throughout bay which is great news. one minor construction project to tell you about, full freeway closure east bound highway 4, detours in place until about 5:30 this morning. >> thank you very much. a weighty decision could come down on proposition 8, the california ban on gay marriage. supporters of the ban asked a court to throw out its ruling declaring the ban unconstitutional. today in the bay's marla tellez is live in san francisco, all waiting for the ruling. good morning. >> reporter: good morning. the future of prop 8 right now unknown but it should be known in a matter of hours. it was here at the federal court house a year ago that judge vaughn walker, he heard final arguments in the prop 8 case. a couple months later ruled the law was unconstitutional. this morning his ruling could be thrown out by the chief u.s. district judge james ware who is deciding if the walker ruling

should be overturned because walker didn't disclose the fact that he's gay. months after walker ruled against the law which prevents same-sex marriage he retired and then revealed he had been in a relationship with a man for the last ten years. prop 8 supporters decided to fight his ruling saying he should have re accused himself from the case. >> no man can be a judge in his own case, and no man is permitted to try cases where they have an interest in the outcome. against the backdrop of these bedrock principles it is clear that the ruling of judge walker must be vacated. >> reporter: judge ware began by asking lawyers on both sides whether he should be allowed to preside over civil rights cases because he is african-american, or, whether female judges should rule on sexual harassment cases. yesterday morning judge ware said that he would have his decision within 24 hours, and so

by our calculations, laura, we expect to hear his decision by 11:00 this morning. of course we're going to be out here at the federal court housekeeping an eye on this case. >> perfect. we hear about it we'll check back in with you. thank you very much. it's 5:02. fun exhibition on the bay promoting the 2013 america's cup in san francisco turned into a scary ordeal on the water. six oracle team members made a mistake and paid for it. their catamaran flipped. it capsized during a training session. it was caught on video. two crew members hit the water, one fell through the boat specially designed sail. the other four including a seasoned sailor managed to stay dry. >> pushing the boot hard. >> look at that. he had a smile on his face. bob redell was racing moments before they flipped their boat.

we'll have a live report on what it was like with the team coming up at 5:30. looks like they are hanging out on top. >> san francisco's police chief which would hold a community meeting on a shooting defending the actions of two officers who shot and killed a bank robbery suspect. he says the officers' lives were in danger. the fbi confirms the man killed was the suspected bandit. they think he was responsible for two bank robberies in irvine in may. the meeting will be 6:00 to 8:00 at the harvey milk recreation art center. sunnyvale police think they know who killed a woman and left her body in a bag in someone's yard. now what they don't know is why. officers have arrested 47-year-old santiago, they think he killed maria at his home on revere drive, then dumped it a

few blocks away. detectives say santiago and roscow knew each other. >> i feel sorry for her because she was, like i told you before you know, she was very quiet. >> the autopsy report shows that she died from trauma to the head. police think she was killed a day before her body was found. >> this morning investigators in lake port are looking for a man accused of stabbing two people over a parking issue. police say on sunday the man got in an argument with a woman for parking too close. then two passengers got involved and that's when he allegedly stabbed them. the victims were treated for major injury. any one with information about that case should call lake port police. >> job cuts are on the table at san jose city council deals with budget issues. the council will vote on next year's budget and discuss a tentative agreement with the police officers union.

the union has agreed to take pay cuts in an effort to save 156 department jobs. even with those cuts, 122 officers will lose their jobs as well as 370 other city workers. 5:05 now. this morning the first lady's in the bay area for two fundraisers. christie smith is live in berkeley where the first lady will host a special breakfast. >> reporter: good morning. the first lady does have two stops in the bay area, the first one here at the clairemont hotel about 200 guests expected here for a breakfast. don't expect to see her in public. these are basically private affairs. you can tell quite a bit of security here and no parking. i can tell you this is hosted by barbara lee and also the oakland

mayor among others. she is expected to pick up big money. in san francisco, 400 guests are expected to attend the luncheon where tickets are going for up to $2500. we spoke with the chef making lunch for the first lady. and he considers her a celebrity in the kitchen in a way. >> i am a huge fan of hers. i think that as a woman she's very, very inspiring and also as a chef, like i said the work she's doing with her get fit campaign is important. >> i think we should eat what it used to be. they need healthy and safe and sustain what it's around us. >> in the kitchen at the clairemont, they are expecting organic eggs, fresh mushrooms, and asparagus, this is put together by alice waters. things getting under way at

after wall street struggled to stay near the flat line yesterday. another downgrade of the credit rating. investors continue to worry about a global economic slowdown. we do get a trio of economic reports that we're going to be focused closely on because they are big. producer prices, business inventories and retail sales expected to drop due to weak car sales and best buy reporting earnings before the bell is what we're watching out of cnbc. the dow rose a point yesterday, 11,952 is where we closed. the nasdaq fell 4 to 2639. it's going to cost you more to enjoy the magic kingdom. sorry to say to families with triplets, disney raised ticket prices at the theme park for the second time in a year. it's so painful. i have to tell you. disney world a one-day ticket goes from $82 to $85 but the longer term passes which

raising parking rates. the plan would take effect in five garages, raising rates as much as 33% and charge for some parking on weekends and holidays. the city says the change is needed to make up for the state's massive cuts to redevelopment agency funding. if approved the rates would go into effect july 1. >> let's check the commute out there. monique sol tanny is filling in. >> if i had a nickel for all of the money i spent in parking i'd be rich. let's look at the south bay commute looking nice this morning. top speeds for most of the south bay. cruising up the peninsula, 101, 280, looks great in san mateo. if you happen to drive there later the san mateo fair is coming to town. it's here. goes until about june 19. you might see slowing on city streets, also 101 and 92. cruising on up the peninsula more, airport check for you there. top speeds. and as we head out live to the

golden gate bridge, you can see it's foggy conditions. however, no fog advisories on any of the bay area bridges. and no real incidents to report this morning. so that makes me smile unlike paying for parking. >> we do have some breaking news out of san jose. police are on the scene of a fatal shooting. it happened on the 1200 block of oxton drive where they found one man who had been shot and killed. it happened at about 3:00 this morning. three other people also had gunshot wound injuries. they were able to get themselves to the hospital but right now it's not known whether this was gang related or the people, their conditions. this marks the 25th homicide of the year for san jose, surpassing all of last year. we have a crew on the way to the scene and we'll have a live report coming up in a few minutes. >> 5:23 now. a blimp explosion is caught on tape and the pilot of the blimp is called a hero this morning.

take a look at this video near frankfurt, germany. the black smoke is from the explosion. the engines caught fire and the pilot fought to hover six feet above the ground so his passengers could try to jump to safety. moments later that blimp completely exploded, killing the pilot. the cause of the fire is under investigation. heroic move for him. >> it is 5:24. this morning president obama is making history, he'll be in puerto rico today becoming the first president since john f. kennedy to visit the u.s. territory. political analysts say the president's visit is aimed at reaching the millions of puerto ricans that live in the u.s. most presidents don't visit because while they are u.s. citizens they cannot vote in the presidential election nms they are living on the mainland. can i say puerto rico any more. you'll be able to skype from your living room couch. i don't know if i want to do that. >> you do it so well though. >> you don't want to see me

station and senate computers so why the fed? the hackers claim they are upset by quantitative easing. really. and cnbc says facebook will file for an ipo. a reporter puts facebook's value at $100 billion. not bad for something invented in a harvard dorm room in 2004. part of these estimates, laura, are based on the private sale of facebook stock. you can buy and sell. there's very few sales of facebook stock so it's a thin data stream. but it's probably the best estimate we've heard so far. >> wow. we know it's going to be a lot. >> a lot. >> interesting. it will be interesting to see how they can grow if they get that influx of money. >> right. as we talked about yesterday, there aren't that many people left to join facebook. >> interesting. 5:26. pg&e investigating copper thefts. thieves are getting bolder.

produces your breakfast it ought to be good. that's what's happening this morning here at the clairemont hotel. they are eating all locally produced food. about 200 guests expected at the clairemont hotel. this is the first of two bay area stops for first lady michelle obama, which is expected to bring in big money for the obama 2012 re-election campaign and democratic national committee. probably won't see her out and about. there are no public events scheduled. in san francisco, 400 people are expected to attend a lunch in the financial district. tickets running about $2500. but again, she begins with a breakfast at the the clairemont. 200 people are expected. and she's become somewhat of a kitchen celebrity for her push to get fit and eat healthy. that has people rolling out the red carpet in plants. >> we looked on the internet and looked at the first lady's favorite colors and we planted them outside for her, so her

first impression hopefully is a great one. >> reporter: at the clairemont, fresh eggs out of vacaville along with asparagus and mushrooms. any political trip would not be complete without krilt critics. some say she is spending too much taxpayer money when the economy is flat. the event starts at 8:45 this morning. reporting live in berkeley, christie smith, "today in the bay." >> it's 5:33. 14 people are without a home after a fire ripped through their san leandro apartment building. investigators are looking for the cause of the blaze which damaged five units of the apartments at hays street. took about 30 minutes to control the fire which started monday night. more than 100 were evacuated but most were allowed to return home

a few hours later. no reports of injuries. >> antioch police say thieves are targeting pg&e property to steal copper. since the beginning of the year thieves have stripped copper from about 300 poles in the city. during the same time last year fewer than 10 copper thefts were reported by pg&e. officers say they are seeing a surge in copper thefts especially north of highway 4. copper thieves typically make quick cash by selling that copper as scrap metal. >> preparing for the worst. today the mt. diablo board is expected to vote on more than $4 million in cuts to positions and programs, the vote as a backup plan in case governor brown's proposed tax extensions do not come through. the money saving ideas include cutting special ed resources, bus service as well as school board medical benefits. the board is considering a few money raising ideas including a partial tax, selling advertising and leasing property for cell phone towers. >> amazing video.

take a look at this. the oracle racing team showing off some of the fastest boats when one hit a wave and capsized. a gust pushes it almost completely over. look at the guys hanging out on top. tossed around like rag dolls. our own bob redell was out with the racing team oracle minutes before the boat capsized. did you have anything to do with it, bob? >> reporter: i wish i was on board because it looked awesome. no one was hurt by the way. we'll talk more about that in a minute. we're here in pier 80 in san francisco, home to oracle racing. this week the team is testing out these brand new sail boats that they designed, that they created. they are the latest and greatest and called ac-45. and yesterday as you mentioned, we were lucky enough to be invited along for the ride. now we're tacking, i believe that's where the sail is going to move. i know you can't see it. maybe george can.

you see there's the golden gate in front of us. and we're getting ready to tact to head back toward the yacht club. and there she is. above you right there. that's what a fixed wing sail looks like. it's fixed, and there's no flapping like on a traditional cloth or polyester sail which adds to the dynamics and the speed that you're going to see in these new class of boats coming to the world cup. >> these are right on the edge. you have to push them to the edge to sail them well. there's consequences, that's for sure. >> we push her more? >> sure. >> you can see these boats are fast. there's a lot of risk involved. >> how fast are these boats compared to the old ones? the old ones topped out around 14, 15 knots. >> if you're lucky. probably the best compareston is a push boat to a formula one car. these are the fastest boats

today over 40 miles an hour. on a short course, just fly it up a bit. you know, so that's the risk. you can tip them over. these boats you have to push them hard. we're not wearing the helmets for the looks, that's for sure. >> they do need the helmets. look at this video. this happened a couple hours after we were out there on the bay. this was actually russell coutts' boat. that's jimmy's colleague. russell's boat is the one that tipped over. caught a gust of wind and you can see all five sailors like ants falling in the water. bottom line, everyone's okay and this is part of the process of them doing these test runs so they can see what limits, how far can they take these boats and here's that fixed wing from russell's sail boat. he actually went, i don't know if you saw it. you saw someone go through the wing. that was him.

he went between one of these spars. you can see this is what the wing is made of. almost like if you did model planes, it's like a sheet plastic. so they started the repair. what they do is take this plastic, they put it on the spars, they get some sort of iron device and it shrink wraps it back on so they are fixing it now. they will be back in to continue fixing it because today they got to get back out there and do more of these practice runs. we'll be talking with jimmy, the skimmer on the sail boat i was on, coming up in a bit. it's fascinating and really, there's a lot of athleticism involved, as you saw. >> because you were on board. of course. how cool was that, though. was it really a thrill? i know you've done pretty exciting things. it seemed so exciting. >> yeah. it reminds me of blue angels on the water. you're not going the speeds but there's that sense of freedom and you know you're with people who you can trust who clearly know what they are doing. it's a rush. i only wish i could have been

starting to pick up. you can see the ride is about 16 minutes. the ride through hayward looks nice. we know in about an hour it's going to be messy through hayward. it usually gets very, very busy starting around 7:30, 8:00 in the morning. that's not the case right now. top speed through hayward, top speed across the san mateo bridge. looks very nice along the peninsula as well. a look at the bay bridge toll plaza. yeah, the sun is shining. metering lights are not turned on. traffic is flowing across the span of the bridge. we've been talking all morning about michelle obama coming to town. well, if we don't have exact streets that could possibly be blocked but we know expect delays around ashby avenue. they don't give out the exact closures but expect around ashby avenue in berkeley. >> a lot of parking signs up near the clairemont hotel too. she's in the east bay this morning, her husband, the president, is stopping by the

>> this morning we're getting a clearer picture of what is next year's presidential race will look like. tracie potts is live in washington with a look at last night's gop debate. good morning. >> reporter: laura, good morning. seven candidates so far they debated in new hampshire on topics ranking from immigration to same-sex marriages, to the big topic of the night, the economy and jobs, all of these candidates right now really focused on president obama making the point that they don't think he's done the job. they also talked a lot about health care, this is going to be a big one for mitt romney because the president obama said he modeled the national plan that republicans don't like after what romney did in massachusetts. romney says if he gets the job in the white house the first thing he'll do is exempt every

state from having to follow that health care plan. newt gingrich taking aim a bit at the republican's plan here, to change medicare. and now we have seven candidates, we could have more soon. >> interesting to see. thank you very much how it all shapes up. 5:45. president obama himself stopping by the "today" show this morning to talk about jobs and the economy. the president sat down with ann curry saying there are two problems with the economy right now. one that we're not recovering as quickly as we would like to from one of the biggest downturns since the great depression. two, that there are structural issues with our economy where businesses have to learn to do a lot more with fewer workers. the president says he's now looking at what is next. >> identifying where the jobs for the future are going to be, how do we make sure there is a match between what people are getting trained for and the jobs that exist, how do we make sure that capital is flowing into those places with the greatest opportunity. we are on the right track, the

key is figuring out how do we accelerate it. >> the president also talked about the anthony wiener scandal. he says if he were weiner he would step down. you can see ann's interview with the president this morning coming up at 7:00. >> 5:46 now. more fallout after a reported gun fight among teen students turns out to be middle school anti-violence project. two oakland school district employees on leave this morning while police investigate. oakland police officers rushed to the scene of a reported gun fight at union point park over the weekend. when they arrived they found teenage boys running around with rifles. it turns out they were making a video for an anti-violence campaign at their school. and they were being supervised by two adult staffers. one of the guns used by the teens was real, but it wasn't loaded. police say they did not fire their guns but they certainly could have. >> here's a reminder in the dublin area. don't be alarmed if you see

smoke later this morning because alameda county firefighters will be burning dry brush at the training center. the burns help get rid of excess vegetation and serves as a great training tool for fire crews. the brush clearing start this is morning from 8:00 until 3:00 in the afternoon. >> our wet weather this spring hitting sonoma county vineyards hard. most growers expect the harvest to fall short of last year which already was smaller than average. growers say the late spring storm, the first week of the month likely cost them 10 to 15% of their crop. it hit when many vines had opened their flowers to begin self fertilization but the rain can wash away the pollen or prevent the flowers from opening. that means fewer grapes are likely formed. growers say they should know where the crop stands in about two to three weeks. big crush happens in the fall.
