closures. back to you. >> thank you, mike. 5:00 now. there are about 7,000 homeless people in santa clara county. of those 2,000 are chronically homeless. this morning hundreds of volunteers hope to change that. today in the bay's bob redell is live at west gate church in san jose to show us how. bob, you're not alone this morning. >> reporter: yes, good morning to you there, marla. right now what they are doing is briefing the volunteers who will be going out today, tomorrow and wednesday morning to look for these people without homes. this is part of an organization called housing 1,000. the plan is in the south bay to get 1,000 of these chronically homeless people off of the streets into permanent homes by the year 2013. what they have done here, they have these volunteers here and what they have got is a map for the areas where there are known people without homes. they are going to go to these areas, these volunteers, to interview these people and try to prioritize who needs the home

the most. they have a briefing going on. can i ask you a question. you're a volunteer. it's monday morning, 5:00 in the morning. what compels you to get out here? you can probably be doing something else. >> could be sleeping right now. you know, it's a really good cause and i feel that there's a big need in the south bay and all over the country actually. i'm just doing my part to help. >> why this cause and instead of something smells. >> you know, there's a lot of causes to support. homelessness is a pervasive problem throughout. it's really helping people on the bottom up. solve a problem that has been so pervasive throughout our society. >> good luck to you. thank you. nice talking to you. there are about 500 volunteers will be scouring the streets over the next few days. it's too late to register because these people had to be trained. but if you want to donate you can go to housing 1000 sv.org.

the goal is to get 1,000 chronically homeless people off of the streets by 2013. reporting live in san jose, bob redell. >> what a great effort. thank you, bob. an update on the deadly amtrak crash in nevada. five passengers remain unaccounted for this morning. at least six people are dead and some 20 others hurt when a semitrailer slammed into two passenger cars. this happened on friday, about 70 miles east of reno. the train was headed to emeryville from chicago. the county coroner's office is sifting through the wreckage. federal records reviewed by the associated press show a spotty record for the trucking company involved, including being cited for operating a truck with tires so bald that truck had to be taken off the road. >> well, crews are searching for a man who they think may have fallen out of a small aluminum boat. someone reported the man fell

overboard yesterday afternoon. he was not reported to be wearing a life jacket. crews searched near dillon beach. his boat was later found washed ashore mere tom's point south of dillon beach. santa clara man who confessed to killing a woman and stuffing her body 18 garbage bag will be in court today. 47-year-old will face murder charges. prosecutors say he killed 46-year-old maria arosko. her body was found innen a garbage bag. they say the two were acquaintances but investigators don't know the motive. >> this morning investigators are trying to piece together a string of suspicious fires in the north bay. they happened last night. today in the bay's christie smith is live in san rafael with a look at all of the damage.

good morning. >> reporter: good morning, marla. we're not talking about one but three suspicious fires in one night. we took a walk down the railroad tracks and that's where the burned area is, each section about 75 feet apart. which might not raise eyebrows on its own but this isn't the first time there have been suspicious fires in this part of san rafael recently. this is near the 600 block of francisco boulevard west behind an old borders book store. firefighters were called out about 9:20 p.m., when they arrived they thought it was one, instead found three. the entire area is fenced off and hard to get to and near a possible homeless encampment. they were put out quickly and the cause is under investigation. similar fires on june 14th a transient was arrested on suspicion of starting two fires along mission avenue here in san rafael.

and in may several fires were started along anderson drive, not far from this location where we're at. we do have calls in to the san rafael fire department. no one was hurt in these but as soon as we get information from them, we'll bring it to you. reporting live in san rafael, christie smith, "today in the bay." >> thank you. 5:06. new legislation will be introduced to stop california's death penalty. state senator loni hancock of berkeley wants to replace the death penalty with permanent imprisonment. she says the death penalty has cost the state millions and does not deter crime a. new report says it cost $184 million more a year to execute prisoners than to keep them in prison for life. under the plan chrisners on death row would have sentences converted to life in prison without parole. >> today is national hiv testing day and santa clara county offers free hiv screenings.

there are several biggies out this week on the health of the consumer in general. we have home prices that we're looking ahead to and conam sooler confidence and weekly unemployment. to recap the action on friday the dow fell to close at 11,934, the nasdaq lost steam as well, 33 points off, 2652 is where we close there. prices at the pump have dipped slightly over the past two week, a new industry survey shows regular unleaded is $3.63 a gallon, nation wide which is down about 11 cents, i know that california is a little higher, though. analysts say that prices could drop even more as the u.s. and other countries release oil from their emergency reserves. and volkswagen says hey, leave the driving to us. seriously. the automaker debut add new feature that lets vehicles drive themselves at speeds up to 80 miles an hour in the city on the highway, it says it can use both. it uses sensors, laser scanners, video cameras and electronic

49 degrees in gilroy, 50 in santa rosa, in the 40s here as we head through the next hour. and temperatures continue to stay mild. right about where they should be for this time of year in terms of your seasonal averages. 79 in santa rosa. 78 in san jose. as we head throughout the week, temperatures fluctuate all over the place but the big news is this weather pattern change. we go to coolish afternoons and heavy periods of rain tuesday through wednesday. the timing looks like this. tomorrow afternoon i think about 1:00 p.m. the bulk of the moisture will start to arrive in the north bay spreading south. lasting through early wednesday morning. but a pretty nice break for the second half of wednesday and temps into the 70s. then the 90s jump back in saturday and sunday. could see a couple of triple digits over the weekend. back to you, marla. >> thank you, christina.

no major issues. the construction had a closure between 680 and capital expressway that should be picked up. i haven't heard about problems for 101 this morning. >> 5:22. michele bachmann is street officially kick off her presidential campaign. the republican minnesota congresswoman will be in her birthplace of waterloo iowa to kick off a campaign announcement tour. a recent poll suggests that bachmann will be a strong force. the poll has mitt romney with 23% of support and bachmann with 22%. the president is going to meet with senate leaders to try to work out a deal to cut government spending while still raising the debt limit. talks between party leaders reached an impasse last week. democrats want to scale back tax breaks for big corporations and the wealthy. republicans want to cut spending

vand rejected tax increases. 5:23. today should be the day the u.s. supreme court rules on that controversial california law banning the sale of violent video games to children. scott says even if the ban has the best intentions legally it's been a loser. >> if the supreme court is sort of, marla, the heavyweight championship of the world boxing match, say, the california law at the center has never won. in fact, it's been knocked out every time in the first round. every court that has dealt with the law has struck it down as unconstitutional. specifically the law bans the sale of video games with egregious violence to children. parents can buy the games but would popular games qualify? that's one of the problems. what does and does not qualify as too much violence. who gets to decide. >> the other problem is the law specifies video games alone. not tv shows. not movies.

border's book store. this broke out after 9:00 last night here in san rafael. firefighters found three spots burning. this is tall grass. and near a possible homeless encampment. they were put out rather quickly but considered suspicious. there have been similar fires in the past month. on june 14, a transient woman was arrested on suspicion of starting two fires along mission avenue. this latest fire, this series of three was near 600 francisco boulevard west. in may several suspicious firings near anderson drive, also not far from this latest location and all along here, this area where there are fires, we're seeing clothes about was sort of suggesting there may be a homeless encampment. we have calls in to san rafael fire.

as soon as we hear we'll bring that to you. christie smith, today in the bay. >> the search continues for five people missing since friday's fiery collision between a semi truck and that amtrak train. crews will return to the site of the crash, 70 miles east of reno to look through all of the wreckage. on friday a semi truck slammed into two passenger cars, killing at least six and injuring 20 others. the company that owns the truck received seven violations since 2010, one which forced a truck to be taken out of service. the amtrak train was bound for emeryville. we know at least one of the victims, the conductor, had ties to the bay area. 68-year-old loretta lee was a long time concord resident before moving to lake tahoe. family says she had a big voice and big heart. she began in the railroad business more than two decades ago, selling sikts and working

her way up to being a conductor. her family says she loved her job. >> we've always been able to say no, that's not my mom's train. she wasn't working today. and we're still kind of expecting to be able to say no, that wasn't my mom's train. and this time it was. it's hard. it's not something you wish on anybody at all. >> lee is survived by three children and five grand children. >> today marks one month since nursing student michelle le disappeared. her family has hired a private investigator to help them find her. police and the fbi are carryinging on their own investigation. le disappear affidavit a class break at kaiser in hayward but she never returned to class.

>> you know how hard this is more than any one because you said earlier you were homeless yourself. what would you impart to someone, the volunteers or someone watching about what the biggest misperception is about homelessness. >> basically that being homeless you know, is hard, we're all outside, we're out there, doing it. some people trying to come up, some are trying to stay where they are at. you got to be strong. hold on, we're coming out there to you. trying to get everyone help. >> you're going to meet with fellow brothers and sisters, offering them a cup of coffee. what will you stay to them? >> basically explain that we're out here now to help you out. here's some coffee for you. and don't get discouraged. that's why we're here to help you get into a place, get into a home. >> i imagine that goes a long way. >> a very long way. >> how are you doing?

>> welcome back. 5:42. a live look inside our control room where all of the magic happens. today the u.s. supreme court is expected to rule on california's law prohibiting the sale of violent video games to kids. state senator leland ye wrote the law in 2005. tracie potts is live in washington, d.c. now with more for us. good morning. >> good morning. we're tracking what's happening with this california law because it could affect a lot of other states as well that are thinking about with or tried to limit the sale of these violent video games. the 2006 law from california never really went into effect because of these court

challenges, the ninth circuit said it could violate free speech. it's in the hands of the u.s. supreme court. california argued this case back in the fall, arguing that the state has a right to protect children not only against obscenities which the court has upheld, but also against violence, the industry countering that not only are the games rated so parents can buy them or not buy them based on their level of violence, but that there is no hard evidence that playing violent video games leads to violent behavior. those are the the arguments. today is the last day of the court's term for this year so we expect some sort of ruling. it is a $10 billion industry, so the gamers have a lot at stake here. at least five other states and two big cities have lost in challenges to laws like california's. >> we'll be watching. thank you. >> this morning a danville teen is undergoing treatment for serious injuries after a sand

tunnel collapsed on him at a watsonville beach. the teenager and a friend were digging in the sand over the weekend to sun set state beach when the tunnel collapsed. the boy was trapped for 15 minutes and not breathing when life guards and church group members pulled him out. the hole was about six feet deep. doctors sedated the boy while they continued to clean sand out of his system. >> two are dead after a car accident at a nursing home. it happened saturday at the amber woods gardens nursing home a. 90-year-old woman mixed up the gas and brake and crashed into the activity room. about a dozen people were inside. 88-year-old esther and 100-year-old suzanne were killed in this accident.

four others were hurt. >> time is running out. california's fiscal year ends thursday and the budget is still about $6 billion short. governor brown met with democratic lawmakers over the weekend, some are frustrated by did governor's veto of the budget. he says they rely too heavily on borrowing. the governor is trying to get republicans on board for a special election that would ask voters to extend the vehicle and sales tax. larry gerston says lawmakers are close. >> we've had revenues come in that have been about $7 billion more than people expected. now we're down to 7 million. the legislature passed something else, a couple of tax increases, fee increases to cut to the $5.8 billion. it can be done. >> gerston says while no lawmaker will admit it the pay docking proposition passed in the fall is working because it has added urgency to budget talks. >> 5:45. time to get a look at the forecast with christina loren.

>> welcome back. a live look over san jose this morning. it's going to be a nice day. we'll check the forecast in a minute. part of san francisco history will be up and running again starting this morning. the california street cable cars will be back on the job, the california line closed december 24th for major repairs and rebuilding. the cable cars were in rehab, pluny ran bus service along the line. mayor ed lee will help celebrate the reopening at 10:00 on california and drum streets. >> a couple members of our morning team making the bay area proud. mike and christina were out helping the nonprofit save the bay celebrate its 50th anniversary. they helped clean up around the palo alto bay lands, pulling weeds with other volunteers. save the bay was launched in 1961 by three east bay women concerned about plans to double

people do not like blood tests. a company has created a saliva test. the ceo joins us live where he is going to open the nasdaq. dr. michaels, good were mooing. >> good morning. how are you. >> i'm doing very well. i have this in my hand. describe to the me. it looks like a little -- almost like a spoon. >> it's a real simple 20-minute test for hiv 1 and 2. it's revolutionary technology first approved by the fda in 2002, for use with a blood specimen. in 2004 we got approval with an oral type specimen. it's the only fda approved test that can be used with an oral speaks a min. >> lots of people are saying that's great, it's hiv testing day. however, for one reason or another you're in a monogo must relationship, i don't need it. what it is your reaction to that? >> well, today is national hiv testing day. and we're sponsoring testing

events around the country working with partners like walgreens, and others but our message is that everyone needs to know their hiv status. and that's whether you're in a relationship or not. it's essential that you know your hiv status, certainly none of us know what our partners may or may not be doing and to be able to stay on top of your status, so that if you should test positive you can get connected to care and people who are -- who find they are hiv positive can lead a long and healthy life if indeed they get the appropriate follow-up treatment. >> and you hope these will someday be over the counter. these are still doctor office but it's not a blood test. >> that's correct. the test today is only available through health care providers citysh county, public health departments, through our partners in oakland and the san francisco health department. we're working to make this
