seems to have an opinion about. it was yesterday morning that when 20-year-old deshon marman had made his way through a security checkpoint like the one you see here, he was successful in going through security. it was after he boarded u.s. airways flight bound for albuquerque when he was arrested for refusing to pull up his sagging pants. he is from san francisco where his mom lives but he plays football for the university of new mexico. his mother tells us he was asked by employees to pull up his pants before boarding the plane. he said he couldn't because his hands were full. so after getting situated on the plane, he did as he was told and pulled up his pants. by then the pilot had ordered everyone off of the plane and marman was taken into custody for trespassing, battery and resisting arrest. his mother says her son was stereotyped and the airline owes him an apology.

>> i want them to take this off of my son's record. >> i think they owe him an apology? >> yeah. it's not like he a's discriminating. he couldn't pull up his pants because he had too much luggage. >> what if he refused? what if the -- >> if he refused, what is america if you can't do whatever you want. >> u.s. airways says it does not have a dress code but expects passengers to dress in an appropriate manner that does not offend passengers. marman's mom tells us he had just attended his best friend's funeral yesterday. his friend was shot and killed in may in san francisco so that was a few weeks ago. it was after his friend's funeral that he made his way back to sfo to head back to unm to head to albuquerque. he is sitting in san mateo jail.

he will be arraigned a little later this afternoon. >> marla, i don't want to be graphic but was it indecent exposure? do we know? >> reporter: you know, one airline employee tells the "san francisco chronicle" that his back side was exposed, i mean i think we've all seen that before when the pants are so low that you can see the boxers that they are wearing programs. i'm not sure if that was the case as i said and an employee says that's what they witnessed. but again, the question is you know, is this worth an arrest. >> interesting to see. if photos emerge as well. >> 6:04. this morning search volunteers are sought to find missing nursing student michelle le. her family and the class kids foundation will hold a three-day search starting tomorrow through sunday. though hayward police are treating this case as a homicide the family is not giving up hope of finding her. organizes say the nils canyon

area may be the focus even though police have gone through the area already. the 26-year-old student was last seen on may 27 at kaiser permanente hayward medical center where she was doing rounds. this morning the man caught on cell phone video in a home invasion in oakland is behind bars. >> will you please leave? how'd you get in here? >> oakland police say the 47-year-old dionne mcdaniel raped the 28-year-old woman who somehow had the wear with all to get on her cell phone and shoot the video of her alleged attacker. mcdaniel was found hiding 18 dog house yesterday a short distance from where the woman lived. >> this morning it appears revenge by suspected child molester has a san jose teen on life support and her mother in critical condition.

investigators say 60-year-old jerry steel shot the women in the head yesterday as a form of payback. steel is accused of sexually assaulting the teen earlier this year. investigators say ashley volore andler daughter moved to crescent city to start a new life. but steel allegedly tracked them down and tried to kidnap them. when that failed police say he apparently shot them both in the head. volore's neighbors are shocked. >> horrible. they were both really night. she was really nice. she was sweet. >> police found steel at a park and as they approached him, he shot himself in the head. >> this morning a new low in sacramento politics. lawmakers aren't pulling punches when it comes to the budget. things almost came to blows on the state assembly floor as lawmakers tried to iron out a budget deal. >> let's not buy the insurance policy that tony soprano is selling us. >> i take offense to the

asked to ditch their cars and hop on public tran silt. christie smith is live with more. prices at the pump are inching up. it's tempting. >> reporter: it is. i think a universal way to get someone's attention is offer something free. that's what b.a.r.t. is doing on this national dump the pump day. there is a catch. first, this morning they are going to hand out these stickers starting at 7:00 this morning. and then if you're spotted wearing them midday, then you could win a free $20 b.a.r.t. ticket. 12th street city center, embarcadero or downtown berkeley as an alternative to the gas prices we're seeing. i just paid $3.50 a gallon. that's down from what it was a few weeks ago. our recent study showed that if a two-car family got rid of one car, they could save about $10,000. b.a.r.t. is showing a video they say was rejected at gas pumps.

i spoke with a rider whether he thinks these ticket giveaways will get people to try b.a.r.t.? >> the same people who ride every day probably the same ones going to get the tickets. so i don't know if it's going to change. not because people who are not here don't ride b.a.r.t. i don't know. >> reporter: a b.a.r.t. spokesperson says they do see more interest when the economy is bad but really it's a personal choice. also, they say you might want to get your camera phones out and take a picture of yourself at the pump and show the price you paid, submit that on line and you could pin up to $500 in b.a.r.t. tickets. the spotters are wearing gas pump tee shirts, they will be out midday from 11:00 to 1:00. the tickets are small so you have to wear them prominently and probably draw attention to yourself to get noticed. christie smith, "today in the bay." >> how do you submit the

much cooler conditions. as we head throughout the remainder of the weekend, conditions will be pretty fair. we'll go about 79 degrees as we head through saturday. sunday, a little warmer. but then as we head into next week, high pressure takes control. take a look at this ridge. it's shaping up in the eastern pacific, really strong ridge, clouds arcing up and around. this is going too take our storm track to the north. our temperatures in the upper 50s, low 60s. today we'll be able to easily climb into the low 80s inland and talking about maybe low 70s at the coast. 65 at noon in san francisco when we tlooz marine layer we see this morning. then as you make your way home, 70 degrees in the city, you're probably going to see warmer conditions in the east bay. up to 83 in livermore. let's get you to work on time with mike inouye. >> good morning. we'll take you out to livermore, the build continues out of the altamont pass. the indicators are red. averaging about 46, 45 miles per hour through that stretch over

>> did you see this. people in vancouver waking up this morning to a not so pretty picture. this is the scene last night as hockey fans rioted in the streets after the canucks lost 4-0 to the bruins. it was the stanley cup final. rioters lit parked cars on fire, threw bottles, riot police had to move in to try to restore some of the order out there. similar scene happened in 1994 when rioters lashed out on the

streets when canucks lost to the new york rangers. probably a cleanup this morning. >> this morning the new victims of flooding in downtown capitola are the nonprofit groups and social services. funding for nonprofits could be cut if the state and federal governments cannot help with the cost from the floods which wiped out the downtown back in march. it's also unclear if the city's insurance can help cover expenses which total roughly $1.4 million. right now the city is giving out 45% of its community grants and then waiting three to six months to decide on the rest. >> new report this morning suggests fewer homeowners are going through foreclosure. while that might sound like good news experts suggest it may be to banks temporarily putting foreclosures on hold. state sales of homes taking a dive. foreclosure filings in the u.s. are down 2% from may to april and down 33% from may of 2010.

in may, home sales fell 13.3% from the same time last year with the median price for a home at $249,000, down 10.4% from may of 2010. you know, this morning there is a bright spot in the real estate market. it's right here in the bay area. bob redell is live in palo alto to tell us about it. good morning. >> reporter: good morning. the recent ipos and surge in tech stocks have pulled up home prices in silicon valley significantly. take palo alto where we're at. still home to facebook and it's much anticipated ipo. modest homes like this we checked are now in the $1 million range. data quick, i want to show you numbers, a firm that tracks real estate. shows that the median price of a home in palo alto jumped 20% between may of 2010 and may of this year, the median price now

$1.6 million. cuperti cupertino, home to apple, is up 12% homes there. saratoga, up almost 5%, mountain view, home to google, don't know if you heard of them, they are an online firm, up 3%. there's no rocket science in figuring out this surge. the people who work at these tech firms and live in these communities have more money to spend and lots more home which is driving up the prices. there's even one school of thought that people are buying homes specifically in palo alto, menlo park and this area, in anticipation of the facebook ipo. facebook currently at palo alto, moving to menlo park. they are aware the home prices would continue to surge as facebook employees would be able to cash in stock options assuming those go public. one economist tells bloomberg news, you take that into consideration along with let's say the recent linked in ipo, he

880 past the coliseum, easy drive for the nimitz freeway. no major issues. 12:35 game, the a's are playing. a nice light drive, look at that on the right side. easy flow, that's toward the bay bridge toll plaza. looking for the metering lights to be turned on. there is a slowing approaching the toll gates. it's a pretty light flow for now this time 6:26 on a thursday but you'll see this backup form over the next 10 minutes. >> we'll check with you then. california lawmakers want to make tax purchases on line they have been trying to get a piece of that pie. scott says it's tougher than it sounds. >> it is. technically, californians are supposed to pay taxes voluntarily for stuff they pay on line. you are supposed to set aside money every april for stuff you buy on the internet. that doesn't really happen. lawmakers want to force sites like amazon.com to add state sales tax to stuff you buy on

line. california argues because washington state-based amazon has business relationships with california, it's subject to this proposed tax. amazon has not reacted well to other states that claimed the same thing. they pulled their affiliate relationships with companies in other states like texas and connecticut. if online companies like amazon balk and pull out it stands to reason that california will not collect the $200 million a year lawmakers hoped for. lawmakers passed this budget last night. the governor would need to sign off on it. >> well, the pandora ipo didn't exactly rock. let's call it soft rock. take it easy by the eagles maybe. yes. shares in oakland-based pandora, slightly above their initial price, up about 9%. pandora is popular but it doesn't make money. i made about as much money

as for marman he is in county jail and will be arraigned later this afternoon at 1:00. he tells nbc bay area he wishes he could do it all over again because he says he would pull up his pants immediately. >> interesting to see what happens. thank you very much. 6:34 now. is a suspected east bay killer caught on surveillance video? police need your help. police want you to look at this video taken from a gas station security camera, they believe the man to the right of the camera is a suspect who shot and killed leyo duncen. police say duncen and another man were arguing in the moments just before that shooting. keeping animal abusers from adopting their next victim. san francisco could create a data base to track animal abusers and prevent them from

adopting animals. the animal control commission will discuss at a meeting at 5:30 at city hall. if the measure is approved it heads off to the board of supervisors for a vote. a civil grand jury says the firefighters need to overhaul the way they respond to emergencies. they say they believe it's unnecessary for firefighters to respond as if they are going to a fire even when going to a medical call. the jury cited a report that says that 70% of the department calls are medical emergencies. 4% are fire related. sending firefighters to cover mostly medical calls is wasteful and inefficient. >> i want to check the forecast with christina loren. a couple of warm ones. >> reminder that our acs need to be running efficiently. we have more on the way as early as next week. a few days of picture perfect

weather. 70s tomorrow and start. today a little warm, we're going the low 80s. high pressure firmly in control out here in the eastern pacific. it's going to start inching toward us. after sunday it will set up over the bay area. that will warm us up as we head through tuesday and wednesday up to the 90s independent the warmest spots. but we'll get a break. it should last. if you try to make outdoor plans i think you'll see more sunshine, warmer but more sun on the way for sunday. 62 degrees right now in concord. and 53 in santa rosa. well on the way to 77 degrees at noon as you broke for lunch. you can see we're going to see some of that stubborn marine air, that low cloud cover, probably till about june. 83 degrees in los gatos. your seven-day moments away. mike is here to help you out.

a spokesperson for congresswoman giffords said she was elated to be out of the hospital. president obama called it a miracle given what she's gone through since she was shot january 8, months in the hospital, four surgeries, we've seen significant progress. in fact, doctors say she has had clear continuous improvement. a long way to go but she will go back and forth every day from her husband's home in houston back to the hospital for intense therapy. she is going to need it for some time. but she's walking with help, she's talking, she still has trouble with complex ideas but we're told her recovery is nothing short of amazing. good news as we find that finally after months she's getting that opportunity to go home. >> a lot of people say nothing short of a miracle. thank you very much. >> it is 6:43. arguments will start this morning in north carolina over whether former presidential candidate john edwards will have to testify in a case involving a

sex tape. edwards is being called to testify in a lawsuit filed by his former mistress. she claims a former aide to edwards took sensitive materials from her including a sex tape showing the former senator. she wants the items returned to her. the hearing is expected to start at 7:00 a.m. >> a new report this morning suggests fewer homeowners are going through foreclosure. it may sound like good news, experts suggest it may be due to banks temporarily putting foreclosure proceedings on hold. state sales of home taking a dive. foreclosure filings are down 2% and down 33% from may 2010. in may, home sales fell 13.3% from the same time last year with the median price for a home at $249,000. it's down 10.4% from may of 2010. but this morning there is a bright spot in the real estate market happening here in the bay

area. bob redell is live in palo alto to explain. good morning. >> reporter: good morning. yes, as you're mentioning home prices statewide generally are down but that's not the case in pockets of silicon valley where ipos in the surge in technology stocks have driven up home prices here significantly. palo alto where we're at, home to facebook, you have a modest home like that one that is valid at over $1 million. it gives you a sense of how much prices are up. data quick tracks real estate is reporting that between may of 2010 and may of this year, home prices in palo alto jumped 20%, the median price of a home here now in the peninsula town is $1.6 million. cupertino, home to apple whose stock has been gang busters is up 12%, we're talking about the

home prices there. saratoga prices up almost 5%. mountain view home to google, now up 3%. there's no rocket science in figuring out this surge. the people who work at these firms, many live in these communities, they have lots more money to spend on lots more home which is in turn driving up the prices. there is one school of thought that people are buying homes in palo alto specifically in anticipation of the ipo'ing of facebook, betting thinking that those employees once they get money from their stock options that they will buy more homes here, driving the prices up further. >> amazing. a little fixer upper for you. thanks so much. one great thing about the bay area is the weather. we can't complain. a couple of warm days though a lot of people did complain, didn't they. >> check out my facebook page. lots of complaints. i had a request for a pollen

help solve the murder. >> a former basketball superstar shaquille o'neal is under investigation for claims he was connected to the beating of a man. the l.a. county sheriff's office is checking to see if o'neill was involved. the victim claimed he had a sex tape of o'neal with another woman while he was still married. he says he was attacked and robbed by members of a street gang who were looking for the tape. they are facing assault and robbery charges. o'neill denies involvement in that attack. the former nba star retired after playing 19 seasons. >> coming up, the new way the walls are going up in one peninsula city. >> a like look outside, golden gate bridge. a little hazy but you can make

>> welcome back everyone. a live look outside across the bay at the embarcadero this morning. very nice temperatures if you have managed to make it to the beach it will be nice. this morning hayward police are still looking for two robbers who shot a man near the b.a.r.t. station. the men robbed a couple late tuesday night after they left that station. the couple reportedly handed over their belongings but one of the robbers shot the man. he's listed in stable condition. >> officers say the two men also robbed a pair of women a few minutes prior to the attack. they took the women's purse, then one of the men shot his gun in the air. neither woman was hurt.

in both robberies the men used something to cover their faces. >> this morning police on the peninsula want residents and city officials to think about landscaping when it comes to preventing crime. last week police hosted the first of several workshops to teach how landscaping can help stop crime. they say by planting thorny shrubbery on fences and beneath low windows and installing video cameras can help prevent crime. i don't know if those will do it. maybe a prickly pear. watch out for the marigolds. doing these things can try to make homes safer. >> technology the key thing for the mayoral debate tonight. the contenders will talk about how they would use technology to improve the city and increase civic participation. the public will have a chance to join the debate by voting on

line. the nine major candidates will be attending the event. it starts at 6:00 at pier 38. >> let's check the morning commute, see if it's picking up. it was light earlier. >> you know, we found our reason why some of the shots we saw were lighter and the reason for the backup. the car fire i found that would cause a distraction. that's westbound 80. it just cleared north of the university. as you approach around golden gate where we saw that slowing it's cleared from the roadway and no injuries but that was enough to distract folks about 20 minutes. look at that backup approaching the merge. that starts to move as it clear, folks will head to the bay bridge toll plaza. that is going to back up. right now at west grand avenue. further south off of the san mateo bridge the accident i reported earlier is still there.
