head on a popular hiking trail. that story coming up. >> by the look outside, boy, can't even make out the bridge there. what a difference. the forecast for thursday, july 7, "today in the bay." >> good morning to you. thank you for joining us. it's 6:00 now. we're also awaiting the sentencing of casey anthony this morning. we're going to take a live look outside the courtroom this morning. we lost that shot this morning. but let's see, this looks like it's actually inside the courtroom this morning. those are casey anthony's parents you see in the distance. casey being sentenced just two days after being acquitted of killing her 2-year-old daughter caylee. she was guilty of providing false information to police officers that was just four

counts of misdemeanor counts. let's go to an nbc news special report right now live from orlando, florida, as we continue to follow the casey anthony sentencing this morning. >> as we look at that scene and what will be to unfold. >> that's right. we know as you just alluded to whatever sentence judge perry hands down this morning it's a far cry from what case weighs facing which was the death penalty had she been convicted of first-degree murder. she's served nearly 1,000 days in jail, and in the course of the trial, runling up to the trial. she faces up to one year in prison for each count of lying to authorities. we want to bring in our legal team. savannah, as we await judge perry. what are the options? >> one thing that we're in suspense about is whether or not there will be witnesses at this sentencing hearing, whether the lawyers will simply make their arguments. judge perry has the option to

sentence her to up to four years in prison, that's one year for each count of making a false statement to police. as you mentioned, she has served nearly three years in jail. but subtract from that, she was convicted, pleaded guilty some check fraud charges, sentenced to time served for that in january 2010. so the clock is ticking from january 2010 on her time served so i calculated about 18 months or so that she could be credited with. so i don't think it's altogether certain that she walks out of prison today. and the judge can take into account the subject matter. what she lied about. >> so we're going to continue to follow the special news report that is coming from nbc news. this is a live look outside of the courtroom. so many people across the nation have followed this case and were very, very upset when she was acquitted of the murder charges. we'll get back to local news. we're keeping tabs on that so we

heroes, can't say enough about what they do for us. taking a live look at the bay bridge, we have no issues across the span. we'll let you know when the metering lights come on. back to you, laura. >> thank you. we also have an update this morning on a shooting at a popular pittsburg trail which left one man in critical condition. bob redell is live with more. good morning, bob. >> reporter: good morning to you, laura. the sun comes up in pittsburg, the park police are still out here guarding this section of the trail still shut down and will be until investigators get a look at the crime scene in the daylight. the scene is less than 12 hours old. it was around 8:30 last night that a hiker came across a young man possibly in his 20s, lying on the ground, unresponsive with a blood wound to the back of the head. that person came across this victim, ran to get help. started cpr.

i spoke with someone who says that the paramedics indicating he might have died but the police tell us he was in critical condition still alive when taken to the hospital. don't know if that is still the condition of this man. again a man shot on a popular hiking trail in pittsburg. police do not have a suspect nor motive. back to you. >> thank you, bob. and we continue to follow sentencing in the casey anthony case right now. we are monitoring, this is the judge in the courtroom now. let's listen in. >> mr. baez, you had asked me to reserve ruling on your motion for mistrial. that takes care of that. >> the defendant casey anthony the is before the court for

sentencing on counts 4, 5, and 6, providing false information to a law enforcement officer. mr. baez, you know of any legal cause why we should not proceed to sentencing at this time, sir? >> 4, 5, 6, and 7. >> and 7. >> the only legal cause that we have is previously filed motion, but no legal cause with the substantive remedies taken. >> would the state care at this time to present matters relative to aggravation? >> no. >> state care to present any issues at this time concerning any other matter? >> your honor, yesterday i filed

a motion to tack special cost of investigation and prosecution and to reserve jurisdiction, the only reason i would bring this up prior to the actual sentencing has to do with the jurisdiction of the court once sentence is imposed if defense counsel intends to appeal the misdemeanor convictions, then this court would not be able to entertain a later hearing until that matter is resolved as it relates to cost of investigation. if, in fact, that is their intent, what we would ask is that the court bifurcate the sentencing hearing, proceeding to the matters of punishment first, the issue of cost of investigation is not intended to be punitive, and i believe can be handled at a later point in time in a bifurcated type of proceeding that would not divest

the court of immediate jurisdiction to hand thl matter so that this can be closed as judiciously as possible. that is the only thing i wanted to bring up at this time. >> mr. baez. >> mr. mason. >> i'll ob to the bifurcation process. they have not presented an invoice or accounting as of yet. we will be challenging as appropriate. she asked for 60 days. i have no problem with that. >> the court will retain jurisdiction to deal with the issue of cost of prosecution and other costs, i guess, pursuant to chapter 938. that's the statute that you're seeking those costs under? >> it is, your honor. >> okay.

mr. mason, mitigation. you may proceed, sir. go ahead. all right. >> may it please the court. >> good morning. >> good morning, your honor. >> we respect the court address the vie laugs of double jeopardy at issue with respect to count 5, 6 and 7. because all four statements in the indictment arose in the july 16 interview between detective and miss anthony all four counts

providing to a law enforcement officer were one countous act. as such each false statement separately charged violates double jeopardy and must be reduced to one conviction based on one count. in hamill v. state, 934 southern 2nd, 634, a florida 2nd case from 2006 t defendant was convicted of 15 counts of using a computer to seduce a child. at issue whether counts 5 and 6 among other things arose from a single criminal episode. the court articulated the test to determine whether offenses arise from a single criminal episode. in that test the court articulated -- >> let me stop you for a second. >> yes your honor. >> i don't seem to have benefit of what you say you provided the court. >> i apologize. i gave that to the clerk and i should have instructed that you

need to have that. >> go ahead. >> thank you, your honor. this test requires the court to look to whether there was a separation of time, place or circumstances between the crimes because those factors are objective criteria used to determine whether there are distinct and independent criminal acts or one continuous criminal act with a single criminal intent. the court went on to say that the aspects of the crime looking at that criteria a court can ascertain whether the defendant had time to pause, reflect and form a new criminal intent between the occurrences. your honor in finding count 5 and 6 in the hamill 6 were a violation of double jeopardy, the court pointed to the fact that there was no break in the conversation or change in circumstances to warrant separate charges, the

conversation in twe and several hours. similarly your honor the false statements miss anthony made to detective occurred in a single interview on december 18, it was one continue interrogation. as required so as to not double jeopardy. we provided the the court with two other cases that is 511 southern second 401 and that was out of the fifth dca, a 1987 case, and we provided the court with berk versus state, 252, that's 1985 case. it's our assertion that the hamill case is similar in that it touches on the temporal aspects present in this case as

well. and however, the double jeopardy was invoked when the defendant was convicted of five incidents of leaving one scene because there were five people who were left at the scene of an accident. berk on the other hand invokes the double jeopardy where there were three convictions of the defendant based on one transaction and the defendant was charged separately. because they were found to be one act, double jeopardy was violated in this case. your honor, in order to avoid a legal -- we request that the court sentence miss anthony only for one occurrence, one count of providing false information to a law enforcement officer. further we reassert that there is an issue of materiality in these charges and should be read into the statute as legislative intent. thank you very much.

>> just a second. let's look at count four. >> yes your honor. >> of providing false information to a law enforcement officer. >> yes, sir. >> specifically, what is alleged in count four? >> count four alleges that on the 16th day of july, 2008, that in violation of the statute 837.055 there was a knowing and willful violation giving false information to a law enforcement officer. so that specific allegation was that casey marie anthony suggested that she was employed at universal studios. however, it arose during the july 16, 2008 interview, as did every other charge, your honor. >> as a result of her that she

was employed at universal studios did the police have to take any resulting action with their investigation? >> they certainly did, your honor. if we are to charge her we have to charge her for the crime, and the crime here arose out of all four incidents were part of the same continuous act. even though there were several false statements. >> count 5 alleges she violated that statute by doing what? >> that during that sames in view on the 16th of july, that miss anthony identified a person and suggested to detective mellic that she left her child with this woman. >> and did that require a separate and distinct act on behalf of law enforcement to investigate? >> it did, your honor. however, i would assert that the

reaction based on the violation isn't how we measure this. how we measure if there was one instance, one particular criminal act, that wasn't broken up tem porly, we look not at the resulting conduct of the police department. we look at the conduct of misanthony and the temporal aspect. >> we're going to continue to follow the casey anthony sentencing that is happening under way right now in orlando, florida this morning. they are going over procedures before actually getting to the actual sentencing. we're going to keep tabs on that. we're going to bring you back to local news of course we'll bring that to you live when it happens this morning. 6:16 now. you might notice changes in airport security coming to bay area airports. u.s. officials say they have evidence of a possible new security threat, even full body scanners cannot detect. marla tellez is live at the san jose airport with more on how

travelers are reacting to this news. al qaeda is getting crafty. good morning. >> reporter: yeah, unfortunately, right. good morning to you. talk about being the bearer of bad news. what we're finding is the passengers arriving at san jose this morning, they haven't hird of these belly bombs so i have to explain it to them. be that bearer of bad news and let them know that security could become more intense and tedious. a belly bomb is literally an explosive that is surgically implanted in a person's body. either in the back side or breast, completely undetectible by a body scanner. u.s. officials say they have new information that al qaeda militants are considering them to blow up commercial flights. to be clear a specific imminent threat has not been identified. the tsa is warning passengers could see added security, airports may resort to trace swabs, more in depth questioning

and pat-downs and enhanced technology. the passengers we told said hearing about a threat upsetting but they don't mind a longer wait at security. >> if we don't know who is sitting next to you or walking next to you so your safety is in jeopardy. terrifying. >> i hate to hear about it but whatever we can do to keep our airways safe. >> reporter: so far no major changes have been implemented at any bay area airport. but officials say if and when they are, they could vary from airport to airport just to keep it unpredictable. experts in the field say, laura, this doesn't necessarily surprise them. we dealt with the shoe bomber, we dealt with an underwear bomber, now a so-called belly bomber. they say this is a natural progression. >> wow. amazing. i guess you hear of so many people smuggling drugs into this

country. what a way to smuggle a bomb in. horrible. thank you, marla tellez live from san jose airport. pretty clear shot there, what about across other parts of the bay area. i want to check the forecast with christina. >> if you are trying to catch a flight out of sfo right now we don't have delays but we have some very, very low cloud ceilings so we'll keep watching that. could see delays. people trying to get in to sfo. you can see we're dealing with an interesting weather pattern out there. high pressure. you see that clockwise rotation, all of the showers moving 18 clockwise fashion. that's monsoonal moisture. it's going to feel sticky, muggy in the south bay and we could see a couple of thunderstorms, a couple of those cumulonimbus clouds developing later today. you can see where the showers are. they haven't made their way in but we're fair game for that. we'll be watching that. looking pretty good. on shore flow is pushing that ridge to the east.

pat-downs screenings could get more in depth as officials investigate a new potential threat. marla tellez is live at san jose international airport with what we can expect the next time you travel. >> good morning, laura. though most people have a love/hate relationship when it comes to airport security as something you've got to do but it can be a big hassle, the passengers we have spoke tune say you know what, bring on that extra security if that's what it takes. this is all because of what's being dubbed a so-called belly bomb, an explosive surgically implanted, either in the back side or breast. officials say they have new information that terrorists are experimenting with them as a way to blow up commercial flights. tsa is responding. a spokesperson issued this statement saying, tsa briefed

carriers to provide greater insight in intelligence indicating the continued interest of terrorists target aviation. end of quote. but to be clear a specific imminent threat has not been identified. what does this mean for you the passenger? airports may resort to trace detection swabs, more questioning and more pat-downs. and the use of enhanced technology. the passengers we stopped say it's all so unsettling. >> i don't care if it takes two hours or three hours to get through security. it's worth it. >> how you can handle that, like implanted in your skin, i don't know. other than to scan. >> that's just it. a belly bomb is not detectible by the current body scanners that you probably have been through here at your local airport. experts in the field say this doesn't surprise them, we had a shoe bomber, underwear bomber, now a belly bomber.

they say this is a natural progression. so far no major changes have been implemented at any bay area airports and officials say when the changes take effect they are going to vary from airport to aerpt to keep everything unpredictable. >> everybody has to be patient. thank you. it's 6:33. this morning bay area families holding on to hope that seven missing fishermen are still alive in the sea of cortez. family members are pleading with crews to continue searching the waters off the coast of baja california. rescuers planned to stop this morning but they are going to continue. i want to turn back to florida where we are waiting the sentencing of casey anthony, let's check in now live. zm we are going to spend some time this morning figuring out her credit for time serve d.

it's going to take us probably about an hour to sort of out because the previous sentences that she has been given, but with the good time depending on preliminary figures sometime early august, maybe late july, but i can't say that until after i first determine time served, and then the jail has to amy according to their figures good time and gain time that she has

gained in this. so, if you want to wait around or we can communicate that with you and if you have a different figure -- >> what we're listening to is the judge, he's going to have to basically calculate the time served that she has in there, but prior to this they just announced that casey anthony will be sentenced to one year and $1,000 fine. of course she was found not guilty of murdering her 2-year-old daughter caylee a couple of days ago but she was found guilty of providing false information to police officers, four misdemeanor counts, that is of which she has been sentenced to one year and $1,000 fine. she's been in an orange county, florida jail for nearly three years, locked up about 23 hours a day. what the judge has to do is calculate that time served versus her sentence of one year

today. we'll continue to monitor this because a sentencing proceeding can go on quite thoroughly. we're monitoring what's happening outside the courtroom. this case has been followed by millions. some people outraged that she was not found guilty of that murder. we're hearing from jury members as well, we're talking about why they reached the decision that they did in this case. one year, $1,000 fine. it does not look like casey will walk out of jail this morning. a lot of people were preparing for that. it is 6:36. back to local news that we're following. a man is in critical condition after being shot in the head at a popular trail. bob joins us live with an update. >> reporter: good morning, laura. yes, this happened under 12 hours ago and police kept this crime scene secured.

it happened beyond that squad car there on the found there. looking at terrific police keeping this section of the delta deanza trail shut down and we suppose it will be until investigators get another look at the crime scene in the daylight. around 8:30 last night a hiker on the trail came across a young man, possible hi in his 20s, lying on the ground, unresponsive with a bullet wound to the back of the head. that person ran to get help. police arrived, started cpr. we spoke with someone who said they saw paramedics stop cpr indicating that this person may have died. >> we spoke to police who indicate he was taken to the hospital in critical condition. police are looking for a suspect and motive. they don't know if this was a random crime of robbery or

something else. in may, a 19 world was shot on the same trail and what was considered to be a gang-related attack. and several years ago a pittsburgh police officer was killed along this trail after being shot while chasing the question. a bank. you can see it's not the first time something like this happened here. reporting live in pittsburg, bob redell, "today in the bay." >> thank you. we've got to clarify some things, some information that came in to me i want to make sure it's all correct and now that i checked it out. casey anthony's sentencing is happening today as we mentioned to you, and she received one year per count, and she was found guilty of four misdemeanor counts and guilty of lying to police, providing false information to the officers. not guilty of course to murdering her 2-year-old daughter caylee. so, that is the judge has sentenced her to four years for lying to investigators, as i

mentioned. that's four years so it was one year per count a. 1 thousand dollars fine. what they are going to do is take into account nearly three years of serving time. so it will be interesting to see when she will get out. the judge mentioned july-august. doesn't sound like she'll walk out of that a free woman yet but many consider her free tor being found not guilty of murdering her daughter caylee. i want to make sure we're getting you the most reliable accurate information as well. >> 6:39 now. going to the forecast? is that where we're going? >> hey, let's switch gears significantly now. good morning to you. we are looking really good. if you want to chime in we always want to hear from you. you can log on to facebook and tell us what you think. we want to hear from you. this morning let's get to the weather because we've got really good news coming out of this

department. we're going to see a nice day, temperatures falling substantially from where we started out. triple digits. they will be a thing of the past. really nice weather, 79 degrees, that's. even in almost where it sends to get the hottest in the bay. we have a difference, a little more of the subtropical moisture has creeped to the north. if you live in the southeast region of the bay area, you know what i'm talking about, morgan hill, gilroy, probably going to feel sticky today. because of the muggy conditions. but it's not going to be all that bad as we head throughout. probably friday into saturday, we're going to see onshore flow kick in that's going to take this ridge of high pressure that is kurning, the wrap around moisture is going to kick it to the east. we'll see a beautiful weekend and on shore flow takes control.

>> new this morning months after it took on the iphone, verizon is ending its unlimited data plans. brian mooar has news of the plan affecting millions of customers. >> reporter: it's really not any coincidence, the run away success of the iphone and other smart phones are chewing up data, causing a lot of difficulties for verizon, at&t and the other phone companies as they try to build out to these next generation systems. somebody's got to pay for it. we start gobbling up more data it's going to be us. so beginning today and going forward, the new accounts, verizon is going to charge for goinging over the data cap. you can buy more. it will warn people as they get close to the limit. it says that basically 95% of its customers right now do not go over the 2 gigabyte cap.

>> new this morning casey anthony is not leaving jail. she could be released from jail as early as the end of the month. this morning moments ago the judge in orlando sentenced anthony to four years in jail for providing false information to police. that's one year for each of the four misdemeanor counts against her. anthony has spent nearly three years in jail so far so she could get credit for time served. the judge says anthony could be released in late july or august. she was found not guilty of killing her 2-year-old daughter caylee back in 2008. >> it is 6:52 now. christina's been pulling double duty this morning looking at the morning commute. how are we looking? slowing out there? >> yeah, unfortunately we've got a crash and a really bad spot this morning. reportedly a big rig lost its
