new this morning, northbound interstate 880 is shut down this morning through oakland due to a hit and run accident and diesel fuel spill. i'm christie smith. we'll show you the cleanup coming up in a live report. plus an east bay toddler escapes a carjacker. we'll talk to the man who found her wandering alone overnight. two missing nurses, one common link, the parallels between a missing person's case and an unsolved murder. a live look outside this morning. it's wednesday, the 1st day of june. this is "today in the east bay."

good morning, everyone. i'm scott mcgrew. it is 4:30, let's get started with an east bay forecast and christina loren. good morning, christina. >> good morning and welcome back, scott mcgrew. we have some weather for you. you came back just in time for the rain. we have rain already this morning in the east bay. nothing heavy and a lot of this is actually virga, which means it's evaporating before it hits the surface. steady rain on the way later on today. it is the first day of hurricane season in the atlantic basin. we'll talk about that as well. it's all on the way. let's get you on the way to work with mike. pretty serious situation already. >> that's right. at leaf the roadways are a little drier right now. my big story, a full closure of northbound 880. the rest of the maze ivery clear but right here coming up towards 990. actually at 7th there's a full

closure so traffic is diverted to 980 headed towards the 580 interchange. you'll take that back to the bay bridge toll plaza. that's a minor reroute but is expected to last for hours so this will cause some problems coming through oakland and send big rigs over to 580. christie, you say it's a hit and run and a fuel spill. so what do you have this morning. >> reporter: good morning to you. well, right now -- well, you can see it going on here, caltrans has at least a half dozen trucks out here trying to clean up this diesel fuel spill and also glass that's all over northbound interstate 880, trying to get this opened up after a hit and run accident that happened around midnight, closed all lanes near 7th street. if you know the area, this is right near the west oakland bart station. the chp is saying that a driver hit one car and plowed into a big rig. the driver of the big rig lost control, ended up spilling about 200 gallons of diesel fuel all

over the roadway. at least one to three people were injured in this. the chp still trying to sort out details this morning. but they have checked hospitals looking for that hit and run driver. meanti meantime, they brought in a sweeper truck to try to clean it up. the problem with that, it broke down. they have senince got a second truck but they say diesel fuel is quite slick so they need to put absorbent down. they're hoping to get the number one lane opened up as soon as possible. latest estimate we're hearing is at least 7:00 in the morning until the whole thing is cleaned up but they're working as fast as they can to get the whole thing reopened. reporting live, christie smith, "today in the east bay." this morning a toddler safe after terrifying and agonizing moments for her mother. vallejo police say the girl was inside her mother's car when they were carjacked by an armed suspect before 10:00 last night. police say the suspect forced

the mother out, then took the car with the child still inside. an officer says somehow the little girl unbuckled herself, let herself out of the car and then wandered over to a nearby apartment complex on spring road where she banged on doors for help. >> she's picking at the door like this. i said who are you? where do you live? she say -- you know, she didn't say nothing. i said i don't know you. where's mommy and where's daddy. she say -- i don't know, you know. >> vallejo police found the car but so far they have not found the driver. this morning outrage leading to change a day after east bay fire crews stood and watched a man drown. the 57-year-old man walked into the alameda bay on monday near shoreline drive along willow street. he bobbed in the water for almost an hour before drowning. last night at a city meeting

people vented their frustration and concern. >> so it just strikes me as unbelievably callous that nobody there with any sort of training could strip off their gear and go and help this person. >> police officers say they were not going to save the man because the man was suicidal and may have acted out violently towards officers. firefighters said city policy kept them from getting into the water because they are not trained in water rescues. that training program was cut in 2009 due to the budget crunch. the city says it will change its water rescue policy. a missing persons case in hayward is looking eerily similar to an unsolved murder in fairfield. michelle le is a nursing student in hayward. phuong le was a nursing student who disappeared last year. police later found her body but an arrest in her murder has

never been made. jean elle reports from hayward. >> supposed to get lunch tomorrow. but there's still hope she's still out there. we just need help finding her and anyone who can help, please help. >> christine is desperate to hear from her cousin, michelle le. the nursing student was last seen friday night. she was in class doing clinical rotations at the kaiser permanente medical center. during a break around 7:00, she told a classmate she was going to get something from her car. she grabbed only her cell phone and keys and went to the north parking lot but she never returned. police found her white honda several blocks away saturday sgloerng and i love her. i even came to that parking lot just to get some sort of piece of her. if she's out there, she's safe,

i pray to god every second that she's safe. >> reporter: investigators are now looking through security video, searching her car and reviewing her cell phone records while they follow up leads. phong le disappeared in april, 2010. she has the same last name, was also a nursing student and drove a white honda. her body was later found in a remote area near napa. police have not made an arrest in that case. hayward police say it may be an awful coincidence, but it can't be ignored. >> we are leaving that avenue open, that possibility. it's still within the realm of possibility. >> reporter: din is convinced something happened to le because she had so much to live for. >> it took her years to get where she is and there's no way that she could have just left. >> that was jean elle reporting. michelle le's family offering a $20,000 reward for her safe return. 4:37 right now. lawyers for a convicted murderer

are pointing the finger at another suspect, the victim's husband. scott dyleski was 16 years old when he was convicted of the brutal 2005 murder of pamela vitale. now dyleski's lawyers say they have more than 100 pages of evidence that was overlooked, including allegations that the woman was physically abused by her husband, attorney daniel horowitz. horowitz says these accusations are false and hurtful. >> there was no rocky relationship and there was no abuse. i mean the thing that i recall is this. this is who was killed. this is who was being attacked. >> now, horowitz also points out that all of the forensic evidence still lynx dyleski to the crime including vitale's dna under his finger nails and his bloody footprint inside the house. let's check back in with christina. >> good morning to you.

you want to give yourself plenty of time this morning. the first front came through yesterday. it tapped into that subtropical moisture. that's why we saw so much rain yesterday along the peninsula, especially the south peninsula and the south bay. now, for today in the east bay we'll see spotty showers to start you out. the action will intensify. it looks like the timing of this thing is speeding up a little bit so that looks like as we head through probably now and 11:00, we'll see that front come through. here it is right here. then this little core is actually going to cross to our north and then our next system dives into the bay. unfortunately, it looks like we've got wet weather all the way through the weekend. i've got your numbers and seven-day outlook just moments away. hopefully, mike, we have some improvement out there. what's going on? >> this is not going to change or improve for hours. we have the full closure of 880. let's get a live shot and show you the activity. christie smith just reported there are six sweeper trucks there. there is a diesel fuel spill after a hit and run accident

involving a big rig and a couple of other vehicles. no major injuries but we don't know the extent of what injuries there are. this is going to take a major problem and hours to clear up. 7:00 is when we're expecting this to clear, so a full closure of 880. one of your alternates is the bart system. this is near the west oakland bart station. the bart system is not affected by this, although a lot more folks might be heading to those stations. getting back to the maps, 980 at 880. northbound 880 is closed. take 980 over to 580 and curve around and take the connector back to the bay bridge toll plaza. this will add more folks to that portion of oakland and send more folks from 238 over there including big rigs as well. right now the volume holding pretty steady and no major issues. these folks are able to make that reroute without any big deals but closer to the 7:00 hour, this is going to be a

major problem. as we approach 8:00 there's a huge backup that forms at the coliseum so we'll track this and see if there's any damage to the roadway caused by the diesel as well. well, mission accomplished. just hours ago space shuttle "endeavour" cut through the morning sky touching down safely for the last time at kennedy space center, the end of an amazing run. 25 missions, more than 120 million miles in space. >> space shuttle has been a work horse for space exploration, essentially building the entire space station, fixed the hubble telescope and doing a whole bunch of other interesting tasks out in space. >> now, as "endeavour" returned home, the shuttle "atlantis" made its final return trip to the launch pad. 4:44. could it get worse for people in san bruno who lost their homes to a gas explosion? yes, it can get worse. some families will have to put their rebuilding hopes on hold. their east bay contractor is shutting down. the bay area news group reports at least five families are scrambling to make other plans now that vanderbilt construction is closing up shop. now, the families say pg&e suggested the company after the gas pipeline blast in september that you're seeing here. the families say they have already paid bills to vanderbilt and don't have enough money to pay someone else to do the work. they're also concerned they'll be on the hook from claims from subcontractors who claim that vanderbilt didn't pay them either. a silicon valley ceo says he screwed up and the rally may be over on wall street. for more on that and other news before the bell, it's nicole lapin. good morning. >> reporter: good morning to you, scott. yeah, futures are lower this morning. this is after yesterday's nice, healthy rally. and that came surprisingly

despite disappointing news on the housing front, specifically a big drop in home prices. today we're looking ahead to the first of three reports on jobs this week. the report which tractors private sector hiring, we're expecting companies to have added about 190,000 such jobs last month. just to recap, the dow jumped 128 points yesterday, 12,569 is where we closed. but for the entire month, let's keep it real, we were down 2%, so netanyahu we're still lower. for the month, the nasdaq also was off 1.3% in may, but it jumped 38 points yet, 2835 is where we are there. yep, google chairman and former ceo eric schmidt admitting the web giant tried unsuccessfully to team up with facebook. speaking at the all things digital conference, schmidt said he screwed up, that's a direct quote, by not jumping on the social networking bandwagon in the last decade. they also showed off its groupon killer, a daily coupon site that

launches today in portland. and steve jobs is back in the spotlight as well. the apple ceo will give the keynote address at the company's developers conference next monday. jobs is widely expected to unveil apple's new icloud service which basically lets users store and stream music online instead of holding it on your hard drive. apple has also reportedly sign deals with warner music, sony entertainment, emi, so apple is just taking over the world. >> they are taking over the world. they needed the cooperation of those music companies in order to get it done and it sounds like they have got it. >> reporter: getting her done, yeah. they're not screwing up like, you know, the google machine. but look, just to be fair, can i say that google does not screw up on a whole lot so just add one little tally mark to a whole lot of knock it out of the park. >> very rare. and they can always make it for

it with share price. the state assembly passed a bill that would force online companies to pay real world taxes in california. if passed into law, it would include all online retailers with physical stores in the state. supporters say california would boost its budget by a billion dollars a year by adding the tax. critics say it's a tax grab that will scare business away from california. this morning bay area company zynga unleashes its latest creation. it will debut "empires and allies" in 12 languages. the game's executive producer describes it as cityville with a risky edge. >> it really blends a lot of the familiar mechanics that our players have become accustomed to in cityville, like city building and managing resources, with the more traditional, more hard core game play elements like fighting, being involved in a single player campaign and telling this great involving story with many different characters and villains. >> now, "empires and allies"

launches at 11:00 this morning just in time for lunch break. it's free to play, but you can upgrade your in-game situation by spending real cash. as they say, the first taste is free. good morning, christina loren. >> good morning. boy, hard lesson in life, i learned the hard way. we're looking pretty good right now. we've got a system of low pressure on the way bringing us more range today. the east bay already getting hit with a few showers. let's take a look at the big picture because we've entered into this wet pattern. i guarantee you the weather will be a hot topic of discussion as we head through the next probably five to seven days with this wet weather just relentless. here's what's happening. we've got a front that came through yesterday. the jetstream just to our south so it's ushering in all this wet weather. rain showers will continue right into the bay area. there's a front that will come through as we head throughout the day today, bringing about steady rain in the east bay.

it looks like the timing for you in the east bay will range between about 11:00 a.m. and 1:00 p.m. let's set that in motion and show you what we're expecting from your futurecast. we stop the clock at 9:00 a.m. and there's that front. it pushes onshore between 9:00 and 11:00 for the north way and between 11:00 and 1:00 for the east bay. watch out for your lunch break, it might get a little slow on the roadways. as i set this in motion for you, thursday we get kind of a dry break, a few showers expected early. then friday take a look at what's headed our way. oh, yeah, that's the big one. it's going to rain friday into saturday. maybe a few showers early sunday. finally we'll get some clearing for sunday. if you want to make outdoor plans for the weekend, it's kind of iffy both days but for the second half of sunday you'll have the best bet. a few showers on monday and finally tuesday a little warmer, a little nicer but i hate to tell you this, another round of rain in the forecast for wednesday, scott. so feeling like january, although this is the 1st of june. >> amazing. all right. well, coming up, dialing up

4:53 right now. good morning to you. happy 1st day of june. this morning after countless studies, there appears to be a reason not to discount a possible link between cancer and cell phone use. the world health organization says there might be a connection. after a week-long meeting in france, the international panel of experts says an increased risk of malignant cancer, especially brain cancer, can't be ruled out. now, some doctors are skeptical and even the panel admits it's far too early to determine anything definite. but the panel is putting cell phones in the same cancer risk as dry cleaning, pesticide ddt and engine exhaust. we have a lot ahead "today in the bay." laura is in the newsroom. good morning. >> good morning. welcome back. good morning, everyone. hey, you're going to appreciate this story, mr. tech guy, check it out. a san francisco man had his mac book laptop stolen. you'd think it would be hard to

injuries. the full closure expected until at least 7:00 as they clean up the diesel and all the debris in the area. take 980 to the east and 580 to the west back over towards the bay bridge and the toll plaza. right now not a problem, but as the commute builds, we should see slowing coming through oakland a little confusion perhaps for folks as well. stick with us and we'll track the progress. hopefully that gets picked up earlier than thought. we'll track it carefully and send it back to you. >> all right, thank you much. bring out the tree trimmers, larry ellison. he has settled a lawsuit with the san francisco neighbors over a cluster of redwood trees. the billionaire ceo's 10,000 square foot pacific heights home has great views of the bay or it did when he bought it in 1998. as you see here, ellison's sweeping view of the bay was partially obstructed by trees from the house below. he sued those homeowners. the trial was set to start june
