june 21, "today in the bay." >> good morning to you. i'm laura garcia-cannon. it is 6:00 right now, as we mentioned a lot going on this morning. a couple of fires, one let's start out with the east bay. it was an old victorian home. christie smith is live at the scene. the flames were engulfing the home. luckily a lot of the kids were out of town that lived there. tell us about it. >> reporter: that's the incredible part. when you look at the damage, looking at one side of the home on 23rd avenue. it's amazing that everyone made it out okay. this is a two-story victorian. the fire broke out, overnight, eight were inside, some sleeping as this was just before 2:00 in the morning. when firefighters arrived they say flames were pouring from the

home here. but the residents were outside. there were working smoke detectors in the home. this home has two units, one up, one down stairs. because of the older construction it was a challenge to knock down these huge flames. here is what one captain told us. >> it looks like they may have overloaded electric circuits or electric issue. >> if they were running fans, it was hot? >> you know, i have no idea. i know the arson investigator was able to uncover debris and find electrical items. >> one firefighter was taken to the hospital with a back injury. firefighters are saying that as bad as it looks this could have been much worse. six children happened to be out of town at time on a camping

trip in reno. that's the good news. everyone okay september for the one firefighter. i spoke with the captain. he says they are going to be on seen for sometime just to make sure that everything is out. reporting live, christie smith. >> were other structures damaged or face threats? >> that's the incredible part here is that the homes are somewhat close together, the one on the far side, and fires say they works hard to make sure that the flames were contained to that one home. the other home perfectly fine. >> thank you very much, christie smith on a fire in the east bay. this in the south bay, crews are still at the scene of a fraternity house near the san jose state campus that caught fire. marla tellez is live there to show us the latest. firefighters arrived quickly to

the scene. >> reporter: yeah, within six minutes. it was called in -- >> you know, we're having trouble with her live shot there. can you hear me? talk now. >> reporter: yes. can you hear me? >> yes. now we can see you. we temporarily lost you. go ahead. >> reporter: i hear our signal is cutting in and out this morning. bear with us. yes, they arrived quickly, it was called in at 3:21 after reports of smoke in the roof area. firefighters were here in six minutes so quick action by a san jose firefighter a. look at what we've seen. massive efforts by san jose and santa clara firefighters. they have made progress. the captain tells me that they are close to containing this fire. when we got here tons of smoke from this frat house, now no

more smoke, it looks to be clearing. 28 fraternity members live here, they were all at home at the time and they all made it out okay. >> they have a place to go. apparently they have other fraternities or family or friends in the area. we've had a lot of people starting to volunteer for helping out. >> there was one firefighter that was injured in the place. his hands were burned. marla tellez has been talking to am is of the fraternity house members that made it out safely. you see how they are trying to tackle it from above. then they will no doubt send investigators to try to determine how this fire started. 11th street downtown san jose, a lot of roads blocked off.

i want to check in with mike inouye. >> we'll give folks an idea. the rest of the free ways. this is north and east of the intersection. it's near downtown, just east of san jose state campus. this is what i'm told is the surround and drown strategy by fire strategy. they are around the structure and trying to keep the names under control. you see all of the fire trucks, this is affecting twefrnth, 12ch, avoid the area if you can. santa clara is main through downtown. that sounds unaffected aside from the additional traffic. a lighter volume, just 6:00 in the morning so just getting up and out of their houses. on this day also the fire, the smoke dying down but it's a

share the air day. we encourage folks not to drive if they continue have to. we do what we can. >> we are facing triple digit temperatures. i want to check the forecast with christina. >> good morning. we've got the triple digits back on the map. look at your noon temperatures where we expect your temperatures to end up as you break for lunch, 94 in fair field. well on the way to 103. 93 livermore. i've got those forecasted high when i get a forecast it's in the forecast, back to you. >> not too long away. a stand off between a man and police ended just a short time ago. it lasted about six hours, ended just before 5:00 a.m. on cairo road. police closed off about three blocks of the police. it started with a man speeding up and down.

neighbors confronted him and he pulled out a condition. the standoff ended peacefully. one person is dead and three injured after a shooting in oakland. police are trying to track down the person. neighbors called 911 last night after hearing gun shots. when police arrive they had found all four victims had been driven to nearby hospitals. three should so far no word on a motive or arrests. san francisco police are looking for the teenagers involved in a fight near countrier's point. they found about a dozen girls and young women physically fighting. officers say they had to use pepper spray just to to break things off. a couple of bottles were thrown

at police. one arrest was made. 6 lon 08. giovanni ramirez is going back to prison, the main suspect in the bryan stow beat iing. yesterday a parole commissioner ruled that ramirez had a gun. police found that when he raided ramirez's apartment back in nay. he was on patrol after serving time for an armed robbery conviction in 1999. the parole commissioner dismissed the allegations that he beat snow. that does not affect their case because they provided little effort to the commissioner. his family says he is getting better. >> 609. something bothering in milpitas.

houses come out at night and fly around the night and even percent many are getting into people's food. >> there are flies all over, trying to be friendly with me. i'm not trying to be friendly with flies when i'm eating. >> the flies may be coming from bonds or the san francisco bay. they may be midge flies, not considered a house pacific northwest. the way is to attack the flies at a location where they are born. i want to check the morning commute with mike she how thoyngs are rolling. he's checking on things now. wire going to go to christina loren and talk about these hot temperatures. >> some like it hot and high pressure stands for hot especially in the east bay. it's going to be really, really warm, the warmest since september and as we head through tomorrow not much relief.

the relief arrives through thursday. we've got the 70s back on the map. today, 5 to 10 degrees warmer than where we ended up yesterday. 62 in napa. santa cruz is the place to be, 85 in santa cruz. the city hit 88 degrees in san francisco. it was a warm day. today 90 in the city of san francisco. so even warmer, all of that pavement, that heat radiating. it's going to be warm. if you works in the business dirkt you probably want to take it easy. 99 degrees in fremont. 100 in gilroy and 103 in fairfield. we have an air quality alert. that means if you don't have to use the aerosol hair spray use the pump white rain. that's my advice. >> white rain? you're fancy.

>> welcome back everyone. a live look outside, this is a fraternity house fire that broke out this morning in san jose.

it is the kappa sigma frat house on 11th street. there's almost nothing left of the house itself. firefighters arrived quickly and it broke out a little after 3:00 this morning. they said it started in the attic. the good news is everyone managed to get out safely. crews doing their best to contain this four-alarm blaze at one point. one firefighter was injured. he was reportedly burned on his hands. he was taken to a hospital. i want to check in with marla tellez live at the scene. you were talking to some of the frat house members in the house. understandably they were very shaken. >> yes, laura. i had a pretty lengthy conversation with the president of cap ta significant ma fraternity. he tells me that everyone had gone to bed, 28 members, they went to bed as normal. they are in summer session, and they woke up because the smoke alarms turned on and he woke up to people pounding on his door saying get out.

they thought it was something minor so a couple of them went on the roof with fire extinguishers to put out the smoke, that's where the smoke was coming from. they had to evacuate. all 28 did get out. it turned into a much bigger fire much more than they could have imagined. the president of the fraternity tells me he is so sad to have to stand here and watch literally his home he lived for at least two years now watch it burn. i'm not going to say it's burning down but significant damage this morning. it is a four-alarm fire. firefighters here, they have made significant progress. this was called in at 3:20, they were here by 3:30. they had to bring in multiple agencies so they have santa clara firefighters here as well. about 90 on scene. again, they are making significant progress. the captain tells me that it is near containment at this point. as you mentioned, yes, one

firefighter did suffer burns to his hands. he was treated and released from the hospital. so he is okay. and in fact, the captain tells me he's going to be back, not to fight the fire but to provide support. >> we had talked to mary gutierrez with the fire department who they believe that it started in the attic but they don't know how just yet. are they saying, it was a warm night. did the they have the air conditioning on? any theories? >> at this point of course it's way too early to determine what caused it. but you're right, the smoke was coming from the attic area. i should mention i did speak to the alumni, the gentleman here actually he maintains the house, he says that it is about 45 years old, and this is of course quite surprising, that they have done major improvements and upgrades so it's in apparently fairly good condition.

>> thankfully that they had those fire alarms working to get those folks out. i understand some of the other frat houses are going to take in those students. kind of always brothers, the brotherhood remains, right? >> they all have a place to go so that is good news. many options. the frat house, this is like frat row, i believe there are about eight fraternity houses where we are this morning. they are all opening their doors, we've seen some of the fraternity members bring food to their friends out here. and one of them has a midterm exam at 5:00 and he says he's going to tell his teacher i can't make that this morning. >> having a tough morning. luckily they all managed to get out safely. that's remarkable. we wish a speedy recovery to that firefighter. 6:19 now. we'll continue to follow that story. also we're talking about stinson beach being partly closed. it still is. after a shark was sighted in the area.

now we have this video of the shark. you can make it out. life guard zeke dirks put this on facebook. that shadow you see appears to be a great white shark. he shot the video at stinson beach. a partial closure means that people can still go to the beach, wade in the water if you dare but you can't go into the deep. the the beach is scheduled to reopen friday morning provide that shark stays out of sight. looks like he got pretty close. we're going to have triple-digit temperatures. a lot of people want to head to the beach. >> the beach to ship santa cruz. in the city today, 90 degrees. hot time, summer in san francisco. it's going to feel so warm. make sure you're ready for it. warm tomorrow and then we get

relief from the heat. you can see not a cloud in the sky. i think we'll see a couple of high clouds. we have a dirty ridge of high pressure. a ridge of high pressure firmly in control. we call at dirty ridge because some of the highest clouds comprised of ice crystals are able to make it through. i saw a couple of those. otherwise, clear conditions, really strong high pressure. in the triple digits today. that will be the warmest. temperatures are climbing now that the sun is out. 64 in consort. 66 in san jose well on the way to 84 at noon. even if you're headed to san francisco make sure you're ready for it. if you work outside, you do construction, drink lots of water and seek shade. it's a dry heat. you're not sweating as much.

shows. roger ebert tweeted just after this happened. here is a look at his tweet. he said, friends don't let jackasses drink and drive. this provoked a lot of anger, fans wondering why ebert would need to chime in just a few hours after the tragedy. after this happened, kind of a sign of the times we started recording on this. this is a real time google look at what people were tweeting as far as this jackass death goes. watch that number change. >> on big stories or those that make the news? >> anything you google you can get a real time result on. it was fascinating to watch it change. not the only sad story. it's not clear what caused an

accident but bob pizzy is dead. just identified on monday, though. >> reporter: breaking news out of oakland this morning. a victorian goes up in flames while two families are asleep inside. i'm christie smith. i'll tell you how they got out and word on a cause now coming in. >> live look outside, golden gate bridge, sun is up, going to warm things up. we're facing triple digit temperatures and a spare the air day. >> good morning. thanks for joining us. it's 6:30 right now. i want to check win christina loren with a look at our forecast. it's going to be a hot one. >> it certainly is. if you are someone who working outside or you drive somewhere and your air conditioning doesn't work in your car like mine make sure you're drinking lots of water because it's so hot, later on 101 in concord. and that's outside. that's the surrounding air.

in your vehicle it gets much warmer. 15 to 20 degrees warmer. make sure you take it easy. let's see how easy your drive is. >> spritz, spritz, then window open and it cools things off. you're not going to have that wind to cool you off. the metering lights were turned on about 6:15. let's see. all lanes backed past the end of the parking lot almost all of them stopped. and back to 880 we're seeing. that person, those are construction workers continuing to work. they are on the roof of the administration building goen on at the toll plaza. >> you know, i bet they are getting an early start. going to be hot. whatever you can do early is probably a good idea. thank you. >> firefighters certainly up early this morning in downtown san jose battling a fraternity house fire near san jose state

university. marla is live at the scene. >> reporter: good morning. i do have good news to report. i just spoke to the fire captain and he says the fire is now officially under control as of 6:12 this morning. so in the last 20 minutes the firefighters on scene about 90 of them, did get this fire under control. live on scene now you can see it is much calmer than it was earlier this morning. it was called in at 3:20. firefighters from san jose and santa clara on scene. this fire all started in the kappa sigma frat house. most of the damage is contained to the second story. of course the roof did collapse. 28 fraternity members in the home at the time of the fire. the good news is they got out all okay.

i just spoke to the fraternity press. he thinks it may have started in the laundry room. >> we thought it's not that bad at the beginning because it was smoke. then after 15 minutes of them doing their thing it was like a huge fier all over the house. it was we had to -- we could feel it from a block away. you could feel the fire in the sky. >> reporter: 28 kappa sigma fraternity members got out of the home okay. they are all outside here and they all do have a place to stay. so ready cross assistance is not needed at this point. it's assumed it may have started in the laundry room. it may have been an electric problem of some sort. >> all right, thank you, marla. she is live at the seen all

morning. i want to have captain rob from the san jose fire department join us. tell us more. how soon can you send investigators in to try to determine how this started? >> we're still 18 phase where we're a coo down phase trying to hit hot spots so getting the investigators in there is a priority but right now we are worried about containment issues. probably hours before we get people in there. it's going to be a prolonged investigation. >> looks like we're looking at photos i understand that you can't see them, from a firefighter who went into the house as it was ablaze. do we have any idewhere it started. could be in the attic, some of the -- do you know? >> we have reports from the fraternity that the fire might have started in the neighborhood or above the and you room.

primarily had originated in the attic somewhere or some place in that general spot. it quickly progressed, it became difficult for our firefighters to fight due to the large expanse of this building. so a lot of room for the fire to run. a difficult one. we were fighting this for about an hour before we had to pull out due to the intregtry of the move. >> there was one firefighter injured. do you know his condition? >> correct. he was treated at local burn center. and then released. from what i understand he is back to the scene just to kind of be here. he's not going to return to duties. >> dedicated. exactly. we understand. thank you so much.

i know you had a lot of backup as well and will remain on the scene. i know it's been a busy morning for you. you should probably avoid the area of 11th and downtown san jose because crews remain on the scene as they will for sometime as they try to determine how that blaze started. 6:37 now. a fire coverage continues. was another fire in the east bay. it ripped through a home. christie is live in oakland where luckily the family managed to get out. >> reporter: good morning. i wanted to start by saying that oakland firefighters just left the scene but they told me they are going to be back throughout the day to make sure this does not claire up again. you can see the worst on the side of the house. that's where they think think it started. this is a two story, two-uhit the victorian. 8 at the home even though this

broke out when they were sleeping. huge flames from the building when firefighters arrived but it remained a single awarm. all of the residents were outside when they got here thanks to working smoke detectors. this is right above international boulevard. what's amazing is that as fast as it looks it could with been worse. one family has six kids, out of down. because this is a sick torian with older construction. it wasn't that easy to knock down. >> because of the way the structure is laid out and there's one unit on the first floor, then the access to the second unit was rear. it took time to get through. like i stated the company made a real aggressive attack on the fire and we were able to make access to the second floor. >> one oakland firefighter we're

told suffered a back injury and a chief took him to the hospital. we're trying to get an update. the red cross was out here offering assistance, residents. for the cause i spoke with the -- someone may have overloaded a circuit. i asked if it was possible this may have been fans because it's been so hot out. they said they didn't know because everything was burned so badly. reporting live, today in the bay. >> you can smell smokes in a lot of the bay mary. it's a fair the air day. boy, is it going to sizzle. >> i'm glad nobody was hurt. i think we can rule out the space heater cause. close to 70 degrees. we're well on the way to the triple digits. some of the warmest air we've had since september.

downright hot in the east bay, 103 in fair field. and right now like i said we're close. san jose 66. 57 in santa rosa. you're starting out cool, i think you're going to end up in low triple digits. 103 or better. at noon seeing the 90s on the map. 93 in livermore at noon. 92 in san jose. if you don't have to go to work, take the kids out, santa cruz is the place to go. 90 in san francisco. can't believe it. 92 in oakland. 101 in concord. 101 in napa. 103 in fairfield and 100 degrees in livermore. because of high pressure we have an air quality alert. unhealthy in east bay. and pretty good air quality today along the peninsula and the north bay.

down to sunol and that's causing slow downs for 680 as well. >> thank you very much. 6: 6:41. the fda is taking steps to try to get people to quit smoking releasing graphic warning labels that depict the negative effects of tobacco use. tracie potts is live in washington with a look for us. >> let me reemphasize they are graphic, they are meant to be, they are targeting the 14% of california adults and 7% of california children who are smoking, these are not just words like the couragen general's box that we're used to seeing on tobacco products. there are images as well that we hope will get people thinking, that it causes lung desire and

cancer and stroke and heart disease, all of mesothelioma sajs in these tine different adds you'll start to see. they will be featured. you won't see them on the back. they will be on the front, the back. pretty large, that was one big point of this when it came up in the tobacco legislation. colorful. you'll also see them intiesments for tobacco prads. they are required to take up at least 20% of the advertisements. do they work? he are already in other countries similar adds to these. not the same ones. they have caused at least a quarter of smoukers to quit or think about quitting. the fda hopes the same will happen here. >> thank you very much. 6:43. coming up, how baseball tries to keep its college world series hopes alive.

bringing troops home from afghanistan. white house press secretary jay carney says the president is still finalizing his decision but cnn is reporting that the president will announce 30,000 troops will leave afghanistan by the end of 2012. there are about 100,000 u.s. troops in that country. state senate could tackle the controversial issue of the death penalty. as one bay area lawmaker is creating legislation to try to abolish it. calling it an expensive failure. senator loni hancock says the death penalty does not deter crime and is costing the state willions. a new report that will be released says it cost 184 now more than to keep killers in prison for life. it would help bring closure to some but some victims advocates disagree. >> there is a guy that
