politicians. wouldn't that be great? >> great day in the forecast maybe not either. we are going to have to wait through 2012. going to get past 2012 and then maybe a break. looking good now.

we have showers coming down across the bay area. north bay getting a break right now but rained overnight. basically all night long you were getting hit with light showers. watch out for slick conditions up there. right now it is the east bay that's seeing the bulk of the moisture. passed through concord. watch out for showers between okay land and fairfield the next hour or two. but your futurecast shows you by 3:00 m.m. we will see a mostly clear bay area. it will still be gray and overcast at that time. and the breeze will substantially pick up. we are talking about downright windy conditions later today. as our next system moves in and the system impacting us now moves out. 56 degrees in oakland. 5 in sunnyvale. 51 degrees in santa cruz. we are only going to hit the low 60s, maybe even just 59 degrees in the city today. cool day. also expecting significant fog formation. we head through the next couple of hours. do not fret. mike and i are all over that. mike is watching a couple of things. >> good morning. do not fret for the maze as well. looking at a nice flow of traffic around the approach to the bay bridge. i will take you back up to the

north bay and showed thank you video from the -- crash in -- we are showing in petaluma. that was a deadly accident accident. one lane is cleared. one lane blocked by all of that. still clearing vehicles from the roadway. but this is not impacting traffic. i misunderstood the chp report. lane blocked but no problem for the northbound flow past that scene. still going on with that investigation and activity will. southbound your commute direction looks fine here. 880 past the oakland coliseum. nimitz freeway shows a nice flow of traffic at oakland. there you go with headlights past the coliseum. southbound inside. glow to the lights you see, there is moisture in the air. christina talking about. east bay getting hit with showers. getting close to the san mateo bridge. nice flow of traffic. 580 coming off the boulevard. reports of a deer running around the lanes there. watch for that for 580. closure for eastbound highway 4 in antioch where christina did show rain coming through the area as well. no slowing but should have that construction picked up and

tuesday morning. taking a live look outside. hp pa viv onin san jose which will be home to britney spears saturday night. hit me baby one more time. maybe you will be heading to that concert. stamford professor could get the nod to become the next ambassador to russia. president obama is expected to nominate the political science professor and leading expert to u.s./russian relations to the post. he is currently the president's top adviser for the national security council. he's also a key figure in president obama's reset policy which aims to promote shared economic and mutual understanding between both nations. mcfall served on the president's transition team after the 2008 elections. the house is getting ready to vote on a plan to raise the country's debt ceiling by $2.4 trillion. the vote will come after the close of the markets today. it is mostly ceremonial. measure not expected to pass because it has no spending cuts

for how the markets are reacting to this and all of the day's news, we turn to nicole lapin at cnbc headquarters. good morning. how are you? >> good morning, my dear. also that is why they are doing this after the markets close because they don't want to disrupt what it was like in 2008 when we saw the biggest drop in the stock market ever. just to give you a little tidbit there. futures, though are high they are morning, laura. stocks lost ground as you well know on europe's ongoing debt crisis last week and weaker than expected data on manufacturing, housing, and consumer spending. asia rose overnight. that came over to europe and then that's coming over to us. we are watching a couple of key economic reports this week. topped off. cherry of them all on the sunday, friday, key jobs report. today we are looking at home prices, manufacturing, and consumer confidence. but to recap on friday, the dow actually rose but was down for the week. 38 points is what we gained

friday, 12,441 is where we close. nasdaq composite added 1327.96. with nearly 5 million homes lost in the foreclosure possible necessary the past five years, more than 500 u.s. cities are announcing larger percentage of those properties that become rentals. "usa today" says the biggest shifts were in irvine, california. that went from 40% to nearly 50% rentals in the past decade. then there's philly at 46%. baltimore, minneapolis, sacramento. shifted to a majority of rentteres over that period. california, arizona, they had the most cities where the share of renters grew at least 5%. this morning consumers, as you know are using apps to make appointments for just about everything and anything. now add clips to the list. rolling out their app this week. letting folks put their name on a virtual blackboard to be first in line for a haircut. 3,000 locations across the country. l.a. fitness is letting people book time with trainers or reserve racquetball courts.

ice cream. can't beat that. rain or shine. there is relief in sight. rain is expected to hit that area on wednesday. now what about us? last week i didn't wash the car because -- well, it was raining. then i got lazy. now this week i guess the -- warn sing on again. don't wash the car. >> hey, hey, keep it lazy. keep it lazy. staying breezy today. we like that. save your time for important things like watching television and watching this program. and forget about washing the car this week. i think we will see enough rain to where you can park it in an open space. you will get enough moisture to give it a pretty good cleaning. especially as we head through the weekend. that's whether the strongest rain arrives. this morning, slight spotty activity. good round of rain move through the north bay overnight. that has wrapped and now east bay that's getting hit. really not all that hard right now. we did see a few light cells just past through oakland and little bit of rain went through vallejo and fairfield. a drying trend now. lit not last long. warm moisture streaming onshore as we head throughout the day

today. this is not a wet system. this is a cold system. as we head throughout tonight temperatures will drop. we are only going to break into the upper 50s in this t city today. 59 degrees is the forecasted high in san francisco. 65, though in san jose and 66 degrees in gilroy. associated with the warmer temperatures we have this time of year and the instability brought on by the system pushing onshore. we could see pop-up thunderstorms today. so severe weather although it is very, very slight chance. and it is possible, especially in the sacramento valley, 63 degrees by thursday. dry break. then -- another round of rain moves in friday into saturday. we will see a few showers early sunday. finally some clearing on monday. but hey, tomorrow is the first of june, laura. >> isn't that crazy? >> yeah, it is. nuts. >> all that snow in the sierra over the weekend. skiing in july here. little bit of something for everyone. new explosion at japan's nuclear power plant. we have the details coming up for you next. >> i'm in important scott

your morning commute eleofefg:we >> welcome back, everyone. it is 5:22 now. beautiful live look at the golden gate bridge this morning. starting today, you know, west side, golden gate bridge, it will be closed for seismic retrofit work. bicyclists and pedestrians will have to share the east sidewalk for four months until september. bike riders will 24-hour access while bridge walkers can cross from sunrise to sunset. it is the last days of the project to retrofit the bridge.

i want to check the bridge and other highways out there with mike inouye to see if traffic will pick up today as folks head back to work. >> we will assume it will be heavier today because it is tuesday and back-to-work tuesday like you said. definitely looking towards livermore coming out of the pass. 580 moving slowly. 14-minute drive. 5:23. things should get more crowded. a little bit coming off the pass. all the way over on the right side of your screen. low clouds hovering around, moisture, rain in the east bay. south bay moving smoothly. 45 just changed over on the right side again, tully road. that's the first indication heavier flow of traffic. that particular off ramp is what causes that -- slowdown for that sensor. getting through san jose and out of san jose, set up for a drive. 237. there's stanford. looking at a nice drive up 101 and dunbarton bridge and san mateo bridge. 92, no major issues. speeds close to the limit.

liquid fuels from smokey fires. they had a square at the fukushima daiichi plant this morning. a loud explosion was heard from outside the reactor building on the south side. the plant operator says the explosion was likely from the gas tank and didn't cause any additional radiation leaks. the cause is, however, being investigated. plant workers also found an oil spill in the sea near two other reactors. the spill was contained by an oil fence. turning now to the tech world this morning, a lot going on in social medimmediatmedia. >> thank you very much, laura. we are going to start with the twit they are morning. that looks as though twitter can be getting into the photo sharing business big time. reports suggests twitter is planning to launch photo upload and sharing service possibly this week. it is a bit of a risk because it could upset third party developers such as twit-pick. social networking site linkden

is expanding in asia. it is hoping to tap into that huge pool of professionals. it is still on a high after doubling stock prices after the initial public offering earlier this month. meantime, anticipation of game maker zinga's public offer sing growing and it is expected to top linkden's ipo. but even before that, zinga plans to launch a new game. some suggest that it could be -- the biggest launch to date. our scott budman will have more on that a little later today. today is a lot like a monday after a long holiday weekend. so we wanted to give you a hug. and this may be the ultimate kitten hug. take this. take a look at this. so far, 15 million people have already watched it on youtube and it is worth it. watch as the mama stretches out and then pulls her kitten in even closer. if that doesn't make you feel warm and fuzzy. i don't know what will. >> that's sweet, precious. >> love it. love it. >> i'm ready to give you a hug.

record keeping is the reason police are still looking for one of the men who attacked a giants fan, brian stubb. a live look at the golden gate bridge. what a beautiful bridge. gorgeous area. the weather, not so much. it is tuesday, may 31. this is "today in the east bay." it could really be a mice morning. overcast skies, great bay area feel. we will make a positive spin it. 5:positive now. plaets get started with a look at the forecast with christina. >> yeah. it always looks better until you hop in your car and get stuck in traffic because it is raining. it is not that bad right now. certainly enough to stump a morning commute. smooth drive. probably not going to find that in the east bay where we had consistent shower activity. over the past half hour, more streaming onshore as we speak. pinpoint the showers where they are headed and how long they are going to last. then we will talk about the next round of rain and wet, windy

pattern we have to deal with all week long. first let's get you to work through the showers with mike. >> good morning, christina. right in the area where you have shown on the map rain coming tlup ant yok. that's where we see the activity. first of all, construction, that's picked up in the eastbound direction. sensors should wake up in a few minutes. westbound speeds dipping down below on 50. that's where you see the yellow coming over from g street over towards horizon lane. little bit past there. typical start for tuesday. we should see a bigger slowdown through the area. we will watch to see if it is as heavy as we saw last week. north bay, earlier closure of a lane in northbound toen tosan a all activity cleared. both directions clear for the morning commute. wet roads continue for that area as well. >> thank you very much, mike. 5:31 now. police are investigating the city's first homicide in rodeo of the year. christie smith is live there where police say they are not getting very much cooperation from neighbors. good morning. >> reporter: good morning.

yeah. in fact, between haven't seen any neighbors out here this morning. investigators are still trying to piece this together. they tell me that they really wanted a chance to go through the victim's car, shooting happened up the hill here on tullaby court. they are waiting for a tow truck to come in and get the victim's car out of here. it should be here soon. this is about 10:40 last night. neighbors called 911 reporting hearing a barrage of gunfire outside. deputies arrived and found a man shot to death in van here. they tell me it appears he was alone. they believe the shooter probably walked up on foot and just opened fire. the victim at this point only identified as a white male in his 20s. they believe he probably lived in the neighborhood. what set this off, though, they still don't know. they tell me then found nothing unusual, no drugs or weapons outside the car. and, again, as you said, deputies tell me they are not getting a lot of cooperation from neighbors this morning. so they are hoping to try to

reinterview people later on this morning. they tell me that actually hearing gunfire in the neighborhood, not totally unusual, but homicides certainly are. they tell me this is the first one of the year in the city. reporting live in rodeo, christie smith, "today in the east bay." >> thank you very much. 5:32. oakland police are still looking for people responsible for a sunday night double homicide. 28-year-old la toya kenny of union city and 29-year-old eric bush were shot on international boulevard near 88th avenue. the shooting happened after a memorial day party hosted by the dragons motorcycle club. in front of the club are tire marks from a side show that began after the party. >> like young kids having fun and everything. next thing you know, pop, pop, pop, here comes shots. so sad two of them got killed and one wounded. she is still in the hospital fighting for her life. >> a member of the motorcycle club tells the bay area news group that the club's barbecue has ended long before that side show began.

fire crews in the east bay are being called into question after witnesses say that they lawn watched a man drown in the waters off offal immediate. shoreline drive near willow street. alameda police and fire responded quickly after a man walked into the water fully clothed. witnesses say that emergency crews watched from the shore it is a man bobbed in the water for almost an hour. police is issued a statement saying that the fire department is not certified to do water rescues. the coast guard was called but they arrived too late. a woman swimming nearby ended up pulling the man to shore but he was not responsive. this morning, the family of a missing nursing student are hoping a reward will help bring her home safely or any information. today bob redell is live and joins us with the latest. >> reporter: good morning. what's got michelle le's family so concerned is that they say that it would be very unlike her, very much out of character for her to up and leave like

this without telling anyone. that's why they don't think that's what happened or concern that something else happened. the 26-year-old nursing student was taking part in a medical rotation at kaiser here in hayward as part of other studies. 7:00 friday night, she took off during break. surveillance footage shows her leaving in her car out of the garage. and that's the last time she was seen. once police became involved officers did find her car parked in a neighborhood not far from the hospital. >> i think it is suspicious and i think any normal individual would think it is a suspicious as well. simply her car was taken from the parking lot and parked a short distance away, secured. just left there. >> she didn't deserve to have this happen to her. i just -- i just want her home. >> that was her brother telling us that his older sister is responsible. does call him on a regular basis. they believe that she does have her cell phone because it wasn't

found in the car. other valuables were found in the car but not her cell. every time they try to call her, there is no answer. the family has posted fliers and is offering a $20,000 reward to anyone that can help them find michelle le. reporting live here in hayward, bob redell, "today in the east bay." a warning for craigslist customers this morning. suspects in halloween masks are stealing thousands of dollars from prospective used car dealers. the first theft took place may 12 in the bay view neighborhood. two people agreed to buy a used honda accord. they drove to the street they were given but the house number they were told to meet at didn't exist. then two men in black hoodies wearing masks and carrying semi automatic handguns robbed them of their cell phones and cash. a similar robbery happened last wednesday. this morning, one suspect in the brutal attack on brian stowe is still at large.

sloppy record keeping could be to blame. two months and hundreds of billboards later l.a. police managed to capture giovanni ramirez, one of the suspects in the case. ramirez may have been captured sooner if parole agents had entered vital information about his appearance into a computer system. details like teardroped tattoo under his eye and dodgers tattoo under his neck which ultimately led to his capture. ramirez is in custody. another suspect and woman who drove the getaway car still at large and brian stow remains in critical condition. a news conference could stir up an old murder case. right now scott deleski is behind bars after he was convicted of killing the wife of famed attorney daniel horowitz. today deleski's attorneys plan to suggest evidence that would implicate daniel horowitz in the crime. that it was never sufficiently investigated or brought to the

jury. they are working to prove that deleski was wrongly convicted in the murder. it will be interesting to follow that one. following the forecast because on the verge of june and rain once again in the works. >> yeah. you know, tomorrow actually kicks off the atlantic hurricane season which is something that you often think about when you think of the summertime. just goes to show we are going to have to wait a little longer for springlike weather and then maybe we will break into summertime at the end of next week. it looks like we will hit the 80s at the end of next week. this wet pattern really isn't going anywhere. we have a very significant dip in the jet stream. this yet is just going to kind of sit where it is. we head through the next few days, bringing storm track, yes, right into the bay area. that's what we are looking at. right now i'm pinpointing the showers for you. they are mostly up in the north bay this morning. watch out for showers pushing right now through novato, petaluma had a light cell go through there. action has calmed down since where we started out the show at 4:30 a.m. lot more shower activity at that time.

because of medicare. handful of negotiators, some democrats and some republicans are stuck on that issue. republicans who control the house have said that they will not vote tonight to raise the debt ceiling unless we cut a big chunk of spending out of the budget. in other words, no more credit unless we spend less. a big part of what we are spending is on medicare. it is politically touching. no one wants to tell seniors we are going to cutback on medicare. but in fact, they have got to do something. republicans want to turn it into a voucher system. democrats want to change the way the doctors are paid. they have a difference of opinion. they seem to be at a stalemate over it at this point. and as you said, we were -- are at our 14.3 trillion debt limit now. the obama administration is saying we can hold off defaulting on any bills million august 2. but republicans are skeptical of that date. laura? >> thank you very much. 5:44. jury deliberations resume this morning in the case of two men

accused of killing oakland journalist chauncey bailey. jurors have been off since thursday because of the memorial day holiday. they are trying to decide if usef bay is guilty of ordering four murders. prosecutors say that bay, the founder -- former founder of your black muslim bakery, ordered bailey's death to keep him from writing about the bakery's financial troubles. the grandmother accused of kidnapping her own grand daughter from the east bay home will be brought back to the bay area today. she will be transported from the l.a. county jail, contra costa county. accused of breaking into her son's home in knightson near pittsburgh and taking her 4-month-old granddaughter to southern california. her neighbors say she faked a pregnancy and planned to raise the baby as her own. the baby is back home safe. she's charged with kidnapping

and burglary. the waters in the sunshine state gave some and memorial day beach goers a sting surprise. more than 400 suffered jellyfish stings over the holiday weekend. along the stretch of central florida's oceanfront. the officials say that powerful winds off the atlantic coast cause a high number of jellyfish to wash ashore. most people suffered stings to their legs, arms, and their bodies. beachgoers were warned to stay out of the water and no other health problems reported. when you see those, we stay away. sometimes they are smaller than you think. >> yeah. they are -- so hard to see transparent. i would prefer my jelly with peanut butter on whole wheat. good morning. we have showers through the bay area. there's nothing heavy coming down right now. only the light green. we are not picking up any yellows indicating moderate rain. this is all light rain. and right now it looks like the heaviest rain is coming down between novato and i would say about napa. that's going to be the case as we head through the next couple of hours and will come to see the showers push onshore.

pad. atlantis rolls out this afternoon. starting the last leg of the journey to liftoff. it is scheduled to launch july 8. the crew will deliver supplies and spare parts to the international space station. in the meantime shuttle "endeavour" is on its way back to earth on what is its final day of plight. the crew spoke to nbc news late yesterday and said the mission has been bittersweet since it is endeavour's last. the commander mark kelly updated us on the condition of his wife, congresswoman gabrielle giffords. she is recovering from a gunshot wound to the head and had skull surgery during the shuttle's mission. >> she just had z;1'&úo'ieink and i the difference on the phone and in speaking to her. so she's improving, continuing to improve every day. i'm looking forward to seeing her in a couple of days. >> the shuttle and its crew will land early wednesday morning at
