chefs working to get ready to welcome her to an east bay breakfast. christie smith is live at the clairemont hotel in the berkeley hills. good morning. >> reporter: good morning. one indication that the first lady is coming is all of the no parking signs around the clairemont hotel in the east bay hills. she is making a couple of stops, the first one here at the clairemont where i can tell you they have been working very hard to spruce things up. a democratic national committee breakfast. congressman barbara lee issuing a statement saying i'm delighted the first lady accepted my invitation to the east bay. her second stop will be in san francisco, a lunch at the juliet morgan ballroom. guests paying $2500 each to attend. in the kitchen chefs excited about her push to get people thinking eating healthy and getting fit. at the clairemont hotel, the red carpet is ready to roll out and flowers are freshly planted in

her honor. >> looked on the internet and looked at the first lady's favorite colors, we planted them outside for her. her first impression hopefully is a great one. >> reporter: in the kitchen organic eggs, fresh mushrooms and shaved asparagus with alice waters preparing the meal. breakfast gets under way at about 8:45 this morning in san francisco they are having chicken and salad and potatoes, we're told that some of the chefs went out of their way to send the first lady some tamales. reporting live, christie smith, "today in the east bay." >> all right, thank you much. 4:33. preparing for the worst. today the mt. diablo school board is expected to vote on $4 million in cuts. this vote is a worst case backup plan in case governor brown's proposed tax extensions don't come through. money saving ideas include

cutting special education, trimming or ending bus service, and cutting medical benefits for school board members. the board is also considering money raising ideas, including a new parcel tax, selling advertising, and letting phone companies install cell phone towers on school property. >> the man identified by l.a. cops as the primary suspect in the attack on bryan stowe has yet to be charged even though he has been in custody for a month. detectives have been able to keep giovanni ramirez in custody on an alleged parole violation. the police chief says they are making use of the time to do additional investigating but time is running out. ramirez' hearing for his alleged parole violation is friday. his attorney doesn't think that police can get ramirez and tie him to the gun in an apartment found where he lived with his roommates. that is the parole violation.

bryan stowe still in a coma. >> former b.a.r.t. officer johannas mehserle waking up a free man. lawyers say mehserle -- the former officer they say, hopes to be able to live in the bay area now that his jail sentence is over. lawyers say mehserle has reun e reunited with his girlfriend and young son, hopes to get a better job. what that will be is up in the air. mehserle was convicted last year of killing unarmed b.a.r.t. passenger oscar grant on a platform at the fruitvale b.a.r.t. station new years day, 2009. >> fallout in oakland where protesters filed a suit against the oakland police department saying officers violated their civil rights when they gathered to protest, mehserle's sentence back in 2010. police arrested 150 people during that protest. none of them were charged but the lawyers filed a class action suit anyway, claiming the protesters were mistreated.

>> the police corralled them and refused to give them an opportunity to leave, and in mass arrested them. then treated them miserably as punishment for exercising their rights. >> the oakland city attorney's office will not comment on the suit, saying the city hasn't examined it yet. >> alameda has a new police chief, mike noonan. the announcement came in russo's first official day on the job. noonan has served as interim chief. he starts work as full chief immediately. >> down to the wire, state lawmakers have until tomorrow to agree on a budget or they won't get their paychecks. governor brown calling on the legislature to set aside differences to close the state's almost $10 billion deficit. brown wants a combination of cuts and that extension of a tax

increase we talked about earlier to close the gap. so far he has rallied support from business groups, educators and law enforcement. >> we've got to do the business of california. in order to do that, i believe the plan that i propose should be adopted or something very close to it. >> brown needs four more republican votes to get approval for a statewide ballot measure on the tax extension. >> state democrats pushing the governor to opt out of a federal program that flags illegal immigrants who are arrested even if they are not convicted of a crime. the electronic data base checks every person arrested and fingerprinted by police. since last year more than 3900 bay area immigrants have been deported through the system. >> this morning more fallout after a reported gun fight among teen students turns out to be a middle school anti-violence project. this morning two oakland school district employees are on leave

while police investigate. over the weekend police rushed to the scene of a reported gun fight at union point park, only to find teenage boys running around with rifles. they were making a video for an anti-violence campaign at their school. they were supervised by two adult staffers. one of the guns used by the teen was real but not loaded. police say they did not fire their guns but they could have. >> this morning a reminder if you live in the dublin area, alameda county firefighters will burn dry brush at the training center on matigan road. this helps get rid of excess vegetation. the clearing starts this morning at 8:00 until 3:00 in the afternoon. >> once in a while this goes wrong, especially due to high winds. let's check in with christina. >> boy, we don't want that. this morning we've got calm winds out there, so we're looking okay. because of the calm winds, however, i think we're going to see a little bit of fog as we

picture of 880 out past the coliseum. high def video calls and a wireless provider on the iphone bandwagon. it's nicole lapin. good morning. >> good morning. futures are higher after wall street struggled to stay near the flat line yesterday. a downgrade of credit rating offset the takeover deals. as investors continue to worry about global economic slowdowns. big economic reports today focusing on producer prices, business inventories and retail sales which are expected to drop due to weak car sales. best buy reports earnings before the open, but yesterday the dow rose 1 point, 11,952 is where we closed. the nasdaq fell to 2639. also this morning comcast is teaming up with skype to bring video calls to your television. consumers will be able to make

and receive calls using skype software, a video camera, a set top box and remote control. it doesn't matter if the person on the other end uses a phone, a pc or a television. that's our parent company. and at long last spript users may be able to get the iphone. reports say that apple is in advanced tests for an iphone that's compatible with sprint's wireless network. apple is set to order sprint cell towers last year. apple conducted tests, you remember, with the verizon towers months before announcing a verizon iphone. >> thank you much. have you ever wanted to scold another driver for speeding or cutting you off and maybe ask them out for a date as well. one company tried to be the face book for your car. it allows drivers to connect via license plates. vicki nguyen has more on this new player in the social media game.

some say it's cool. others call it creepy. >> reporter: it turns out there are at least two things that just about all of us have. a cell phone and a license plate. and mitch, the ceo of bump.com is betting you're going to like an idea he says is sort of facebook and force ware meets low jack. >> a communication platform around your vehicle which you're going to spend five years of your life in. >> bump.com has entered 250 million license plates, that's every registered vehicle in the u.s., into its data base. users can go to the company website and claim their plate that allows them to send messages to others who also signed up. >> comes in and says this is my license plate, you can send me messages if you see me. >> 20-year-old kourtney has signed up and thinks it's a great idea. >> i think it's practical. i mean, you know, especially living in the mission beach area, parking gets tricky and

sometimes you get boxed in. it would be great to send somebody. >> the company has partnered with businesses to offer discounts, deals and coupons users can receive over cell phones. >> we send out certificates and coupons to everybody that drives down prospect street so people can log in and receive a discount to the museum cafe. >> this is where some feel things get sticky. bump.com is using license plate reading technology via existing security cameras, whether it's in a public parking lot or fast food joint that bump partnered with. that technology allows the companies to track your consumer habits through your license plates. >> i think that's pretty creepy to drive into a parking lot and have a store owner there all of a sudden send me a message on my phone, even if it is a coupon. >> amanda is concerned bump.com isn't up front with how your information is being passed on to its business partners.

reported. officers say they are seeing a surge in copper thefts especially north of highway 4, copper thieves make quick cash by selling the copper as scrap metal. >> the bay area's rapture evangelist is recovering from a stroke. we're told that harold camping is resting. he made international headlines after predicting the end of the world a few weeks ago on may 21. the 89-year-old then revised the date to october 21. staff members at his oakland ministry say they will be playing prerecorded programs by camping until he is well enough to get back on the air. >> unbelievable pictures of a sail boat crash in the bay. bob redell was racing with those guys. >> you have to see the pictures to believe it. the oracle team demonstrating some of the fastest sail boats in the bay area. as they try to generate excitement for the upcoming america's cup races.
