appropriate dress aboard a commercial airline will ratchet up a notch. it has to do with a man who boarded with saggy pants. christie smith is live at sfo with more on how the naacp is now getting involved. good morning. >> reporter: good morning to you. this story really picked up steam when pictures and video surfaced of another u.s. airways passenger, a man was shown flying in women's lingerie. now the naacp here in san francisco, they are launching a protest over what they see as discrimination and racial profiling based on another passenger, a young african-american, who was arrested, he was wearing saggy pants, that is 20-year-old deshon marman. he was thrown off the plane in a dispute. he was arrested after police say he ignored an employee's request to pull up the pants.

the san francisco naacp saying they have concern about this whole baggy pants fad but say the punishment certainly does not fit the crime. then that video came out and photos of a man flying six days earlier, same airline, in women's underwear. they say he went free of harassment. >> he's a big tall light-skinned black boy with dread locks. gets on the plane with saggy pants, right there you're stereotyped. >> reporter: the naacp statement goes on to say why would a cross-dressing person be allowed to fly without bother if the airline said it has no dress code, if there is no dress code why was the young man singled out and then arrested? there has been debate whether this is about profiling or it's about doing what you're told to do on a plane. the press conference is at 10:00 a.m. here in san francisco. they are joining deshon marman's

mother and hosting a public forum on sunday at jones methodist church. reporting live, christie smith, "today in the bay." >> thank you very much. closely following this one. call it an all nighter for dozens of people camped out at san jose city hall. they want a seat in the chambers for this afternoon's special meeting addressing pension reform for city employees. mayor chuck reed and the council decided to do today it could set the groundwork for how much money it could save from retirement reform. earlier this week san jose's police and firefighters union agreed to a framework for negotiation through october for pension reform. the mayor wanted to put a fall ballot measure before voters but now is going to hold off until at least march. today possible language for the ballot measure will also be discussed. >> this morning the faa and the

national transportation safety board will continue investigating the crash of a plane near palo alto's airport. it crashed last night in the bay lands not far from the airport. the plane originated in concord with three men on board. all remarkably walked away. one was taken to the hospital with back pain. the plane crashed nose first but then flipped. fire officials say the plane was fully intact so that is how the men were able to get out so easily. >> this morning swimmers at stinson beach can now go back in the water after a great white shark sighting over the weekend. the officials say unless there is another shark sighting, the beach will reopen. the u.s. coast guard helicopters spotted an hate 10 foot great white 250 yards off the northern part of the beach on sunday. life guards cleared the water and posted warning signs. stinson beach is part of an area

scientists call the red triangle because of the large numbers of great white sharks that have been spotted there. people in coastal alaska scrambled for higher ground after a powerful earthquake prompted a tsunami warning. the 7.2 quake. the islands are sparsely populated but by a lot of fish attracting a lot of fishermen where they film the show "deadliest catch." the earthquake hit last night, luckily no reports of damage. the tsunami warning was canceled a few hours later. >> springlers and fire alarms, that's what a civil grand jury would like to see in all new and remodeled san jose unified schools. the report shows the building that burned down at trace elementary school last july did not have sprinklers and automatic alarms. if it had those things the

damage would have been greatly reduced. the new building will have those new sprinklers and alarms. parents say it's a good move. >> i don't think there should be any question whatsoever. it needs to be mandatory and -- qualification you know, standard set that all schools have this. >> san jose unified school officials say they will comment after they have read the entire report. >> talking about the forecast, getting a cooldown that we had from the higher temperatures earlier this week. what are we looking at? >> i have good news to report this morning. best day of the week, it's friday. >> really. because it's friday? pay day friday? >> i wish it was pay day friday. that's next friday. i know. nice and clear, across the area but we are expecting that fog t marine layer to be back. i think so deep this morning that it will get all the way to livermore. so, expect pretty cloudy

>> welcome back everyone. it's 5:12. james whitey bulger was keeping one step ahead of the fbi for 16 years until his capture in santa monica this week. the 81-year-old boston mob boss is expected to be sent back to the east coast to face federal charges including murder and racketeering. john cadiz klemack from our nbc station in los angeles joins us live with more on what will be happening to bulger this morning. good morning, john. >> reporter: good morning to you. we're standing outside the metro jail here in downtown los angeles. this exit where whitey bulger is expected to be taken out of and on a private jet to head back to boston to officially face the charges. when he was in court yesterday, he didn't say much. we're told that the answer to the charges was more of a smug yes, he understood them. keeping an eye on this here, there is activity. they are telling us that we are

likely not going to see him when they put him in a van and take him out of here. the only real indication anything will be happening is a possible convoy of u.s. marshals that might be following that van that you see there. keeping an eye on all of this of course, we'll keep you up to date as to any changes that happen. as you mentioned. serious charges that he'll face. obviously nobody keeping an eye on this more closely than the family of the victims involved in some of these alleged killings, 19 total. and obviously there could be more coming as they continue their investigation. we're live in downtown los angeles. back to you. >> thank you very much, john. delta airlines new partnership with saudi arabian airlines is outlining some people. it doesn't discriminate against passengers but admitting that jews and israelis may not be allowed to board. the partnership was announced in january. there is fallout from the relationship.

jews, israelis or carrying a non-item of faith generally not permitted into saudi arabia. delta will be forced to follow the rules of that country. the american center for law and justice is considering legal action to stop delta from abiding with saudi policy. >> delta airlines standing there at the gate in new york saying are you jewish? you can't get on this flight. did you have an israeli stamp? sorry, can't get on this flight. make sure to give us your bible so we can toss those in the trash because you can't bring those on the flight to saudi arabia. >> delta says it does not discriminate but like all international airlines it is required to comply with laws governing entry into the countries that it serves. >> does the postal service need a major overhaul. for more on that plus other stories this morning we turn to

ryan at cnbc. good morning. >> i'll get to that post office story in a second. i want to tell people stock futures slightly negative as we head to the open. we had a late day turn around yesterday. stocks were down, the dow was up on news, the jump in jobless claims, a slump in oil, the u.s. and several countries surprised the markets by announcing they would release 60 million barrels of emergency oil reserves aimed at boosting the economy by bringing down gas prices. late in the day there was a potential deal announced with greece on their measures and the stock market rebounded. asian market desire edge higher overnight. there are some green arrows in europe now. for the u.s. we get data on durable goods and the report on gdp, in about 14 minutes. we are likely to learn the economy grew. the dow closed down. the nasdaq rebounded.

17 points to 2686. let's get to the post story. ice is a introduce add bill to overhaul the postal service. he says action is needed to prevent a taxpayer bailout of the agency. the bill would eliminate saturday delivery and give the postal service the ability to close locations. the service of course has been hurt by the recession, technology and e-mails has had an impact and billions of dollars in pension obligations. this might be my favorite story of the day. the vatican going green. the reports are the next generation pope mobile will be a hybrid. the pope wanted a solar powered vehicle but that might have taken a modern-day miracle given all of the bullet proof glass. it's supposed to run up to 16 miles on electric power. the most important thing, it's at parade speeds, got to keep

sunol grade, traffic appears to be moving smoothly there. bay area drivers who carpool to work could see the commute get quicker. the state issued stickers to more than 85,000 hybrid owners allowing them to drive without passengers in hov lanes during the commute. but after july 1, owners of hybrid cars that have the yellow hov stickers will no longer be able to zip through carpool lanes unless they actually carpool. according to the dmv the perk will go away because the hybrid no longer fits the program there. i wonder how many hybrids we have in the bay area. >> 47. no. more than that. a lot. there are a lot. we're looking at hybrids and regular cars which clog up this portion of antioch where we're looking at 63. for the last couple of days we've seen pretty smooth drive over to hill crest to leverage. in the eastbound direction for

4, and northbound for 242, only a lane blocked. the orange circle around the 56 is registering around willow pass road east, that is a portion, bay point, pittsburg area, a lot of slowing and specifically for the last two days it has been slow where it has not been a problem into antioch. we'll watch that shift. it looks like it's in place for th short-term. benicia and the carquinez bridge, heading out of the area through the bridges you might have slowing north of there vacaville and fairfield as folks head to the cooler sierra. no major delays coming through here. 18 minutes from the carquinez bridge across the span. over from san francisco, lower deck still has one lane blocked. we're looking at a couple of issues for the city. giants game, congestion around at&t park, you can watch it here, but also in the city this is the final friday of the month, critical mass goes on at

herman plaza. we don't know the route so watch for congestion on the streets. the golden gate bridge, no problems and a beautiful view. we might have fog later on. >> thank you, mike a. so called ipad hacker pled guilty to his crime. that had one benefit. >> did it. it showed how insecure the early ipads were. to understand what daniel sitler did you have to go back to the early days of the ipad. seen here he was able to fool at&t servers in a simple way. and discovered the e-mail accounts of washington politicians, even military officers high up in the pentagon, all of whom were using the ipad on official business, just days after it came to market. so you got a security breach on both ends. spitler's hack was a crime but the decision by the people in government to use new untested devices to conduct business was not a smart one.

flight without hassle. deshon marman was thrown off of a flight and arrested. police say he ignored an question's request to pull up his pants. was this failure to comply or was it racial profiling. then the story took off with photos and videos of another person on a u.s. airways flight. in a tube top and heels. one passenger says it was hike a female stripper. she complained and nothing was done. then she heard what happened to marman and called foul. >> it was so hypocritical for the airline to allow this man who is obviously ebs supposing so much flesh, you know, deshon marman looked like he was dressed for church compared to the man on my flight. deshon was not exposing his flesh. i understand he was exposing his

they hated men who dressed like women. the d.a. says he will file felony charges at trial. >> i think it send as different message to the community and i'm puzzled why the judge did one but not the other. i think it was important to send a strong message ha they will be prote protected. >> misdemeanor can lead the one year in county jail. >> this morning police are searching for a gunman who shot and killed someone in oakland. that happened around 9:00 last night. there are few details. police don't have information on a suspect. available up dates we'll bring to you. >> it appears an isolated scare. we're hearing from health leaders after a family claimed they got sick from drinking a

bottle of crystal geiser water. she says-er brother purchased from the market. tammy and her son say they game ill. it's not clear what caused the illness. the department of health told us this appears to be an isolated event. it was not completed the analysis of the suspect water. for its part crystal guise ser testing the water as well. they have not received other complaints. >> boston crime figure james whitey bulger could be on his way back to boston as early ased the after he and his girlfriend were arrested wednesday night at santa monica. he had been on the run almost 16 years. yesterday he and his girlfriend had their first appearance before a judge. the judge ordered him to be returned to boston to face charges for his alleged ties to

we'll check the full forecast with christina loren coming up. it's 5:42. in politics this morning, on the fence, last night president obama jumped head first into the controversy over whether to endorse gay marriage. he held his first fund-raiser where lawmakers may be on the verge of making it legal to marry there. how this politically touchy situation may affect the 2012 presidential election. good morning. >> reporter: it sure could. good morning. the president was in new york with about 600 supporters, gay rights supporters, for the first time ever, trying to explain what he calls his evolving position on same-sex marriage. the president focused on his record saying i rolled back the ban on gays in the military, we're no longer defending the defense of marriage act in my administration. he supports civil unions, supports benefits for gay couples but stopping short of saying he supports same-sex

marriage nation wide. as a result there were protests outside that dinner, also protests outside the state house in new york where they are trying to figure out if they will become the sixth state to now support and legalize gay marriage there, one vote away from that. we could see that vote happen today. there are five other states no longer including california that do support and have legalized gay marriage. this may be an issue the president can sidestep before the 2012 campaign. you think about it the supporters and he got a pretty warm reception there, but they don't have a lot of other choices at least so far in 2012. the republican candidates, pretty much all stacked against them. >> interesting. a lot of issues that the president's tackling this week as you know, tracie. he said he would withdraw 10,000 troops from afghanistan by december and here's what one soldier had to say. >> personally i feel about the pullout is it's about a pretty

good time to do it. we made a lot of progress and especially since we've been here in getting them trained up and capable of what they need to be able to do to ensure their own logistics, protecting their people, providing security. we've done a lot in that area. i'm quite confident in their ability to handle their own. >> the troop withdrawal timeline is drawing fire on all sides. in afghanistan, president hamid karzai said he welcomed how ever the troop draw down. we're learning that osama bin laden had considered changing al qaeda's name. in a letter recovered in the u.s. raid that killed him, bin laden wrote that his group needed a name change because they were killing too many muslims and it was bad for business. wrote that al qaeda's name should convince muslims worldwide that they were in a

holy war with america. >> a georgia man could be headed to prison after he pleaded guilty to supplying parts for iranian helicopters. michael todd used his business at the airport to supply parts for military jets and attack helicopters in the iranian air force. federal authorities say another man would buy the parts and ship them through several nations to bypass the boycott against iran. he has been sentenced to 56 months in prison. >> 5:46. closer to home, the forecast for this friday morning. >> good morning to you. we've got a good looking weekend. great for indoor activities, great for outdoor activities. give your ac a break after tuesday, i bet. you'll get a chance to do so this weekend all the way through next week. pretty interesting weather on the way. mild for this time of year.
