tomorrow. i've got your full forecast coming up. 6:00 a.m. now. let's check with monique. >> thank you. the drive is flowing nicely. here's a look at the south bay. top speeds on your major freeways, that's fabulous news for you as you head off to work or school on this beautiful tuesday morning. moving along the silicon valley commute looks good. palo alto, redwood city, top speeds there. as you cruise your way along up the peninsula past the airport, looks wonderful. san francisco, looks great too. more on traffic in a few minutes. >> thank you. this morning a surge of violence continues on the streets of san jose. right now police are trying to track down a gunman who shot and killed a man on oxton drive close to highway 101 and tully road, the city's east side. police say three others were also shot and injured in addition to a man who was killed. the death marks the city's 25th homicide of the year. we havea crew on the way and

will bring you a live report. >> this morning the first lady is in the bay area for two fund-raisers to raise money for the president's re-election campaign. christie smith is live in berkeley where the first lady will host a breakfast. good morning. >> reporter: good morning to you, laura. when it comes to food, the first lady is going straight to the top with this big breakfast produced by alice waters here in berkeley. this is going to be all local food that they are serving. and this breakfast is the first of two stops in the bay area for michelle obama. the clairemont breakfast with 200 guests expected to pay about $1,000 to $2,500 just to eat. then it's off to san francisco where 400 supporters are expected to shell out $2,500 to attend a luncheon in the financial district, a trip that should pick up big money for the

obama 2012 re-election campaign and democratic national committee. we spoke with the chef making lunch for the first lady and others who consider her a real health and food celebrity. >> i am a huge fan of hers. i think that as a woman she's very, very inspiring and also as a chef, like i said the work she's doing with her get fit campaign is important. >> i think that we should go back and eat what it used to be and eat healthy and safe and sustain what is around us. >> reporter: for the menu this morning here at the claire mont we're told it's organic eggs from vacaville, fresh mushrooms and shaved asparagus. making me hungry. but she's also drawing critics who complain that she's spending too much taxpayer money on a trip when the economy and the jobs should be the issue, but the breakfast gets under way this morning at about 8:45. christie smith, "today in the

bay." >> interesting to see who else will attend. thank you. 6:03. san francisco's police chief will hold a community meeting tonight on a recent police shooting. the chief has defended the actions of two officers who shot and killed a bank robbery suspect last tuesday. he says the officers' lives were in danger. the fbi confirms the man was this man. they think he was responsible for two bank robberies in irvine in may. the meeting will be 6:00 to 8:00 at the harvey milk center on scott street. this morning investigators in lake port are looking for a man accused of stabbing two people in a parking issue over the weekend. police say on sunday, james verbally confronted a woman for parking too close to his car, then two passengers in the car allegedly walked over to the scene and he allegedly stabbed one and cut the other. the victims were treated for major injuries.

any one with information about the case is encouraged to call police. >> sunnyvale police think they know who killed a san jose woman and left her body in a garbage bag. what they don't know is why. officers have arrested 47-year-old santiago. they think he killed maria at his home in sunnyvale, then dumped her body a few blocks away. detectives say santiago and r s rossco knew each other. >> i feel sorry for her because she was like i told you before, she was very quiet. >> the autopsy report shows that she died from trauma to the head. police think she was killed a day before her body was found. >> her face is an bill boards and flyers in the east bay and still no sign of missing nursing student michelle le, she has

been missing since may 27 when she disappeared while on break at a hospital in hayward. hayward police say they believe she was killed in the parking lot. le's family holding on to hope she's still alive. her family is asking any one with information to call police or visit michelle le missing.com. >> this morning we expect a development in the prop 8 federal appeals case. a federal judge will rule if judge vaughn walker should have removed himself from the case. supporters say walker should have recused himself because he's gay and did not disclose his long term relationship with a man before the trial started. judge walker ruled to overturn california's ban on gay marriage. san jose council will deal with the budget issues. the council will vote on next year's budget and also discuss a tentative agreement with the police officers union. the union agreed to take cuts to

save 156 department jobs. even with the cuts 122 officers will lose their jobs, as well as 370 other city workers. >> muni operators are working under a contract they rejected. an arbitrator ruled that the terms of the contract are the best way to go until a new contract is agreed upon. muni workers say they don't want to protest the decision with a work stoppage. they had not decided what their next step will be. >> sail around the bay prompting the america's cup in san francisco. it turned scary. six oracle racing team members were on this catamaran when it flipped during a training session. you see it caught on video. two crew members hit the water, one fell through the boat. the other four including murray jones managed to hang on and stay dry. >> we were pushing the boat

hard. we had a little capsize. we knew it was going to happen and it happened today. >> our bob redell is out with the team just moments before the boat flipped. he'll be live to tell us about his trip coming up. amazing. >> i guess they learn from it as well. they are able to repair things, get it going. it's all practice runs for the 2013 run. >> you know what's amazing is that there is always a camera watching these days. >> bob redell. >> disaster, bob redell. we love him. high pressure moving in. really warming us up. it's clearing out nicely but this afternoon, yes, it's going to be one of those days. might be the first in months where you used your ac overnight. overnight climbing into the 60s. that's as low as we're going to go. we're not going to see real relief from the heat.

court tower, alcatraz island in the distance. going to be a beautiful day by the bay. 6:13 now. amazing video of a boat crash on the san francisco bay. the oracle racing team was actually racing across the bay in one of the fastest catamarans when a kaef and gust of wind, look at that, tossed the boat over. it flips on its side ejecting a crew man. they were all safe and sound. amazing to see that on the water. you know what, bob redell got a chance to sail with the team. he's live in san francisco with team oracle and update on what happened. i got to say i'm jealous. you got the chance to be out there. >> yeah, it was quite an experience. good morning to you. we're at pier 80, the headquarters of oracle racing in san francisco. this is the fixed wing sail that you saw on that boat that capsized. you'll notice some holes in it. what they are doing is repairing it putting on this shrink wrap plastic, that's the best way to

describe it. getting it ready so it can be back out on the water today. what oracle racing is doing right now is testing out what they say is the latest and greatest in sail boat technology. these sail boats are ac-45s, they are doing dry runs here. fortunately, yesterday they were kind enough to invite us along for a ride. now we're tacking. i believe that's where the sail is going to move. i know you can't see it. there's the golden gate there in front of us. we're getting ready to tact to head back toward the yacht club. and there she is. above you right there. that's what a fixed wing sail looks like. it's fixed. and there's no flapping like on a traditional cloth or polyester sail which adds to the dynamics and the speed that you're going to say in these new class of boats coming to the world cup. >> these are right on the edge.

you have to push them on the edge to sail them well. there's consequences, that's for sure. >> can we push it more? >> yeah, sure. >> these boats are fast. there's a lot of risk involved. >> how fast are these compared to the old ones? the old ones topped out around 14, 15 knots? >> probably the best comparison is a push bike to a formula 1 car. these are the fastest boats out there over 40 miles an hour. on a shourt course, just fly it up, chase. that's the risk, you can tip them over. these boats you got to push them hard to get the most out of them. >> not wearing the helmets for the look, that's for sure. >> i got the skip e jimmy, who was captaining the boat, he ras waysing, what led up to

yesterday's amazing capsizing that was caught on video? >> we went into a testing on the bay, the wind built. it was a beautiful day. we started to do some racing. and we are very competitive here. look, that's part of pushing the limits and learning. the boys put the boat in, did a pretty nice capsize. the guys have been working, right out there again today. >> not that you want to capsize but i imagine it does tell you where your comfort zone is. in a race if you know where your comfort zone is or you are more comfortable sometimes that's the make or break. >> definitely. this is why we're here early. we need to push the limits. we need to go out and do these to learn. that's why we have these boats so when we get the big boats we'll know before we get to line. look. yesterday wasn't the first capsize. won't be the last. >> how do you get back out after

you capsize? i imagine there is some adrenalin but also maybe some fear involved. that's why one reason why you wear helmets. how do you get back in the saddle? >> you do that. you get back out there, you learn from. the guys already have learned quite a lot from it. it's exciting as well. that risk factor, that's what does it for you. yeah. they will be out there. it will be a lot of fun. >> all right, skipper. thank you very much. skimmer jimmy spithill here with team oracle, defenders of the america's cup coming to the san francisco bay in 2013. if you are out on the bay today, tomorrow, friday, possibly monday you'll see these ac-45 fixed wing sail boats out there. doing test runs. around 1:30 to 3:30. here you go, you got a crew dedicated to get these fixed because in several hours they have to be back out on the water.

>> good tuesday morning. the commute is fully under way in antioch, pittsburg. look at this line slowing, 20 miles per hour. that's also the case through livermore, westbound 580 to the altamont pass, very slow there. looking about a 21-minute ride from the altamont pass to 680. not the case in hayward. traffic is flowing nicely down there southbound 880 through hayward. across the span of the san mateo bridge, from hayward to foster city, about 13 minutes to make that ride. but the bay bridge, metering

injured three others. marla tellez is live at the scene with the latest information. >> reporter: good morning. yeah, the city's 25th homicide of the year happened over three hours ago. i can tell you that this residential neighborhood is overcome by police presence this morning. still a very active scene. take a look as allen pans in. an officer tells me the deadly shooting happened down here on oxton drive. the 1200 block. to give you perspective, the closest main intersection is tully and mclaughlin. we're in southeast san jose this morning. police got the call after 3:00 when they arrived they found a man shot to death here and then later learned that three others were also shot. police say those people actually walked to local hospitals to get help. one is said to have non-life threatening injuries, the other two, their condition is not known. at this point, though, noord

yet on the suspect or suspects. they took off before police arrived. so, they are still on the loose this morning. so far no arrests have been made. at this point, laura, police say they are not sure if this latest shooting in san jose is gang related. a recap again, this is the city's 25th homicide of the year. >> really becoming so common. it's sad to see. thank you. 6:34. this morning 14 people are without a home after their san leandro apartment building was damaged by fire. investigators are looking for the cause of the blaze that damaged five units of the apartments at hays street. it took firefighters about 30 minutes to control the fire. it started about 6:30 monday night. more than 100 people were evacuated from the building but most were allowed to return just a few hours later. no reports of any injuries. this morning the first lady is waking up in the bay area for

two fundraisers to help raise money for the president's re-election campaign. christie smith is live in berkeley where the first lady will host a breakfast prepared by friend and famed chef alice waters. very nice. >> reporter: yeah, it is very nice. i know we're getting close because we're seeing more and more sheriff deputies show up, parking is getting restricted. we had to move to the corner of the lot. about 200 guests are expected here at the clairemont hotel this morning, to have breakfast with first lady michelle obama. as you said you said she is bri alice waters of chez panisse to produce this. author and pioneer and fresh local food, she is going to be here. this is hosted by barbara lee and oakland's gene quan. it's about $1,000 to $1500. this is to benefit the obama 2012 election campaign.

thank you. preparing for the worst, today the mt. diablo school board is expected to vote on $4 million in cuts. that vote is held as a backup plan in case governor brown's proposed tax extensions don't come through. some money saving ideas, cutting special education resources, bus service, and school board medical benefits. the board is considering money raising ideas, a partial tax, leasing property for cell phone towers. >> 6:37. we keep talking about the warm-up that's going to hit the bay area. >> you know, i think that we meet back tomorrow morning after we've gone flew the warm-up, i think more people will take heed to what i'm saying when i mean drink a lot of water if you work outside. we haven't had this weather yet this year. it might catch you off guard. so even just ordinary activities, just running through

>> wonder when you should buy organic and when not to? now there is a new list out with the fruits and vegetables that have the most pesticide residue on them. tracie potts is live in washington, d.c. with a look at this list. good morning. >> reporter: good morning. that's after you wash them and peel them when they are ready to eat. the environmental working group says there is the so-called dirty dozen which they think are the fruits and vegetables according to testing that seem to have the most pesticides. they start with apples. almost every apple seemed to

have a number. celeries, peaches, spinach and a number of others. the group took a look at some of the cleanest fruits and vegetables like onions, corn and pineapples. if you switch and eat more of those and fewer of the dirty dozen you can reduce the number of pesticides from 14 to 2. now, the fresh produce industry says that this report is not accurate. they call it sensational. they called at publicity stunt because they say the levels of pesticides on these fruits and vegetables are way below government standards. >> here in the bay area lots of folks love farmers markets and the organic goods. thank you. keep it healthy. 6:44. the baggage fees that airlines love and passengers loath, are paying off pretty well. the biggest airlines in the u.s. collected $3.4 billion in 2010. according to new federal figures. that's a 24% increase in baggage

fees from 2009. delta pulled in the most money off the fees with $952 million. american airlines second with $581 million. pretty penny there. 6:44. celebrity television host montel williams wants to blaze ahead of the medical marijuana. williams is partnering with a sacramento-based cooperative to raise awareness about what he calls the healing effects of pot. williams has multiple sclerosis and credits medical marijuana for improving his health and well being. >> giants are in arizona today getting ready for a three-game series with diamondbacks. it's a big one. giants lead the division but only half a game up on the d'backs, if they win they maintain the lead. today's game starts at 6:40. >> the dallas mavericks championship parade on thursday and it's not going to cost the people of dallas a single penny.

boat flips, sending a number of crew members hanging on. bob was riding with the team a short time before. he's live with team oracle in san francisco where they are i guess repairing some things. >> reporter: well, the fixed wing mast, the sail there, that's the sail on the boat that you saw on the video that had cap sized. here they are at pier 80. the team is out here fixing that sail because they do need to be back out on the water later today. they are in the middle of trial runs, i say trial runs, test runs because these boats here, these sail boats, ac-45s are brand new, using the latest in sail boat technology. considered to be some of the world's fastest. now we're tacking. i believe that's where the sail's going to move. i know you can't see it. maybe george can go there. there's the golden gate there in front of us.

and we're getting ready to tact to head back to the yacht club. there she is. above you right there. that's what a fixed wing sail looks like. it's fixed, and there's no flapping like on a traditional cloth or polyester sail which adds to the dynamics and the speed that you're going to see in these new class of boats coming to the world cup. >> these are right on the edge. you have to push them to the edge to sail them well. there's consequences, that's for sure. >> can we push it more? >> yeah, sure. you can see these boats are fast. there's a lot of risk involved. >> how fast are these boats compared to the old ones? the old ones topped out around 14, 15 knots. >> if you are lucky. probably the best comparison. a push cart to a formula one car. on a short course, you know, so

that's the risk of -- you can tip them over. these boats you got to push them hard to get the most out of them. we're not wearing the helmet for the look, that's for sure. >> and they need the helmets as you saw when that sail boat tipped over. i got jimmy and joey who are racing russell, whose sail boat capsized. can you describe what led up to that? >> we were doing some racing in the bay, and it was pretty windy. we were pretty close to russell and he just got at the wrong angle and the boat tipped over itself and threw the guys in the water. >> you don't want that to happen, obviously. you are trying to push the limits. what do you learn from that? you learn hey, i can't go beyond this. what do you learn that's useful? >> you need to find where the edge is. the reason these smaller boats is to learn as much as we can. if we did that on a 72-footer

that would be a bigger consequence. this is the time to do it. we've got a few years leading up until the cup and we need to push hard. >> how do you get back in the saddle so to speak when you capsize like that? everyone's fine, no one got hurt. i imagine it's frightening a little bit or is it? >> yeah, definitely gives you a fright when you see the guys 40 feet up in the hair. >> spiders on a web. >> it's hard and not get a heart starter. and we had one of the guys fall through the wing so that's in the back of your mind. you got to get up and keep pushing. this is what we do for a job and we love doing. we love sailing. something like that, it was frightening but it's cool and exciting as well. >> and falling through the wing is a reason why they are out here this morning putting this plastic sheeting if you will back on the winged sail here. and it's actually quite an easy process. they have an iron, one gentleman

applying it. they take that rigid taut form again so they can be out. let's see, i think you'll be back out at 1:30. that's quite a turn around. will be surprised after seeing that yesterday to know that less than 24 hours later that sail boat will be ready to get back on the water for the test runs. >> amazing. >> i want to show people. do you have a knife or something? kidding. you nuts? it's not your boat, it's russell's. >> it's russell's. it's fine. >> never going to let you on again. >> of course oracle racing defenders of the america's cup, coming to san francisco in 2013. you're going to see world series competitions leading up to that throughout the world including i know they will come back here before 2013. so look for these guys, they will be out here today through friday, possibly even monday doing test runs in the water. it's a beautiful sight to see. >> very cool.
