>> good morning to you. thanks for joining us. i'm laura garcia-cannon. quickly approaching 5:00. i want to check the temperatures for today. first day of summer. >> first official day of summer. that's right. if you are someone waking up with us now you're going to get the best weather of the day. through this afternoon downright hot conditions across the bay area. i'm using the triple digits like crazy. wait till you see your forecasted highs today. the good news is it won't last long. i've got the cooldown coming up. let's gets you to work on time. >> livermore we have slowing but it's not where the construction is. well, it's in the area. construction eastbound, the slowing westbound. this is not a big surprise. we've been seeing slower conditions for much of the morning commute. the south bay moves smoothly. i want to shout out downtown san jose where there is a big deal,

this fire. it's down east of san jose state, so we are going to track that for road closures, no official information on road closures but it's around 10th, 11th, so i'll hand it off to you with that fire. >> we're getting new information in and we hope to have a phone call this morning from the fire department. but they are battling that fire right now. >> also new this morning a fire ripped through a home in oakland. the house is on 23rd avenue, that fire started around 2:00 this morning. we'll attempt to get that video for you. apparently two families were inside. thankfully everyone including a few children managed to get out safely. it took firefighters about an hour to get that under control. look at the size of that blaze. so far no word how that fair started. also new we have developing news on a standoff in oakland.

an armed suspect was held up. good morning, christie. >> reporter: good morning. i can tell you that this is over. it ended about 25 minutes ago. when we last checked in this block cairo road was blocked off behind police tape, it was full of oakland police officers, s.w.a.t. team members. they left maybe 25 minutes ago. the police not saying if they arrested the man in the home but will say no officers were hurt and no other people hurt. this started last night around 10:30. s.w.a.t. had been here since late last night and reports of a man with a gun in a home about two blocks down. this is here hagenburger road. this apparently started when he was speeding up and down the street in a truck. a neighbor confronted him. that man apparently pulled a gun and went in the home. that's when oakland police were

called out. s.w.a.t. also to try and make contact with the man. as i said, we heard a boom sound, oakland police not giving a lot of details on how this came the a conclusion, only that no one was hurt. >> thank you very much. san francisco police are looking for the teens involved in a fight near hunter's point. police were called to the intersection of newcome and third around 9:00 last night. they found a dozen girls and young women fighting. the officer tried to break things up. officers used their public address system to disperse. one arrest was made. >> the man accused of hitting bryan stow will serve 10 months on a parole violation. a judge says ramirez violated

parole because he had a gun in his possession. ramirez' attorneys plan to appeal today's decision. los angeles police say the investigation into the stow attack is continuing. >> pg&e will pay the price, a fine for violating safety. it stems from this explosion in 2008. it was a gas leak. it killed one person. once the investigation into last year's san bruno is complete, pg&e could face new kins. following breaking news, firefighters battling a fire at a fraternity house. the three-alarm fire is raging at the kappa sigma fraternity house. we are joined by mary at the fire department.

what can you tell us? i have a feeling mary isn't there or she can't hear us right now. we can't hear her. anything? she's not there. we'll continue to monitor this. we have a view on the scene gathering information. from what we understand no one was injured, may have gotten out of the fire. we'll confirm that. and the san jose fire department as well. moving on this morning. things could get crowded here at san francisco city hall this afternoon as cab drivers from all over the city stage a short strike. drivers will circle the area today in fact, starting at noon through 2:00 in the afternoon, protesting plans to increase the number of cabs on the streets and new charges for every credit card transaction. it argues that it will take money from their wallet.

they don't expect disruption to services during the short protests. >> stenson beach is partly closed after a shark was sighted in that area. amazingly didn't keep folks away. look, we have video of the shark. it was post bid zeke. the shadow is what appears to be the great white. he shot the video, partly closed the beach. a partial closure people can go to the beach and wade in the water but cannot go into the deep. the beach is scheduled to reopen on friday morning provided that the shark stays out of sight until then. >> you're going to need to cool off. >> it's scary when someone does this in the kiddie pool. good morning. 101 yesterday. sharks, we don't like that.

101 pleasanton. hit the triple digits. more on the way today. i'm going warmer and tomorrow more of the same. then we get heat relief. we have a couple of warm days first as taxpayer is now at its maximum energy. it's going to be the hottest day inhand in almost, going about 100, concord 101, and then tomorrow about the same, maybe a degree or two shy of where we'll end up today as we have on shore flow, kind of depends on the timing. it could be hotter tomorrow as we're going to wake up with inches close to 70 degrees. 64 in livermore. at lunch time as you break for lunch you're fanning yours down. 94 at noon in fair field. it's funny, too. last week people were complaining all over my facebook

page when is it going to warm up? here it is, 101 in concord. and 100 in santa rosa. down in southern california they are talking about 115-degree weather potentially. a warm-up. and as we head through the weekend, the good news comes in. 79 friday. 76 saturday. a little more filed since sunday into monday but we'll be out of the hot seef. >> nothing like the temperatures you were talking about. it's cooler because some of our workers picking up their 23rd on ramp. a smooth approach. getting toward the bridge to the south we have no issues getting to the san mateo bridge. did you have that closure. that is picking up. i'll wait for confirmation but

>> welcome back everyone. we continue to follow breaking news in the south bay this morning. this is a live look, you see the smoke at the center of the screen billowing up. that actually is a fire at a fraternity house near san jose

state university. we're talking kappa sigma house on 11th street. i'm joined by mary gutierrez from the san jose fire department to tell us the latest. are you there? >> yes. i'm here. >> thank you. what can you tell us? was it a pretty big blaze? >> yes. we have active fire going through the roof. the call at about 3:20 this morning for a fire at kappa sigma on 11th street. the crews arrived, they had heavy black smoke from the rear of the building. on the second floor they found a fire in the attic. they did an aggressive interior attack with other units. in about 45 minutes the building was declared unsafe. we did a vacate. and we went to a defensive attack which is putting our strains at 1,000 gallons a minute. >> did everyone get out safely, do you know? >> yes. all students had gotten out of

the building by the time fire had gotten here. there was a search. we have one firefighter with burns to his hands transported to the hospital. >> so one injury. describe the structure. sometimes you see some of the older homes used for these frat houses and what's around it? >> you know, it's so difficult to see the structure because of the amount of smoke. but it looks like it is a few story, older fraternity and is surrounded by other fraternities. >> is there a threat of having to evacuate and this fire spreading? >> i'm not sure. i don't have that information. i'm sure they have evacuated because of the amount of smoke and potential for fire. >> and i would imagine some roads may be clocked off. >> yes. all of the roads are shut down, four alarms of equipment. we're up to 80, 90 firefighters and had to call in santa clara

county. >> busy morning for you. appreciate you taking the time to help us get informed. mary gutierrez with the san jose fire department. again it's a fire at a fraternity house near san jose state university. this is the camera shooting from far away. it's 11th street, a few blocks from the san jose state campus. the good news is all of the students are safely out of that frat house. we do have one injury to a firefighter to his hands. he was burned. but he was taken to the hospital this morning. we'll attempt to give you a live report from the reporter on the scene. >> it is 5:15. not quite las vegas but it is a hotel casino with glitz and it's coming to the south bay. garden city casino building in saff01 1 101 near the airport. the shell of the casino is called the matrix.

it's up at the intersection of first street and brokaw. there are craigslist ads. the project should be done by december. it's 600 rooms with an indoor theater and restaurants. some new jobs to the area. >> california lawmakers taking a few days off to cool off before they return to the negotiating table to talk about the budget. they have adjourned until thursday. the big point of contention is whether to ask voters to extend tax increases set to expire this summer, lawmakers passed a budget but governor brown vetoed it. for the rest of your news before the bell, we turn to nicole lapin at cnbc headquarters. >> great to see you. good morning. wall street looking to build on monday's gains, markets rising on some of the fears over

greece's debt. investors snapping up some bargain stocks. in athens again today, the prime minister faces a vote of confidence later today. asian markets rising on the news so europe is higher and that's coming to our side of the world. we get some of our own data on home sales and the fed kicking off a two-day policy meeting. the fed is not expected to rang interest rates. we'll be watching everything that comes out of ben bernanke's mouth. the dow rising to recap the action yesterday, 12,080 is where we closed. the nasdaq to 3629. we're hearing that sales of hybrid vehicles are stalling out as buyers are opting for more fuel efficient compact cars. hybrid 6.5% of the market in mid 2009, now 1.6%.

sales of conventional cars are hot. these cars use various ways to boost mileage, all rated at least 40 miles per gallon without all of the extra stuff that can add up to six grand to the sticker price. we hear that the fcc may propose rules to protect consumers from cramming. it's illegal mostly hidden fees on your phone bill. 20 million people may be affected, charges from phone companies and adding 1.99 to 19.99 a month. the fees are usually in the lengthy phone bills and the hard the understand language. they often go unnoticed but maybe not for much longer. >> exactly. got to try to read it all. thank you very much. it's 5:18. something is bugging people in

milpitas. a swarm of flies is attacking the south bay city. thousands come out at night, set on people's cars, look at them. many are getting on people's food. >> there are flies all over and they are landing on my eye trying to be friendly. i'm not trying to be friendly with them when i'm eating. >> santa clara county says they may be coming from ponds or the bay. vector control says they may be midge flies and not considered a health stret. the best way to fight problem is not to spray but attack them at the location where they are born. certainly hope the hot temperatures don't bug you. we're going to see them across the bay area. >> good morning to you. high pressure is really in control of our pattern. you may have noticed yesterday afternoon we had windspicking

up. the warm downsloping winds are what warm us up when we have this pattern. high pressure is going to keep things hot. we have an air quality alerd. this is our first spare the air day. we're sparing the air in the east bay, unhealthy air later on this afternoon. you wasn't to keep that in mind. we're looking okay in the north bay along the pensence you have good air kault. we're in the moderate range in the south by. in terms of temperatures, 66 in concord, 67 in hayward. 62 napa. we'll see the triple digits in the east bay. fairfield 103 degrees. it might be warmer. we watched these temperatures sky rocket yesterday between about 8:00 a.m. and 10:00 a.m. we jumped up about 15 degrees. in places like los gatos. we'll have to see how long this ridge is and how giclee it's able. you can see here, we're going to

>> welcome back everyone. a live look outside. this from the south bay this morning. can you see the smoke from the center of the screen that is not steam, it is smoke. firefighters continue to battle a blaze at fraternity house near san jose state university. it's at the kappa sigma house. we're told that everyone got out safely. one fire has been injured but they have a lot of crews out there trying to tackle this one. we'll of course keep you posted with a live report coming up. >> 5:24. muni will officially say good-bye to its head today. definitely not without controversy. transit agency's board will vote to allow nathanial ford to step down. at the meeting senator ye plans to submit over 1,000 signatures. he is expected to receive 384,000 in pay and benefits.

>> reporter: actually, according to the public information officer, this has been upgraded to a four-alarm fire. mutual aid has been called in. you're going to see santa clara firefighters as well, about 90 of them. and allen is giving you a live look at a couple of ladders active spraying down. you can see all of the smoke billowing from this building. we're on south 11th street. it's the kappa sigma fraternity house. all of the streets in the area are closed off. the 35 frat member who is live here, they are all evacuated this morning, they are on the corner. you're getting a look at them now. all of these gentlemen here, all fine as you can see. but the unfortunate news is one firefighter has been taken off the fire because he burned his hand. minor injuries to his hand so. a little better news there

no. serious injuries for that firefighter. his colleagues here fighting this fire the best they can. they are in the defensive mode and we're going to stay on this and bring you the latest in our next report. at this point it's just too early to determine a cause. this was reported, first reported, 3:21. firefighters arrived on the scene within six minutes, by 3:27. >> okay. we'll give you a chance to talk to some of the students out there now. and don't have anywhere to go. i think they are out of class, too. maybe they are there for the summer. we'll let you find that out. thank you, marla. it is 5:33 now. also following another fire, this ripped through a home in oakland. this house is on 23rd avenue. it started around 2:00 this morning. two families were living in that

two-story home but thankfully everyone including children managed to get out safely. took about an hour to get that fire under control. so far no word on how that fire started. >> one person is dead, three injured after a shooting in oakland. police say neighbors called 911 around 8:30 after hearing gun shots and screaming on 32nd street near west street. when police arrived they found out all four had been drink tune nearby hospitals. the three should recover. no word on a motive or arrest. police are looking for a gunman who shot and killed a man. shots were fired around noon near bancroft avenue. the man died at the hospital. police have not named suspects or motive in that shooting.

>> this morning the three hikers charged with espionage in iran have a new hearing date. a lawyer for the three says he has been notified the case will come up on july 31. the three grads were detained in 2009 along the iraq iraq border. sarah shourd was released last year and refused to return to iran for the trial. >> people will gather all over to rally against the recent supreme court ruling that rejected the sex discrimination lawsuit filed against wal-mart. they said it was too big and didn't prove a common cause for all of the women. the woman at the center is from the east bay. betty duke says this is not over and women will continue to fight.

she accuses walmart of paying less. they will gather at 11:00 this morning to protection. also rallies in boston and washington, d.c. 5:35. talking about the first day of summer, boy, is it arriving as summer should, i suppose. >> oh, yeah. it's a warm, warm day. as we head throughout tomorrow, pretty much the same. then we're going to start to cool off. that's the good nous. satellite rimmage shows us in control of our weather. the hottest area today the east bay. you are probably used to that. make sure if you work outside that you're drinking plenty of water, seek shade when you can. i would say that goes for tomorrow. after that kind of a cooldown. a lot of people were automatic cough guard by this excessive heat. through thursday back in the 80s burt we do have a spare the air alert in the east bay, the entire bay area though we have

good air quality in places in the north bay and along the peninsula. your forecast including the cooler seven-day. >> cooler, cooler than 103, sure. we're looking here to antioch where highway 4 is showing the slowdown. 5:30 and on a tuesday so there it is. the build through this zone to referage, and then probably move over to pay point where you see this amount of slowing. summer commutes are compressed so they start off around the maze, not until about 8:00 for the real slowdown, then it kicks in before the 9:00 hour. we'll watch that. a live look shows you how the volume is right now. a pretty mooth drive. we're going to send it back to you with this live shot. >> thank you.

i spoke with the captain with the oakland fire department. he says basically what they are doing now is wrapping up. the fire is essentially out. looking at the damage to this victorian it's hard to believe this is a single alarm fire. started about 1:30 this morning. what the captain is telling me, this is actually a two-story victorian, two families, one in the upstairs, one in the down stairs. when this broke out they were working smoke detectors in the home. everyone was able to get out. three in one, five in the other. one thing that stuck out that was so amazing is that one of the families has six children who happened to be away camping at the time so. this could have been much worse. but did flames ripped through this home. the red cross is here helping the eight people involved. what firefighters are telling me is that it appears per the arson

investigators here is that an electronic area they think that there were too many things plugged into the home and that may have been the cause of this fire. no one was hurt who lived in the home though one firefighter suffered minor injuries to his back. at this point they tell me that they will be wrapping up soon. as you can see quite a bit of damage to the home. the red cross helping eight people this morning. live in oakland, christie smith. >> thank you very much, christie. that fire in the east bay. another in the south bay. at a fraternity house. a live reporter on the field. luckily everyone got out. one firefighter injured. we'll keep you posted on that one. >> you can see aerial pictures from our chopper this morning. firefighters are having such a time that they are attacking it from above. we're talking about san jose fire department.

they had to have so many crews. now it reportedly started at the kappa sigma fraternity. the good news is that all of the members got out safely. they are standing on the corner trying to wait and see what they do now. certainly they won't go in there soon. we've got a reporter on the scene gathering more information. the fda taking new steps to try to get people to quit smoking. they are releasing new and very graphic warnings that depict the negative -- tracy is live with a look for us. >> good morning. 14% of california adults and 7% of california kids smoke. that's who the fda is targeting. let me tell you, they are

graphic. much different than the box you're used to. other countries have been doing this a while. the cdc did a study and it convinced about a quarter to consider not smoking. since last fall the fda has been trying to come up with new visual graphic images to put on cigarette boxes, on advertisements, to get people thinking about the dangers of smoking and quitting. these ads are required to say that smoking is addictive, it can be harmful to children, even unmorn children, it can give you lung disease, cancer, and in fact there is a way you can quit. all of the ads have a 1-800 number you can call to quit. they have to be very prominent on the cigarette package, in the upper portion containing half the size of the package we're not going to see them for about a year.

we'll take time to change the manufacturing. but the fda as of today saying we need to come up with a new way to encourage adults and children to stop smoking. >> have you seen anybody die of dancer, that's all it takes. 5:45. we continue to follow the fire at a fraternity house. marla tellez is live in downtown and joins us with an update. >> so much activity on south 11th in downtown san jose. this is a cappa significant ma fraternity house. you can see two ladders spraying down water fast and furious. there is a third you may be able to see from our chopper shot. it's multiple agencies, you are looking live at our chopper video. you can see all three ladders.

san jose, santa clara, about 90 firefighters estimated to be here. all the members, the frat members, 28 of them, currently in the house, they were all evacuated safely. that is the key and the good news. they are standing on the corner behind us. if we can get a live shot of these guys. dough want tonight to talk to us directly but did tell us that they are rattled and shaken up by this. they have been fraternity brothers two to 5 years. most have finished the school year. a couple of them are in summer session. they say this is not a good way to start a tuesday morning watching their home burn down. at this point laura, the cause has not been determined. it was call in about 3:20 with smoke from the attic.

>> a good tuesday morning. we continue to follow breaking news in the kout bay. a fire at fraternity house near san jose state university. it is the kappa sigma fraternity house. san jose fire arrived quickly after it started. they even had to call for a lot of backup a. four-alarm blaze. they tackled some of the flames leaping from the building this morning. it started in the attack we're told. luckily, everyone made it out. one firefighter was injured this morning, he's at a hospital recovering. stay away from that area. it's 11th street in downtown san jose. tonight the fight is over. walnut creek neighborhood will find out if a cell phone tower will be built close to their home.
