this is an nbc news special report. >> good morning, everyone. i'm matt lauer along with ann curry, a democratic source with knowledge of the situation tells nbc news that anthony weiner, the democratic congressman from new york, has decided to resign his seat in congress. this following a week of daily revelations, drip, drip, drip, none of those revelations good for congressman weiner. a series of text messages and photos between the congressman and a series of young women across the country. nbc's luke russert's on capitol hill. he's got more on this. good morning. >> matt, after nearly a two-week

saga that engulfed the democratic party, anthony weiner informed nancy pelosi at congressional picnic that he would step down as a member of congress. this comes after nearly one week of his colleagues calling him to step down because he was a distraction to the party and prohibiting them to talk about issues they deemed to be important like economy and health care. around 9:30 a.m. we saw leaving the d.c. office on capitol hill. they left with their belongings and would not say where they were going. the doors were locked and the office lights were turned out and all calls need anthony weiner's offers would go directly to voice mail. so we can now report anthony weiner has stepped down and this is really a sad ending, a lot would say to what was once a bright, promising political career. the youngest person ever elected to the new york city counts nil the '90s and congress in 1998. someone who had a $4 million war

chest for a possible run for mayor of new york in 2013 has now resigned as member of congress and his political future is certainly unclear this morning. >> hey, luke, i'm asking you to speculate a little bit here, but this comes just about a day after his wife huma returned from an overseas trip with her boss secretary of state hillary clinton and it came as congress ramped up the pressure congressman weiner. do we know if this was a result from pressure from his wife, pressure from his colleagues or a little of both? >> it's certainly -- about 4:30 a.m. yesterday morning. we presume that that consultation did occur. also, matt, the timing on this is interesting. at 10:45 a.m. today nancy pelosi was slated to give a press conference, the first one that she was going to give since this scandal started where we can now know the announcement that she

would give this press conference last night and she knew he would step down which would make her more inclined to go before cameras. if she had to answer questions why he was still a member of congress. the writing has certainly been on the wall the last few days and anthony weiner no longer representing new york's ninth congressional district, matt. >> luke russ or the capitol hill. he's been covering the story from the beginning. thank you very much. >> let's bring in nbc's chuck todd, nbc political director and chief white house correspondent. good morning to you. >> gm, ann. >> given that the intense pressure anthony weiner was going to intensify, did he have any other choice? >> he appeared to make this decision yesterday because it was last night, you know, the white house, president obama who was the most recent person in that interview with you, ann, to call on weiner to resign, it was at a white house congressional picnic last night anthony weiner called nancy pelosi and steve israel, he is chairman of the

democratic campaign commit e but also a member of the new york delegation, sort of one of the persons that's been a go-between between pelosi and anthony weiner in this and it was last night, yesterday evening, that weiner called two of them and said he would be resigning this morning. >> given his ambitions and also his -- the prospects that he once had, give us some sense about how steep this fall is. >> it's a pretty big fall. this is a guy who was a protege of chuck schumer. he's the senior senator from new york, very famous for being unafraid about going before any tv camera, having sunday news conferences. he learned sort of at the foot of chuck schumer, this idea of being a little blunt, a little in your face and always knowing how to get media attention and for anthony weiner, his ice were on the mayoral ship of new york city. he almost ran four years ago and thought he could beat -- decided

he couldn't beat bloomberg when bloomberg decided to run for a third term. he was getting this together to try to run again and he was serving as sort of the bombastic angry progressive, trying to be the anti-tea party liberal in congress taking on these folks. he'd become sort of a hero to the more progressive left who were always upset that democrats don't stand up for themselves. here was the guy that had all this potential to become a huge political figure to become may offer new york city and now it's going to be tough for him where he goes next. huma, his wife, very close to the clintons, maybe they can help him out and it's want clear where he goes next. being a politician was what he thought he was going do for the rest of his life. >> meantime today you will hear a lot of relief from the democratic party m but i wonder how you think this will play out. now they need to have an

election to fill his spot. what is the timing? what is the thing that you expect to happen over the course of the next couple of days. >> it's awkward with what will happen in new york state because new york is supposed to lose two congressional districts and lawmakers in albany have to figure out which ones they'll get rid of. now it probably means they'll get rid of this one, but it will be between now and january of 2013, they'll have to have a special election and you'll see that and perhaps some familiar names for new york city folks may decide to run for that seat, but the seat will probably be gone and that makes for an awkward waste of money, frankly, for the state of new york to do this. and, you know, the rest of this week is gone for the democrats in trying to talk about medicare, talk about the economy, but i think that the point they finally get to turn the page and go back to trying to beat the republicans up over the paul ryan medicare plan which they believe they were getting traction on until this weiner mess exploded. >> chuck todd, always great to

vancouver canucks 4-0 in a winner-take-all game seven, but as bruins fans partied the night away, looting and rioting where the fans set fires and flipped over cars. at least four people were stabbed in the violence. police unleashed tear gas and pepper spray on the unruly mob. for the first time since 1994 also after the canucks lost game seven to the rangers? more than a month after al qaeda leader osama bin laden, the terror network has named a successor, formerly al qaeda's second in command. ayman al zawahiri is now the group's chief. the news comes from an al qaeda-affiliated website. he was born in egypt and comes from an upper middle class family of professors and doctors. president obama is defending the legality of the u.s. operation in libya as ten congressmen filed suit against him calling action there

unconstitutional. the white house sent a report to considering arguing it does not violate the war powers act even as the operation a proefrps the 90-day deadline for action without congressional approval. meantime, a pre-dawn attack targeted the compound in tripoli. the swollen waters are haste -- after the river burst through a levee and although river levels dipped slightly following several other intentional levee breaches, the water is once again on the rise there again today. the financial crisis in greece has investors skittish this morning. courtney reagan is at cnbc's world headquarters. courtney, good morning. >> hi, good morning to you, natalie. believe it or not, stocks are actually able to hold on to some of those gains so far this morning despite that continued turmoil in greece. though that turmoil does add to investors worries about the european economy and potential debt crisis spreading around the

world. economic news so far this morning is mixed. fewer americans did apply for unemployment benefits last week, but the applications still remain above levels that are consistent a healthy economy. natalie, if stocks finish lower for the week it will be the first time the dow has reported seven weeks of losses since 2001. back to you. >> cnbc's courtney reagan. thanks so much. nasa has conducted a fueling test on the space shuttle atlantis in advance of the 135th and final flight of the 30-year program and while anywhere concerns that a possible hydrogen fuel leak could delay the liftoff date, engineers were able to isolate the problem and the issue can be repaired without delaying that july 8th launch. it's 7:10, pacific time, you're up-to-date. let's turn it to matt and ann. >> thanks so much. so far al's lend a hand tour has landed in anchorage, las vegas and houston. this morning we find him in

birmingham, alabama. hey, al. >> hey, matt, ann, thank you so mu much. zee $1.7 million for a very, very worthy chair they will help folks in tornado-ravaged tuscaloosa as well, but first let's check your weather and show you we have two areas of risky severe weather today. first of all, as you see out west it's pretty nice. sunshine in denver, 89 degrees and 105 in phoenix, los angeles, nice and tempered 70 degrees and seattle, beautiful day, upper 60s and plenty of sunshine. those two areas we're talking about, one in the central plains and the other moving in the upper ohio river valley and beautiful weather along the west coast, the gulf coast sizzling from southern california all of the way to florida, we've got the potential for a lot of record-setting temperatures. tallahassee got to 105. their all-time high record ever >> our high temperatures are coming down a little bit, on

average 5 to 10 degrees from yesterday's highs. i've taken the 90s off the map. 62 in concord, 58 in hayward. headed to the 70s along the peninsula and the east bay. oakland 73 for you today. 70 in san francisco. a little warm down in the south bay as high pressure has retreated to the southeast. that will be the warmest spot across the bay area. ch. we'll see you in a couple of minutes and let's get more now on the morning's top story, the breaking news that new york congressman anthony weiner has decided to resign. nbc's luke russert is on capitol hill. we first saw this in "the new york times" that he told friends about this and that he reportedly called house minority leader nancy pelosi last night and you saw members packing things up in the office, so this

is a done deal? >> it is a done deal, matt. last night at the congressional picnic which is a rite of passage, he invites numb s memb have biggers and dogs. anthony weiner was remorse ofl that phone conversation and he called steve israel head of the democratic congressional campaign committee and fellow new york democrat also informed him of that decision and then early this morning when we were staking out anthony weiner's office we saw the lights shut off, staffers leaving with their belongings and when we tried to call the office it went directly to voice mail. why is that interesting? at 9:00 a.m. congressional offerses are usually open for business and it certainly sent a signal and it was later confirmed, matt. this comes on the heels of his wife huma abedin, before anthony weiner could make any decision

about his political future he would have to have a face-to-face conversation with her. >> one other thing to note in terms of timing it comes 12 or 24 hours after one of the women that he exchanged text messages with, this person we're referring to as a former adult film star held a press conference and said that anthony weiner actually encouraged her to lie about their text message exchanges. >> absolutely. that was the concern of members of the democratic party, matt, was that each day that went by it seemed to get worse and worse for anthony weiner. remember, this scandal is three weeks old. yesterday, very publicly, gingerly, the former adult film star basically said that, look, anthony weiner told me to lie about our correspondents over e-mail and he called me and told me about that and if i have to testify before the house ethics committee i would be more than willing to give forth all my e-mails and phone conversations. so it did not look like there was a plausible way for anthony wean tore stay in congress and be an effective member.

meaning someone who could fight for his constituents and be a day-to-day as a member of congress. this comes as a sigh of relief for many democrats. this is the one word we heard time and time again, as distraction. not allowing us to talk about the economy, not allowing us to talk about social security and medicare. this is something a lot of democrats wanted desperately and they got it this morning. the one thing i keep reiterating that i heard yesterday, that if anthony weiner were to come back to the house representatives he would be a man without a country. it seems that message has resonated with anthony weiner. >> they're not going have to worry about that any longer. luke russert at the capitol. thank you very much. >> thanks, matt. >> it's 15 after the hour. here's ann. >> let's go back to chuck todd, nbc's political director and chief white house correspondent. good morning once again. boy, does congress need to put this thing behind them and you found out more evidence because we have a new nbc news/wall street journal poll and 74% of

americans disapprove and that's higher than usual. >> congress' numbers are basically at the same low point they were in march 2010. what happened in march 2010, that's when healthcare was passed and it was at the time very unpopular and nobody was happy with how things were being handled and just look at the last three weeks, you know, whether it comes to how's washington handling themselves on the superficial front you have that anthony weiner mess and he was dragging it out. and you had people when reporting on weiner talking about the other transgressions too common among form members of congress and current sitting senators and that would add to that and throw in the fact that these guys can't agree on figuring out a plan to dealing with the debt crisis and dealing with the debt ceiling which could put our economy in danger and frankly, when you look in hindsight, not surprising where on one hand you got weiner and

on the other hand you've got gridlock and it's no wonder many folks of both parties throw up their hands and say these guys do not know what they're doing. >> you talk about looking. >> in hindsight, what about looking ahead to 2012 because the poll also found that republicans are discouraged by the republican presidential choices. 73% in 2008 said they approved of the list, but look at this, today just 45% of republicans are satisfied with their choice over 2012. >> it's the lowest number we've ever had since we tracked this number of being saefred with a current presidential field or not satisfied. ann, it explain yes all this week e so you have this presidential debate on monday night among republicans and every single day we heard from somebody who wasn't on the stage thinking about running whether it was john huntsman, former utah governor, rick perry, the -- excuse me, current new jersey governor and rudy giuliani. it's because it's not just

republican, leets who are not satisfied with this field and with mitt romney in particular, it's rank and file republicans and it's mostly, ann, tea party populist republicans who don't feel as if mitt romney is ready to take the fight and have the kind of conversation they want to have nor is there anybody in this field filling that void and ready to take him on and do it for them, and i think that's why you see a lot of chatter about rick per. >> we're out of time, but i should mention that obama's -- the president's approval ratings are taking a hit. >> economy, economy, economy. >> know that's the bottom line. it's now 7:18. once again, here's matt. >> thank you very much. in other political news congresswoman gabrielle giffords has taken a big step in her recovery. this morning she's home for the first time since she was shot in the head in january. >> nbc's tan tro has more. >> gabby giffords' coggive inity ability have improved that she

no longer needs full-time care. she's been released to her husband and their family. a moment they've been waiting for since that horrific day in january. >> husband astronaut mark kelly were seen with family coming and going from kelly's houston home, all part of the homecoming day they hoped for for months. a neighbor captured the emotions of so many. >> think it's a miracle and so we've just been very happy that she's come this far and that she's at this point. >> reporter: already this week new photos were released showing a radiant gabby giffords smiling. in a phone interview giffords' communications said what the homecoming was like for gap. >> she was e lated and happy to go to mark's home and be with her family every evening. >> of course, it was january 8th when the congresswoman was shot in tucson, leaving six people dead and 13 injured including

giffords, who clung to life after a gun shot to the head. with her husband by her side, the nation has followed giffords' progress every step of the way. >> gabby opened her eyes for the first time. gabby opened her eyes for the first time. >> reporter: then her first word. >> she was having oatmeal and yogurt for breakfast and she asked me for toast. she sounded great. >> reporter: soon, she was able to have a conversation with her husband. >> she's speaking a lot and at some level they're even asking her to slow down a little bit. >> reporter: giffords continued to work. eight hours a day in rehab, determined to be at her husband's final shuttle launch. >> she's, un, more than medically ready to be here and she's excited about making this trip. >> in april she not only made it to florida, but she did it on her own two feet. her progress continues to surprise everyone around her. >> it is amazing to think that this woman was shot at point-blank range in the head less than six months ago.

>> reporter: still, doctors warn that gabby's recovery is far from over. >> whenever someone has a traumatic brain injury like this people always want to know when will i get better, how long will it take? what it will look like? and the reality is no one really knows. so i think it is important for people to recognize that while everyone is excited for her discharge, this doesn't mean it's all over. it means that we've turned a new chapter in her life. >> a new chapter that gappy and her family are happy top ginn at home. >> reporter: as an outpatient she'll still have a lot of intensive rehab and that won't change and she has a lot of work to do on her speech and a lot to do on her motor skills as well, matt, but at the end of the day she'll be able to go home with her family and that means everything to the congressman. >> thanh i truong. thank you very much. we have new developments to report.

>> good morning to you. 7:26 now. i'm laura garcia-cannon. police need your help identifying a cyclist who died on the alameda creek regional trail. officers responded to an accident along the trail in north fremont on tuesday. that's where they found the cyclist. he was pronounced dead at the cycle. he didn't have i.d. on him. he is asian between 55 and 60 years old, between 5'5" and 5'7". he is about 180 pounds. call the east bay regional park district if you know who he is. >> let's check the forecast right now with christina.

i'm matt lauer along with ann curry. just ahead the casey anthony trial enters a new phase. >> the defense is to call its first witness a day after they claim the prosecution failed to prove casey anthony murdered her 2-year-old daughter. >> plus, more details about the bizarre plot to rob and possibly kill joss stone. two men with arrested with swords, maps and photographs of the singer's home. we'll have the latest from london coming up. >> when it comes to parenting, does father or mother know best? there is no evidence that dads may be onto something with their constant wrestling and horseplay with the children that's very good for them. we moms should rethink when we try to stop them. >> we have a lot to get to. let's begin with casey anthony's murder trial. kerry sanders is in orlando where he has been for a while now. good morning to you. >> reporter: good morning, matt.

three years ago today, caylee marie anthony died. it's a strange confluence of dates because on this day the defense will start arguing that casey did not murder her own daughter after they lost an argument in court. they lost the argument to the judge that prosecutors did not produce enough evidence for any jury to conclude that casey murdered her daughter. casey anthony stared at her attorney as he argued the judge should dismiss the case now. >> now, in this case, there is not any evidence of anything other than a caring, loving mother/child relationship. >> reporter: in what will be a preview of the closing arguments, mason said prosecution witnesses may have testified about deadly chloroform, duct tape found on caylee's skull, even her skeleton hidden in the woods

about a five-minute walk from her mother's home. even with that, mason argued, the state didn't prove caylee was murdered or that her mother had anything to do with it. >> there is no evidence to establish when the child died, where she died, how she died, who, if anyone, was with her in attendance when she died and they have failed wholly to rebut the reasonable hypothesis of innocence that it was an accidental death. >> reporter: the defense argues caylee accidentally drowned in the backyard swimming pool and in a misguided effort to avoid her mother's criticism, casey covered it up. >> the law is the law. >> reporter: prosecutors believe their witnesses have proven casey suffocated her daughter and, for the first time, they added, even absent toxicology

tests they believe the jury will conclude casey poisoned her daughter. >> it is our position that a reasonable jury in this case can conclude that caylee marie anthony died as a result of the application of three pieces of duct tape to her nose and mouth. that a reasonable jury can conclude that caylee marie anthony died as a result of poisoning by chloroform. >> in our case there has been no evidence presented that casey marie anthony used duct tape for any purpose, that she used chloroform for any purpose and in any way whatsoever contributed to the cause of death of this child. it is forcing, guessing and speculation and not in this country. >> reporter: shortly in the courthouse over my shoulder here

the defense will begin presenting its case. the big question is, will casey anthony take the stand in her own defense? matt? >> kerry, thank you very much. savannah guthrie is "today's" legal correspondent. good morning to you. >> good morning. >> we'll get to the question about whether casey will take the stand in a second. if you're a member of the jury and you have been sitting through the prosecution case and you have not seen direct evidence about when caylee died, how she died, who killed her or anything like that, how confident would you be feeling about a guilty verdict right now? >> the proof beyond a reasonable doubt is a very high standard. it's questionable whether jurors will feel they ha enough. i think the prosecutors have proven something criminal happened and that casey anthony is connected to it. will jurors be able to look at the evidence and come to the conclusion that this is a woman who premeditated the killing of her daughter and executed it through the chloroform and the duct tape? they say they have proof beyond a reasonable doubt.

that's the question. >> what the prosecution has done a very good job of -- two things. one, they have proven that casey anthony is a liar. they have trapped her in several very important lies. does that, in some way in the mind of a jury, make up for a lack of concrete evidence in other areas? >> in terms of some kind of conviction, it does. she's lying for a reason. jurors will ask themselves, why? and this is a woman who did not report her child was missing for 31 days. jurors will look at the evidence and say, why? they'll think she did something. >> that's the other thing the prosecution has done a good job of doing. they painted a picture of a woman who went out partying and enjoyed a good life knowing her daughter was dead or missing, depending on the story you believe. that cannot help casey anthony. >> it can't. however, i have always had a problem with the motive prosecutors offered in the case. >> she wanted a better life, to have fun? >> she was a mom too young, wanted to party.

first of all, prosecutors do not have to put on any evidence of motive. as a practical matter they like to because jurors want to understand the motivation. >> let's talk about the defense case. some legal experts i have read have said, you know, in some ways the defense has painted itself, backed itself into a corner by saying caylee anthony died in an accidental drowning in the swimming pool. as the defense puts on the case do they have to prove that happened? >> as a legal matter, no. they don't have to prove anything. as a practical matter, yes. jose baez stood up and offered a counter narrative, an alternate story. jurors want to hear it. >> prove it to me, yeah. >> if they don't see the proof they may not be willing to believe it. and the story comes from the proven liar, casey anthony. >> you stole my last question. yes, the question of whether casey anthony will take the stand in her own defense, the jury already knows she's a liar.

oakland police are releasing new surveillance video of a suspected killer from a gas station in oakland. officers say the man to the right of the camera is suspected of shooting and killing leo dunson on june 4th. the suspect is african-american, 5'9" tall and weighing about 170 pounds, 30 to 35 years old with long dread locks. they actually have red tips. this is him walking down the street. call oakland police if you happen to know who he is. >> could you please leave? how did you get in here? >> remember this video? this was actually taken from a woman who had the presence of mind to get out her cell phone and shoot video of her alleged attacker. oakland police have arrested the man, suspected of breaking into her home last tuesday, raping her, and then robbing her. police say they found 47-year-old dionne mcdaniel yesterday a short distance from where that woman lives. officers say the cell phone video was long enough for them to identify mcdaniel as the man in it. let's check the forecast now
