bay." good wednesday morning,000. halfway through the week. thanks for joining us. i'm laura garcia-cannon. we want to get a look at our weather and our traffic this morning, pulling double duty. christina loren. good morning. >> good morning to you, laura. good news in the weather department. we downgraded hot icon to warm. not quite as hot, no triple digits in the forecast. as warm as i'm going is about 98 up in clear lake. for us in the bay area, north bay, east bay cities will be in the low 90s today. so some much needed cooling on the way. we've got a bigger cool down as we head through this weekend. we'll talk about that coming up. right now get you to work on time, a couple of things to tell you about. new accident, northbound 280, alpine road. watch out for police on the scene there. you're going to find one lane blocked. that could be in place for another 15 minutes. traffic, though, very, very light this early. you don't have to worry about adding extra time to your travels. we also have a live shot of 880 in oakland.

you're going to find construction slow for the cone zone this morning. northbound 880 from broadway to avaline. we'll let you know if it wraps in time. back to you, laura. thank you very much. 5:00. police chief says budget cuts have taken a toll on his department and something has to change. he's planning to reshuffle his staff so it can operate more efficiently. marla tellez joins us live this morning with a preview. good morning, marla. >> reporter: good morning, laura. later this morning chief anthony bass is going to give details to the plan to reshuffle his department and those changes are going to be implemented very soon, this weekend, in fact. in the wake of budget cuts the police chief says the department needs to be reshuffled because it currently has 638 officers. that's almost 200 less than its peak strength of 832 officers.

that was back in 2008. a year ago budget cuts forced 80 officers to be laid off. what's worse, attrition has his department losing six officers a month for the next two years. the chief says the major feature of his reorganization plan is to divide the current bureau field operations into two bureaus, each to be led by a deputy police chief. now, how this is actually going to affect public safety and what this means, we're going to have to wait to hear what he has to say today. in a letter to oakland, residents chief batts writes -- the president of the police union that represents the opd says the plan means less priority will be given to property crimes such as burglaries and thefts and in

many cases wouldn't be investigated at all. chief batts is going to explain his plan at oakland police headquarters at 11:00 this morning. and saturday july 9th. thank you very much, marla. the man accused of breaking into a woman's home in oakland and raping and robbing her is expected in court. deion mcdaniel is the man in this cell phone video. after the attack the woman had the wherewithal to pick up the cell phone and take this video. mcdaniel is expected to enter a plea of charges to rape and burglary today. gang retaliation is blamed for a recent shooting spree in richmond. police say rival gang members were looking to avenge an earlier shooting at night. one of those killed was bailey, who was working two jobs during the day while also attending college. the 19-year-old wanted to become a counselor or social worker.

killing come after shootings in the night, in all four wounded. there have been eight homicides since june in richmond raising the total to 15. you may have been awakened by a little shaking. the quake street south of holster. no reports of damage or injuries. a school teacher will pay a fine for destruction of artifacts. a civil jury ordered margaret and her relatives to pay a san jose man $750,000. papers written by physicist albert einstein were destroyed during the wildfire back in 2007. she was found responsible for starting that fire when she was illegally burning material. more than 47,000 acres burned, four homes destroyed. attorneys say the fine is excessive and is seek agnew

trial. we've heard about how much california has had to cut back on expenses in order to rein in a multi-million dollar deficit. while the state was slashing budgets, some employees were still receiving sky high paychecks. "today in the bay's" bob redell outside the state building in san francisco. some employees made over half a million dollars last year. >> reporter: laura, the top five employees who work for the state of california earned over $560,000 last year. the top paid person was a prison doctor who took home a little more than $777,000. this was in 2010. a dentist also with the department of corrections was just shy of $600,000. there are more than 1400 people who earned more than $200,000 last year. many of them medical personnel with departments of corrections and mental health. now, these numbers represent a combination of salary, overtime,

bonuses and payouts of unused vacation and sick time, which is supposed to be capped at 80 days, but for whatever reason many state agencies ignored that limit. now, state controller john chiang posted online the earnings of the quarter million people who worked for the state. he just released these numbers within the past 24 hours. he did this in the interest of full disclosure after the city of bell, california, had that scandal which employees there were paid absorb tant amounts of money. they have been voted out of their jobs or fired for that case. spokesperson for federal receivership in charge of the prison health care system defends the high pay of prison medical personnel, pointing out those people could be earning more in the private sector and that a lot of those employees couldn't use their vacation time because they were so short staffed at the time. but many of those positions the spokesperson points out have since been filled, meaning they

shouldn't be seeing such large payouts again in the future. by the way, if you're wondering where does the governor rank in all this, he's certainly not at the top of the list. governor jerry brown's salary, the governor makes just shy of $174,000. reporting live here in san francisco, bob redell, "today in the bay.." >> very interesting. thank you very much, bob. it's 5:07. attending state college could get more expensive this coming fall semester. california state university chancellor charles reed will ask trustees to raise tuition by 12%. if approved undergrads would have to pay more than $6400 per semester which includes mandatory campus fees. university officials say increases needed to offset funding cuts from recently approved state budget, $650 million was slashed with a possibility of more cuts by winter. alameda county will have to do a better job helping voters who don't speak very much english. the department of justice sued

the county for violating the federal voting rights act by failing to distribute ballots and other election materials in chinese and spanish. under a settlement the county agreed to provide election related materials in chinese and spanish and staff polling sites with bilingual workers for voters. more than 22% are latino, nearly 10% are chinese. this morning b.a.r.t. and muni extended a joint pilot program that allows seniors and disabled unlimited access to ride the systems. yesterday the agencies announced they would add six more months to the project which gives discounted tickets to seniors and disabled passengers. officials say the $26 monthly pass provides for muni and b.a.r.t. service. it will be extended january 2012. passes awarded on a first come, first serve basis to the first 1,000 senior and disabled passengers. all right. let's see how the forecast is going to look for today.

cooling trend starting, christina? >> yes, are we happy about it. good morning, give your ac a break by this weekend. probably need it in the warmest spots across the bay, he's bay and south bay, still a little on the warm side but not as warm as it has been. we're going to subtract 5 to 7 degrees on average from where we ended up yesterday. can you see where the storm track has taken all the way up into canada high pressure this area of clearing from the california coastline to the eastern pacific, that's high pressure. it's going to keep us warm today, but it is breaking down as we head through tomorrow. we're going to notice some differences today, especially in the south bay and in the areas if you live near the mountains you will notice a difference, especially east bay hills. more cloud cover, monsoonal moisture will come up and maybe thunderstorms. 92 in san jose, down from 95 yesterday. 79 degrees in richmond, 92 in benicia and moraga and 85 in redwood city. another beautiful day in san

. wow, i just love this shot this morning. beautiful, beautiful of the bay bridge this morning. thanks to photographer aaron murphy up early out there. got a great eye for photography this morning. some great picturesque places we have in the bay area. it's 5:14 right now. she wowed audiences for years. this morning people in san francisco are remembering the oldest and continuously performing drag queens. she died from an undisclosed illness. she performed in san francisco for more than 50 years at aunt charlie's lounge in the tenderloin. in addition to making a name on stage she was one of the first in the nation to undergo gender assignment surgery.

the nasdaq lost nine points at 2825. president obama has called congressional leaders to white house for a summit on the budget deficit. the president says he and lawmakers made progress over the weekend but still have differences to hash out. he set a two-week deal to reach the debt limit or borrowing limit so they can pass the bill before august 2nd when the u.s. will run out of money to pay bills. republicans oppose any tax hikes and any deal. more details on the plan for data used every month on the smartphone. the cap supplied new customers upgrading to smart phones. you'll be able to choose $30 for two gigs, $50 for five, $80 for ten. 95% of customers actually use less than two gigs a month.

injured or killed. but it's amazing to see those things coming. just a wall that comes rolling in. >> looks like armageddon. >> another thing i don't miss about arizona. that and the heat. i had a friend that e-mailed me and said it was 119. >> ouch, ouch, ouch. you know what, we're going to see some of that monsoonal moisture in the bay area today believe it or not. could produce a couple of thunderstorms. >> not to that extent. >> of course not. of course not. that's actually what we call a gust front. in order to get a gust front like that, you need a really strong line of thunderstorms. what happens is it forces all that air in at once. bad air quality in arizona today, as you can imagine. for our area, we're just going to see a little bit of spinoff from that monsoonal flow in the form of instability. enough instability and moisture sent in our direction for some pretty isolated thunderstorms. some of these storms could be strong. we're watching for that, the best possibility to see storms will be, of course, in the south

bay and wherever we get that orograph orographic. especially the mountains in the south. this is what we're looking at. high pressure firmly in control of our weather pattern. another warm day across the bay, just not quite as warm as it has been. we're talking about monsoonal moisture. it will produce a muggy-like atmosphere especially in the south bay. you'll probably notice the big difference if you're waking up in the south bay. this is where we're headed throughout the remainder of the week, prefiated workweek. hopefully you had the fourth of july we didn't. 89 on thursday, 88 friday. chief meteorologist you notice tuesday he put wash car on there. i don't know if he's talking to you, talking to me. i think he may be clarifies the fact we're not going to get any showers. hey, i take that personal this morning. >> exactly. put it on the rear window there. >> wash me. >> exactly. nbc bay area teaming up with local food banks and businesses to help feed the hungry. we worked with subway to raise

welcome back, everyone. and a good wednesday morning to you. look at that on the screen. some spring cleaning this summer. 5:22 right now. police had their hands full during this fourth of july weekend. drunken driving arrests increased 32% here in the bay area. 251 drivers were arrested compared to 190 last year. statewide more than 1500 drivers were busted for duis compared to last year's total of 438. 34 people died on the roads this weekend, 10 more than last year. 5:23. i want to check the morning commute with christina loren. she's helping us out. mike has the week off. >> lucky duck. we miss mike. he'll be back soon. still working that accident this morning on northbound 280 at alpine. that's an injury crash. going to find one lane blocked

in that area. we have a tow truck on the scene in addition to emergency crews and local heroes, california highway control. take it easy this morning. no delays, all green around that accident. take a live shot of san mateo bridge here. nice smooth ride from hayward to foster city. just about a 13-minute drive across the span. really still looking kind of holiday light out there, lawyer ark, back to you. >> a lot of people have the day off. 5:24. did you hear this? not guilty. after months of cable coverage and courtroom fascination, the florida mother accused of killing her own daughter is cleared. 25-year-old casey anthony faces four years in prison, found guilty of lying to police but not of killing her toddler. two-year-old caylee anthony was found dead in 2008. nationwide outrage quickly followed the verdict along with accusations the prosecution botched the case. anthony is expected in court later this week for sentencing.

she has already served some time. first barry bonds, now roger clemens. jury selection begins in the trial against seven time cy young award winner roger clemens. record setting pitcher is the latest former major league star to be on trial for allegedly lying about steroids. prosecutors say he lied to congress in 2008 when he denied ever using performance enhancing drugs during his 23-year career. the trial is expected to last four to six weeks. scott mcgrew will head up to facebook later this morning to hear about what do you think? >> that's the big question, isn't it, laura. the ceo promises something awesome. mark zuckerberg said it last week as he invited reporters to the discussion. we'll assume it's slightly less amazing than the last time facebook had a big gathering. that was to welcome the president of the united states. what could it be? expecting integration between facebook and skype, all the devices between cameras built

"today in the bay's" bob redell with a live look at who were the top earners. good morning, bob. >> good morning. to give you perspective, the person who arguably had the most responsibility in the state, the governor, only makes around $175,000. i say only because he's not even close to the hundreds of other employees who make much more of the top five employees in the state of california working for the state made more than $560,000 last year. at the top of the list was a

kung fu panda proves too dangerous for fans. giants slugger pablo sandoval took a swing and lost control of his bat. it bounced off the dugout roof, sailed into the stands. one woman was sent to the hospital after being struck in the head. two others fans treated at the park for minor injuries. oakland police department making big changes to its force. the police heave chief is reshuffling due to budget cuts. marla tellez joins us live in oakland with more on when this plan will take effect. good morning. >> reporter: good morning, laura. we all know change can be good, but in this case it may not be for the oakland police department. the police chief says the department needs to be reshuffled because it's losing officers and currently has about 200 less than it did almost

three years ago. right now, 638 officers are on staff compared to 832 back in november of '08. now, keep in mind, last july budget cuts forced 80 officers to be laid off. now to make matters worse, attrition has his department losing six officers a month for the next two years. in a letter to oakland residents, chief batts writes -- the department's reorganization is designed to address police staffing short falls and deliver police services under a strengthened model of field supervision. now, what this means and how this is going to really affect public safety, we're going to have to wait to hear what he has to say today. just last november, chief batts addressed his department's shrinking staff and how it relates to the homicide rate. he had this to say. >> try to reduce the murder rate, homicide rate in the city to a number of 60 from a number of 109 last year. i thought we were pretty much on

target until we had to do the layoffs. >> there turned out to be about 90 homicides in oakland last year. now, to be clear, chief batts wants to stress to the community that he knows it's going to be a tough road ahead. but again, he stresses that public safety will always be a top priority. now, he's going to be holding an 11:00 news conference here at police headquarters in oakland. we'll be here to cover that, to bring you the latest, of course. changes to take effect in his department this weekend saturday the 9th. laura. >> thank you very much for the update there. 5:36, search under way for an east bay cyclist who disappeared over the weekend. no one close to 29-year-old mike martin has seen or heard from him since saturday night. that's when the uc berkeley grad student went for a bike ride and never came back. the only sign of him was a cell phone recovered by another cyclist on tunnel road in berkeley. martin's girlfriend said he had

been fasting for three days before he disappeared. he was riding a fluorescent green bicycle. search continues this morning for seven people still missing after their boat capsized on sunday off the baja coast. these are four of the men the coast guard is looking for. this man retired after 37 years on the job with the "san francisco chronicle." >> i actually spoke with him. he was very excited. he's an extreme workaholic, really dedicated to his family and never put time aside for himself. a buddy fishing trip proved to be deadly. the latest on the search for survivors. >> good morning, laura, the last three days have been devastating for the surviving passengers and families and the san diego-based company that owns the fishing

boat as the search for seven missing americans continues. just released last night, these are four of the men they are looking for, the mexican coast guard and u.s. coast guard are still scouring the baja coast after the sportfishing boat capsized sunday morning. the fishing boat "erik" left san felipe harbor before dawn. it sank 60 miles south of the port, two miles offshore. one fisherman drowned, 35 others survived. the crew said before leaving the captain was told not to leave the harbor because the weather because too dangerous. gary wong was separated from his brother brian as the ship sank. the husband and father of two is missing. >> whoever made that decision, i don't know who went out there to make the decision to stay out there, that was a bad decision. i'm not leaving until i find my brother. i'm not leaving.

neighborhood, this moisture air mass, warm moisture air will collide with drier air. we have potential for thunderstorms especially throughout the east bay hills and south bay today. i think towards the coast you're nice and safe from thunderstorms. but we're going to keep watching that for you, 10 to 20% shot of thunderstorms in the bay area today. go figure. 68 in livermore, 58 in gilroy, 63 in san jose. if you're headed to work in the city today, another gorgeous day. a little bit cooler. we are going to see a little bit of that fog creep in as we head through the next couple of hours. right now nice and clear through the local bridges, 70 degrees, mild at noon. by noon, 75 degrees, abundant sunshine. of course we've got a giants game in town. we'll get to that forecast in just a minute. temps today really coming down. 99 the forecast, high in concord yesterday, 92 today, 75 in san francisco. oakland you'll get a break as well, back to the 70s for you, 79 degrees. all right. here it is, your giants

investigators say they received a call shortly after midnight yesterday. someone reporting a possible dead body. when they arrived at the scene, they found a dead man. so far police have not identified him and they have no motive or cause of death. that death marks the city's fourth homicide of the year. police are asking anyone with information about that death to call concord police. paying too much for health insurance? today state lawmakers will vote on a bill that will let them crack down on health insurers who charge too much for coverage. they will let the commissioner or department of health care to veto hefty rate hikes. critics say the proposal is wide ranging and beaurocracy that adds cost, does nothing to deal with rising medical costs, certainly driving up some insurance rates. it's 5:47 right now. the history of lesbian, gay, by sexual and transgender americans could soon become a required part of the school curriculum

an advocacy group in san francisco is using social media to fight parking tickets. people are being urged to send their stories or being slapped with a ticket.

about being slapped with a ticket. the group will select four winners and pay off their fines for them, also tackling the issue of a city law which prohibits city businesses posting ads outside their stores. the group found a loophole in that law but the work aron is fought in federal court. city official says all the talk about parking tickets is just a front for complaining about the sign ordinance. all right. i want to check in with christina loren, she's actually filling in for mike on traffic. you had just told us about big-rigs, 2011 them colliding. >> two big-rigs involved in an accident. you know what that means. it's going to take a lengthy cleanup process before we see lanes open up. clear this morning, good news two lanes blocked here, 880 at 23rd avenue, an injury crash. we don't know the extent of the injuries. we know two lanes are blocked, two big-rigs involved of it's going to take heavy equipment if either of those rigs need to be hauled out. keep that in mind. that can slow you down. as of the current time no delays
