grass fire in the east bay overnight comes damagerously close to homes. we'll have the story coming up in a live report. >> yet another appeal in the battle over same-sex marriage. a live look at the beautiful bay bridge on this tuesday, june 28th, this is "today in the bay." >> good morning everybody. welcome to tuesday, i'm marla tellez. it is straight up 5:00. laura garcia-cannon is off today. we're going to check the bay area forecast, rain and some spots of the bay today. good morning, christina. >> the whole bay is going to see the rain today. it's going to continue throughout the evening hours, so kind of one of those days you want to make sure you've got those indoor plans ready to go even though it is full swing summertime now. as you can see here's the front now starting to see our first

showers in the north bay. pushing into santa rosa, it looks like the steady rain is about 15 minutes from the north bay now, we'll let you know where it's headed next and more importantly when it's expected to subside. let's get to you work, you probably want to leave early. >> yeah. as the rain comes in going to cause slowing. no major issues. the roadways are dry through this portion of the east bay. where we had an accident, a couple lanes were blocked but about 10 minutes ago all lanes cleared and the slowing we saw coming past that golden gate field area is clear. back to 18 minutes down from 20 minutes as far as the commute goes. we'll get a live look out there coming up. there you go. pretty smooth. back to you. >> this morning we're following developing news from the east bay where a two-alarm grass fire ripped through property in concord last night. christie smith is live in concord with more on the fire. christie, you said that it came close to some homes. >> reporter: yeah, that's what

we're hearing. good morning to you. we're also hearing that firefighters are still keeping an eye on this overnight because it's rather windy at this hour. they want to make sure that this fire is indeed out. it was quite scary for some homeowners here. this fire crept right up close to their homes. in fact, firefighters had to do structure protection overnight. fortunately, no homes were damaged. this broke out just after 11:00 in the hills behind discovery way near cal state's contra costa center off ig nashia valley road. flames came close enough that some gathered important things. this was a two-alarm fire and in the end burned two acres of grass before the fire was knocked down in a little over 30 minutes. there are reports of some neighbors saying they heard what they thought might have been loud fireworks before the fire broke out. i talked with a dispatcher this

morning to see if she heard anything about that. they tell me at this point the cause is still under investigation. reporting live in concord, christie smith, "today in the bay." >> thank you. 5:02. we have new details this morning on a double stabbing in walnut creek. police arrested two suspects overnight. witnesses say a large group was fighting in the parking lot of a walnut creek car wash on north main street about 9:00 last night. when police arrived two people were on the ground with stab wounds. they are in the hospital this morning. both of the suspects are from walnut creek, they are in martinez detention facility on $50,000 bail. >> the battle continues for prop 8 as backers file an appeal with the federal courts. the appeal was filed yesterday. the same court which is hearing another appeal on a decision striking down the ballot measure. prop 8 sponsors want to overturn a ruling which upheld the decision to overturn the

measure. it argued the judge was biased because he did not disclose he was in a long term relationship with a man. opponents of prop 8 say their argument was frivolous and offensive. >> at&t is hoping a proposed scaled back version to its network will get city i proofl. later today the board will consider proposal by the company to install more than 700 four-foot tall boxes. each unit would house high speed technology at&t says will improve internet, cable and land line service. opponents say the boxes would get in the way of pedestrian traffic and property owners. they say they are an eye sore. the board delayed a vote twice so far. >> some of the leading alzheimer's researchers will be at stanford university to share their work on that disease. this comes after reports show soldiers suffering from post traumatic stress disorder could develop cases of alzheimer's.

today in the bay's marianne joins us live with more. >> reporter: good morning to you, marla. during the next 20 years the impact on california of alzheimer's disease is going to increase dramatically. think about it. many baby-boomers are already in their 60s and people are living much longer than they did decades ago. right now in california about 600,000 people are living with alzheimer's disease and that number is expected to increase. new research out of ucsf showed soldiers at a much higher risk of developing dementia and alzheimer's and by 2015, 678,000 families in california will be living with alzheimer's. today, at a special conference at stanford, researchers from around the world will gather to share their work and collaborate on future research. the conference begins this morning here at the becktell center on the stanford campus

until 4:30 this afternoon. coming up i'll tell you how a spice that you probably have in your cabinet right now could help you ward off the disease. that stcoming up. >> 5:05. we're going to turn it over to christina for a look at the rain. >> good morning. just having marianne is spicy on the morning show. we have a system of low pressure, hasn't quite reached the east bay, south bay or even the peninsula yet but the north bay, already feeling the effects. seeing a little shower activity pushing into santa rosa and petaluma. that will continue through the next half hour, becoming more steady. this is what we're expecting in terms of the time. 9:00 a.m. this morning, you can see the yellow embedded in the green. that's moderate rain. i think we'll see pop-up thunderstorms. by noon it slides to the south. this is a slow-moving system and it should bring pretty heavy rain to everybody in the bay

area. gilroy looks like the only city that might get a break. noon today -- noon tomorrow a good amount of clearing, mostly clear bay area. then we warm up really fast. 92 by friday, 95 on saturday, and 90 on sunday. i'll let you know when fair weather returns to the bay. it's not too long now, that's coming up. let's get you to work with mike. >> fair weather fans. right now looks a little bit of an issue for 101. we had overnight construction through belmont. a full closure of 101. there were no issues for slowing, no incidents. likely construction vehicles moving through the area causing this slowdown on the sensors. we'll track this along the peninsula. prepare for slowing south of 92, again likely because that construction quipment is moving. here's the south bay. a nice smooth flow, coming out from the santa cruz mountains,

heading to the summit there is a lane blocked south of the summit and another patch as you get closer to the fish hook because of construction, doing the drainage repair and clearing. good news in 18 months when it's done. 580 out of the altamont pass. a little slowing around airway. a 14-minute drive so a smooth flow. watch as the rain comes in. it will come in about the time when it's bumping up in this area. we'll end with the san mateo bridge over to the peninsula where we start. oakland first of all, 880 through the area. i'll take whatever the control room gave me. i threw two changes at them. 880, glowing lights because of the moisture in the air, that's the issue but the volume not so bad fast coliseum. 880 over to the san mateo bridge, taillights away from us. the the glowing lights, the headlights, so that is the issue. the moisture in the air. that is the concern that christina is talking about coming from where the headlights come from. >> good thing the control room's

>> 5:11 we welcome you back with a shot of mission, san rafael across the golden gate bridge of course in marin county courtesy of our photographer aaron murphy. thank you for that. an east bay city invites people to weigh in on its budget planment concord council says it's brighter since a half cent tax increase passed. the money will not restore programs cut over the past two years but will keep funding at the current levels. if you would like to attend this meeting at the city council chambers. belmont city council will talk about raising the water rates by 4.5%. that's tonight. the city says the rate hike is needed to make up for projected revenue loss and decreased water consumption. if the increase is approved the average home would pay about $25 more per year. >> e-readers gain popularity. a study finds 12% of u.s.

households own some form of an electronic book, three times more than the number owned a year ago. the increase in e-readers is partly due to the drop in prices. the cheapest is now available for just over $100. we turn to nicole lapin live at cnbc. you know what, i don't even have an e-reader. >> i have one. but i know p.m. around here that have multiples. this morning futures are heighter after yesterday's big gains. the dow sapping a three-day losing streak ahead of a key vote in greece. asian markets were higher overnight on the optimism that the greek debt crisis will be resolved. europe is just a touch higher now but we get significant data out at the top of the hour on home prices which are forecast to have dropped again in april, and on consumer confidence an

hour later. the dow rising 108 points yesterday to close at 12,043. the nasdaq also added 35 to 2688. reports ever mortgage fraud rose 31% this winter we're hearing as banks scoured through files to find shady loans made during the housing boom. the treasury department says the majority of fraud involved activities that happened more than two years ago but fraud is still occurring with the newer loans and in some cases foreclosed homes are sold to a straw buyer at an artificially low price who then flips it and sells it for a quick profit. the rubber might not hit the road. automakers complain of a tire shortage especially for high performance brands. when they get the tires they need they are paying double digit increases over last year. tire makers are running plants at full capacity. car companies say the shortage could last a while. it doesn't help that the u.s. government has slapped

take a look at this. showers have not yet breached the golden gate bridge so we're looking pretty good. everything is happening to the north in marin county. what that means for your afternoon is hey, we're going to see pretty slick conditions as you try to make your way home from work. look at this juicy system. very well organized dip in the jet stream. that's going to bring the shower activity to the south. and that means wherever you live except for maybe gilroy you'll get showers. we have the yellow in the green and even red moving in. that is an area of heavy rain headed to santa rosa. you work in the city, 56 at noon and then 4:00 p.m. when the front starts to kick in, 60 degrees, thunderstorms. we're going to keep you updated because some of these storms could be strong so we're going to keep watching those all the way throughout the day. i don't think i'm going to get a break until 1:30. but take a look at where we're headed back to the 90s. we're going to track these showers for you all morning

telling our viewers anything erroneous and it works. >> that's great. good to support our local anchor, like you. support folks in the area. also through livermore, the restaurant there said -- supporting the local vineyards. livermore moves smoothly. the latest incident reported a fire on 580 in the westbound direction. sounds like a tire tread that's in the middle lane causing a problem because it's a distraction. a lighter volume, 14 to 15 out of the altamont pass. i see there is also a large log. this may be the same thing as the tire tread. there may be something on fire in the middle of the freeway. not good. we'll watch this and watch as the slowing starts or the crews arrive. the maze here approaching the bay bridge, that's moving smoothly. a great view as far as the speed

sensors. green means above 55. a live look shows you what it's like crossing the bay. the bay bridge, a wide shot from san francisco shows a good stream of headlights. no backup at the toll plaza. the low clouds lifted about but things continue to change as christina watches. we'll get back to the map as well and on the bottom i added the a's icon. prepare for some slowing on that side of the bay around the coliseum after work. further south we're looking at san mateo. we had slowing but that might be construction equipment moving. the golden gate bridge, 101, this time into the north bay and there you see the misty conditions, you can make out the lights but there's moisture in the air and even a sheen on the roadway because of that mist. be careful this morning out of the north bay. >> it is a pretty shot. thanks, mike.

a bay area congresswoman who spent almost 20 years announced her retirement. lynn woolsley says she is going to retire in 2012. the 75-year-old yesterday said after two decades of service in this district it will be time for me to move on. at least three people have come forward to say they intend to run for her open seat. >> the federal government is stepping in to help protect bay area companies. the u.s. government is ruling out a new cyber security program. the program will give small and nonprofit companies more tools to protect themselves from hackers who enter their websites through programming weaknesses. the latest effort comes on the heels of the series of high profile hacking attacks against corporate and federal websites. facebook hired a hacker. scott explains. >> facebook apparently gave george hots a job.

he has been in the news for hacks including one that allowed kids to run programs on sony play station, stuff that wasn't illegal or probably wasn't illegal, but certainly put hots in the focus of many companies. what he will be doing at facebook we don't know. some back story to this. sony sued hots for what he did. that lawsuit angered other hackers, the group calling itself anonymous. then they launched a hack attack that brought the sony network to its knees. bottom line which facebook probably figured out it's better to have hackers on your side. the supreme court will consider whether the fbi can stick a device like this undoor your car without a warrant. a gps tracking device. a student discovered this under his car. it's a mystery to him why the fbi thought he was suspicious. he sued though the supreme court will consider a separate case

we're going to send it over to christina loren with a look at rain headed this way. >> it's hard to believe it's the final week in june, and we're just days away from july with a really cold potent storm on the way. it's pushing into the north bay. this is going to drop pretty good rainfall amounts over the entire bay area. especially areas north of the golden gate bridge. we're going to talk about when it's expected to clear and make its way into your neck of the woods throughout the morning. right now let's get to you work on time. mike's been busy already. >> good morning. got the opposite of showers, we have fire reported, it was a tire tread that was westbound 580 around north livermore avenue. another update came in that said maybe it's not a tire, maybe it's a piece of wood that could burn. i don't know whether they are an active fire. i'll report debris and report slowing coming through area past north livermore. chp is heading to the scene. the bay bridge, nothing at the toll plaza. but the volume is starting to

increase. we're seeing more lights. back to you. >> thank you, mike. new this morning two people arrested after a late night stabbing in walnut creek. witnesses saw a large group get in a fight on north main street. when police arrived they found two people down on the ground with serious stab wounds and a third who suffered a minor stab wound to the arm. right now two of the victims are hospitalized in stable condition after undergoing surgery. it's unclear how the fight started or if it was gang related. both of the suspects are being held at the martinez detention facility. firefighters are checking for hot spots after a late night grass fire in concord. the two alarm fire ripped through property near csu's contra costa center. christie smith is live in concord with more on the blaze. good morning. >> reporter: good morning to you. i wanted to show you the type of grass that burned out here. it's really quite dry.

you can see with a little wind like it is now that this could get moving, a fire, a dispatcher tells me this burned two acres overnight and that firefighters had to do structure protection to protect the houses from the flames. the good news, though, none of them were damaged. it came close enough that some neighbors prepared to evacuate, grabbing important things. this started around 11:00 last night in the hills behind discovery way off valley road. neighbors heard what they thought might have been fireworks before the fire broke out but a dispatcher says that at this point the cause is still under investigation. the fire did jump to two alarms, again burning two acres. it took less than an hour to knock down but crews did stay for sometime to make sure that it didn't flare up again. that's the latest. reporting live in concord, christie smith, "today in the bay." >> thank you. 5:31. cell phone video of giants fan

bryan stow inside dodger stadium is raising questions about about who is responsible for his beating. tmz has released this video. you can see a man in a dodgers jersey confronting stow. stow's hands in the air, he seems to be trying to cool things down. there he is. the man in the video is not giovanni ramirez. los angeles police consider ramirez to be their prime suspect in the stow beating but have not filed charges. a criminal law professor says if ramirez is charged this video may be key for the defense. >> as a defense attorney i want to plant something in the jury's mind that is a logical alternative to my client having done it. >> ramirez' attorney says their client was not at the game on the day stow was attacked. the l.a.p.d. will follow the

evidence where it takes them. >> investigation into the amtrak crash continues, investigators looking into the driver's cell phone records trying to determine if lawrence valley's cell phone was the distraction that caused him to crash his semitruck into the train. they want to find out if he was text messaging or talking on the phone before the accident. one person is unaccounted for. amtrak is trying to determine if that person was even on the train at the time of the crash. >> a special vigil tonight to highlight an unsolved murder four years ago today. gary jones was shot and killed at a hayward gas station in 2007. the alameda county sheriff's department says jones left a medical marijuana facility when a minivan began following him. jones stopped for gas, someone stole his marijuana. jones confronted the person and was shot and killed. no arrests have been made.

today's vigil is at 4:00 at abe's gas station where jones was shot. >> later today experts in the field of alzheimer's research will be at stanford tufrt share their latest work on that disease. marian marianne favro is live. >> reporter: the number living with alzheimer's disease is expected to double. we're talking 1.1 million people. today there are going to get together, scientists from around the world, to talk about a cure. new research out today shows that cinnamon has the potential to prevent the degenerative brain disorder. a team looked at cinnamon extract, they added it to the drinking water of mice with an aggressive form of alzheimer's disease. after four month, the researchers found the cinnamon had slowed the development of

the disease significantly. every year dozens of studies like this come out and researchers only have so many dollars to work with so they have to collectively decide which are the most viable theorys to pursue. that's one of the things they'll do at this conference and talking about new key findings regarding a cure for alzheimer's disease. right now there is still no cure. reporting live, marianne favro, nbc bay area news. >> thank you. 5:35. christina has a look at the forecast that includes rain in santa rosa where mom lives. she's going to get rained on. >> momma get that umbrella out. we have rain, also a mix of rain and snow over the sierra nevada. it's hard to believe. we are well into summertime now. but there is some snow on the

way and in fact, mammoth will be open. we have steady rain now moving into santa rosa, ready to slide to the south through the next hour or so. and san francisco, you're about an hour away from your steady rain. you can see the front's probably going to break apart before it makes its way all the way inland to san jose. south bay you'll see the least when it comes to the totals. i think the bulk of the moisture will stay to the north as per usual and maybe up to an inch of rain possible in the north bay. also expecting thunderstorms this afternoon with those thunderstorms we could see heavy downpours in the east bay and the south bay. as well as along the peninsula. i think it will be too cool but we'll keep watching those all day long. by noon, moderate rain, the east bay getting hit by 4:00 p.m. the south bay will slide through at about 7:00 p.m. making for a

rough commute home. this morning not so bad so far but mike's here to help you out all morning long. how we doing? >> rain wise we're okay but slowing we have. we're going to show you antioch after 5:30. the westbound slowing. and a little lighter than yesterday but speeds coming down in the 30s from l street to love. yesterday it held about 58, today we'll see if it dips into concord. sometimes 242 gets slow. we had the debris clearing now on the map at north livermore avenue. that's cleared. that's good but a new accident at the dublin interchange. chp has the incident reported involving a big rig. no injuries so far. 16 minutes there. we'll see how things are on 880. a smooth drive. no delays through cass so valley. past the coliseum shows a smooth flow with the taillights away

>> a live look at hp pavilion. it's 5:41. tough federal standards go into effect today for cribs. it's the first change in almost 30 years. tracie potts is live in washington with the look at these new standards. good morning. >> marla, good morning. it's happening because more than 30 children have died suffocated when their head got caught in this gap between the drop side of the crib and the rest of the crib itself. this has been happening for some time. now the cpsc says let's get rid of those cribs altogether. as of today you won't be able to buy them at retailers, second

hand store, either privately or on line. hospitals are exempt and so are hotels, and child care agencies for now. until the end of 2012. then they have to comply also. also, they are changing the standards for the testing of these cribs. you won't be able to, the manufacturers, won't be able to re-tight at any screws in the middle of the test as they have done before. the cpsc says that's not realistic, that's not what parents do. >> tractracy, thank you. police found the body of a woman kidnapped and murdered by the i5 strangler. the sheriff's department found ellen burleigh's remains this week in a dry river bed near lake berryessa. she was killed in 1977 by serial killer roger reece kibbe. he murdered six women between 1967 and 1987.

dropping their bodies along freeways. >> a teen buried alive under sand is in critical condition. doctors say ryan buchanan is unconscious but his brain is reacting to family voices. that has lifted the spirits of his friends who gathered for a prayer service last night. buchanan and dozens of other church members were having fun at sunset state beach, near santa cruz, it happened saturday. he and another teen were digging a 6-foot deep tunnel when it collapsed on top of them. in seconds church members and strangers ran over to dig the teens out. >> very shocking. something you never want to see, you know. the young boy buried head first in a six-foot hole. >> the creek side community church says it will hold a prayer service every night until buchanan comes home. the good samaritan has much more to say about the frantic rescue.
