just popped up, so nothing on the reports yet. i'll see what's going on there. we're also looking, forecasting some slowing for antioch westbound highway 4 right around this area that i circled. but eastbound into the area we heard about someone walking on the side of the road. chp is heading out there. again, anything on the chp incident report we follow that. back to you. >> thank you very much. later today a rally will be held at san francisco's civic center station over a recent shooting at the b.a.r.t. station. the reason this is important is the rally has a potential to impact b.a.r.t. riders this afternoon. bob joins us live with the latest. good morning, bob. >> reporter: good morning, laura. a group called no justice no bart is organizing this to take place at the civic center b.a.r.t. station between 4:30 and 7:00 this afternoon with the intention they say to disrupt the afternoon commute. what they are doing is trying to bring attention to, trying to

protest the b.a.r.t. police shooting and killing of charles hill, a 45-year-old transient who died a week ago at this station after a confrontation with two b.a.r.t. police officers. the officers were responding to a call that hill was drinking alcohol on the platform and at risk of falling on the tracks. they say he was aggressive, had a knife and slightly injured one of the officers when he threw a vodka bottle at himment they shot hill three times. in a news conference b.a.r.t.'s chief of police said he was comfortable with how his officers handled the situation. protesters think that b.a.r.t. police are participating in a cover-up. they will demand that the b.a.r.t. police department be shut down t firing of those two officers on leave. the release of surveillance footage of the shooting and independent investigation. it should be noted that b.a.r.t. and the san francisco police

department are both conducting parallel investigations of the shooting. this is the second bart police shooting that caused controversy. in 2009 oscar grant was shot and killed by b.a.r.t. police officer, former b.a.r.t. police officer johannas mehserle. he has said he did not mean to shoot him with his handgun but rather with his taser. this morning we reached out to linton johnson, and this is what he had in response to what is happening today. quote, while this news outlet must think it's acceptable to promote unsafe and illegal belavier b.a.r.t. is focused on keeping passengers safe, secure and on time. we find it reprehensible that this news outlet would even both tear ask tuesday participate in this and risk the safety and security of bart passengers and

employees and other guests. reporting live, bob redell, "today in the bay." >> thank you. arson investigators are on the scene at daily city elementary school. crews responded to a one-alarm fire at skyline elementary school sunday night. report shows the fire started outside the back area of the school, then spread into a reading lab. investigators have not ruled it arson. they are trying to find the source of the blaze. >> a weekend sleepover turns tragic, one girl is dead and three friends ill after they drank a soda mixed with an unknown substance. police suspect alcohol but will not know until a toxicology report. the 14-year-old was found dead on her bedroom floor sunday morning. her parents told police the girls were sick in the middle of the night with what they thought was food poisoning. they cleaned them up and put them to bed. when they woke up in the morning their daughter had died.

>> a developing story this morning in pittsburg where police are investigating a second shooting on the de anza trail. christie smith joins us with an update. >> reporter: good morning. pittsburg police are still here investigating. they haven't spoken with us on scene but i can tell you that the shooting happened just down the trail beyond the police truck you see parked there. what they are telling me, i spoke with a dispatch wer the east bay regional parks. one man was found shot on the trail. they are not releasing his condition yet. but this occurred about a block away from a shooting last wednesday also on the delta de anza trail. 20-year-old victim who was shot in the head has died. both city police and park police saying they don't think that shooting was random and this latest shooting happened around

12 midnight. neighbors heard a gun fire. they called police and found a man down on the trail. there was another shooting on may 9, shot in a gang-related attack. we do have calls in to pittsburg police about a possible connection but the dispatcher i spoke with i asked if there were any arrests or suspect information and he said no. reporting live in pittsburg. >> richmond police trying to figure out how it happened but say a triple homicide over the weekend is a result of a drug deal. police say three men were shot in an apartment on triangle court around 4:30. in the next room was a 6-year-old. police say three men were involved in a close range gun fight. the child was not hurt. he was the nephew of one of the victims. the investigation continues but they are confident that everyone involved is either dead or in

custody. 5:06, san francisco police officers agreed to a new report with the city that will prevent layoffs and save money. police officers will immediately get a 3% pay increase with another small increase next april. officers will pay an extra 3% into their pensions. firefighters in the city are exexpected to vote on a similar contract soon. if approved san francisco could save $31 billion over the next two years. as you get in your car officials want you to remember to watch for construction workers. the agency is starting a campaign along with the highway patrol to remind drivers to move over. cal transofficials say should move over a lane when you see flashing lights. the campaign comes in response to a string of caltrans worker deaths. time to check the full forecast

with christina loren. >> good morning to you. we have a good looking week on tap. probably one of the best weeks we're going to get all summer long with our temperatures ending up in the 70s. we've got a gorgeous day for you today. and take a look at the differences on your satellite imagery. compared to where we were at this time on monday. we have that monsoonal moisture from high pressure over the four corners region. for us, low pressure is in control. it's kicking in the onshore flow. that means we're going to start with a pretty good formation of fog early. i think we're going to see a solid cloud bank along the coastline until at least noon. as a result you'll probably break 60 degrees at about noon, maybe 1230. and only rounding out at about 65 with all of that fog. we are expecting it to be so dense in parts that we could see the mist generated. i think that's going to happen today. 53 degrees in san mateo, 56 in sunnyvale and 57 in hayward.

looks like a morning commute, folks are up and about getting going on this monday morning. it's 5:13. the final pieces to the eastern span of the bay bridge will soon make the journey to the bay area. crews are loading the final pieces of the steel girders and tower on a transport ship today. it will make the 22 voyage from shanghai to oakland by outsourcing from china the project saved $400 million in labor and material costs. california department of transportation also chose the maker because it has a huge crane needed to lift the pieces of the span. the new eastern span scheduled to be open in 2013. >> the price of gas is going down just slightly over the past two weeks, average cost for a gallon of regular dropped to $3.62. for the rest of the news before the bell we turn to nicole lapin. good monday morning to you. >> hey, very good monday morning to you, laura. futures are lower as investors

confront a pair of worries, europe's debt crisis spreading to italy and the u.s. budget talks creeping at a snail's pace. as the government tries to avoid a debt default next month. there's also a little bit of carry over from a disappointing job reports on friday. unemployment upticking to 9.2%. on that asian markets fell, europe is in the red. no big data today but this week we get reports on retail sales and pork prices, the trade deficit and inflation. earning season kicks off today when alcoa reports their results. to recap the action on friday, the dow fell 62 points to 12,657, where we closed there t nasdaq lost to 2859. the job market could be sluggish for some time. there is a new survey that finds 64% of small businesses don't plan to hire new workers over the next year. 19% plan to add employees and

five feet of beach it's significant up there and they did say that it's not actually going to peak until later on this month. we've got to watch for more of that as we head throughout the coming days. let's look at what we can expect for today. you can see right now things are looking pretty good. we have on shore flow which has increased significantly by the system of low pressure. what's going to happen it's going to continue to drive to the east. as it does so it's going to bump this guy out of the way, nudging high pressure off to the east as well and for us, some nice marine air is going to continue to pull in. we are expecting good fog formation as we head throughout the morning especially along the coast. watch for that. temperatures are going to be really comfortable, though, as a result of that on shore flow, only the upper 70s across the bay. you give your ac a break for the first half of the day. fairfield and concord getting a breeze but that's it. southwest wind at 21 miles per

area to show slowing. here through livermore the reason for that slowdown, there was an earlier full closure. sounds like the equipment is in the area and messing with our sensors. though we're showing 18 minute drive it's probably closer to 15 in the westbound commute direction. east bound we had construction. moving over to the maze, smooth drive approaching the bay bridge toll plaza. we'll get a live look and show you. across the water this is a darker shot. some of the fog, the clouds are rolling through, the deck of visibility is reported okay. there is a wind advisory and that's probably what's pushing the clouds through the area from time to time. it's buildsing. >> thank you. a lawsuit involving former governor arnold schwarzenegger will have its first day in court today. parents of louis santos are suing because he commuted the sentence of one of the men involved in santos' killing. swars wars reduced the sentence

from 16 years to 7. the suit claims he did it because nunez is the son of a political ally. schwarzenegger sent a letter to the family apologizing for not informing them but he has not admitted wrong doing. >> court case in colorado raising interesting questions about computer passwords. >> good morning. a woman is on trial in colorado, she's accused of mortgage fraud and prosecutors think there's valuable evidence on her lap top. but her lap top is encrypted so the big question is should the accused have to give up their passwords? if doing show would show them to be guilty. that seems like a violation of the fourth amendment. the counter argument if you hide evidence 18 safe you have to give up the key. does that fact that the password is in your head change things? it's a precedent-setting case and we'll keep watching it.

before midnight. police came out and found a man dead. i mean a man down, i'm sorry. this follows a trail shooting on wednesday night on the other side of railroad. i spoke with east bay regional park police. they are not releasing much information about the man's condition this morning. they say they should have more after 8:00. on wednesday, a 20-year-old pittsburg man was shot in the head on the trail. police say they don't think that that one was random and there are reports that he had been shot at in antioch days before that happened. the "mercury news" reporting that man has died about a half mile from that one on may 9, another man was shot in the shoulder in an apparent gang-related shooting. we have calls in to pittsburg police about a possible current weather conditions these shootings. one dispatcher told me he has heard that pittsburg police are increasing patrols in light of all of the shootings going on on

the trail. but i asked if he had suspect information on this latest shooting. he said no and there have been no arrests. christie smith, today in the bay. >> thank you very much. two men are in custody after a long car chase stretching from san pablo to fremont early this morning. we understand the suspects carjacked a driver in san pablo. law enforcement agencies gave chase on southbound interstate 880. the suspect then drove south fremont boulevard where they crashed on an on ramp. police arrested two men in the car. the female in the car taken to a hospital by ambulance. 5:33. protesters will rally at san francisco's b.a.r.t. station today. they are angry over a recent officer-involved fatal shooting. the reason this morning is important it could impact afternoon service for b.a.r.t. riders. bob redell joins us live with

14 when she had her first child fathered by garrido, she had another child of his later on. dugard says she talked to one of the probation agents and made her feel like they didn't care. she thanked the two police officers that finally rescued her. dugard is now 31 years old and trying to build a life in northern california with her two daughters and mother. her book will be released tomorrow in her own words. >> u.s. navy will be in the waters off baja california looking for the seven fishermen missing after the boat capsized. divers are expected to search the remains of the boat looking for any bodies. the seven missing were among 44 people, many from the bay area, thrown into the water of the sea of cortez on july 3. yesterday the coast guard searched by air, while the mexican navy searched by both the hopes of finding the men. the family members of those still missing launched a website

>> hey, good morning. there was a rare sunday meeting at the white house between the president and congressional leaders, not very long, though, described by at least one person as a bit tense. the president and congressional leaders sat down, he said wear your business casual attire but they met for less than an hour and a half and weren't able to come closer. the president is pushing for a grander plan, some $4 trillion in deficit reduction over the next decade. he says that he would put social security and medicare on the table in exchange for closing some tax loopholes but republicans still holding firm saying they don't want change to the tax structure, they are looking for a deal more in the range of 2 to $2.5 millitrillio. the president was asked going in whether they will be able to do something and hammer this out in the next 10 days, he said we need to. as you said he will answer more questions this morning. he has a news conference planned at 8:00 a.m. pacific time. and so he's likely to face a lot

of questions about what's next. he is meeting with congressional leaders again today. he's told them be prepared to meet every day this week. he also asked republicans today to bring more specifics. >> a lot of people worried about money these days, kristin. students at all of the state schools and ucs, they all face the possibility of tuition increases this week. uc board of regents vote thursday to increase tuition 10% for the semester that starts next month. that is on top of the 8% increase approved last november. both uc and csu systems were hit with $650 million cuts in the state budget. both are asking students to try to make up the difference. >> it's really painful. we're already paying a lot of money, and this extra tuition increase is really going to affect my family now. i already don't get a lot of financial aid from the college. so this is just even more is

going to have to come out of my pocket. >> the administrators will vote on a 12% hike for undergraduates tomorrow that's on top of a 10% increase approved last fall. >> this morning sam fran fire crews mopping up after a fire ripped through a building on the sunny side neighborhood. the one alarm fire broke out this morning on melrose avenue blocks from city college of san francisco. firefighters say heavy smoke and flames were burning through the roof of the home. strong winds spread the flames to the house next door, damaging the exterior and the kitchen. luckily no one was injured. firefighters say the fire most likely started from the living room. >> an east bay county is using the power of the internet to help the legal system. superior court launched a new website to help people who think they are not eligible to serve on jury duty. the site saves the time of having to travel or call the court.
