mcgrew. we're looking pretty good. more hot weather on the way. about 5 to 10 degrees cooler in most east bay cities. then we cool down for the weekend. i've got your forecast, we have father's day. stay tuned for. that let's get to you work on time. >> good morning. we have slowdowns through livermore. westbound 580 past airway where we had closures, crews yesterday we saw slow readings. but no slow driving likely caused by construction in the area. the construction northbound 680 on eastbound 580 continues. further south, scott, we have a tree down, it was reported about two hours ago on 84 but west of 680 that will affect to or from the niles area. we've got a lot of traffic heading to the ge power plant. >> thank you. a lot of crime to report to you this morning. we're going to start with new video of a murder suspect.

video from a gas station in oakland. oakland police say the man to the right of the camera there is suspected of shooting and killing leo duncen on june 4. the suspect is african-american, 5'9", weighing about 170 pounds, 30 to 35 years old. he has long dread locks, those have red tips, call oakland police if you know who he is. >> will you please leave. how did you get in here? >> this is extraordinary. this man is now in custody suspected of breaking into a woman's home on tuesday, raping and robbing her. the woman had the presence of mind to get the cell phone out and shoot video of the man. police say they found 27-year-old dionne mcdaniel yesterday a short distance from where this woman lives. officers say the cell phone video was long enough for them to identify mcdaniel as the man stone cold.

>> police need help identifying a cyclist who died on the regional trail. he was found along the trail in north fremont on tuesday. he didn't have identification. they are trying to figure out who he is. he is asian, 55 to 60, about 5'5" to 5'7". 180 pounds. call the east bay park police. also this morning hayward police looking for two people who shot a man near a south hayward b.a.r.t. station. we reported this yesterday. the men robbed a couple tuesday night after they left the station. they handed over their belongings but one of the bad guys shot the man anyway. that gentleman will be okay. police say the men robbed a pair of women a few minutes prior, taking the women's purses and shooting guns in the air. neither woman was hurt. in both robberies the men covered their faces. >> well, pulling no punches, a new low in sacramento as both sides sought to reach a budget

affect one east bay family. >> reporter: the high school class of 2011 is graduating. >> people don't want to finish school so it's a blessing to have finished school and have accomplished this. it really is. >> reporter: she has big plans. >> i'm going to go to city for two years, probably shorter and then transfer to a big college. >> her step-father wants to make her dreams come true. it won't be easy. >> then they cut grant money and student loan money so you know, it's going to be a struggle. >> the class of 2011 may face a bigger hurdle. the lieutenant governor says the new state budget includes $300 million in cuts to csu and uc system. take a look how fast tuition is rising at state schools. in 2002, a year at csu would be about $1400. it has increased every single year since. to its current rate of almost

$5,000. if the governor signs the budget that figure is expected to keep climbing. tuition increases may price some of her classmates out of college. >> its discouraging. if you don't have a lot of money already people don't want to go to college so if you don't have money it's giving you a reason not to go. >> the budget includes funding deferrals for k-12 leaving districts scrambling for money they were banking on. >> these deferrals force us to get money from somewhere and usually that comes with a cost, whether it's interest rates or taking away from other programs. >> making it tougher for all bay area school districts to get students where they belong, accepting a high school diploma. jean elle, "today in the east bay." >> gas prices are getting better but commuters are encouraged to dump the pump and take public transportation especially today. christie smith is live in oakland. good morning. >> reporter: good morning, scott. this national dump the pump day

is probably an easy sell when gas prices are the way they are. yesterday i got gas and i paid about $3.50 a gallon. i felt like it was a steal. a recent study came out showing that if a family with two cars got rid of one car, they could save about $10,000 a year. so b.a.r.t. and other agencies are getting the word out to drivers trying to get them out of their car, protect the environment and save cash. this morning dump the pump stickers will be handed out in the morning commute on b.a.r.t. if you wear one in some areas you could win a b.a.r.t. ticket. or if you are artsy and submit a photo of yourself posing with the gas pump showing your outrageous gas price per gallon you could win up to $500 in b.a.r.t. tickets. you submit those on line. they are also going to screen a new ad they say was way too controversial for gas pump

we have big time changes on the way. as we head through the next few days starting today the cooldown has arrived. we didn't have a major heat wave. it lasted a couple of days. a lot of people are done with it. already seeing cooler conditions. at the coast the greens on the map here. we're seeing a little bit of the onshore push. i think we'll see the marine layer push pretty much all the way to oakland, might not make its way to livermore but i think we'll see pretty good inland penetration of the marine push. 57 in sunny vam. on the way to the 70s at noon but not the 80s. we'll see the upper 70s and round out the day with comfortable conditions. 83 in livermore. 82 in concord, 82 up in santa rosa. i've got your seven-day outlook coming up. we have father's day this weekend. a lot of action when it comes to sports so i'll break down the forecast. today, the cooldown starts, tomorrow kicks into high gear. let's find out what gear you're driving in with mike.

>> it was a hot time at the toll plaza at treasure island because there was a car fire off of the roadway. it was earlier disabled vehicle, then a car fire was reported. the latest i got is that the fire has been put out. so a little smoke, maybe a flame or two. no injuries and now this activity just a disabled vehicle off of the upper deck as you approach treasure island. lanes sound like they are open heading to the city. a look at the bay bridge toll plaza. very light volume of traffic. that's the reason we don't see major slowing heading up on the incline or to that area. we see the southbound, sorry, the left lane, the northbound side, that's unusual. you see a crew is now moving some of the roadway signs and that should be clearing up past the coliseum, now a little slow from 66 to 98. >> mike, thank you much. it's 4:40. coming up -- >> 200 million websites today and $100 billion is lost to fraud. >> how do you know the tickets

dropped support for hp made servers. for the rest of the news before the bell we'll turn to nicole lapin over at cnbc. good morning. >> good morning. futures are teetering around the flat line after yesterday's big sell-off. stocks of course dropped as the dollar fell against the euro and worries about the debt crisis continues in greece. workers there went on strike, then rioted, then protested budget cuts as the government attempts to thwart a debt default. the u.s. also could be impacted by a greek default. reports say banks have about $41 billion of exposure. asian markets fell, europe is in the red but we get significant data out stateside on unemployment, housing starts and building permits. a report on regional economic conditions is something we're watching as well. the dow dropping to recap, 178 points yesterday, below that 12,000 mark to close at 11,897,

the nasdaq lost 47 as well to close at 2631. also this morning citigroup says 360,000 customers were affected by a hacker attack. nearly twice the amount initially suggested. the breach was made public last week but first defected in may. citi had to reissue a lot of cards, 217,000, the state with the most affected customers is california with 80,000. and ibm is celebrating its 100th birthday. in 1911 three companies that made scales and other machines merged. the ibm name came in 1924. among some of big blue's invention the first hard disc drive t floppy disc, the atm, bar codes, thank you very much, the strip on the back of your credit card we can't live without. i can't. this is interesting trivia, skoxt if you bought a share of

festival. he was quickly contacted by jason who said he was affiliated with stub hub. but things quickly went downhill after keenan wired the the man $700 for a pair of tickets. instead of getting the tickets via fed ex, he got tangled in a web of lies. >> he asked me things. >> reporter: jason told him the transfer was a mistake and he should pay cash on delivery. to get $700 back he needed to send more money. when keenan balked, the threats began. >> he was getting fairly angry. kept saying if i didn't go through this he was going to contact the police in his area and he would have to deal with this legally because i agreed to send the money. >> he tried to bully you into sending more. >> pretty much. >> concerts are probably where we see more fraud. >> this is a new trick, fraudsteres claiming they are affiliates of well known companies.

>> unless you are on the stub hub website, calling the 866 number you're not dealing with stub hub. >> reporter: aside from bonus tickets, the cash you paid for front row tickets and putting you in the nose bleed section. hidden fees can cost you big. >> i'll see a ticket, maybe $500 on another sight but it's $50 on this site. think it's face value. you buy the ticket, they get the credit card statement and they have an $800 fee. >> jeremy sounded site jabber.com, a free resource for consumers to check out reviews of unfamiliar sites. on line fraud is big business. >> 200 million websites today and $100 billion is lost every year to on line fraud. >> he says on line ticket express.com are among the sites with the most complaints but there are plenty of other one star reviews. buyers should always check before forking over money.

>> we help consumers avoid fraudulent websites. >> he says look for the company's physical address. then do a google view. >> if it points to an empty warehouse by a railroad track, maybe that's a red flag. >> beware of bad grammar which may indicate an out of country scam. when he called police he sent his money to manila. there was little they could do to get it back. >> the worst experience for in our minds for fans is you look forward to this event, you get there, show up, you go through the turn style and get rejected. it's a horrible feeling. >> because the last thing you want to say is i was supposed to be there, man. in the coming weeks more ticket buying security, stub hub, one of the first sites to release new software that will send your tickets to your smart phone and reduce concerns about counter fitting. in the meantime, using your credit card and representable sites still your best form of protection. vicki nguyen, nbc bay area news.

>> 4:49. let's check win christina loren and a warm forecast. >> yeah. it's going to be hot today. well, not that bad. still another hot one. we're going to cool down tomorrow. comfortable weather in the forecast. high pressure building back in to the four corners region. that mean you're going to be headed here or just watching the giants came tonight in phoenix, they are going to be playing in really hot weather. you can watch it here on nbc bay area at 6:40. you can see we have clouds pushing into the bay area. this is all part of on shore flow that's starting up again. for us, that means cooler days but we're going to have coolish, cloudy starts making way to sunny afternoons. that starts up today. i think we're going to see cloud cover pushing in especially the north bay, starting to notice that. as we head through the end of next week take a look at this. really big ridge of high pressure shaping up in the eastern pacific. this guy is going to warm us up back in the 90s at the end of next week. we're going to get a short lived cooling trend, then warm up to

the end of next week. really if you like the weather, the hot or the cool you're going to get both of. 53 degrees in oakland. 56 in hayward, 57 in sunnyvale. headed to the low 80s. yesterday we had the mid 90s so i shaved off 10 to 15 degrees from all of these temperatures. san francisco a gorgeous day in the city, 70 degrees for you. 85 at gilroy. and 83 degrees in livermore. here is your seven-day outlook. tomorrow that's when it starts to go comfortable. 78 degrees, we'll have to get through the cloudy start. 75 on saturday, not too bad for outdoor plans, better on father's day, a little warmer, 79 degrees. then the ridge builds in and warms us back in mid-80s as of tuesday and wednesday. only the 70s for the few days. hope you can enjoy it. back to you. >> thank you much. the a's playing a day game at the coliseum this afternoon. they are trying to string together a win streak. last night a strong outing by josh atman. he didn't give up a run.

the a's beat the royals 2-1. let me say that again. the a's beat someone 2-1. the two teams play again at 12:35. the boston bruins probably still up celebrating their stanley cup victory. a strong performance by tim thomas. he shut out the canucks to help boston claim its first nhl championship since 1972. thomas also named the mvp. for the canucks, some of their fans did not react well after the loss. they rioted in vancouver, breaking windows, flipping cars, setting them on fire. a similar riot erupted in vancouver when they lost in the finals in 1994. >> coming up, another major step in the amazing road to recovery for congresswoman gabrielle giffords. >> and recovery for the road across bay bridge. a different tunnel, the

we have 580 with slowing between north livermore and airway but as the earlier closure, there's probably construction equipment. that is clearing. 680 on the eastbound 580 we're watching the transition. there is construction and north of there at the red gear area. also coming off of the san mateo bridge eastbound 92 at southbound 880, the transition ramp was closed. i got an update. it looks like that's reopening even as we speak. a look at 880 fast coliseum. i showed you flashing lights. they moved the construction vehicles and there was a burst of traffic that has cleared. looks like the road is cleared to the nimitz into downtown. >> thank you much. this morning congresswoman gabrielle giffords is home. she was released from a houston hospital on wednesday where she was recovering from that gunshot wound to her head. after four surgeries and months of rehab she has shown increased improvement. she has to go back to the hospital every day for therapy

but her spokesman says she is glad to be home. >> her mood was fantastic. she was elated. she is happy to be able to go to mark's home and be with her family. >> you may recall, well of course you recall, giffords was shot in a town hall meeting in january. she has months of intense therapy ahead but staying home may actually help her progress. >> coming up, a peninsula man kicked off of his flight at sfo and arreste bec pull up his pants. we'll hear from his mother.
